In Israel, Miscegenation Equals Rape
On Monday, Sabbar Kashur, a young Palestinian man from East Jerusalem, was sentenced to 18 months in prison for something called "rape by deception." Apparently, Mr. Kashur had consensual sex with a Jewish Israeli woman after assuring her that he was also Jewish. When she found out that he had lied to her, she went to the police.
Imagine living in a society where you can say, "I wish I had never slept with you. I'm going to the cops." Only it's not funny because Sabbar Kashur will probably go to jail for a year and a half. Meanwhile, efforts to combat actual sexual violence are undermined by a cynical distortion of the term rape. The real crime here, of course, is miscegenation.
Anyone from the US should recognize the Jerusalem District Court's ruling for what it is: an anti-miscegenation measure on par with the now-defunct US laws against "race mixing" that were once used to uphold white supremacy. For most of us in the US, dating across race lines now seems about as edgy as wearing white after Labor Day. But check out Angela Davis' Women, Race and Class for a reminder of how white Americans' obsessions with "racial purity" were codified to keep African Americans and white women in their place. That's the paradigm in which we should understand this case.
In the US, anti-miscegenation laws were on the books until 1967, when the Supreme Court declared them unconstitutional. That was the same year that Israel began its occupation of Sabbar Kashur's home in East Jerusalem. Since then, Israelis have fine-tuned their own obsession with racial purity. Only they like to call it "national purity," since Jewish privilege in Israel depends on maintaining the Jewish character of the state. In fact, race-mixing is perceived as such a threat that more than half of all Israeli Jews agree that Jewish-Arab intermarriage is a form of treason.
In the East Jerusalem "neighborhood" (it's really a settlement) of Pisgat Ze'ev, a group of men who call themselves "Fire for Judaism" actually patrol the streets in the hopes of spotting and disrupting relationships between Jewish women and Palestinian men. The towns of Petah Tikva, Kiryat Gat and even super-liberal Tel Aviv have government-sponsored municipal programs to prevent miscegenation. The programs include psychological counseling for Jewish women who stray and a hotline for people to inform on Jewish women who date Palestinians.
The goal of this week's court ruling (and of Israeli laws governing marriage, adoption and surrogacy) is to prevent Jews and Palestinians from forming intimate or family relationships. In the West Bank, this degree of separation is ensured by a giant concrete wall that runs through much of the territory. But where there is no wall, the state will rely on other forms of power to maintain strict separation between the two peoples of this land. By the way, the Afrikaans word for separation is Apartheid.

That is a separate issue, of course, from the legal one.
How anachronistic - racism by a dominant group, some of whose members share common ancestors with the dispised (and therefore are the same 'race'), and in fact, there are Jews of every 'race'. It's just more Arab/Palestinian bashing and repression. Also, at least per the article's example , there may be sex discrimination since Jewish men 'dating' Arab females is not mentioned.
One thing peoples and nations cannot stand, beyond diplomacy and saber-rattling and nuclear threats, they absolutely hate to be laughed at, and Israel is rapidly becoming ridiculous.

I don't know if Israel has anti-sex discrimination laws since that might make the female lineage rule illegal. That would make for an interesting situation, wouldn't it?
Here's a total aside, but I'd love some feedback on this issue: Every month or so, I can no longer post on CD and have to request to reset my password. I find this incredibly annoying and pointless. Also, the re-registration doesn't work on every browser. Does anyone else have this problem with the having to re-register and the only one browser issue? I also don't know what would happen if I registered for the second browser, would they both work or would the first one stop? I am unwilling to play that game to find out.

You are mixing up terms here. To be Jewish is to be of the Jewish faith. That is a religion.
To be Palestinian is to be born in that area. Palestinian is not a religion. You can be Palestinian and be Christian, Muslim or Jewish or whatever other religion.
Actually, I'm not mixing up terms, I am merely repeating my understanding of the ideology of Israel which has this mixed up concept; to wit, If you are Jewish, you are not Palestinian. I've always thought that mass conversion by all the Palestinians would solve the problem immediately, although the Israelis would probably not recognize the conversion. This would open up interesting new areas for leverage because there would be others converted by the same rabbis and they too would not be recognized or would they?
I've been told by Jewish acquaintances that a child born of a Jewish woman is considered Jewish by birth, whereas if only the father is Jewish, the child is not considered Jewish, although the child can of course become Jewish if he or she so chooses.

I am using Firefox and Google Chrome. Right now, Firefox is OK but Chrome won't work. When I enter my e-mail address and password, it tells me that username or password is not recognized.
I guess I could ask to reset it for the other browser, but then would that kill the one that is currently working? I don't want to play browser tag with CD. Also, I have tried to contact them about this but I have never gotten any reply. You'd think they'd have some kind of canned response to send about this.
Can you log into other sites with Chrome? Are you trying to log in with at the same time?
If you can log in fine with FF, then the issue is not with CD.

Maybe. But look through history, look at American history. Black man, white woman. Chinese male, white female. White male, black female. White male, Chinese female. Historically, in American history, at which interracial relationships was all the racist vitriol directed against? When racists talked about miscegenation, did they spend much time ranting about white males and black females? Or did they rather obsess about black men and white women? When racists talked about some yellow terror looking to invade America, did they talk about Chinese women stealing white American men?
Or look at "honour killings", and the similar atrocities that happen throughout the world. It usually is about "purity" of the woman of the dominant group.

Most websites use "cookies" to allow you to log in, and remember that you are logged in; this allows the site to remember you, (and to track your browsing habits on that site at least; cookies can also track you across the web, if your privacy settings on your browser allow them to) The more conscientious websites, tend to set a fairly short time limit on their cookies, at least on the cookies they use for login, after which the cookie(s) expires (whereas less conscientious / commercial sites, might set a time limit of many years). From a quick at the cookies that CD has stored on my comp, a couple expire in a month or so, a couple expire in 2011, one in 2012.

Thanks for your replying to my inquiry, but as for using my existing password, that's the problem. It no longer recognizes my existing password and makes me have to request to reset it. I know I haven't made a mistake in entering it, because a) it is stored and b) it's always the same.
If all I had to do was just re-enter my password it wouldn't be such a pain. But with the two browsers, one is OK and the other isn't, it doesn't make any sense to me.
Today as a matter of fact the same thing happened to me for the twentieth time.

On my last visit to Jerusalem and the rest of the occupied lands, I noticed how aggressive and flirtatious the female Israeli soliders and civil servants were towards the young arab men. Keep in mind the EVERY "citizen" (which is laughable since there are a fair amount of Americans carrying an Israeli passport or joining the ranks of "settlers")is or was a member of the euphemistically named "Israeli Defence Forces". Therefore they are indoctrinated into this racist idealogy.

My understanding is that circumcision is not a requirement for Muslim men but a practice Muslims have adopted from Jews.

There is a general misconception that circumcision originated with the Jews. You have a point there; parts of Louisiana, Texas and other parts of the South as well. Example: A former co-worker of mine was from Vider, TX where he showed me a photo of a street sign on the outskirts of town stating that black folk better not let the sun set on them in Vider. The sign used racial slurs that I will not repeat. He said that if the police caught a black person in town after dark, they would be in for a beating, or worse.

So little Palestinian girls getting strip searched and fingers shoved up them during IDF interrogations doesn't qualify as rape in Israel I suppose.
I cannot agree that such ethnic discrimination can be justified on the basis of religion. First, there are some religions or interpretations thereof that are racist. This is certainly true in Israel, where influential rabbis (see Israel's Fateful Hour, by Harkabi) talk about the holiness of Jewish DNA and the greater value of Jewish life.
Moreover, it is clear that in Israel religion is used as a pretext for racism; for example, the religious precepts against fornication and adultery are ignored, but those against miscegenation are scrupulously observed.
Whatever it may have been in the past, Jewish self-identity now, particularly in Israel, is overwhelmingly based on ancestry (despite few conversions that are grudgingly tolerated), and hence ethnic; and ethnic discrimination/exclusivity is every bit as obnoxious when done in favor of Jews as when against Jews. In any event it is certainly arrant hypocrisy to approve discrimination in only one direction.
All discrimination is defended by talk of "preserving" one's own "culture."
The founders of modern Zionism were not very religious; their nationalism derived from the blood-and-soil ideology common in the late 1800s and early 1900s, and it persists in Israel today----hence the obsession over the "demographic problem."

I have never heard of "rape by deception" before. Is this the first conviction ever? It seems laughable considering all the things people might lie about for sex. What if the woman lied? Is Israel happy to convict women of raping men by deception? What if the Jewish person lied and the partner was unhappy to have slept with a Jew? Would the law be applied equally?
"Rape by deception" is a crime in many jurisdictions, and there's a bill currently being advanced through the legislative process in Massachusetts to codify this in that state.
Men have raped women by posing, for example, as doctors, putting them on a gynecological examination table and then raping them. Since force is not involved, this sort of betrayal of trust is not legally rape. Does anyone suggest that it should not be a crime? What was it, a "joke?"
Likewise, HIV positive individuals have falsely claimed to be negative, then claiming that the actions were consensual, and therefore not a crime when the deception was revealed. Again, is it just the now-infected individual's tough luck?
If the man had drugged her with a date-rape drug, is it still a crime? She consents, after all, so isn't it her tough luck if she regrets her actions the next day?
As a matter of law, one can be charged with the crime of robbery if one sticks up a gas station with a revolver; does anyone think that stealing a similar amount of money by posing as an accountant and embezzling from the same gas station isn't a crime?
This issue has been "framed" in a one-sided manner. The man is, from my viewpoint, a malicious predator rather than a martyr.
He had the bad taste to commit a crime in a society which places a high value on chastity, but if he'd been across one or more borders, where an even higher value is placed on sexual "purity," he might be awaiting a death sentence, as Sakineh Mohammadi Ashtiani is this very minute in Iran, quite possibly the victim of a false accusation by the man who murdered her husband in a "plea deal."
Of course the man is no saint.
That's not the issue. The issue is whether what he did is rape. If he had lied about being a rich doctor / lawyer / banker would you consider it rape? If he had lied about his educational / financial background is that rape? If he had a wife, and lied about his marital background, is that rape?
If you do, do you then propose to prosecute all such cases of deception? Why not? What makes lying about ethnicity / religion, any worse than lying about educational / financial / marietal background?
If you do consider all such cases rape, then you must prosecute all of them. You cannot selectively prosecute.
In fact, there is a long history of prosecution of rape through deception or fraud in the USA.
Here are a few thought experiments:
Many people take drugs for fun. Many people drink alcohol for fun. Many people have sex for fun.
Is a man who deceptively plys his date with drugs -- say, rohypnol -- or alcohol mixed more strongly than normal, so that the woman's judgment is impaired without her immediate notice, and then has sex with her guilty of rape?
After all, he only tricked her about the drugs, or the alcohol, so it's only trickery one step removed.
Is a masked man who uses a gun to stick up a bank guilty of theft?
Is a man who masquerades as an honest man and uses a position of trust to embezzle funds from that same bank guilty of theft?
Why would the latter be a crime? He only tricked the bank, and they allowed him access to their funds voluntarily.
Isn't embezzlement just another word for "morning after" regrets?

In the case of doctors, they would at least be up on ethics charges. But it would be so hard to prove. Almost impossible. Oh, now we are back to al gore again......
Actually, it's been proved more than once. In Don Moran v. People (1872) and Boro v. Superior Court (1985 and then again in 1987) doctors convinced gullible women that sexual intercourse, therapeutically applied by the physician, was necessary to avoid a painful and expensive operation. So both coercion and fraud were used in these cases, and the courts eventualy rejected the defendant's arguments that -- because the sex was "consensual," it could not be rape. In McNair v State (825 P.2d 571 (Nev. 1992) (sexual assault upheld)) such an assault was held to be a crime, and in the Boro case he got off once, and the California legislature was so incensed that they passed a law making Boro conduct a felony, whereupon he was convicted, since he used exactly the same scam again.
Similar scams have been undertaken in religious and counseling situations, and the practitioners involved have gone to jail.
This is, in short, not a horrible example of covert racism, but a common and legitimate response to a specific class of sexual predator who do, in fact, rape through fraud and deception, and are so common in the world that there are legal texts detailing how to prosecute and defend such cases, and laws against it all around the world.
Or are we to suppose that the California and Nevada legislatures (all evidently run by Jews) have proactively passed legislation substantially identical to the one under which the rapist in question was prosecuted in Israel, just in case a Palestinian manages to get past Homeland Defense and dates one of our pure Jewish girls?
I dare say the racism involved in this case is evident, and it wasn't on the part of the Israeli courts.
If these cases are so commonly prosecuted, please cite cases of someone being prosecuted for lying about marital / educational / economic status.
OK, here's one statute from the USA:
Alabama criminally punishes certain lesser forms of sexual misconduct as misdemeanors. One section of Alabama's statute punishes sexual misconduct if: "Being
a male, he engages in sexual intercourse with a female . . . with her consent where consent was obtained by the use of any fraud or artifice; . . . ." The commentary to this statute provides: Section 13A-6-65 is not concerned with aggravated cases of rape, . . . rather it is directed toward the more unusual situations
where a person has acquiesced to sexual intercourse . . . as a result of some fraud, artifice or stratagem.
There are others.
There was a hysterical decriminalising of many crimes formerly defined as seduction throughout the USA and other nations, but these crimes are slowly being brought back within the law's purview based on experience.
I don't particularly feel like doing your research for you, nor educating you in the law, so searching for prosecutions in the public records is up to you.
