Land-Auction Meddler Has a New Plan
He hopes to raise $45,000 to keep the parcels until Obama steps in.
The University of Utah student who foiled a federal oil and gas lease auction the Friday before Christmas hopes he can buy time for Utah's scenic redrock desert -- and himself -- until the Bush administration is out the door.
Tim DeCristopher speaks with members of the news media after he was escorted out of the Bureau of Land Management offices in Salt Lake City on Friday, Dec. 19, 2008 following DeChristoper's bid on several oil and gas leases during a BLM auction. (Steve Griffin/The Salt Lake Tribune) Tim DeChristopher announced Wednesday afternoon that he would pay the U.S. Bureau of Land Management $45,000 to hold the 13 lease parcels he won in a Dec. 19 sale. His aim is to fend off drilling at least until President-elect Barack Obama takes office and new officials are in charge of the federal Interior Department and Bureau of Land Management.
"This would be the most effective way of ensuring we could protect the land, at least until the new administration came in," DeChristopher said.
The 27-year-old economics major faces possible federal felony charges after winning bids totaling about $1.8 million on 13 lease parcels that he admitted he had neither the intention nor the money to pay for.
But since committing what he called an act of civil disobedience, DeChristopher has heard from hundreds of individuals around the country willing to chip in to keep drill rigs off the land and DeChristopher out of prison.
So far, would-be benefactors have pledged $14,000, he said.
DeChristopher, his lawyers and other advisers reckoned that if there were a specific reason for the fundraising, rather than just an ill-defined defense fund, enough money would roll in to allow him to write a $45,000 check to the BLM within the next couple of weeks.
"If I follow through on purchasing the leases, it makes it simply a question of my intent in opposing what I thought was a fraudulent auction," DeChristopher said.
The amount is based on a percentage of the $1.8 million; the agency requires such payments of all bidders to hold their parcels. Three Web sites have been set up to take pledges: www.wateradvocacy.org, oneutah.org, www.bidder70.org.
BLM special agents questioned and released the Sugar House resident after he disrupted the auction of 149,000 acres of public land in scenic southern and eastern Utah. The 13 bids he won by raising his auction paddle were on 22,000 acres of land near Arches and Canyonlands national parks.
DeChristopher admitted he ran up other bids by about $500,000 and said he would be willing to go to jail to defend his generation's prospects in light of global climate disruption and other environmental threats.
Melodie Rydalch, spokeswoman for the U.S. Attorney's office in Salt Lake City, said Wednesday the investigation into DeChristopher's actions are continuing. Prosecutors would have to decide whether to take the case to a grand jury for possible indictment.
Defense attorney Ron Yengich and former BLM Director Pat Shea, an attorney, are representing DeChristopher.
Shea said Wednesday his client could face several felony charges with penalties that could include substantial fines and a prison term. Shea also said "someone" with the federal solicitor's office suggested that because the lease sale is in flux due to legal action, paying the $45,000 might help DeChristopher.
"I can't make any predictions," he said. "We've had very good cooperation with the BLM and the U.S. Attorney's office."
Shea said he believes the Federal Land Policy and Management Act of 1976 could provide DeChristopher with some legal cover, though others argue he would be bound by the Mining Act of 1872 to develop the parcels should he buy them.

Show AllI always wonder why someone like this gets so much print.
Are there REALLY that many people out there in 'la la land' also known as 'the good ol USA' that BELIEVE ANYTHING is going to change when Mr. Obama takes the "oath"?
He has already shown that he is only offering a change in the "melanin content" of the skin of the office holder and little or no other changes.
The environment is of little consequence to the 'body politic' since the big money that put them into office are the big business interests that are raping the environment and laughing at those who think they can impact any decisions in DC, with cute little stories about college students who 'muck up the works'---even for a few weeks.
Now, MY people know how to make DC listen (they just lost their voice for awhile, and MAY be getting it back real soon), that is make it cost them $$$$$$. Then, reveal to their constituency that they are fools and muppets and are making the voters pay extra for the privilege of getting "sodomized" with a fence post (un-lubricated please, I just love it when it hurts).
Get real people. The only way to fight those in DC who would sell your environment to the highest bidder is to show them you can make it more expensive to keep on doing the "stupid thing".
For just one suggestion. There will shortly be, thousands of Black water Mercenaries OUT OF WORK, and in need of some more money to supply their 'drug habits'. So put them to work, wreaking havoc on the "big Business' projects that are destroying the environment and using the corrupt legal system controlled by the corrupt members of both houses and the 'big house', and show those sons of bitches that the people mean business about the pollution of the environment, and will stop at nothing (just like the polluters) to prevent it.
Mercenaries worked very well for GW Bush and his 'gang', why not the 'people'; and the Mercenaries, being mostly the lowest scum that society can produce care little where their 'drug money comes from'; you can't have a better combination. Just ask GW Bush, Dick Cheney, Condi, and the others. They are and most likely going to get away with international crimes that would keep the worst offenders in 'admin seg' in the Max Security prison ----"just a few miles from where you live" awake at night from fear.
Now for those who would argue that the polluters would hire their own "Black water scumbags", take into consideration that the polluters could not get the same tax deductions for using Black water that they do using the politicians; so they would not go that far. No insurance companies would cover them, since costs of rebuilding the damage would far exceed the premiums they could collect on the reverse. Soon the 'cost of doing business" would exceed the profits, and the pollutors would be forced to comply with the law----they might not know how to do that exactly, but there may be SOME Americans left who might be able to help them.
If you are stuck with a corrupt society and political system, you cannot beat them, so you might as well join them. And since most Americans are so obviously adept at "keeping quiet" about all the crimes commmited in their name, they are basically no different than the criminals they put into office.
Good luck America, you really need it.
You're absolutely right the whole system is corrupt. The key to solving the problem is to eliminate money. Make money irrelevant. We have the capacity to feed, clothe, house and provide healthcare for everyone on the planet. Money is in the hands of the few, controlling the resources of the many. An economy based on abundant supply of resources to all instead of debt to the monetary system is a far better outcome for the world. If everyone had all their needs fulfilled because the system provided the things needed instead of having to have money to buy them. The aberrant behaviors spawned as a result of not having enough money would be erased. The current situation is based on scarcity. We would eliminate useless jobs like accountants, financial services, stock market, insurance, mortgage brokers, bankers, the FED,the bloated military industrial complex, etc. We have had the same problems since money and the banking system was implemented. We could end economic slavery tied to the monetary system. People would be free from debt because we wouldn't owe anyone. I will support any movement to get rid of the monetary system. We will never be free if money continues to enslave humanity.
Money is a huge problem. It would be hard to eliminate however, as most is in electronic credits and personal assets. But since money in any form is power, we can end repressive power centralization by capping personal net worth.
A binding yearly referendum could establish a cap on personal net worth. Any excess wealth could be given away to individuals and counted in the recipient's personal wealth cap. Any cap excesses not given away will be deleted from the person's electronic money by a cancelbot in the financial system. Deleting money would cause deflation, but giving it away would not.
Institutions, churches, governments or organizations of any kind have to be prevented from concentrating power. We can do this by placing their net worth in the hands of it's members and counting it in their personal caps. This would enrich almost everyone, so these organizations would truly serve their most common purpose.
The cap can be high enough to keep a progressive profit motive, but low enough to prevent power concentration. I would estimate around one to ten million per person.
A Wealth Cap can be made inversely proportional to the global birth rate. The higher the birth rate, the lower the cap and vis. That would give a money incentive to lower the mother of all humanity's problems, overpopulation.
Bush is a TOXIC TERRORIST all over America's Landscape. Change is coming from the bottom up in Appalachia http://www.wisecountyissues.com Hannity's America sure isn't My America.
NativeSon, while you're daydreaming about setting Balckwater operatives on corporate executives with, people like Tim DeChristopher are doing something to change what they see as the problems. Less bitternes, more action.
"So much press" as if the press is lousy with good hearted activists who put their life where their mouth is. I happen to agree with the sentiments expressed in the last two comments--except the tone of cynicism. Hope fortified by action will affect change. Thanks Tim DeChristopher. For the time being we still have to live in world that uses money. I plan on giving some to him for those leases.
Thanks again Tim. For the real hope I can actually believe in.
Well if that is the case, I would think that a "mental wizard" such as yourself would spend your money better and just go ahead and give the money to the first politician that "sings your song" (like Obama) then wait and see how long it takes the "other side" to "out money you". Since you most likely are used to dealing with "prostitutes"*, you know they will sing the song they are paid to----right?
You remind me of the "country bumpkin" in town on Saturday morning and sees the "shill" at the "three card Monte" or the "pea under the shell" game win; it looks cute, and that "little shill" has a "good heart" so if he can win at that game, then you can to.......................so you put your money down.
Instead of sending this guy some money, I will sell you some 'beach front property in Arizona', at a "really-really- really good price"-----and all you'll need to do is 'wait for California to fall off into the Pacific', then you can throw a big party, there on the 'beach', or fall asleep each night with the sound of the 'waves against the sage brush'.................or you could have "Tim" over for the party and a sleep over, that might be 'fun'.
As far as the cynicism is concerned, I came by it naturally, the USA and Americans like you-- worked very hard to earn it,and will make no apologies for it.................
* I am not referring to the 'sexual' variety of prostitutes, but the 'political' variety, your private life is yours; your political life; is shared with everyone else when you VOTE...............and as for the "real hope" you can actually believe in, unless you and the other Americans make some real changes and very soon; when you hope without the proper action; then hope in one hand and defecate in the other and see which one fills up first..............
Oh, and keep this in mind, I am not "bitter", its just getting tiresome waiting for you Americans to finally piss it all away so that my people will be free to "ride our horses through your empty cities"----but with wisdom like yours we may not need to wait that long. So keep up the good work, and send this guy some MONEY. Or hey, maybe run for office yourself. Or make a real stretch of logic, contact "Bob Redford", a multimillionare movie star who wrote an article about the same "Utah Wilderness"---and match his donation to Tim, penny for penny.
Why not check back with me in a week and ask me then how much sleep I have lost thinking about whether you agree with me; or approve of me. While waiting, you might try holding your breath.
Good luck America, you really need it.
You're pathetic.
"His aim is to fend off drilling at least until President-elect Barack Obama takes office and new officials are in charge of the federal Interior Department and Bureau of Land Management."
I'm really interested to know why Tim DeChristopher thinks that any new officials in the Obama administration would fend off drilling. Aren't we really going to have the same old corporate a**holes in charge of everything as usual? Sorry DeChristopher, but dream on! Your aim should be to fend off drilling PERMANENTLY!
True that the only 'change' we're likely to see is a different color of wool pulled over our eyes, and drilling shall commence along side minor 'green' projects that will soak up all the limelight. But I certainly give DeChristopher props for putting himself on the line and single handedly duping Chairman Crunk™. It's more of a powerful commentary on the sorry state of young activism in our rumored to be 'advanced' country... the fact that there's only one guy daring enough to do this.
Props to you DeChristopher!! Give them hell!!
Hang in there man ! Obama's going to not only save the environment but I hear that he supports legalizing industrial cannabis.

Obama, manlike god or godlike man?
HEY ! Give him a chance man. At least Obama's putting more environmentally friendly people for cabinet picks and he's not giving up his ideas of saving and repairing he environment which includes legalizing industrial cannabis for fuel and manufacturing. Talk about saving the environment big time. You wouldn't be seeing this in a Mccain administration. Trust me. I used to be a conservative Republican until a few years ago. I first voted Democrat in 2004. Sure, Congress has been a dud but a better White House might just pull them out of it.

As far as I am concerned he has blow his first chance with his cabinet picks!
Where is your evidence to support your optmism? How about his pick for secretary of the interior, he could have pick someone like RFK Jr. but no he picked Senator Ken Salazar of Colorado, who said that his job would be to try to balance protection of public lands with the continued development of domestic sources of coal, oil and natural gas. This statement alone proves that Salazar is an appeaser since the two goals are diametrically opposed and can not be balanced.
Personally I think progressives need to keep the pressure on Obama, he is not a closet progressive, he is not an environmentalist in disguise, he is an equivocating centrist plain and simple. The only way to get him to do the right thing is to make him believe it is in his political best interest.
"Never underestimate the power of very stupid people in large groups."
- John Kenneth Galbraith
I commend Tim DeChristopher's courageous civil disobedience regardless of its ultimate impact or outcome.
During his candid and credible interview with Amy Goodman, Tim expressed a thoughtful, intelligent, but ultimately modest rationale for acting. He really did want to "do his bit", arrived on the scene and spontaneously was inspired to throw himself on the works of oppressive power after eschewing more conventional protest, i.e. public demonstration.
I do happen to share the stance of null expectations for Obama. So it may prove "foolish" for Tim to have impulsively complicated his life with grave personal and legal risk merely to kick the ball down the field.
But I emphatically disagree with the judgement that Tim should be mocked or derided for his conscientious and bold actions because Obama may ignore or drop the ball. That's on Obama. It doesn't detract from Tim.

And what if Obama actually turns out to be pro-environment? He's not Bush/Mccain at least on this issue. Give him a chance.

I don't think many juries would convict him. If I were defending him, I'd find a way to subpoena Dick Cheney to testify. After hearing from him any jury would acquit.

Every time I read about this all I can think is, why did this guy tell them he wasn't serious? All he had to say was, "Sure I'm going to raise the money for these leases. I've got backers. Who are they? That's cofidential!"
The only case they have aginst him is that he had bad intent. And the only evidence of his bad intent are his own statements. He reminds me of my nephew. God love him he is just too honest for his own good. Somebody needs to teach our idealistic youth the value of a little honest BS. It is admirable to go to jail for your principals but not if you don't have to.
that's not the point. it is NOT even about the charges to be brought against him for ":fraudulent claim" AS IF he is ONE of these Wall street bankers claiming they know what they're doing with money - and gobble up and loss TRILLIONS.
what is HE in comparison as a "fraudulent claimer in a bid in an auction of public land?"
when he has CLEARLY stated that it was his TACTIC for a STRATEGY of buying time - HOPING that the new administration will pay attention to these things , if not necessarily HIS case.
I personally DON"T think obama will pay attention...he will have whisperes in his ears against it and try to be dismissive of this case and young man as just another "naive" person -- in order to move the EYE of the publci AWAY from what WILL continue -- CORPORATIONS BUYING UP PUBLIC COMMONS to EXPLOIT at the EXPENSE of the american people.
THAT is what HE ought to be ACCUSING the others of as his DEFENSE!
this is the time when the "best defense" IS an OFFENSE -_ BIG TIME!
I'm 72, retired, and without much money. I still send something to worthwhile projects. This was one of them. He doesn't need that much more for the initial payment. Where are the rest of you? Don't just intellectualize about it. Do something.
I am poor...and barely making it month to month ...but i will also send him whatever little amount i can manage.
Tim DeCristopher is a fearless non-violent eco-warrior! Thanks for the inspiration brother!
Right on! This is what we need a whole lot more of: Monkeywrenching the corrupt insider deals that have been degrading our environment ever since white men set foot on earth! Tear down the system ourselves, don't wait for Messiah Obama to do it, because he ain't gonna....
well, since he has taken bold action - whatever the practicality - but with CLEAR reasons justifying it , on moral, environmental, economic, "future legacy", and many other grounds -
he and his lawyers ought to think outside of the box -- and STRIKE - now that they are in the news - by EXPANDING their "bid" -- as part of a "defense" - as a COUNTER OFFENSE -
namely :
attaching his "bid" and "defense" AGAINST the of expected charge against him: "fraudulence and felony", BY TURNING THE TABLES on government allowing the auction -- and accuse the government , specific officials involved, and the corporations
AS THE TRUE FRAUDS and FELONS against the AMERICAN PEOPLE and the legacy of americans and the world.
let THEM try to "charge" him against THAT.
he and his lawyers ought to SHIFT THE SPOTLIGHT and PUT THE ONUS on THEM, both the government that expects to charge him for going against "legal" law and order rules (charging THOSE also as FRAUDULENCE) - and the corporations and privateers -
and ACCUSE THEM - and FORCE them to defend themselves for using "the law" against HIM -- in order to ENACT THEIR fraudulence and FELONIES against the american people and the legacy of the american people and the legacy of the future generation.
the problem with america NOW - is americans are STILL TOO FRIGHTENED of their "laws" which have proven to be MOSTLY to PROTECT the people and interests that HARM the american people.
they like to have "respect for the law" even if the LAWS no LONGER REALLY RESPECT THEM and their welfare but only of private greedy , FRAUDULENT , FELONIOUS interests USING the "protection" of the "law and order" to browbeat small people into submission to make an example of them for the REST to "not rock the boat" and just accept -- as when "bidding and auctioning off" COMMON LAND to private profiteers who CLEARLY will pollute and mess up the legacies for the generations to come , as proven by the TRACK RECORD of privateers --
and SO -- americans allow themselves to be "polite" in respect of the "law" - or the "courts" - or the "agencies" that make the so-called "regulations" which serve the interests of the powerful and protect the powerful FROM the PEOPLE -- like this young man and protect those private interests from what the young man REPRESENTS :
the COMMON WELFARE!
and THAT ought to be shown by this young man and his team - as the FELONY OF LAWS and AGENCIES in cahoots with these privatizers that the government, agencies (examples are FBI, the POLICE spying, etc.)
that these entities are the ONES who OUGHT to be put in jail and PROVE themselves IN COURTS of the world.
and IF a JUDGE dsimisses HIS "charges" or "defense" as being "out of order" THAT JUDGE should be ACCUSED FORMALLY and LEGALLY - no matter that it will go nowhere , for NOW -- but to make a WORLD SHAKING POINT -
that the "laws of the united states" - not only the ones BUSH created out of thin air -- are NO LONGER SERVING the people of the united states!
It most likely would not be a very intelligent move to send this individual money. From the story it appears that he did not take the necessary time to study the approach he should take in order to be most effective. Taking that into consideration since the potential for his actions to result in Fed. Criminal charges being filed against him, any money that readers might send would either go to his defense, or other non related expenses. After one sends money to someone like this you have absolutely no control over what the recipient might do with it. To send a check with a caveat attached would be pointless since the control is lost with the signature on the check.
Young Mr. De Christopher may be a well intending poorly informed college student, just trying to do his part; and as he is quoted "waiting for the new President to be sworn in to make the needed changes. If Mr. Obama did move to make the needed changes, it would have little impact on Mr. De Christopher's pending charges, or his impending trial. If indeed he is what he presents himself to be, he will have many years to outlive his felony conviction and move on to a productive life.
The "look before you leap" advice, being one of the many choice aspects of "Americana" and "home spun wisdom", should be considered here. His ill prepared move might cause the better informed observer to understand that the "process" is conceived and executed by the people in power to prevent others like this young man from interfering with that process.
The fact that people might send him money, could also work against him in that it would disqualify him from receiving the services of a public defender in his up coming legal proceedings, and unless enough money were directed to him, he might not be able to afford the 'best' defense, which would put him in a precarious situation.
On the "brighter side", he most likley would be convicted since his 'intentions' are now public knowledge with this article, and he knew that he was committing an offense when he made his ill advised move. Upon conviction he will either be given probation, or sent to a minimum security facility where he will be able to complete his education at public expense.
As for those who would send him money; that gesture would most likely be a waste of your money; but then it is your money.
The lesson here for everyone should be to find out all of the information you need to make a rational decision about your actions. And; there is most likley no bigger waste of one's time than to be involved in a legal case where you are defending ill advised actions, unless of course it would be the even bigger waste of time than to be serving a prison sentence or even probation for a crime you committed under the influence of ignorance.
In a society that is dominated by the mythology of someone who "sacrificed themselves to save others", it is no wonder that this story was even published, but a closer examination of the sacrifice might reveal that it was pointless and most likely "not worth the ink on the paper" to publish it; since it solves nothing, answers no questions, presents no solutions, gives little true comfort even though it seems to, even if for a brief moment.
They cannot require him to develop the parcels unless they require the other bid winners to develop the parcels as well..
Nice litmus test - I'm sending him some money to hold the leases.
Tim DeChristopher is a national hero along the lines of Daniel Ellsberg and other whistleblowers. We should so honor him, and two funds should be created that people can donate money to -- one for the purchase of the land and the other for his defense.
Unfortunately, I am unemployed (thanks GDub, you have destroyed the economy along with so much else) and cannot donate.
I would suggest that more people read the posts here.
The level of unintelligent response is not surprising, and if these posts are made by the "progressives" then this is a very plausible explanation of how and why the neoconservatives have had so much control for so long.
But if it makes the reader 'feel warm and fussy inside' to send their money to what may very well be another conservative 'shill', then those sending the money will feel better afterwards, the conservatives will feel better afterwards, the 'plaintiff here in this story' will feel better; and nothing will be accomplished which will make the mining/drilling lobby feel good.
I would consider sending a penny, but it would cost .42c to send it.
I would suggest that you keep your opinion to yourself.
America needs more "progressive" thinkers like these "good people". The reason why is that these "good people" are the very reason why the conservatives have pissed away their country, put war criminals in high places of power, made a mess of their environment, lost the future for the great great grand children, and well, I could go on forever..............but for many Americans "forever" is "day after tomorrow".
These "good people" need another "smirk" to send their money to and place their miserable hopes on; they can't take action on their own, have very little originality, and NEED guys like this one. And you have got to admire this guy, if he really is what he presents himself to be, then anyone that stupid , i.e. "give the Feds a reason to lock you up, and while your at it, give them a picture of you and an address where they can find you" or, he simply does not have anything else to do with his young life than to spend it in a Fed Prison----for what would amount to "chump change"..........or, he is working with the drilling companies as a "decoy", like Duck hunters use, or a decoy to "make these "good people" THINK they are doing some good.................either way, we need these "good people"
And if he really is that stupid, then he NEEDS to be LOCKED UP---so the rest of us can be safe.
So, 'countcoup', leave these 'good people' alone, don't use your usual intelligent logic and vocabulary and reasoning, they are going to do what they are going to do; and MY people need them to hurry up and finish the mess the conservatives started so that we can ride our horses through their empty cities..........
So folks when your sending this "fine young man" money, WITHOUT AN ACCOUNTING PROCESS----- while your at it send 'Jesus' some money also---- here's my address................
I just love it.
Good luck America, you really need it.
I'm starting to think that people some just want to push negativity and discouragement onto others. I am kinda sad that you guys would all make comments about this young man was if he made some kind of mistake, or like acting out of passion and commitment to the betterment of the world is foolish. Goodness, what have you guys done to save the earth from development and violation? Anyone that wants to make discouraging remarks about this fella really should look at themselves first. YOU guys were probably busy NOT doing anything, not really caring about Bush giving more land that isn't his away to his buddies, busy TALKING about how someone SHOULD do something, wasting water, using harsh chemicals somehow, or were driving your SUV's while he was risking his ass to try to make a difference. Geez, Howabout giving him a little real respect? We are all in a bind here, and CommonDreams has a membership with the capacity to make real change happen. Why don't we all stop bickering about everything and get along enough to add insight and solution to some of these problems? It's so depressing to read your bickering and intellectual one-upsmanship all of the time. let's embrace positivity this year.
Well, rev. you opened the door, start the 'list'.
The true leaders will always rise to the occasion, with answers and direction.
This guy may very well be like the suicide bomber that blew himself up at home before he could get to his destination to accomplish his mission.
Sending this guy money would not be advisable since he made so many errors on his own, how well will he put the money to use that people such as yourself would send him.
He accomplished absolutely nothing except giving the Feds an easy case to prosecute.
Unless you advocate a no win approach to a problem, what was it that this guy accomplished?
Do you believe in action that delivers no results?
Do you advocate sending money to someone who obviously did not research his approach, or was just plain stupid since his "sacrifice of himself" revealed pointless endeavor with some serious flaws in the planning?
Is failure acceptable to you if the one who failed has "his heart in the right place"? Do you slam the door on your own hand just to see if the pain is "just a rumor"?
So send your money to a fool who would leap from a precipice only to see the rocks at the bottom while he is in midair.
Why not take your money out to the back yard and douse it will gasoline and set it ablaze, if nothing else you'll save the postage costs.
Get the point?
