SAN FRANCISCO - Chilling testimony by Israeli soldiers substantiates charges that Israel's Gaza Strip assault entailed grave violations of international law. The emergence of a predominantly right-wing, nationalist government in Israel suggests that there may be more violations to come. Hamas's indiscriminate rocket attacks on Israeli civilians also constituted war crimes, but do not excuse Israel's transgressions. While Israel disputes some of the soldiers' accounts, the evidence suggests that Israel committed the following six offenses:
- Violating its duty to protect the civilian population of the Gaza Strip. Despite Israel's 2005 "disengagement" from Gaza, the territory remains occupied. Israel unleashed military firepower against a people it is legally bound to protect.
- Imposing collective punishment in the form of a blockade, in violation of Article 33 of the Fourth Geneva Convention. In June 2007, after Hamas took power in the Gaza Strip, Israel imposed suffocating restrictions on trade and movement. The blockade -- an act of war in customary international law -- has helped plunge families into poverty, children into malnutrition, and patients denied access to medical treatment into their graves. People in Gaza thus faced Israel's winter onslaught in particularly weakened conditions.
- Deliberately attacking civilian targets. The laws of war permit attacking a civilian object only when it is making an effective contribution to military action and a definite military advantage is gained by its destruction. Yet an Israeli general, Dan Harel, said, "We are hitting not only terrorists and launchers, but also the whole Hamas government and all its wings." An Israeli military spokeswoman, Maj. Avital Leibovich, avowed that "anything affiliated with Hamas is a legitimate target."
Israeli fire destroyed or damaged mosques, hospitals, factories, schools, a key sewage plant, institutions like the parliament, the main ministries, the central prison and police stations, and thousands of houses. - Willfully killing civilians without military justification. When civilian institutions are struck, civilians -- persons who are not members of the armed forces of a warring party, and are not taking direct part in hostilities -- are killed.
International law authorizes killings of civilians if the objective of the attack is military, and the means are proportional to the advantage gained. Yet proportionality is irrelevant if the targets of attack were not military to begin with. Gaza government employees -- traffic policemen, court clerks, secretaries and others -- are not combatants merely because Israel considers Hamas, the governing party, a terrorist organization. Many countries do not regard violence against foreign military occupation as terrorism.
Of 1,434 Palestinians killed in the Gaza invasion, 960 were civilians, including 121 women and 288 children, according to a United Nations special rapporteur, Richard Falk. Israeli military lawyers instructed army commanders that Palestinians who remained in a targeted building after having been warned to leave were "voluntary human shields," and thus combatants. Israeli gunners "knocked on roofs" -- that is, fired first at corners of buildings, before hitting more vulnerable points -- to "warn" Palestinian residents to flee.
With nearly all exits from the densely populated Gaza Strip blocked by Israel, and chaos reigning within it, this was a particularly cruel flaunting of international law. Willful killings of civilians that are not required by military necessity are grave breaches of the Geneva Conventions, and are considered war crimes under the Nuremberg principles. - Deliberately employing disproportionate force. Last year, Gen. Gadi Eisenkot, head of Israel's northern command, speaking on possible future conflicts with neighbors, stated, "We will wield disproportionate power against every village from which shots are fired on Israel, and cause immense damage and destruction." Such a frank admission of illegal intent can constitute evidence in a criminal prosecution.
- Illegal use of weapons, including white phosphorus. Israel was finally forced to admit, after initial denials, that it employed white phosphorous in the Gaza Strip, though Israel defended its use as legal. White phosphorous may be legally used as an obscurant, not as a weapon, as it burns deeply and is extremely difficult to extinguish.
Israeli political and military personnel who planned, ordered or executed these possible offenses should face criminal prosecution. The appointment of Richard Goldstone, the former war crimes prosecutor from South Africa, to head a fact-finding team into possible war crimes by both parties to the Gaza conflict is an important step in the right direction. The stature of international law is diminished when a nation violates it with impunity.

Although America is more than equally guilty, this emphasis on war and aggression as a so-called methodology for containing terrorism or neutralizing enemies is bogus to start with. No peace has ever been gotten from war. For all the astronomical wastes of blood and treasure, sounder trade dealings, more deft uses of diplomacy and those proverbial carrots and sticks would lead to a far more lasting peace than the stains and scars of enmity produced by the savagery of generation after generation being trained to cultivate hatreds among tribes.
Any religion true to its Creator would teach the fundamental oneness of mankind potentially using the analogy of ONE tree with many branches. Can a tree grow tall with only one branch? Would there be a gorgeous world without a variety of colors? Could we be lifted by ecstatic music if it didn't consist of many notes? This is why I teach the Circle as a fundament for broadening human understanding. As the rigid leaders of our times call increasingly for conformity, for warfare as the false path to peace, for "free" trade as a covert device for seizing other nations' resources, it is imperative that a new understanding of the faceted nature of our human personalities and motivations come into play. This knowledge would prove helpful in that so many fail to notice the same personae as they historically recycle. They may be called pharaoh or king, dictator or tyrant, yet they are cast from the same place in time, and must be recognized to be countered. The power of "the people" united is greater than these power-hungry foes; but so long as "the people" allow themselves to be diverted into groups fighting among themselves, a genuine global liberation from the control of elites cannot take place.
Nationality divisions, class distinctions, ethnic determinations and religious ones have been fomented to turn people against people when in reality, they generally share the same goals and have the same love for their children/grandchildren that would make for actions motivated towards sustaining the earth's ecosystems for ALL to enjoy and thrive upon.
An ethos that envelopes our shared aspirations is overdue. Since time circles, elements of ancient understanding could provide the "medicine" needed to guide our vision(s) today.
Ethnic cleansing
A fundamental component of a peaceful resolution of conflict is that of balance.
We need to recognize there will also be "conflicts" between groups of people and these conflicts can often lead to war.
When trying to resolve such conflict it imperative that the side of strength recognize the concerns of the side of weakness and tries to ensure that any resolution will ensure the weaker sides SUCCESS and not its failure.
This lies at the heart of the Palestinian/Israeli conflict. Israel wants the Palestinians to fail and advances policies to ensure that , thus there can never be a peace.
We can use WW11 as an example here.
The war started due primarly to the vindictive nature of the triple entente at World War Ones end, where they lay the entire blame for the war on the Germans and imposed conditions on them that were onerous. These conditions by the words of the victorious powers were so to ensure Germany failed.
In so doing they guaranteed another war.
If one looks through history at the example of what were seemingly endless wars , very much the same pattern emerges. One side is victorious for a short period, imposes harsh conditions upon the other which are by design to keep the latter subjugated, which leads in turn to another war.
When the "Victors" come to any table to bargain with the "defeated" the only thing in their heads if they truly want peace is to say "How can i ensure the other side prospers and succeeds' rather then "how can I ensure they remain weak and subject to my power" .
That Israel will not do this , is the clearest sign they have no interest in peace. They want to perpetuate the conflict so that they can "rationalize" the ethnic cleansing of the Palestinian lands to the rest of the world and in turn call them their own.
This should be as clear as day to any world leader and any world leader that does not condemn Israel for its actions, is complicit.
And make no mistake. There is NO WAY imaginable the Zionist state of Israel could get away with their atrocities, if not for the support of the United States.
The most deceptive, most irresponsible, most complicit world leader to be named is none other than Barack Hussein Obama.

KALIDAS: Thank you for the response. My beliefs fall somewhere between the Eastern view of karma (regarding animals) and those of the American Indigenous cultures. There are times when it is NECESSARY to take another life, but if it is done with grace and thanksgiving, it does not count against the soul to the degree wonton destruction does.
In America there is NO respect for living things... even in these times of evident climate change I see IDIOTS constantly cutting down trees. Q: When Israel withdraw from Gaza in 2005, there was an agreement between Israel, the Palestinian Authority, Egypt and the European union that allowed border crossing. When the hamas captured Gaza by force, they killed / dispersed all the Palestinian Authority border control personal, expelled the European Union monitors, and declared that all the past agreements with Israel are void. (Including the border crossing agreement) - These are the facts.

It is yet to be proven that the civilian Palestinian targets were not used to carry out attacks against Israel. On the other hand, there is no dispute that the Hamas intentionally targeted civilians within Israel.

Only a small minority of Hamas attacks are initiated from schools and mosques. This does not excuse IDF for targeting other civilian property in Gaza.
IDF artillery attacks are made by portable units operating from civilian property. This fact, by your judgment, "excuses" Hamas retaliation against Israeli civilian property. Anyway, Qassam missiles are highly inaccurate and are considered lucky if they even make it into Israel.
As for Hamas "hiding" among civilians, Gaza is an overcrowded jail with more than 1.3m people. This is an urban conflict and it is impossible for Hamas to conduct any operation without rubbing shoulders with their neighbors.
As for disproportionate response, a total of 24 Israelis have been killed by Qassams in the past 9 years. That the IDF has slaughtered many thousands of Gazans in the same time frame constitutes a disproportionate response.
There are no conflicting reports on the use of WP, as the IDF has admitted using the stuff.

If the IDF had fired Qassam rockets and indiscriminately killing 24 Palestinian civilians - this would not be sufficient to stop the Hamas' attacks. (These are perfectly acceptable losses by the Hamas)

I wasn’t referring to Palestinian attacks. Most of the Palestinians in Gaza are innocent civilians, who don’t attack anyone. I was comparing the Hamas rocket attacks (And I hope you don’t think all Palestinians are Hamas militants) to mosquito bites.
The analogy was not that the Hamas are mosquito. They are humans. The analogy is that an equal / proportionate response would not stop the rockets.

The fact that Israeli soldiers can get these made at all shows how deep the sickness in Israel is. Shooting pregnant women is right up there with cannibalism, child rape and snuff erotica.

The t-shirt designs are generally approved by the battalion commander, or at the very least, the platoon sergeant. That ranking officers have the power to make these decisions means it is official battle dress.
