Bush Burns the 'Midnight Rules' Oil
He is trying to preserve his legacy with a flurry of decrees and interviews – but the issue of torture may well return to haunt him
Presidencies begin with a slate wiped clean and a first 100 days in which the new incumbent sets out to change the world. They end in the tawdry process in which George W Bush is now engaged: a final flurry of presidential dec-rees to prolong power beyond the grave, a concerted effort to regild a tarnished reputation - and, of course, pardons.
For months now, Bush has been issuing new regulations and notices to tie the hands of the Obama administration. The practice is not new: one of the worst previous offenders was none other than the deeply virtuous Jimmy Carter. But this Bush has indulged it far more than either his father or Bill Clinton. At the last count he has signed more than 100 such orders - in effect, new laws that don't need to be approved by Congress - and more are likely during his last fortnight in office. And if you're a liberal or an environmentalist, or just a run-of-the-mill Democrat, you'll hate them.
Among other things, these "midnight rules" clear the way for developing oil shale deposits on government land and make it easier for coal companies to dump strip-mining waste into local rivers. It will now be easier to build a coal-fired power station near a national park. In these same national parks, moreover, you may henceforth carry a loaded or concealed gun. A separate regulation chips away further at abortion rights, while another allows truckers to drive for longer periods without compulsory rest. Other changes weaken the Endangered Species Act and loosen federal rules on factory farming.
Last-minute regulations will be easy to unpick, but others less so. Some executive orders, with an impact of at least $100m a year, were published at least seven weeks ago, so they will have completed the required 60-day waiting period to become law by the time Barack Obama takes over.
"Midnight rules" are one way to try to reshape a presidency. Another is the media blitz that Bush and his acolytes have been conducting. For most of his term, Bush was sparing with interviews, but in the past few weeks he's given a dozen or more, talking up his achievements (yes, there have been a few, such as increased assistance to Africa, especially to fight Aids, and the "No Child Left Behind" education bill) and skating over the rather more numerous failures.
Bush, of course, famously hates putting himself on the couch, claiming that he's been too busy making history to worry about what the scribblers think about him. But sooner or later, every president gets the legacy bug. His valedictory interviews have been true to form: a few regrets, above all over those non-existent WMD in Iraq, but not the hint of an apology. Those who want to read more about his "freedom legacy" across the Middle East, and the glories of extended prescription drug benefits for the elderly, can take comfort from the book Bush is planning to write.
In the meantime, his senior aides are already rewriting history. You thought Dick Cheney secretly ran US foreign policy, at least in Bush's first term? "Hooey," Stephen Hadley, the meek and mild National Security Adviser, told The Washington Post last week. You thought the 43rd President was an incurious and arrogant ideologue who would not listen to anyone who disagreed with him? Wrong again. "The President is very good about hearing and wanting contrary advice," chimed in Josh Bolten, the White House chief of staff. Everyone who deals with Bush "appreciates what a good leader he is, how smart he is and especially, how humane he is". And, Bolten might have added, maybe what a voracious reader he is.
That unexpected insight emerges from a remarkable Boxing Day column in The Wall Street Journal by Karl Rove (remember him?) in which the man once described as "Bush's Brain" claims the President devours books, getting through no fewer than 95 in 2006 alone, including L'Etranger by Albert Camus (presumably in translation, but who knows?). Anyway, so much for the ignorant Texan hick we spent the past eight years mocking. Bush, it turns out, is a bona fide intellectual. Thus are images reburnished, even transformed. Might Rove be, shall we say, massaging the truth? Perish the thought.
Finally, there are the pardons. In fact, Bush has been surprisingly stingy in exercising this presidential prerogative. Of 8,000 applications for pardons, he had granted just 191 as of Christmas, fewer than either Ronald Reagan or Bill Clinton, who infamously pardoned the indicted financier (and generous Democratic party donor) Marc Rich in the final hours of his presidency. Bush has also commuted eight other sentences, most notably the jail term handed in 2007 to Lewis Libby, Cheney's one-time chief of staff, for perjury. There were expectations Libby might be granted a full pardon, but, thus far at least, not so. Among those who have requested pardons are Michael Milken, Wall Street's former junk bond king, the bribe-taking former Congressman Randy "Duke" Cunningham, the disgraced Olympic champion Marion Jones, and of course our old friend Lord Black of Crossharbour.
But there is one problem for the departing Bush that neither a special "midnight rule" nor any amount of history rewriting, and perhaps not even a pardon, will make disappear. I refer to the alleged war crimes committed by his administration: its refusal to comply with the Geneva Conventions, its forced "rendition" of terrorist suspects to countries where it knew they were likely to be tortured, and above all its own use of torture.
Already Cheney and the former defence secretary Donald Rumsfeld, among others, will be carefully checking future foreign travel plans, to avoid a "Pinochet situation" - when the former Chilean dictator was arrested in Britain in 1998 on a warrant issued by a Spanish magistrate for atrocities committed against Spanish citizens.
But a separate threat also exists, of possible legal action within the US itself, prompting speculation that Bush could issue pre-emptive pardons to top officials at the White House, the Justice Department and the Pentagon who were responsible for drawing up the "coercive" interrogation rules, and to the CIA personnel who put them into practice.
Such a step would not be new. Gerald Ford pardoned Richard Nixon just a month after taking office in 1974, while Bush's own father pardoned Reagan's former defence secretary Caspar Weinberger on Christmas Eve 1992, to spare Weinberger trial on felony charges arising from the Iran-Contra scandal. But it would be political dynamite. As he tries to push through an emergency economic recovery package, the last thing Obama wants is a distracting and bitter row with the Republicans, stoking up the partisanship he has pledged to reduce.
But sooner or later something will happen. The stain on the country's reputation is too large, the outrage at the violation of the US constitution too great, and America's sense of decency and justice (albeit sometimes delayed justice) too ingrained for the whole torture scandal to be swept under the rug for ever.
"We owe the American people a reckoning," Eric Holder, the incoming Attorney General, is on record as saying, and sooner or later that reckoning will come. Maybe a special prosecutor will be appointed, or perhaps Congress will carry out an investigation along the lines of the 1975 Church Committee that probed the misdeeds of the CIA. One way or another, Bush will have plenty to think about when he's not writing his memoirs (and reading books) in the golden years ahead.

Anywho, as I looked at the swinging bodies I couldn't help feeling giddy imagining the faces of Wolfowitch, Perle, Frum, Crystal, Rice, Powell, Rumsfeld and many more in place of those of the actors..... Of course, they would be executed after being convicted of Crimes Against Humanity..... We wouldn't just execute them without a fair trial.... That would be uncivilized.... I take issue that No Child Left Behind was a positive development. I believe it is an attempt to destroy public education in the United States, and I'm pretty sure many public school teachers and administrators would agree. The fact that the standards were put in place but not the funding assistance shows that the schools are meant to fail. I'd say that NCLB is more along the lines of the gradual destruction of the national parks.
You are so right!! NCLB not only is underfunded, it is entirely misplaced, teaching only to the test and taking up far too much valuable class time with actually taking those tests! Let's teach our kids to be creative thinkers, rather than rote learners!
The national parks problem is a disgrace. They, too, have been underfunded for years, and rangers have been participating in "Homeland Security" maneuvers and training for at least several years now. Here at Acadia, a friend of mine was minding his own business, reading the paper in his car at an overlook, when he was "stopped" by a ranger, with gun drawn, and ordered to step out of his car. Apparently, the ranger thought he might be a "mushroom poacher!" Excuse me?!?
The only things that won't be underfunded to the point of ineffectiveness under conservative rule is military, intelligence, and police. Anything else they want to get rid of.
Legacy? Do these sophomoric parasites think they are writing for a preppie yearbook?

After 40 plus years of disappointments, no turd the sheeple vote for would surprise me.
But if the Democrats keep pandering to the rightwing, we may very well get it. Hell, short skirt Paling may even win in 2012 because she'll have no trouble tickling Obama and the Democrats into defeat for their crimes in shitting on the base and pandering to the rightwing.
Don't forget that in 1998, Jeb Bush won the gubenatorial race by a huge margin as a result of the racial rift in the party. Conservative Democrat Buzz Ritchie engineered the ousting of Willie Logan in February 1998 and then making excuses such as "Logan isn't raising enough money and he's too liberal" bullshit. Logan was a pro-populist Democrat and even the whites in the panhandle didn't hate him. Logan was persecuted and the blacks were furious and choose not to vote, vote Independent, or even vote for Jeb. That year, even before Jeb was elected, the Democrats lost most of the special election races as their rightwing pandering showed up big time. And look where the Democrats in Florida are at right now. The GOP still has a solid lock on the state level even though Obama was lucky to win at 51%.
The lesson of this tragedy is that the more Democrats piss off the progressive base, the more long term losses they will endure.
P.S.: The same thing happened here in Texas even though I have to admit that it has had conservative leanings. Still, unlike CA and NY, we will not tolerate opportunists who pander to the other side. Ralph Yarborough was a solid liberal and against Big Oil and was the best senator TX could ever have until then neocon Lloyd Bentson defeated him in the primaries in 1968 tragically enough. Well, god punished Bentson with a defeat in 1988. And I remember the gubenatorial races in 1994 and especially 1998 when Dubya won simply because blacks and latinos along with even the conservative whites smelled opportunism and angrily abstained from voting or even voted Republican. At least, that's how I see the entire picture of how the GOP won this state though I could be missing something.
Hang in there people. Obama will put a long term undoing to not only Bush's tantrum throwing last minute attacks but also a long term undoing to Reagan's and Nixon's economic ideology. Sure, Obama may look conservative at first but I think he'll surprise us as a moderate progressive that not even Republican conservatives can resist. Let's give Obama a chance and help him out. And let's not allow our Congress people to block his agenda.

AMEN BROTHER ! I notice that most products I buy from the little guy may cost some more but they last longer and make us happier and secure in the long run. My wife loves the small mom and pop stores over bullies such as Wal-SWEAT-Mart. Everything imported from China comes from sweatshop labor.
What most people don't realize is places like wal-mart deals in seconds. I've noticed that the cost isn't always higher, a lot of the time the little guys prices are the same or slightly lower. Especially when it's on sale. Don't ever ask for help at a wal-mart, all they can tell you about a product is it's for sale. Ever notice how wal-mart doesn't really have sales anymore.

I can never forget the rude awakening moment 5 years ago when my wife had a hell of a time trying to get a good pair of glasses from Walmart. They gave her the quality that sucked and in 2 days, it chipped off and broke. She tried to get a free replacement as per the rules but they kept inventing excuses on making her buy a new pair altogether. I was furious and showed up at Walmart the next day and punched the sales clerk in the face and got into a near boxing match but of course the security guards came in and kicked me out. I was to be arrested and jailed for assault but I hired a tough lawyer albeit hellishly expensive and the store decided to go ahead and settle this with a refund. I often warn people about Walmart's devilish ways but since I'm in MS, I get sneered at by both blacks and whites since all they want is cheap cheap cheap !
And not one mention of the most costly and insidious Midnight Rules in this whole article. Not much of an article.
GWB just signed a Midnight order allowing employers to hire foreign agriculture workers withiout determining if there were American workers that were available. There goes the wages for Americans down once again. This is how you make illegal legal. This is how you transfer even more money to other countries, increase the profit for Agribusiness and trash the American worker.

You'd think so wouldn't you. But many Progressives supported big business and their use of illegal aliens. They actually opposed sending illegal aliens back to their own country. Actively encouraged them to take Americans jobs.
I admit that many were fooled by business and their shills like LaRaza, but anyone should have been able to see thru their thin reasoning in my opinion. Some idiots even advocated erasing the border, talk about delighting their corporate masters!
Unions also encouraged illegal aliens by allowing them to join, therby betrayinyg their American members whose jobs they were taking. At the same time they were driving down the wages of other Americans in the industries that employed them.
The same thing is happening with legal workers under the H programs and others.
The American worker has been betrayed on every side. Its shameful.
That reminds me of the conservatives who would loudly claim to be against illegal aliens and yet they'd turn out to be closet supporters once their opponents exposed their hypocrisies such as an illegal worker doing their cleaning or even staffing. The biggest disappointment from the Democrats and even a lot of progressive groups is their refusal to even discuss the need to cancel NAFTA, CAFTA, GATT, WTO, etc ... On the issue of illegals, even George Lakoff made it clear that hiring guest workers is like welcoming immigrants and then chaining them as slaves ! My parents and I came to this country legally back in 1965 btw and while I don't support the idea of illegal entry, I can't stand the way the media and the government elites of Mexico and the US cooperate on silently povertizing Mexican workers through "free" trade and oppression and then finally turning them into illegalized immigrants and dumping them into the US with big business ready to accept them as near slaves. And don't forget that Obrador tried to make it clear that he would improve the economic conditions in Mexico so that more Mexicans wouldn't be economically forced into desperately crossing the border while Calderon made no bones about his plans to exceed Vicente Fox in his plans on oppression and dumping. The US media and government also helped Calderon STEAL the Mexican election just like they helped Dubya steal the election in 2000.

You are as aware as I am that these people have no interest in helping the people "that just want to do jobs Americans won't do" Their only aim is to exploit them. I believe the reasson a lot of the rest of the country doesn't understand this is that they don't see it yet. They don't have that many illegals in their state.
I know you know about the meat cutters since that was in your neck of the woods. Average wage before the illegas were brought in, $19.00 an hour with benefits, now $9.00 an hour with no benefits. What a deal!
They don't understand that business is pushing the cost off on us. Texas last year...over 700 million in hopspital costs for just the illegals. Around a billion and a half in total costs over and above any taxes they pay or benefits they bring.
And the abuse these poor people take from these "blank's", its terrible, especially for some of the girls.

Thats about the size of it. Hopefully this year more people, especially progressives will find out who they have actually been helping.
I think we're gonna need someone like the old Ross Perot of 1992 to enlighten the public although I'll see what Obama does on this issue since he did at some point vote on the border or something like that.
On the issue of meat cutting, I can tell you everything tastes crappier than the older days. The workers who are getting paid less don't even get any benefits or worker protection rights. Plus, their human rights are stripped. Completely disgusting I tell you. The only places I can find anything better is on the small farms and local mom and pop stores still remaining and they usually offer grass fed pasture raised meat and diary. Unfortunately, Big Brother is about to persecute them yet again with NAIS. If you haven't heard about NAIS, look it up on google. Jim Hightower and others have discussed this in the past two years. Big Agri gets a "free" pass while the small farmers don't.
I'm afraid Obama is in the open border business pocket on this.
