Justice Department Argues Against Releasing Cheney Interview
President Barack Obama's Justice Department is arguing that former Vice President Dick Cheney's interview with prosecutors in the CIA leak case should remain secret for five to 10 years to persuade high-level government officials to cooperate in future investigations.

(REUTERS/Larry Downing/Files) "In making public the vice pesident's interview, you will chill them," Justice Department attorney Jeffrey Smith told Judge Emmet Sullivan during a two-hour hearing Tuesday on a Freedom of Information Act lawsuit seeking release of records about the Cheney interview, which took place in 2004.
Sullivan sounded highly skeptical of the government's arguments, but he said he had not decided how he would rule in the case. "Where do I draw the line? This happened five years ago," the judge said. "Would there be impediments to putting this information in a time capsule?"
As the hearing concluded, Sullivan said he thought Congress had drawn a "bright line" with language in the Freedom of Information Act that generally exempts information about pending investigations from disclosure, but not closed probes, like the CIA leak case. He also said he would stay any ruling so the government could appeal before he released any documents.
Smith said the Justice Department's view was that a delay of five to 10 years was appropriate, marked from the time the official or his or her administration left office. "It's a judgment call," Smith acknowledged.
Smith suggested that such a delay would make it more likely that the information was used for historical purposes and not for political embarrassment. "The distinction is between releasing it for historical view and releasing it into the political fray," Smith said.
At a court session last month, Smith said the government feared the material could end up being used to mock Cheney on "The Daily Show."
"How do you distinguish the political fray from the public's right to know what the government is up to?" Sullivan asked.
At another juncture, the judge said the Justice Department seemed to be urging him to create a new vice presidents' exception to the Freedom of Information Act.
"What the government's asking me to do is create another exemption ... legislate - something courts can't do," Sullivan complained.
Smith said the danger was not only that officials might not cooperate with investigators but that the officials would be less candid. "People speak differently when they're speaking in public than when they're speaking in private to an investigator," he said.
An attorney for the liberal public-interest group seeking the documents, Citizens for Responsibility and Ethics in Washington, told the court that the government's arguments amounted to rank speculation.
"It's all about hypothetical posturing," the lawyer, David Sobel, said. "Where does that rationale end?"
"There is no reason why the claims [the government] makes couldn't be extended to members of Congress. ... What about the CEO of a publicly traded company?" Sobel argued. "The list of who might have apprehensions about their interview becoming public is endless."
At the hearing last month, Sullivan said he was not satisfied with the Bush administration's legal filings on the issue. In response, the attorney Obama appointed to head the criminal division, Lanny Breuer, filed a declaration saying disclosure of Cheney's interview could lead to a lack of cooperation that would "hamper" future investigations.
While prosecutors could resort to grand jury subpoenas to gather information, that could "have the effect of injecting the law enforcement investigation itself into the political process," Breuer warned.
"Presidents don't really have to cooperate if they really don't want to," Smith noted, referring to President George H.W. Bush's refusal to agree to an interview sought by Iran-Contra independent counsel Lawrence Walsh.

The prosecutor is a friend of mine. I probably committed a crime. The prosecutor investigates me but does not seek an indictment. When the press asks to see the results of the investigation (who knows there could be evidence of a crime), the prosecutor tells them that he cannot release that information because there might be details in it that could cause an embarrassment to me. I now go to court to get the information. The prosecutor tells the judge that the information should not be released for 10 years to avoid embarrassment to me and so that criminals in office won't have to worry about him releasing embarrassing information about them when they possibly commit crimes. Of course, I will likely be dead in ten years and, even if I am not, I can get my friend to use the same argument then and buy another ten years of silence.

Love the framing...CREW is a "LIBERAL public interest group"...as if THAT explained their position. Sick how this game has infected "journalism." Readers can't be trusted to simply evaluate facts or issues. "Journalists" have to paint overly-simplistic cowboys/indians sharks/jets conflicts among personalities...the story can never be about the simple merits of two opposing ideas. I've been gobsmacked to find that seeking the enforcement of our laws has become a "liberal" position.

Smith represents guilty parties, and misleading the judge is his job.
These witnesses are not coming out for congeniality, but because the house is crumbling. Every piece of data that outs is potentially another step towards trial and conviction.

It was reported today that Obama will keep secret Vice President Dick Cheney's interview with prosecutors in the CIA leak case for 5 or 10 years or until Dick's multi billion contract with Oprah Winfred has been signed for a 10 week show appearance.Oprah has been perfectly clear that she will be using the wet noodle method to get Cheney to open up about the murders he authorized the CIA to commit.
Oprah has confirmed that after she is done with Cheney high-level government officials will be jumping up like moles in wack a mole to cooperate in future investigations.
Oprah's producers however said that they were having trouble getting in touch with Cheney and had searched all the known caves and hidey holes known to be frequented by Dick.Just like his term in office everyone is wondering where is this dick.
Where in the world did Obama and his sidekick Eric Holder come from? The republican party. Havent they the ability to understand that you wont have to worry about the corrupt criminals in the Gov. not testifying if you hang the war criminals in the Bush/Cheney regime. Who says crime dont pay?
I am so sick of Obama and his lying ways. I was a Democrat but not any more. We have been scammed again. Obama with his secrecy, deception, executive orders, wiretapping,torture,no real health care, pro war stance, etc etc is beginning to look like scum since at least Bush was known for what he was and Obama has the cult of personality veneer to fool people. When Valerie Plame was "outed", the danger to her and her family was IMMEDIATE and everlasting. But, more than that, an entire cadre of agents may have been put at risk. Any foreign agency need only research the companies listed in Mrs. Wilson's portfolio, and then extrapolate any other Americans also listing the same companies as previous employers.
I do not subscribe to putting ex-presidents and VPs on trial for 'official' actions, however, in this case, I believe that the actions of VP Chaney, IF the allegations are true, to be criminal in nature and not within the official duties of his office. In order to determine if the allegations are indeed true, it would necessitate the release of information that Justice Dept. is trying to keep secret.
In a free society, the citizens MUST be kept informed in order to protect that society. To do otherwise is to turn those "citizens" into "subjects". I fear that after the past sixteen years, our form of government is near it's end. The corporate controlled fascism that follows will leave many martyrs in it's wake.
This country seems like Rome as it is beginning to fall! This has been going on for a number of years, but the cracks are much larger now. I still have a tiny hope that it could be saved. The only way for that to happen is for those in high places to come clean regarding their subterfuge and criminal plans which are bringing the country to it's knees. Propping up such a corrupt system may work in the immediate future, but cannot last very long. The government is a puppet of the corporations which care for absolutely nothing but numbers. The stock market is a game for gamblers and the stakes are high. The middle class has been conned into playing and still haven't learned.
We the people have been caught in a web of greed and have been blinded by false promises. As of today they still have us fooled, but I don't think they can continue much longer. How scared these people at the top must be...I bet they are looking for places to hide when it all crumbles.
I don't like being lied to by those in government. They are there for our benefit, not for their own. Seems that whomever we vote for really doesn't matter...they get gobbled up in the corrupt machine that is Washington.
We cannot of course be totally blameless for in the most part we only want what we believe is our right to a "comfortable" life even when it is at the expense of our brothers and sisters in other lands.
It would be a good thing for Cheney and all those who lied in high places, even if they thought they just had to, in covering others lies to be forced into coming clean. Then we will really know who makes these god awful decisions that affect us all. Trouble is these people think we are children and do not know what is best for us.

Having no Federal Government whatsoever, like we had from 1610 - 1776 is preferable to this abortion of a government. The Anti-Federalists were right all along. You can only tolerate a weak central government in a free society.
Let's liquidate the Fed and give everybody refunds. That should stimulate the real economy and put all these Corporate Welfare cases and paper-pushing government freeloaders on the street.

It looks good. It's the good old Potomac Two-step. Simple Faux News minds say to themselves: Oh, something was done about that problem. We investigated Prescot Bush (the chimp's grandfather) for trading with the enemy (Hitler). He was convicted by senate investigation. His businesses were confiscated. Then they were given back to him, and he was promoted to Senator.
Same chit with poppy bush G.H.W. Bush (chimp's father.) He was involved heavily in drug running and arms trading as head of CIA and then Vice president. He was promoted to President.
