Leading Lawyer Calls for Rumsfeld Prosecution
The President of the legal nonprofit Center for Constitutional Rights,
Michael Ratner, has resumed calls for a formal prosecution of ex-Bush
Defense Secretary Donald Rumsfeld following revelations by a
Congressional report that Rumsfeld was to blame for the Pentagon's
policy allowing torture.
In a statement, he said that the report reaffirms findings he spelled out in his book published this September, The Trial of Donald Rumsfeld: A Prosecution. Ratner's group was the first to volunteer an attorney to meet with one of the CIA's "ghost detainees."
"The Committee's report reaffirms that high-ranking administration officials, including Donald Rumsfeld, were directly responsible for the abuse and torture of detainees in Guantanamo, Iraq and Afghanistan," Ratner said in a statement to RAW STORY. "The brutal interrogation techniques used on our clients and many others were carried out despite well-documented opposition from military lawyers and others concerned by the illegality and ineffectiveness of the techniques."
"There is no question that Rumsfeld and the others must be held individually accountable, and it must be before a court of law. There must be consequences for their illegal activities," he said. "A special prosecutor should be appointed. To do otherwise is to send a message of impunity that will only embolden future administrations to again engage in serious violations of the law."
A Senate Armed Services report issued Thursday asserted that former Defense Secretary Donald Rumsfeld and other members of the Bush administration "conveyed the message that physical pressures and degradation were appropriate treatment for detainees."
According to the committee, prisoners were tortured in the Iraqi prison Abu Ghraib, the US prison at Guantanamo Bay, Cuba, and other US military installations. Senators Carl Levin (D-MI) and John McCain (R-AZ) were responsible for the content of the Senate's findings.
The report determined that placing the blame on "a few bad apples," as Bush administration officials attempted to do in the aftermath of the Abu Ghraib scandal, is inappropriate.
The policies were adopted after government assessments determined waterboarding and other torture techniques were "100 percent effective" at breaking the wills of US officers who underwent the military's Survival Evasion Resistance and Escape program.
Ratner says Rumsfeld's being singled out is no coincidence.
"After reviewing thousands of documents, this bi-partisan committee confirmed that senior officials are directly responsible for ushering in one of the darkest chapters in our nation's history and the loss of our moral authority in the eyes of the world," Ratner said. "The report re-asserts that the torture and abuse of detainees in U.S. custody was the result of deliberate decisions made at the top, with explicit approval given by Rumsfeld and other officials for inhumane treatment of prisoners, and was not merely the work of a few bad apples way down the chain of command."
He addds that report notes that techniques used by the Pentagon were "based on Communist Chinese methods employed to obtain false confessions for propaganda. Professional interrogators agree that the fastest way to get the best information from a prisoner is through building trust and rapport, not torture. The recognition of the illegality and unreliability of this kind of evidence is critical in the cases of some of our clients, like Mohammed al Qahtani. Time and time again, we have seen that torture simply does not work, and only undermines our commitment to basic human rights."
"We hope the courts and the next administration take notice and take action," he concludes.

I'm with Poet on this one . . . a dose of their own medicine, while not quite up to the true crimes of these sadistic criminals, would be at a minimum some form of . . . well, poetic justice.

Teddy, I used to think the same thing--about Dubya's & Co. being so many inept and nasty dunces. I have also alternatively thought that all this crap from PNAC to 911 to the "war on terror" was a cynical plot being cooked up decades in advance.
Today I am not so sure because of two things: the utterances of people like Cheney (believe it or not), Rumsfeld, and even Dubya prior to their ascension to power in 2001. It is also tempered with the realization pointed out by some other posters that Slick Willy Clinton (and Madeline Albright his Secy of State)in a slightly more subdued and covert way were every bit as nasty and devious a bunch of war criminals for what they did to Yugoslavia and Iraq.
Which brings us to President-elect Obama and all those Bush-lite appointments he has made or pledged to continue in his adminstration in apparent contradiction to his "change we can believe in" and "yes we can" sentiments. Perhaps there is a force more powerful and evil than even we (or they) can imagine directing their thoughts in directions they never imagined prior to taking power.
Astrologers like Siouxrose would call it celestial body influence, religious mystics would call it Abadon, Appolyon, or Satan influence. I just do not think humans left to their own devices could get this bad this fast. Neither am I so sure that everyone of these characters are as cravenly hypocritical as their blatant reversals of promises and commitments would indicate. Okay, the howls and shrieks of protest may commence.

"anything is possible" , is probably the most we can say...and we are just relying on the "knowable" or what is surmisable based on whatever limited or relatively well-known circumstances.
but, indeed, as you say -- WHO is to know?
Our hopes have been high many time that the criminals in this administration, Bush's, including Bush and Cheney get their just desserts but as of yet nothing comes to fruition!! WHEN will we get closure to this and something of consequense truly happens to all of them????
supposing only that nothing fitting to their dastardlky crimes is dealt to them -standing in courts of law on trial and rightfully being punished LIKE the war criminals that they are - probably , if they EVER get to that point - it will not come at the hands of the US institutions -- but from other world bodies or governments which itself is remote. i think it will also depend on how much DEEPER , and swifter, the US economy, situation, failures of policies proceed.
the weaker the USA becomes as a result of ongoing policies, including whatever consequences come out , such as more harm done to other nations that they can not ignore in comparison with their "interests" to remain on "good terms" with US partnership (economics, etc.) -- the higher the chances for indictments or charges , prosecution and eventually, probably in their much OLDER age, actually being hauled off.

look at how long it took for PINOCHET - the rightwing dictator coddled by the United States - and how many administrations and even shifts in political winds took for him to be , almost without warning, arrested while in London for medical treatment.

I dearly hope Rumsfeld will be prosecuted. Maybe it will start a domino effect and other culpable administration personnel can also be charged. At the very least a lot of interesting names and connections should be revealed. The more light and air this shameful era of US history receives, the better.
Caution should be taken by all Americans on the scope and venue of the proposed, "Court of Law", in this and any other essay, article, opinion editorial, or just plain guessing.
If Mr. Rumsfeld is allowed to be tried before a civil court, then the chances of criminal charges are lessened. The same would be the reverse,eg. criminal v civil.
He would walk away after appeals, or the present administration or the next would be available for pardons, or other interventions. Millions of dollars of the Tax payers would be wasted bring to trial those who wasted millions of those same tax payers dollars, the lives and bodies of their service members, the lives and bodies of their captives, and the lives and bodies of thousands of thousands of Iraqi, Afghan, and other lives. The American people would be held in such contempt by the world as to make their present disregard look almost like love.
George Walker Bush, being the President and Commander in Chief bears all of the needed responsibility for facing charges, and his subordinates like Mr. Rumsfeld, and many others should be his "co-defendants". No less than the Nazi and Japanese officers and men that allowed themselves to be taken alive.
The possibility that Mr. Bush would commit suicide is as remote as anything possible on the planet; but if that is an assumption, then the responsibility "rolls down hill".
The only court that would have any lasting impression, either upon future administrations or the "world at large" (which is watching the U.S. very closely on this and many other important subjects) would be for the International Court of Justice. Any other courts would and should be secondary to this highest of all courts in the Human Rights arena.
This could very well be a turning point for the U.S. and world relations and the future of the U.S. could well be hanging in the balance.
For those readers who are laughing at the possibility of such a "ridiculous thought", should remember that all through history human kind has always destroyed that which they fear the most. If the world class crimes that this administration is directly responsible for are not answered in the proper venue, then the other world powers would be forced to take action.
The United States of America could not possibly stand alone against the world, and they would rightfully win the hatred and fear of those who could destroy them.
On the overall achievement category, the U.S. has been on a downhill slide for at least since the Vietnam era, and have shown the world that they cannot be trusted, are treacherous, hypocritical, arrogant and conceited and are capable of total destruction of those who would offend them. The pragmatic thing to do would be for Obama to sign on to the ICC (international criminal court) and then if the court indicts any Americans he should extradite them for trial.
Of course Rumsfeld should be held accountable and so should his bosses. Cheney and Rumsfeld are old cronies whose political careers have been joined at the hip for decades. There is no way Cheney wasn't involved.
A president, no matter how dimwitted and disconnected, must take responsibility for what went on in his administration.
But it goes beyond being the titular head of government.
There are documents linking Bush and Cheney to torture.
If the US punishes those responsible in an effort to regain it's ethical reputation (if it ever had one) it must also make sure that all future interrogations are performed with independent oversight or at very least, video taped. It would be no good secretly extracting a valid confession if the subject is later allowed to plead he was tortured. It would be all too believable that he was. The US now bears the permanent stain of untrustworthiness.

I am vehemently opposed to torture, BUT would love it if Rummy got some of his own medicine (see Christopher Hitchens's inspired articles on his voluntary submission to waterboarding in Vanity Fair)!
Also, Vincent Bugliosi's book, "The Prosecution of George W. Bush for Murder," explains clearly how W's crime(s) in promoting an illegal war are actionable. When I heard his premise, during the DNC in Denver, he said the only element missing was a plaintiff, who, as they were crimes against the state, would need to be a public prosecutor on the state or national level. None had come forward; I'm still waiting (and hoping).
i too am of course opposed to torture , UNDER ANY and ALl circumstance, EVEN if a loved one is endangered. it is something one will simply have to bear - in order NOT to DESCEND into the same evil that an evil person will inflict on EVEN a loved one . were it so that our world did not have people that become evil like that. but THAT is why also those of us that have conscience of any kind SHOULD NOT, EVER, resort to it or even tolerate it if it is within OUR power to inflict it for any reason. because that is fighting fire with fire and everyone will be consumed.

I agree with that post by newlight, though haven't read Christopher Hitchens' book and haven't really read about what it says. If the Center for Constitutional Rights only focuses on the torture of detainees in this GWoT, however, then I'll find the Center's work to be awfully partial, for while these crimes are indeed crimes and the people responsible need to be indicted, tried, etc., and and by a real court of law, and serve many years incarcerated, this would be far from enough; it'd be just a very little "gift" to the world and might, potentially perhaps, cause people to be complacent regarding the far worse crimes of the U.S. govt. Those are the launching of these totally criminal wars and maintaining them, to begin with, but also more, for the U.S. government should be indicted, tried, etcetera, for the crimes committed against many governments, many democratic and democratically elected governments, so also against the populations of the countries of these ... many governments. There are many international crimes the U.S. government's rulers and their puppet U.S. Presidents, and their administrations, need to be indicted and tried for; and there are the national crimes, namely the ongoing genocides against the indigenous, but also other crimes against U.S. citizens (and the same applies in Canada and elsewhere, where Euro-descendants continue genocides of indigenous populations, and racism against other citizens).
There's also the extreme crime of supporting, encouraging, and protecting the Israeli government in its extreme crimes against other populations and governments of the Middle East; Palestine, Lebanon, and others. In this, the U.S. government is, I believe, the most guilty, but also guilty beyond any question or doubt of reasonable kind are Canadian and European governments.
So, and again, I hope the Center for Constitutional Rights is not blind with regards to these many other and actually more extreme crimes. Mass genocide is as bad as torture when the genocides don't include murdering the genocided populations, but the genocides of the U.S., et al, are extremely murderous, and against far more people than those tortured in U.S. GWoT prisons.
It's odd that the ACLU has been doggedly against the torture practices in the GWoT prisons, so of the Bush administration and high-ranking military officers, as well as CIA and other parties of the U.S. government that are guilty in this, for while I agree that these crimes must be stopped and the guilty parties treated to real court of law processing, I've not been aware of the ACLU and the above Center doing or saying much, if anything at all, really, about the many far worse crimes.
Torture is bad, but there's worse, too.

THAT IS to be put to [torture], and the U.S. is the most criminally responsible, given that it is always the U.S. that opposes UNSC efforts to try to get the Israeli government to abide by the UN Charter and international laws, etcetera; if the U.S. did not do this, then Israel would have to stop or else would be forced to stop. Where are the above Center and ACLU when it comes to demanding full accountability of the U.S. presidential administrations in this regard; and it's not the sole example, for there are others, in Africa, and elsewhere?

I am no different from many that have been reading news about the palestinians and their dispossession over the decades...but i never even had an idea that they are REDUCEd to THIS -- eating grass....this really heartbreaking...how CAN something like that be happening? one can really understand their rage at the israelis and american favoritism.

From the Election of 2000, the "Rule of Law" has ceased to exist in the United States. Everyone knows that the "Political Elite" are protected all the way up to the U.S. Supreme Court.
The U.S Congresses of the past 8 years, have abrogated their reponsibilities to the Executive Branch of the United States Government. During those years the following illegal events have occurred:
1. Kenneth Ley, of Enron, had private meetings on Energy Development
with Dick Cheney. When asked to provide documentation on the discussions,
documents disappeared.
2. The worst 1st Degree Murder of almost 3,000 U.S Citizens was never
adeqautely investigated. Physical evidence was removed from the
crime scene. Eyewitness testimony of explosions was never subpoened.
At other locations, videotaped evidence was confiscated and, more than
likely, destroyed.
3. The Department of Defense destroyed all evidence of "Able Danger Group"
and its relationship or knowledge of Mohammed Atta.
4. Anthrax is sent out through the mail system. The Anthrax came from
the Department of Defense´s labs at Fort Detrick, Maryland. The
same location that was used by Sydney Gottlieb, the CIA's "Doctor Death",
for his development of chemicals to be used for assassinations. Bruce
Ivins',Alleged FBI "Patsy", death was not properly investigated. (There
have been many mysterious deaths of microbiologists who worked with anthrax.)
5. Documents were, knowingly, fabricated to justify invading Iraq. There
was no investigation of the sources of those fabrications.
6. Congress helped to immunize American Soldiers and Contractors from any
Crimes. The theft of Iraqi property was legalized. The murder of unarmed
Iraqi citizens was legalized. Defrauding the U.S Government was legalized.
7. Top Secret Documents from the Department of Defense were passed to
Iran by Ahmed Chalabi. There was no investigation.
8. The "Alleged" murder of Pat Tillmon is covered up. Pat Tillmon's writings
are all destroyed and the Department of Defense investigated itself.
9. The rapes and murders of some American Female soldiers are written up
as suicides. Again, the Department of Defense investigates itself.
10. Abu Ghraib, no explanation here. A few low level soldiers punished and
the Department of Defense investigated itself.
11. Guantanamo became the updated "McGill Project". Let's try and "Brainwash"
the prisoners into admitting that they were responsible for crimes they
never committed. You: bribe people to turn in their enemy, kidnap
people, transport people illegally, imprison people illegally, torture
people, video record the tortures, and destroy the video tapes.
12. The Executive Branch illegally spies on American Citizens.
13. The Executive Branch fires, without cause, several U.S. Attorneys and
then destroys 5,000 emails dealing with their firings.
There were many more crimes. However, nothing was done and nothing will be done as the United States Government "Privatizes" the U.S. Treasury and gives away its contents.
