Turning the US Army Against Americans
An antiwar activist has been accused of spying for the US army, raising legal questions the Obama administration must answer
An antiwar activist in the state of Washington had been exposed as an undercover informant for the US army, stationed at massive Fort Lewis, south of Tacoma. And in one of those Kafkaesque twists for which our government is renowned, the army is now investigating itself to determine how such an arrangement came to pass.
Although the Times gave no credit, the story had been broken on 28 July by Democracy Now!, a leftwing television programme co-anchored by Amy Goodman, a longtime progressive journalist. For nearly an hour, two former associates of John Towery – a civilian employee of the army – explained how they learned their fellow activist was in fact a military spy.
"We hung out," said Brendan Maslauskas Dunn, who filed the public-records request that inadvertently outed Towery, who had been going by the name John Jacob. "We gave workshops together on grassroots direct democracy and anarchist struggle. I mean, he was a friend."
Fellow activist Drew Hendricks offered a weird twist, telling Goodman that, as far back as 2007, Towery identified himself as an army employee and offered to provide Hendricks with "observations and inside knowledge of operations on Fort Lewis".
The picture that emerges is worthy of a cheap spy novel. If Maslauskas Dunn and Hendricks are correct, then Towery truthfully told antiwar activists that he worked for the army, but lied about his name and real purpose: gathering intelligence on his new associates and what threat they might have posed. (According to the Times, antiwar groups in Washington have attempted to "disrupt military shipments".)
Moreover, Towery's alleged activities would almost certainly have been illegal. According to two lawyers whom Goodman interviewed, Larry Hildes of the National Lawyers Guild and Mike German of the American Civil Liberties Union, such spying would violate the Posse Comitatus Act, which prohibits the use of American military forces for domestic law-enforcement operations. The law was weakened during the Bush years, though Hildes and German told Goodman that operations such as that attributed to Towery remain illegal.
Towery's alleged spying is yet another sign that Barack Obama's reluctance to come to terms with the legacy of George Bush and Dick Cheney's legacy is simply not tenable. By attempting to move on without accountability, Obama is becoming complicit in the very activities against which he ran.
The Bush-Cheney administration's obsession with running roughshod over constitutional and legal principles is by now well-established, with torture being just the most infamous example. Only a week ago, the New York Times revealed that Cheney had pushed hard in 2002 to send troops to suburban Buffalo in order to arrest several al-Qaida suspects. It's difficult to imagine why Cheney would want to do such a thing other than to set a precedent. In any event, Bush said no.
And as we know, Cheney, Donald Rumsfeld, Paul Wolfowitz and their fellow neoconservatives weren't above casting institutions such as the military and even the CIA as weak and unpatriotic when it suited their purposes.
General Eric Shinseki, after all, was cashiered from his position as army chief of staff after he dared to tell the truth about how many troops would be needed to carry out a successful invasion and occupation of Iraq. (Shinseki is now Obama's secretary of veterans affairs.)
And when former diplomat Joseph Wilson, on a mission for the CIA, revealed he had found no evidence that Saddam Hussein sought to purchase uranium in Niger, Team Cheney retaliated by exposing his wife, Valerie Plame Wilson, as an agency operative.
The Towery allegations are not the first time it's been reported that the goverment has infiltrated the rather impotent antiwar movement. A little more than a year ago, for instance, it was revealed that the Maryland state police had spied on peace activists in that state. But the alleged misuse of the army places this on a different level, both ethically and legally.
Not to get ahead of the story, but if the Towery story bears out, then it's difficult to imagine he was alone. In that sense this could prove to be reminiscent of Cointelpro, the FBI's secret, illegal programme, which kept tabs on dissidents from 1956 to1971. We need to know the truth about what happened during the Bush-Cheney years, and what may still be happening, with or without Obama's knowledge.
Since his inauguration more than six months ago, Obama has been half-hearted, at best, about exposing his predecessor's wrongdoing. Maybe he's right – maybe he can't investigate the Bush White House and govern the country at the same time.
But if that is the case, then Obama should quietly encourage officials like Vermont senator Patrick Leahy, who has made it clear that he'd like to conduct a no-holds-barred investigation.
Much as Obama would like to put it all behind us, he can't. And he shouldn't.

Show Allfrom personal experience growing up and to college - in the Philippines during the marcos dictatorship era - i can say this:
Martial Law - behind which is a dictatorship of an oligarchy of big powers - CAN RUIN a nation. the STARK contrast of the economy and the sense of liberty between not having that kind of dictatorship and "police- security" state and having it - as happened in the philippines (marcos instigated martial law - and it can be instigated in the USA although under more disguises without naming it AS martial law) - is so great -
that if it came to that in the USA - americans WILL see - only then - what it REALLY means to live under a police state. and the RUIN that it can do to the economy.
in the philippines we did not even have the "burden" of maintaining overseas commitments that - for the USA - is bleeding it dry...and it began when the philippines was STILL quite prosperous actually -- and by the end of the dictatorship -- everything was ruined, EVERYTHING (not without assistance towards that BY the USA that was in full support of marcos right to the very end until they whisked him away in a helicopter from the Palace Rooftop to a waiting US submarine that gave him his "escape" to Australia and then to hawaii)... from which it is still struggling to recover today - .
americans have NO Idea what that can really be:
a Martial Law, security, police state....considering how ADVANCED the USA is - 30 years later - in technology in spying, controlling people's movements, employments, personal information, "policing", etc...
and then - wtih all the wars and the corporatocratic robbery abetted by the government itself -
just how ruinous it will all come to.
americans simply have NO idea how horrible it can become.
65 percent of the people in this country have had enough. All we need is a true leader, real honest reporting on treasonous acts to subvert the constitution , and then the power of the people.
Cointel pro is back in a new form , Gang Stalking.
The military, local, state and federal agencies working with community watch and right wing christian vigilante groups are using gang stalking torture tactics to destroy chosen targets lives.
These are the very same people being used to disrupt town hall meetings about health care, just look at them, and you will start to recognize them wherever the fake christian right wing republican party needs dirty work done.
They could be peace activists, political adversaries to the republican party, pro choice activists, pro single payer health care activists, anybody that the right wing self righteous fake christian corporate supported hate machine wants slandered and humiliated and destroyed.
These christian mafia fake people have a lot of money and power, they are nasty, and will stoop to any kind of activity so as not to be proven incorrect in their false accusations of a target.
Thanks to the Christian Fellowship, C- street playboy Christians and Bush-Cheney , they have been embedded into self serving positions of power and have a death choke hold on America.
But , they have now been discovered and with a little help from President Obama and warrant less surveillance, we will find these traitors and flush them out.
I have been a victim of 24/7 gang stalking by this highly organized gang of fake republican christian thugs for 3 years.
They have bugged my house, my phones, my internet activity.
They have subjected me to severe tailgating, both while in my car and on my motor cycle. Noise attacks while at home by cars with loud stereos, the police never come to shut them down. They follow me the second I get in my car , and every where I go,Fire fighters and EMS workers organize the surveillance, these lunatics have mobbed me in stores and gone door to door in my community telling people lies about me, using NSL letters to keep them silent.
They hire the most shady people they can find to follow me at night, to scare me, keep at home, isolate me from a normal public life.
I could write a book, and reveal all there nasty tricks.
And the real disgusting part is that , its the elite of your community that are fully aware of these activity's.
Lawyers , Doctors, Judges, Fire fighters, EMS workers, nurses , business owners, Verizon. etc.etc.etc.You can not get help, you do not know who to trust.
They will not be wrong , you will not be able to fight them, they will come after you, your kids, parents, friends . They will do what ever they have to and protect their ring of of self righteous pricks.
Only real federal government whistle blowing protection will help crush these traitors, and that legislation is on the way.
The ring must be broken from within its ranks, and I bet there are plenty of people on the inside just waiting for the chance.
I would gladly cut people in on a law suit for damages caused by torture to any whistle blowers that would step up and identify the ring leaders and money men.
These people are out of control, and need to be stopped.
Warrant less surveillance of these right wing domestic terrorists by the new Democratically controlled DHS should have started by now. We all know about the right wing memo earlier this year from the DHS. That was Secretary Napolitanos polite way of saying cease and desist, the game is up, we are coming after you.
But my 24/7 surveillance continues, these arrogant pricks are going to drive me crazy to protect themselves. Dumb asses, I was married to an alcoholic for 20 years, she could not drive me crazy, they dont stand a chance. They just dont know it yet.
I am patient , and will have my day in court, and these torture freaks will pay a high price for their treason, its Karma, and justice. Tell that to Jesus, he knows.
He did say that if laws were broken, he would seek justice. If he tried, now to go after Bush, Cheney or others from the previous administration the republicans will try to burn down the entire village. There is still time for him to make a stand against the crimes we all thought we saw being committed in our names.

You can know that if one of the posters are not spies then they are reading the comments here. I hope they do.
In Equador a number of years ago the people showed up in vast numbers in front of the Rose house their white house. There they confronted the military. The order to fire weapons was given but no shots were fired. The american puppet president quietly left by the back door left the country by plane flight and is here in the US.
Not unlike in the movie V for Vendetta.
The question is Can we change or right the ship of state before it sinks and we find ourselves in the streets against our sons and daughters in the military. But believe that that day approaches. What do we do?
This is the best that Obama could do... And still save face...
The manufactured tea-bagger revolt will crescendo...
With a predictable outcome... Justification for nothing changed...
and transition into the next phase of the fascist police state...
"Cheney had pushed hard in 2002 to send troops to suburban Buffalo in order to arrest several al-Qaida suspects. It's difficult to imagine why Cheney would want to do such a thing other than to set a precedent."
Darth Viper recognizes the utility of setting precedents toward his agenda of totalitarian world domination through domestic slavery and foreign conquest, and Darth Viper had a large gang of compliants, many of whom carry his torch today in the Whitey House, the US Congrass and the US Supercourt.
'Precedent' fits.
The degree of interest suggests fairly immediate plans, sadly. If Cheney put on a coat, he expected rain.
I suspect he would not have expected the economic crash so quickly, so I suspect he expected a deeper reaction to something he had planned.
Since 0 seems to follow Cheney's policies fairly closely, including maintaining extra-Constitutional population control, it may rain soon.
(According to the Times, antiwar groups in Washington have attempted to "disrupt military shipments".)
That is seriously unAmerican!
The American government has always maintained the right to ship arms to belligerents. President Washington took this position when France protested against the sale of arms to England in 1793, the answer being that "the exporting from the United States of warlike instruments and military stores is not to be interfered with."
So true.
President Washington was a Federalist along with Hamilton (banker and war hawk), and along with Adams, did not trust the French. The fact that Washington had fought against them as a young man in the French and Indian War of 1765 might have had a lot to do with it. French threats on American shipping became a real problem in both the Adams and Jefferson's administrations, but both Adams and Jefferson were able to keep us out of European wars for a long time. Everybody loses in a war: the victims, the taxpayers, the environment. Everybody except war profiteers like bankers and munitions runners.
My big fear, is that with the economy in shambles, no export will be refused: especially military hardware and aerospace products. This can't be good for world stability. It's time to realize that our biggest enemy as Americans are really unprincipled bankers (financial terrorists) imho. Just think about how much damage to retired Americans was done by Neil Bush (president of Silverado S&L) and Bernard Madoff.
Hank Paulison and GWB need to be publicly audited for the theft of the TARP funds.

"All tyranny needs to gain a foothold is for people of good conscience to remain silent." - Thomas Jefferson
AND with that great comment TJ ...we are returned to General Smedley Butler, US Marine, 1933 speeches:
"OUR FOREIGN POLICY has always been geared towards gathering as much of the world's resources unto ourselves at the expense of others....War is a Racket ...by Big Money, Big Finance, Big Corporations, Big Business, Big Banks...The True Purpose of our US Armed Forces is to be the Big Muscle for our Money and War Racket ..and to make the world safe for our Big Boss..our Supernationalistic Capitalism and our Cultural and Economic Assault..the trouble with us Americans is...if our Dollar can't buy more than 6 percent of its value at home...we get uneasy and want to go abroad so it can buy 100% ...and where the Dollar goes, the Flag follows, where the Flag goes, our army follows".
it remains the same today as it was :
"americans do not really understand that the reason we are living our lifestyles is because it is only part of a very, very vicious system of exploitation that dehumanizes and enslaves people everywhere...our foreign policy is designed to make other countries permanently subjugated and servile to our will and of our Chamber of Commerce....i was part of this American Empire building project..."...

The creepiest part is this -
"Towery identified himself as an army employee and offered to provide Hendricks with 'observations and inside knowledge of operations on Fort Lewis'"
Don't think that bait was taken, or there'd have been some "homegrown terrorist" arrests in Washington State. And peace activists no less!
(all the "terrorist cells" are notable by the central role played by a government provacateur, and one of the pieces of evidence convicting the New Jersey "terrorist cell" was the possession of a map of Fort Dix, despite the fact that the possessor was a pizza delivery driver)
"Obama is becoming complicit in the very activities against which he ran."
BS
This issue wasn't even mentioned during the campaign.
Why don't the former Obama supporters who feel "betrayed" just go a head a publish an imaginatively re-written version of history in which Obama ran on the platform they wished he did?
Because when Dan Kennedy writes,
"Much as Obama would like to put it all behind us, he can't. "
He's got it backwards. Obama wants us to but it all behind us, because he wants to continue and expand the same policies.
He hasn't "been half-hearted, at best, about exposing his predecessor's wrongdoing." Because he hasn't been exposing them AT ALL, he's been advancing the same agenda.
I wholeheartedly agree.
US elections are a charade of the corporatist elite. This term we have don't have a hawk out of their own ranks but a black puppet.
hope3dup 4:51 ------ Obama did run on transperancy and as you said his DOJ claims state secrets in almost every case in which it is involved.
"Obama did run on transperancy"
and I saw through him from the start.
nothing but a hollow hope dealer.
There are a few clear reversals that Obama has done and that's one of them. I think his use of state secrets qualifies, even though he never specifically said he wouldn't use it if elected. Glen Greenwald has an excellent article on the subject.
http://www.salon.com/opinion/greenwald/2009/02/10/obama/
Seems like now would be the best time for a coup here at home; what with all our military hardware and troops off overseas fighting. There wouldn't be much dissenting states could do (if there were any) with a good portion of their National Guard troops out as well. There is however quite a large pool that Xe could draw on to supplement domestic police duties. And I don't believe Posse Commitatus covers mercenaries (contractors).
Keep your powder dry
Shocked, shocked to find that the myrmidons of the plutocrats would spy on and murder trade unionists, peaceniks, strikers and other in the good old U.S. of A. Don't get all disorderly and demand liberties and rights, and they won't shoot you.

This is beginning to look like the old "Spy vs. Spy" comics in Mad Magazine. Anybody engaged in direct action protest should expect that whatever group they are a part of will be penetrated by government agents.
In fact, don't be surprised if some groups have been formed and run by government agents. That was almost the state of the KKK in the 60's in the segregationist South, where J Edqueer Hoover had informants informing on informants without either knowing the other's alliegence or affiliation. .

I think we can assume that anything remotely like CD is actively monitored in some way.
It costs almost nothing to do; we type things, so the data's searchable; and anyone who is coordinating anything has to appear somewhere.
Turning the US Army against Americans is nature's way of balancing our population by getting cons to kill people off.
I believe that Vermont senator Patrick Leahy has an anthrax score to settle with the Cheney/Bush administration. As do a bunch of murdered and maimed USPS workers...
When it comes to exposing the egregious evil of Bush and Cheney, Obama has been perfunctory to say the least and that is because nothing has really changed.
I hate racism and all that it stands for. Racism has no place on CD.
racism doesn't stand for anything.
it sort of slimes and slithers.
NC Tom, I cringe at the thought of your crazy health system. I cry for all the sensible americans who cant make the others see sense. I take an interest in all things US because we have to make sure we don't let corporate greed come before peoples health. There is no debate in America because of the MSM being owned by the corporations.

When asked by a reporter whether he was afraid of unions, notorious robber baron Jay Gould replied, "No, I can hire half the working class to kill the other half."

"I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States."
That's it. The whole kit-and-kaboodle. Anything other action, or omission, is treason.
Obama (and Bush) were doing exactly that. The richest men in America composed the Constitution to protect them and their ilk--government of the rich, by the rich, for the rich.
Treason is defined as a betrayal of trust or confidence. You quote, "I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States." However, several former Presidents have failed to preserve, protect and defend the Constitution of the United States, therefore what Spc. Victor Agosto is guilty of more closely resembles integrity rather than treason.
There is nothing treasonous, either by your definition or that of the government, in the action taken by Private Agosto. He betrayed no trust or confidence. He enlisted, did his duty and fulfilled his commitment before taking his action. He demonstrated integrity in his decision. He demonstrated courage in his actions. It is not treason to adopt a political or personal philosophy in opposition to the majority. It's as American as apple-pie.
Hey Luckylefty
Thanks for the post, I couldn't have said it better! Very succinct!
Let's not forget that in the waning days of the Bush administration, he enacted the creation of NORTHCOM, the North American Army Command, with the specific order to use US military personnel and weaponry against the American people.
Obama has not rescinded that order either.
What does that tell you?
Walk in peace.
Obama will do nothing about this. Nothing.
From the article:
"...Obama should quietly encourage officials like Vermont senator Patrick Leahy, who has made it clear that he'd like to conduct a no-holds-barred investigation."
Leahy's just selling wolf tickets. If he ever got a clear mandate, a staff and budget and subpoena power, he'd farm the job out to Phillip Zelikow and content himself with hauling buckets of whitewash.
Yeah, the phrase "no-holds-barred investigation" caught my eye too.
It's so... quaint!
Three years ago, the progressive blogosphere was full of excited and confident moderates predicting that once Democrats were installed as chairpersons on various Congressional investigative committees, they would begin conducting one "no-holds-barred investigation" after another into the Bush maladministration's ongoing crime spree.
And then, having assembled a vast body of damning evidence, they would go in for the kill. We know how THAT worked out!
I don't see how anyone can still use the phrase with a straight face.

koalabuger,
I know this is off topic for this article, but briefly what is your opinion of the health care "debate" that is going on in the U.S.? And second would you and your average Australian trade your health care system for the one we have in the U.S.?
if you can call what you have in the US a "system".
The corporations occassionaly allow the promotion of a saviour of the people. They are always trojan horses. We got one in Australia called Bob Hawke who was Prime Minister after being head of the Unions. He caused the sacking of a lot of striking pilots because it was convenient for his multi millionare mate. If the mainstream media is supporting them they are a plant.
Yeah, and look what they did in Oz to Gough Whitlam. It was a bit more sophistocated than the recent getting rid of Zelaya in Honduras, but it was a coup de etat. Hawke was probably told to toe the line before on being sworn in as PM. The corporations wont allow their media assets to report any dissent.
As X-File Mulder said: "Trust No One".
Frightening scenario, but with infiltrations for disruption purposes at town hall meetings, paid troublemakers at peaceful protests, and now this...?
Damn! What has this country become if not Fascist and Police State? But how the hell do you fight it when the cops and military are armed to the teeth, highly programmed, and willing to shoot their brothers and sisters on command?
How do you fight it?
You join a legal Union, get your co-workers and neighbors to do the same, and then "withhold services" and boycott everything until the government sits down and allows a redress of grievances like it's supposed to. Item one is to cut the military and pentagon in half.
TJ
"The greatest threat to free peoples everywhere is a large standing army." - George Washington 1775, promising congress to disband the (Boston) Continental Army at the conclusion of the war.
But how the hell do you fight it...? That's a problem when the only thing the White Majority really wants is a full restoration of their "Insulated White Privilege". They still want (White) Male Supremacy, Gender Slavery, the Rights of Conquest, and feral Oligarchy along with the Authoritarian Patriarchy that serves as a foundation for them all. They still refuse to make an equal place for "everyone" at the table. They still want the Roman Slave Republic based on Exclusion and they're still willing to throw major portions of the society under the bus if they think that will buy it for them. Union workers thrown under the bus? Slave labor? 2-3 jobs just to live or a just one 50-60hr/wk job? No problem just as long as they can still afford to buy the slave labor, child labor, prison labor, sweatshop labor products from Wal-Mart.
And now they can't and they're unhappy, and they haven't quite realized that the movie is over and they won't be able to afford such 'niceties' for any foreseeable future. They will be realizing it shortly. The consumer economy (70%) is D E A D. The loss of Social Class is the loss of Everything in America - friends, family, church, social networks, Everything. It is the Great Shattering. They will go mad. And they are becoming a numeric minority in the land their people committed genocide to steal. Such a population is doomed. Many will call it Justice.
Peace.
