The Sad Defeat of Our Constitution
Today I was given two hours of "advance notice" regarding DOJ's decision to not prosecute the remaining alleged 9/11 conspirators in an open court of law. According to DOJ's statement, the remaining individuals will be sent to military tribunals.
I recognize that there are many, many other things for Americans to be upset with today, but I hope everyone can take a second to contemplate this decision and recognize what it says about President Obama, the Department of Justice, and the United States.
As for the Department of Justice, it shows their inability to prosecute individuals who are responsible for the death of 3,000 people on the morning of 9/11. Apparently our Constitution and judicial system -- two of the very cornerstones that make America so great and used to set such a shining example to the rest of the world -- are not adequately set up to respond to or deal with the aftermath of terrorism. To me, this is a startling and dismal acknowledgment that perhaps Osama Bin Laden did, in fact, win on the morning of 9/11. And chillingly, I wonder whether it wasn't just the steel towers that were brought down and incinerated on 9/11, but the yellowed pages of our U.S. Constitution, as well.
And what does it say about the solemn capabilities of our Department of Justice if it is left to "subcontract out" its duties and responsibilities to the Department of Defense? We should all think about that scary notion for a bit. But, perhaps more disturbingly recognize that it is not occurring under the tutelage of Bush and Cheney, rather it is coming at the hands of Obama.
At least when President Bush was in office, he was candid about his feelings regarding the alleged 9/11 conspirators in our custody. He didn't care about them. He allowed them to be tortured. He was fine letting them rot in the heat of Guantanamo for all of eternity. They were less than human to him and he certainly was never going to afford them the benefits of our U.S. Constitution or the Geneva Conventions. That was President Bush. Whether you agreed or disagreed with him, you, at least, knew where he stood. And you could, like it or not, rely on his word.
For the past two years, it's been President Obama in the Oval Office. Quite early on in his presidency, Obama invited the 9/11 families to the White House to discuss 9/11-related issues. During this meeting in Feb '09 the topic of closing Guantanamo and the use of Article 3 courts to prosecute the remaining alleged 9/11 conspirators was discussed. Many of us were incredibly relieved to learn that as a matter of course President Obama was going to shut down Guantanamo and support the open prosecution of the alleged 9/11 conspirators. He gave us -- the various widows and children at the meeting -- his golden word. He shook our hands. He smiled broadly. He posed for pictures. (In fact, several weeks later many of the widows even received hand signed courtesy copies of these photos from Obama -- a nice touch. I did not receive such a photo.)
It's been almost ten years now since my husband was killed. My daughter has gone from a 2-year-old to a 12-year-old. Our country has started two -- and now maybe three -- pointless, misguided, costly wars. And if it wasn't already difficult enough to accept that Osama Bin Laden will probably never be caught or held accountable, now I have to swallow the fact that I will never see constitutional justice for the handful of individuals we actually hold in custody. In short, justice in a court of law for the murder of my husband and 3,000 others will never come.
I suppose in life timing is everything. To me, as a lawyer and a 9/11 widow, DOJ's announcement today acknowledges the sad defeat of our U.S. Constitution when it comes to 9/11. How truly tragic in my eyes. And you would think that a man who was once a constitutional law professor might feel the same way. Yet, not so much for President Barack Obama who has chosen this great day to announce his billion-dollar campaign for re-election. His slogan asking us to "join in" by writing him a check.
First, I've never been much of an "in"-sider. Second, I truly wonder how you can trust a leader who carries no compunction to keep his promises or his word -- whether those words and promises were made in support of gay rights, to not start or perpetuate illegal/useless/costly military campaigns (or wars), in support of environmental causes even to the detriment of big business, to put an immediate end to torture and unlawful detainment, to rein in the bloat and greed of Wall Street, to oppose gun control, or to correct the broad overreach of a previous administration.
But perhaps most pointedly, if you can't trust what a man says to a group of widows and children, then what words and promises of his can you trust?
So President Obama, am I IN? Will you be receiving my check?

The selection of Bush by the SCOTUS in 2000 is a bloodless Military/Judicial[SCOTUS] coup. The Florida election fraud which included the counting of absentee military ballots cast late was only part of the fraud which was engineered by Cheney/Rummy because of their Pentagon contacts from when they were the Defense Secretaries. Due to the electoral college system a bloodless coup does not have to be nation wide, just a few key states. The fact that Gore didn't really want to be president judging from his strategy. Choosing Lieberman, not campaigning in Tennessee which he narrowly lost despite himself, it was close. Not campaigning in New Hampshire for its 3 votes which would have made him president without Florida.Counting on Florida, where his brother was governor and his campaign manager would count the votes. Bush said in Sept. 2000 their was no way he would lose Florida, meaning he knew the fix was in.

9/11 was a 1 day war and the USG was defeated by 19 men and 3 airplanes. The magnitude of such a staggering defeat is incomprehensible to most Americans. Even more staggering is that the Bush/Cheney criminal gang even admitted and acknowledged the defeat but due to it being incomprehensible to the American psyche it has never been processed for what actually happened which is a total, complete defeat of the USG by 19 men. The criminal Bush gang then went on a temper tantrum which is now 10 years old and the reality of the total destruction of the Constitution has not been acknowledged by our criminal USG. As with most temper tantrums a lot of bluster, revenge, snarling tough talk by a bunch of cowards has created a smoke screen to obscure the reality of the 9/11 defeat and that the illegal measures being used against even suspected terrorists set the precedents necessary to be used against Americans rather than the rule of law.
How can anyone, in April, 2011, still believe the incredible official lie that 19 men armed with boxcutters evaded the most extensive air defense system in the world for two hours and completely demolished THREE steel-frame buildings, including one, Building 7, which was never hit by any plane?

The fact that the Bush gang declared the official version is astounding in its own right. They so despise the American people that they put this used this preposterous propaganda for public consumption only shows the derision and contempt it has for the American public and believe the public is so shallow,they may be right, they concocted/admitted that 19 men defeated the USG in the 1 day war of 9/11. Even worse, the public brought this story never questioning, criticizing, held the USG responsible, or even realized that the USG was thoroughly, soundly defeated by 19 men in a 1 day war. That Bush used children in Florida to hide behind, well that's another story.
The present and last President along with the last three US Attorney Generals should get an all expense paid, one way trip to Gitmo for all that they have done to our country! I can't put it any simpler than that!
Indeed they "should." But there is no higher authority that can issue warrants and make them stick. Habeas corpus has been cancelled, not just for currently imprisoned terrorists but for all of us. The rule of law is a nice thing unless the Powers That Be themselves are threatened. Then a "state of emergency" can be declared to chuck it.

911truthnow is the only place I have found that states the most facts that our government MUST IGNORE or DIE trying to open the door to the Cheney/Rumsfeld/Kissinger/Bushes/Wolfowitz/??? scheme to bring down the towers to end the investigations going on in the tower offices, and to kill some people who knew too much, and to start a war with Iraq etal. Beyond the betrayal of those who increasingly spit upon our Constitution, are the minds that devised a scheme that would adroitly assign blame to those that war was being readily designed for. (I noticed at least one major Arnold Schwarz. film turning Arabs INTO terrorists before any actual war efforts got underway. This soft form of propaganda utilizes mainstream culture to plant the seeds of "the next enemy," so that when an apparent probable cause emerges, the machinery of pop-culture has already effectively demonized this specific group... making it RIPE and ready for assuming "enemy status.")
By transposing the rule of law to "military courts," the segue into a Mars-rules society is made complete. These kangaroo courts are known to throw significant evidence away. Plus career officers, accustomed to following orders, know exactly how to present the semblance of a case while doing NOTHING in the way of justice. Militarism and justice are polar opposites. The design of time itself, via the astro-logos, posits Aries/militarism 180 degrees away from Libra/law/justice for a Divine reason! The two are NOT compatible. They are antithetical.
There is another apt analogy here. Just as some have made the case that nuclear power plants are just excessively expensive and dangerous ways to boil water, our entire military is the war strategy equivalent. It's inordinately expensive and dangerous, and given that the ostensible premise is "winning," where is there the slightest remote evidence to substantiate that claim to fame?
Whomever survives the next few years of The Transition with all of its chemical effluents washing back over us, its war karma in a boomerang of blowback, and its financial/job/housing uncertainties will realize that war will become the chief word (and ethos) removed from the mind of each member of what remains of society.
WAR is the enemy to life and all things living. The "Defense" industry is the ultimate oxymoron! Right up there with Military (courts of) justice!

It's a pretty bleak day when Progressives have no president, or foreseeable presidential candidate, that we can support. America's "blue screen of death" is at hand.
It's more than that. The entire working class have no president, or foreseeable presidential candidate.
I'm just hoping for the day when the entire working class realize it.
The USA hasn't had a President of the USA since 1963 when Kennedy was assassinated which is why he was assassinated. Since then the USG has had a serious of President of the Republican or Democratic party. Jimmy Carter may be somewhat of an exception, he was too smart for the MIC which is why he was jettisoned. Their is a short documentary about JFK which explains that the denied the tremendous pressure by the Pentagon warmongers, Curtis LeMay, Twinning, at least to start 3 nuclear wars, perhaps 4. They wanted nuclear wars over, the Bay of Pigs, the Berlin Wall, the Cuban missile crises. This documentary show the brilliance of JFK, real leadership as President of the USA, not just a political party president. It is not shown often. The list of wannabe assassins. The MIC, CIA, FBI, LBJ, NIXON, OIL MEN, ISRAEL, ORGANIZED CRIME and Oswald. JFK had contacted the Israeli PM and told him to stop his nuclear weapons program. The pressure for war in Vietnam was in jeopardy, real or imagined,by the MIC. RFK had to be eliminated for obvious reasons. Also, Malcolm X in early 1965, MLK 1968, Medgar Evers, Hampton[?] in Chicago, and the list of mysterious deaths surrounding those who may have known or saw something about the JFK job.

Public prosecution of the terrorists would open up a whole fleet of hornets' nests regarding the actual physics of the collapse of the WTC towers. Upon close inspection and challenge in a court of law, the government cannot provide convincing answers to these issues, and it therefore could be faced with a string of acquittals and growing demands to find out how and why those collapses, all clearly demolitions, occurred. If this cat gets out of the bag, it will be seen that it was not so much a cat as a giant lizard....

Absolutely right ! Can you imagine Giuliani having a trial right at the crime scene where he personally showed foreknowledge of the WTC collapse? He didn't go to his "special emergency" office in building #7. He had to have been deeply involved in the preparations for the civil defense drill being held.. He had control of the air defense over NYC. All the guys, Cheney, Rumsfeld, Bush, were coordinating the events. Right, they are going to have a public trial. Whoever imagined that they would? This just add more proof of their guilt. The whole thing was a false flag. They murdered 3 thousand people at once, and then hundreds of thousands more later in their wars.
Additionally, torture was needed to obtain "confessions" and "testimony" that fit the predetermined "story" of events, and to guarantee no actual open trial could proceed.

Obama represents the vast majority of Washington. That is why he will raise 1 Billion dollars for his super-ego masturbatory campaign of corporate debauchery.
These people have no allegiance to the Bill of Rights.
When they talk about the Constitution, they mean the document freed of all those "amendments."
They would love to return to the time when Senators did not have to pretend that they gave a rat's ass about what the voters thought. They believe that the corporate elite know best.

Obama made his position blatantly clear BEFORE the "election" of 2008 when he voted to protect the Telecom criminals from the nasty constitutional restrictions because it was more important that the government be able to spy on the rabble of the less monied.

Maybe , should a nation want a Constitution that is truly great , they should look to countries that have Constitutions written by the people including the poor on behalf of the people and for the benefit of the people rather then one that is designed to protect one percent of the people and their wealth.
Maybe a judicial system build around the concepts of justice and rehabilitation rather then one built around punishment and the amount of money one has is superior to the US model.
Remember what happened after Shays rebellion, or to Eugene Debs, or to the Native Americans or to the Japanese Americans. The Constitution did nothing to protect them from the Judiciary.

Here is a forgotten shame in history. President Franklin Roosevelt knew that the ACLU was going to shit a brick when he issued Executive Order 9066 to round up and imprison Japanese Americans. So - days before this directive was issued in Feb 1942, he called the Head of the national ACLU to the Oval Office and =Jaw Boned= this person into promising neutrality and passivity wrt the event.
ACLU directives were wired to attorney members on the Left Coast. Quite a number of attorneys sent wires back to Washington D.C. canceling their ACLU membership immediately. One such lawyer later filed Ex parte Mitsuye Endo, in which it was ruled that the government cannot detain a citizen that the government itself concedes is loyal to the United States, decided December 1944. The Japanese Americans were free citizens - but could not =go home= because all their homes and belongings and bank accounts had been seized.

Speaking in the language of the astro-logos, Neptune, the principle of total empathy, just left the air-sign (air = intellectual, the realm of thought) of Aquarius to enter its own home-sign, Pisces. I really feel the difference in that Pisces, as water, is more about direct feeling. Neptune, known for its camouflage powers (inclusive of all sorts of deception) now in the sign that signifies the oceans, reminds me of the efforts being rendered by authorities to change legal limits on toxic & radiation exposures. Just tell people it's all safe through a sleight of semantics, and all will be well. Ultimate deception! Still, I wonder how many others are sensing an inner shift... that they can no longer retain, merely in their minds, what their beings FEEL to be real and true? The collossal cost of so much mis-directed energy (and resources) is hitting more viscerally; and while a great many people are anesthetized via alcohol or anti-depressant drugs, I would expect that those who can feel with clarity are going to feel what previously had existed mostly in the colder realms of intellectual assessment. The man is the biggest liar to ever hold the office of presidency As for the trial, its just like his 'public' speeches. They're done in the confines of some military base where he can't be exposed to the citizenry. Like GWB, they have to hide him. They don't dare have this trial in NYC. Don't you know? It's unfortunate that Ms. Breitweiser references what I've come to call the "pernicious factoids" of the Official Account of the 9/11 events, i.e. that the alleged "terrorist attacks" on that day were solely the work of Nineteen Lone Nuts mentored by an Elusive Super-Villain.
Be that as it may, anyone who fatuously believed that the Obama maladministration was willing and able to respect and enforce the provisions of the U.S. constitution-- as mandated by the president's oath of office-- should have been disabused of this notion back in November, 2009.
A seemingly minor, passing exchange occurred then that should've hit those who respectfully defer to Obama like a two-by-four over the head. This shockingly telling revelation of the truth of the matter happened during Obama's ill-fated announcement that the Khalid Sheikh Mohammed trial would be held in New York City.
During the Q&A following his remarks, a reporter blithely asked Obama how he could "guarantee" to the Amerikan People that KSM would not be acquitted!
Regardless of the controversy and hysteria enveloping the issue, and regardless of Obama's determination not to put a foot wrong (i.e., in his mouth), there is simply no way a sane, reasonable, responsible President of the United States could respond to that loaded question without first addressing the execrable ignorance of civics and due process from which it proceeds.
Even if Obama intended to tapdance his way around the question, the least he could have done was attempt a "teaching moment" in which he emphatically pointed out to the reporter that any trial with a "guaranteed" outcome is what is called a "show trial"-- and We Don't Do That Here.
Instead, Obama unhesitatingly accepted the offensively stupid question at face value, and bloviated his confidence that the trial would reach the "right" verdict. It was abominable. It was reprehensible. It was revelatory.
Of course, around that time Obama also made similar "Judge Roy Bean" statements about the Fort Hood shooter-- almost literally, and without irony, placating those of the lynch-mob persuasion with assurances that Hasan will get the fairest trial in the world before we hang him. Obama hedged this blatantly prejudicial stance by further hints that the government is prepared to imprison "terrorist" defendants indefinitely-- i.e. permanently-- regardless of the verdict!
Again: abominable; reprehensible. And I'm not impressed by the disclaimer that it is the Attorney General, not the President, who is the chief law enforcement officer in the land. Even if Holder were the bestest Good Cop ever, pure and resolute (which he isn't), this circumstance does not excuse a chief executive who coolly flings down and dances upon his oath of office in order to pacify and mollify an ignorant, clamorous, hysterical mob.
So these new developments are simply cumulative or redundant proof of what's long been established.
I appreciate why Ms. Breitweiser would view evidence of Amerika's post-constitutional status as an indication that "Osama bin Laden won." But I see it a little differently, as I wrote in this comment to the Karen Greenberg article published on CD today:
The Amerikan Imperium, despite its historic ceremonial trappings as an enlightened "constitutional republic" empowered by ordinary unprivileged citizens, and devoted to civil liberty and the rule of law, is actually a despotic, barbaric, authoritarian capitalist state.
It operates, as all predatory monsters must, on a single principle, or Prime Directive: Might Makes Right.
The popular personification of the U.S. as a stern, but benevolent, "Uncle Sam" is but a euphemism; a more appropriate mythical image would resemble an Amerikanized "Mr. Hyde", Robert Louis Stevenson's fictional nocturnal sociopathic homicidal maniac.
A more accurate answer to "Why Khalid Sheikh Mohammed Will Be Tried in Guantánamo" is that in the light of day "Uncle Sam" must walk among nations in his civilized, benevolent guise. Thus, he needs to ensure that his most depraved actions have "the color of law" and a plausible semblance of propriety.
In the end, the question of whether Congress truly obstructed and thwarted the Obama maladministration's desire to convict the "Worst of the Worst" in federal court rather than in military tribunals is moot. Whatever the process-enthralled legal minds may claim, the "guilt" of the detainees is a foregone conclusion and their fates are sealed.
It's not so much a matter of Osama bin Laden "winning", or politics trumping justice, as Might trumping Right.

I, Juror
Yesterday, 3/29/2011, I was a juror and today I feel like I'm the one who put the last nail in the coffin of justice. I did my job, but I couldn't deliver justice. I participated in a system that no longer works and by doing so allowed the illusion to persist that we are a nation of laws and that justice in America is blind. In so doing I helped validate a system that allows injustice to persist. I can’t change today what I did yesterday. I understand your pain, I avoid jury duty like the plauge! for just that reason, It seems the system is rigged to get it's own answers. Participiting feels more like letting justice down than, aiding justice.
As your only choice is to comply or be jailed yourself you can only do the best you can.

I've served on a jury.
The jury is the final and ultimate check and balance in the system.
It is the greatest privilege and responsibility of a citizen.
When you serve on the jury you ARE the law; you are the embodiment of justice.
In my case, several of us acting together were able to spare a young man a terrible injustice.
That's the way it's supposed to work.
And it CAN.
But if those of us who love liberty and love justice "avoid jury duty like the plague" we leave justice in the hands of those with neither the wit nor the heart to serve her well.
Besides, a jury vote is about the only vote these days that isn't electronically "rigged."
