So Little Time, So Much Damage
While Americans eagerly vote for the next president, here's a sobering reminder: As of Tuesday, George W. Bush still has 77 days left in the White House - and he's not wasting a minute.
President Bush's aides have been scrambling to change rules and regulations on the environment, civil liberties and abortion rights, among others - few for the good. Most presidents put on a last-minute policy stamp, but in Mr. Bush's case it is more like a wrecking ball. We fear it could take months, or years, for the next president to identify and then undo all of the damage.
Here is a look - by no means comprehensive - at some of Mr. Bush's recent parting gifts and those we fear are yet to come.
CIVIL LIBERTIES We don't know all of the ways that the administration has violated Americans' rights in the name of fighting terrorism. Last month, Attorney General Michael Mukasey rushed out new guidelines for the F.B.I. that permit agents to use chillingly intrusive techniques to collect information on Americans even where there is no evidence of wrongdoing.
Agents will be allowed to use informants to infiltrate lawful groups, engage in prolonged physical surveillance and lie about their identity while questioning a subject's neighbors, relatives, co-workers and friends. The changes also give the F.B.I. - which has a long history of spying on civil rights groups and others - expanded latitude to use these techniques on people identified by racial, ethnic and religious background.
The administration showed further disdain for Americans' privacy rights and for Congress's power by making clear that it will ignore a provision in the legislation that established the Department of Homeland Security. The law requires the department's privacy officer to account annually for any activity that could affect Americans' privacy - and clearly stipulates that the report cannot be edited by any other officials at the department or the White House.
The Justice Department's Office of Legal Counsel has now released a memo asserting that the law "does not prohibit" officials from homeland security or the White House from reviewing the report. The memo then argues that since the law allows the officials to review the report, it would be unconstitutional to stop them from changing it. George Orwell couldn't have done better.
THE ENVIRONMENT The administration has been especially busy weakening regulations that promote clean air and clean water and protect endangered species.
Mr. Bush, or more to the point, Vice President Dick Cheney, came to office determined to dismantle Bill Clinton's environmental legacy, undo decades of environmental law and keep their friends in industry happy. They have had less success than we feared, but only because of the determined opposition of environmental groups, courageous members of Congress and protests from citizens. But the White House keeps trying.
Mr. Bush's secretary of the interior, Dirk Kempthorne, has recently carved out significant exceptions to regulations requiring expert scientific review of any federal project that might harm endangered or threatened species (one consequence will be to relieve the agency of the need to assess the impact of global warming on at-risk species). The department also is rushing to remove the gray wolf from the endangered species list - again. The wolves were re-listed after a federal judge ruled the government had not lived up to its own recovery plan.
In coming weeks, we expect the Environmental Protection Agency to issue a final rule that would weaken a program created by the Clean Air Act, which requires utilities to install modern pollution controls when they upgrade their plants to produce more power. The agency is also expected to issue a final rule that would make it easier for coal-fired power plants to locate near national parks in defiance of longstanding Congressional mandates to protect air quality in areas of special natural or recreational value.
Interior also is awaiting E.P.A.'s concurrence on a proposal that would make it easier for mining companies to dump toxic mine wastes in valleys and streams.
And while no rules changes are at issue, the interior department also has been rushing to open up millions of acres of pristine federal land to oil and gas exploration. We fear that, in coming weeks, Mr. Kempthorne will open up even more acreage to the commercial development of oil shale, a hugely expensive and environmentally risky process that even the oil companies seem in no hurry to begin. He should not.
ABORTION RIGHTS Soon after the election, Michael Leavitt, the secretary of health and human services, is expected to issue new regulations aimed at further limiting women's access to abortion, contraceptives and information about their reproductive health care options.
Existing law allows doctors and nurses to refuse to participate in an abortion. These changes would extend the so-called right to refuse to a wide range of health care workers and activities including abortion referrals, unbiased counseling and provision of birth control pills or emergency contraception, even for rape victims.

The administration has taken other disturbing steps in recent weeks. In late September, the I.R.S. restored tax breaks for banks that take big losses on bad loans inherited through acquisitions. Now we learn that JPMorgan Chase and others are planning to use their bailout funds for mergers and acquisitions, transactions that will be greatly enhanced by the new tax subsidy.
One last-minute change Mr. Bush won't be making: He apparently has decided not to shut down the prison in Guantánamo Bay, Cuba - the most shameful symbol of his administration's disdain for the rule of law.
Mr. Bush has said it should be closed, and his secretary of state, Condoleezza Rice, and his secretary of defense, Robert Gates, pushed for it. Proposals were prepared, including a plan for sending the real bad guys to other countries for trial. But Mr. Cheney objected, and the president has refused even to review the memos. He will hand this mess off to his successor.
We suppose there is some good news in all of this. While Mr. Bush leaves office on Jan. 20, 2009, he has only until Nov. 20 to issue "economically significant" rule changes and until Dec. 20 to issue other changes. Anything after that is merely a draft and can be easily withdrawn by the next president.
Unfortunately, the White House is well aware of those deadlines.

I agree with your assessment that this was a shallow imitation of "criticizing Bush" and his criminal administration. They print this and the dumbed-down repugs think the NYT is a leader of the "liberal" media. Where was this kind of criticism for the past 8 years?
As someone else so aptly said, the New York Times excels at walking onto the field after the battle is over and shooting the dead.
They have consistently shaped the news by burying criticism and dissent in the inner pages (if it is reported at all). Their coverage of anti-war events and dissenters is tinged with disdain. They thwart the possibiity for peace and justice in the Middle East by omitting most news that shows Israel in a bad light. They omit much disturbing news of civilian casualties and devastation in our occupations and invasions. They suppress truth about things like the invasion of Iraq until it is too late to prevent it. They make the paper a comfortable place for the customers who buy the luxury goods in their ads. They make the paper a comfortable place for the prosperous "liberal" wing of imperialism.
Now these sanctimonious zeros hope to hitch a ride on the Obama train by last minute criticisms of Bush and Cheney.

The environment and civil liberties points I can agree on but "abortion"? No way. Not gonna happen. Besides, if the women concerned about losing their rights to an "abortion" would actually sit down with their men and try to have a reasonable conversation, maybe they wouldn't be in this mess now. Better yet, try reaching out to men who are gay and/or so-called crossdressers. Giving them your sympathy might help you out in return.

Alright. I know I'm gonna get flanked again for saying this but here goes. There are societal inequalities against both men and women. And I was flanked by "Sioux Rose" for suggesting that men should also be free to wear what they want since women can pretty much wear anything men can wear but not vice versa. In fact, women have been able to take over a lot of what men used to wear and it's still happening. I'll let you figure out this one. So what if a guy wants to dress like Robin Hood or Peter Pan, hint hint. So what if he's gay? So what if he doesn't want to be a macho warrior bully? If these kind of men weren't written off, then maybe the women demanding their rights would have found allies to help each other out. I know this sounds too confusing at first but trust me. You'll get the picture over time. Sorry if I sound like a "pervert" as some people in this INTOLERANT society would like to call it.
I still don't quite know what you're talking about, especially the abortion and talking reference, but as far as being a drag queen, I can tell you that my Republican co-worker was extremely proud when her dress (worn by a drag queen co-worker) won first prize in a contest.
You may believe that people are more intolerant than they actually are.
Another Republican co-worker told me Friday that she was dreading seeing our mutual friend because years ago she had given her grief for letting her son dress as a powder puff girl on Halloween, and this year she (the first one) had let her teenaged son dress as Hannah Montana, and she knew that it would be revenge time.
So hang in there.
I'm not saying that only "conservatives" are intolerant as I've met people who claimed to be "liberal" showing off their intolerance. As for drag queen, I'm not taking it that far. I'm referring to the idea of letting men wear what they want to wear without facing persecution, a privilege women enjoy today and should no doubt keep. Now, I'm not a guy who puts on tights or skirts but remembering that men in the Middle Ages had it before the women, I say leave all options open. I just get turned off when some many feminine groups complain about women's rights going under siege when in fact those same ones say nothing about the same happening to men. The elites do a hell of a job dividing men and women and throwing different sets of inequalities against them. The issue is some of them are recognized but made too much a big deal of while others are suppressed. We gotta end those double standards and resolve the various inequalities being thrown at both men and women.
P.S.: A neighbor of mine who wears tights under his pants some days told me that his legs got better in addition to lotion treatment. Now there's a healthcare inequality issue we can pick up from there. He doesn't wear it for fetish purposes but for health and comfort purposes and since no one at work will ever find out, his wife is fine with it although she can sometimes annoy and tease him about it at times.
Well, I got slammed for pointing out that male circumcision is as wrong as female circumcision, so I know what you're talking about there.
Plus, there are more male rapes in the US than female, because of the brutal conditions of our prisons and the extraordinary amount of people that the US has locked up.
I consider myself a feminist, but to me it means equality for everyone and decent treatment for all.
My overarching concern is life. Not just the limited view of life as often debated in the death penalty and abortion, but a full and expanded view of life that is basic to our very existence. Environmental degradation is anti-life, human degradation is anti-life, spiritual degradation is anti-life. Today America is in the grip of a death culture and ONLY a life culture is big enough to fix it.
We all understand that we are approaching a critical mass, life or death. Global warming can lead to an extinction event, and nuclear war can lead to an extinction event. ONLY an appreciation of life in it's fullest sense, and a collective determination to sustain it, will move us away from the brink of extinction. Progressives need to wake up and realize that support for abortion is supporting anti-life and the death culture. Life cannot be cherry picked. One is either fully for life or one is for death. Change now while there is still time.
Some progressives support "abortion", others don't. The issue is really nothing more than a red herring designed to bait and switch the social libs/cons on both sides. The easiest way progressives can put this issue to rest goes like this:
"No one's forcing you to have an abortion. If you don't want an abortion, don't get one. The decision for a woman to terminate her pregnancy rests with her as well as God and her doctor who is also responsible for the woman's safety. Besides, let's stick to taking care of the existing lives on issues such as wars, environment, health care and safety, worker rights and safety protections, etc ... If that's not pro-life enough to you, then what is?"

What makes you think that those women who oppose criminalizing abortion don't sit down and speak with men or have an especially unfriendly attitude toward gay men? Or that if a woman is faced with a wrenching decision like abortion she could have avoided the mess by having had a reasonable conversation?
I sense a general hostility to women here. I am sorry if you have met some who have hurt or insulted you.

Why Frank! What a question. They only love themselves and hate real Americans. They couldn't find the courage to serve when called so they get even by sending kids to die for them while they beat their chests from safety. Cowards usually do.
Besides we had their money, so they got it all back while they could and gave a lot to their friends too.
Other than that, they are nice folks.
They hate us because "They" are a small cadre of ruling class idiots who have stolen or inherited their wealth and position and they have to create an elaborate Flim-Flam (War, politics, media propaganda, celebrities, consumer society and useless commodity production, etc.) to justify their hollow existence and the exploitation of the entire world and its resources - so that they can enjoy their unearned leisure while we are over-worked and exploited.
We remind them of this.
Agreed, and we shouldn't forget that the small cadre of ruling class idiots have a large contingent of bamboozled rubes, footsoldiers of a sort, under their control. And all they have to do is tell the rubes to hate us too, and the rubes do so without hesitation.
It is nice, though, to see that SOMEONE at the NY Times has finally started to try to restore what was your great reputation as the "paper of record."
Now let's see if you will do any stories on ELECTION PROTECTION issues. And what about some stories on HOLDING BUSH-CHENEY ACCOUNTABLE??? Ever have a book review on Vince Bugliosi's new book about trying Bush for murder when he leaves office?
We DO need one major newspaper willing to tell ALL the stories. Otherwise, we'll just keep using them (newspapers) in bird cages and going on the internet for our real news.

The NYT deserves some credit here. They may have been going on the band wagon with all the other news sources for many years now, but they are atleast making better decisions now. This may be a signal that they will begin to actually report REAL NEWS and say what most of America knows or needs to know.
Any MSM that breaks from that pack needs our support to show them that they are making the right decision.

I gave up on the NYT when they started censoring my opposing posts to their slanted blogs. They do NOT want the editorial bias in their "news" questioned.
They only deserve the right to fail... or are they TOO big as well?

I hardly think that adding neo-con in chief, Bill Kristol to the NYT staff is a movement in the right direction. Why showcase a political extremist whose ideology has been widely discredited? I stopped reading the Times after the addition of Kristol. There are better sources of news.

All I can see is let's all boycott all major news media outlets and put them out of business. Then, insist any news media outlets that we do support report censored news stories, have a much wider spectrum of views, do more investigative journalism, and report evenly on the multiparties in all election cycles.
Many of us have already done so. We have lost all respect for corporate news years ago. National Public Radio is overwhelmingly Jewish and therefore inadequate to reflect the news objectively. Foreign and alternative news have been our sources for news and commentary. Common Dreams represents Jewish perspectives well beyond their numbers in the population in general, therefore, it too is biased. We must be aware of attempts of Jewish hegemony in the market of ideas. Much of this begins as unstated policy from the State of Israel. Read Azure Magazine. It contains articles on how Israel plans to influence America. Organized attempts from the extreme right and left to dominate the arena of ideas is not healthy.
Most articles I read are lenient to Palestians, the innocent ones at least. The truth is, when it comes to Israel vs Palestine, we're gonna have to separate the wheat from the chaffe on both sides.
1000 percent agree. Man, Opinions of the journalists is not NEWS.We don't want that. For the future all present journalists should be removed from their present position. Send them to some far out of the main stream of life. Let them live in a realistic environment. Perhaps there would only be a newspaper to learn their trade.
Canadian stations report correctly even when they are bombarded with all of the Election campaignes lasting for 2 years. This is ONE deal that needs to be brought forth to the citizens to vote a referendum. Not the congress!!!

I stopped reading the NYT the day they published the news of the Downing Street Memos hearings about page ten at the bottom of the page. What a sorry excuse for news reporting. Making amends after thousands have perished is inexcusable. Maybe when they decide to 'investigate' the real story of 9/11 I will start reading it again.
Why do people find degrading, defacing, belittlement of a man who was willing to take on the responsibility of the Presidency if elected.
What do you gain from the demoralization of the administration. Why is it helpful to tear apart the years served.
