Senior Obama Official Backs Cheney and CIA, Says Concealment of Assassin Program Legal
WASHINGTON - Democrats on the House Intelligence Committee are preparing to hold hearings to investigate the role of vice president Dick Cheney in allegedly ordering the C.I.A. to conceal a secret assassination program from Congress. As I reported yesterday, there are two crucial issues at play: the nature of the U.S. assassination program and the role of former vice president Dick Cheney in concealing aspects of it from Congressional oversight. On the broader issue of U.S. government assassination, it is very unlikely that will become a central focus given that there has long been a bipartisan assassination program that continues under President Obama. Indeed, most legislators frame their opposition to this program through the lens of the concealment issue, not the assassinations.

moves, however, by the Obama administration indicate that it is backing
Cheney and the C.I.A. In May, when House Speaker Nancy Pelosi was under
fire over allegations she had been briefed on U.S. torture tactics, she
publicly accused the C.I.A. of misleading her. In what many viewed as a
response to Pelosi, C.I.A. Director Leon Panetta wrote C.I.A. staff a memo,
saying, "Let me be clear: It is not our policy or practice to mislead
Congress. That is against our laws and our values... My advice - indeed,
my direction - to you is straightforward: ignore the noise and stay
focused on your mission. We have too much work to do to be distracted
from our job of protecting this country. We are an Agency of high
integrity, professionalism, and dedication."
After Panetta briefed the Intelligence Committees on June 24 and, according to Democratic lawmakers, revealed that Cheney had concealed the covert assassination program from Congress, six Democrats from the House Intelligence Committee wrote Panetta asking him to retract his statement that the C.I.A. does not "mislead Congress." Last week, a CIA spokesperson said Panetta "stands by his May 15 statement."
Some lawmakers, including Senate Intelligence Committee chair Dianne Feinstein and Senator Dick Durbin, have suggested the concealment was illegal. "The executive branch of government cannot create programs like these programs and keep Congress in the dark. There is a requirement for disclosure," Durbin said. "It is inappropriate for the vice president or the president to be ordering that a program be kept secret and not disclosed at the highest levels of congressional leadership."
As Democrats try to build momentum for the hearings, a senior Obama official has now come forward to defend the legality of Cheney and the C.I.A.s' alleged concealment. President Obama's Director of National Intelligence, Dennis Blair, says the C.I.A. did not violate the law. In an interview with The Washington Post, Blair said that he believes the C.I.A. should have informed Congress, but was not required to. "It was a judgment call," said Blair. "We believe in erring on the side of working with the Hill as a partner."

Blair said that Panetta told him in advance of the decision to terminate the program and that he supported the action as well as the decision to inform Congress.Panetta "felt it was urgent and appropriate to brief the Hill," Blair said. "You can make a judgment call on whether a briefing was necessary. We were on the side of ‘Let's do it.' We're trying to reset our relations with Congress."
Blair also asserted that killing the program did not diminish U.S. options for battling al-Qaeda, including the possible use of insertion teams that could kill or capture terrorist leaders.
"This particular program didn't make the cut," he said. "But it is absolutely not true that we are doing less against al-Qaeda. Our primary criterion is effectiveness, and we will continue to do things that we think are effective to make terrorist lives miserable, and hopefully, short."
A C.I.A. spokesperson, George Little, told the paper the program was "never fully operational and never took a single terrorist off the battlefield." Little added that Panetta has been "aggressively using the vast tools and tactics at our disposal - those that actually work - to take terrorists off the streets."
At the end of the day, as I have pointed out previously, among the crucial issues for Congress to investigate are: what is Dick Cheney's role in concealing information to which Congress has a right? What covert assassination programs were activated by Cheney (and/or Bush) and whom exactly were they targeting? Is it true, as has been suggested by the current C.I.A. and National Intelligence directors, that this specific program was never activated? Part of this investigation should also include a deep probe into the assertions made by Pulitzer Prize-winning journalist Seymour Hersh that Cheney was running an "executive assassination ring."
The current portrayal of what exactly this program entailed is, at best, very fishy on several levels. To me, this very much seems like some major league misdirection. There is no doubt that Cheney was running some nefarious programs and any orders from Cheney to the C.I.A. to conceal information on programs to which Congress has a right should be fully investigated. BUT, when compared with other information about Bush/Cheney illegal operations, the description of this one seems really small potatoes for the Intel Committees outside of the need for Pelosi to be vindicated. I guarantee you that there are much worse things that members of the Intelligence Committees are aware of than a program that never was activated, which Cheney told the C.I.A. not to mention to Congress. It bears repeating: this secret program, as it is currently being described, is very, very similar to the longstanding U.S. assassination program that the Intel Committees have known about for years predating 9/11 and Bush/Cheney's time in power.
Former C.I.A. operator Robert Baer, has an interesting take on all of this at Time. I am not endorsing Baer's view, but think it is worth reading:
Sounds alarming. But like many of these stories, there's less to it than meets the eye. The unit conducted no assassinations or grabs. A former CIA officer involved in the program told me that no targets were picked, no weapons issued and no one sent overseas to carry out anything. "It was little more than a PowerPoint presentation," he said. "Why would we tell Congress?"That's a good question, especially since the program was an open secret. On Oct. 28, 2001, the Washington Post ran an article with the title "CIA Weighs ‘Targeted Killing' Missions." And in 2006, New York Times reporter James Risen wrote a book in which he revealed the program's secret code name, Box Top . Moreover, it is well known that on Nov. 3, 2002, the CIA launched a Hellfire missile from a Predator drone over Yemen, killing an al-Qaeda member involved in the attack on the U.S.S. Cole. And who knows how many "targeted killings" there have been in Afghanistan and Iraq?

The most hilarious thing about this is Panetta's assertion that the CIA never lies to or "misleads" Congress. That's like saying George Bush never lied or did anything illegal. It's as egregious a lie as can ever be told. But this is the way all Washington operates: Get caught telling bald-faced lies and just lie your way out of it. Everyone there respects each other's lies. They have no other way of functioning. Lies, corruption, murder, theft, greed, and more lies--that's the American Way, buddy.

Meantime Obama is alienating his base by going along with this in the hopes that Repugs won't take any act of terrorism between now and election time and use it as a club. A Zionist strike against Iran and the start of WWIII is a possibility, as is losing to the Taliban. So Obama has been convinced he can't appear weak or disarm in any way if he wants to be re-elected.
If I guessed right, we could hope he is re-elected to a second term were he won't be constrained by the need for campaign funding and by political chess moves and will act in the public interest. But like a poster here says, I could be wrong.

Breaking the law is breaking the law - no matter how totalitarian sympathisers like Dennis Blair try to spin it. With friends like Dennis Blair and Hillary Clinton (who her allies have been involved in the coup in Honduras), Obama need no enemies. It's a short ride for Obama.

That is until, or if there's been, the first murder. Then it's aiding and abetting a felon.
Is the issue whether Congress should be informed? It's clear that the law requires the CIA to inform Congress of its activities. Is "Box Top" the concealed program? We've all been led to the cliff and most everyone has jumped. But, why would Cheney direct CIA to hide a program/project from Congress that was only in planning stages? I don't imagine that an operation that is not underway would require informing Congress. So, my conclusion is: there is/was another operation which Cheney specifically ordered to be concealed -- What was it?
What authority does a Vice President have to order the CIA to do anything? This fits in with his frequent visits to press for sinister "information" about WMD, prior to the invasion of Iraq. It was widely noted at the time that previous VP's had seldom, or never, gone there.
In this day ANYTHING is legal if it can be argued as a difference of interpretation of the Constitution. At least this is true if you have lots of money, or the backing of DoJ lawyers.
As I understood it, assassination is illegal, and so is deceiving Congress by the Executive. As for the 'integrity' and 'professionalism' of the CIA, well, that has to be good for a laugh. A cynical laugh, full of despair. The history of the CIA is as infamous as any of the mafia crime families. Next they'll start talking about the 'integrity' of the Bush family. Cheney doesn't need integrity. He has power, still. I would be interested to know whether he still holds any power within the intel/defense agencies. If he does, I'd like to know if Obama's power over them matches Dick's. It's probably a moot issue now. I once thought that Obama might be different, but I don't think so anymore. Lawlessness is here to stay, and being law abiding isn't a matter of honor any longer. It is simply a matter of fear of the bigger dog.
Having sat through eight years of the most offensive regime in U.S. history, I was sure I could stand no more of it. But now we have Obama who pretends to be honorable, liberal, and supportive of the Constitution, justice, and democratic principles. Every single day that passes proves him to be as crooked as those who came before him.
I have learned cynicism in a huge way, and it is painful. I was always rather cynical, but in the words of Lilly Tomlin "I just can't keep up". What do I tell my children? Telling them the truth will only make them enemies of the State. I wish I still believed in God. At least then I could tell myself that all this has a greater purpose, a GOOD purpose. If some criminals aren't brought to justice I will have to resign myself to being an enemy of this criminal state.
I'm still waiting to hear if my local court will pass me over for jury duty-- my choice, as I responded on the questionnaire that I have lost faith in the criminal justice system and will not vote to convict anyone of a crime as long as we allow the crimes of the Bush Administration to go uninvestigated and unprosecuted.
Unfortunately, that means some zealots who are supportive of the "War on drugs" will replace me, but so be it. I cannot take part without becoming seriously ill.
Baer does have some point insofar as the entire war effort was illegal and fraudulent from the beginning. It seems natural that they would not inform Congress, just as it seems natural that a company that runs coke and smack doesn't inform the IRS of all its earnings.
However, that makes a poor argument for not prosecuting.

If you would look at the rate at which important politicians die in plane-crashes, that would certainly justify the fear that some people have of flying. I wonder whether anybody could calculate the chance of getting killed in a plane crash when you are a politician as compared to when you are an ordinary citizen. Would be an interesting comparison. The issue is that plane crashes are very favourite assassination methods: very hard to prove. The following unsolved murder mysteries show:

I have the feeling that I forgot still a few. The stories of all these individuals and the reasons why they 'had to be killed' are very different, but I am sure the CIA knows more about at least some of these murders.
Oh yeah, and then there is also still the unsolved murder mystery of 3000 U.S. citizens in 2001 that died because of four different plane crashes. Seems also very hard to prove what exactly was going on there ....
Also seems that not a lot of politicans in the U.S. really want to know ....
The Washington Post quotation attributed to Dennis Blair does not square with the eye catching headline on Jeremy Scahill's article.
Blair is quoted as saying "You can make a judgment call on whether a briefing [of Congress] was necessary." Blair, the "senior Obama official" referred to in the headline, was talking about Panetta's decision in June, 2009, to brief Congress about terminating the program. Blair is not talking about a decision by Cheney and the CIA to conceal the assassination program in the CIA's oversight briefings.
Although I agree with Scahill's analysis and slant, this article still seems to miss the main issue in the current brouhaha: according to Wall Street Journal and other mainstream news sources, in 2001 George W. Bush issued a secret, classified presidential "finding" that authorized an assassination program (whether ever operational or not, whether nicknamed "Box Top" or not). Failing to promptly brief the appropriate House and Senate intelligence committees about this presidential finding is a clear violation of law, under both preexisting executive orders and federal statutes. What is required is (1) first, a presidential finding for the CIA to engage in homicidal covert operations abroad, then (2) a prompt briefing of Congress by the executive branch, divulging that the classified finding had been made.
All this posturing about whether the death squad team program was an embryonic PowerPoint brainstorm, in early planning stages, in training, partially operational, or fully operational is just that - secondary sound and fury, signifying much of nothing ("really small potatoes", as Jeremy aptly phrases it).
The big potato is that George W. Bush issued a classified presidential finding to authorize CIA paramilitary hit squads to kill people, and the existence of that finding was concealed from the legislative branch of government for the next seven years. If vice president Cheney was indeed instrumental in that patently illegal concealment, that's just sour cream and chives topping.

The 2008 Presidential election was their first shot at national politics--and they f*cked up completely. It would seem their political choices are even worse than their songs. ;)

This is our problem. We have "bosses" instead of leaders, "CEOs" instead of representatives. Our regionally elected chairmen of the board treat government as their own personal piggy banks and our bosses make new rules as they go along to fit the agendas of those supplying them most. Native Son hit the nail on the head earlier. Usually, I deflect posts that use "you" in targeting the USA. I say, "its not me, its our government."
I can't say this anymore. Anywhere. At anytime. Americans have allowed this establishment of Machiavellian politics. We've allowed our CEO's and chairmen to strip us of our voice and representation. We like to pretend. We pretend that the world is ok as we stare into giant, glowing televisions. We pretend, on election days, that we actually have a say in how our government is conducted within the global community. We pretend we live in a democratic society. We pretend that our government is not a monster of our own making. Gluttony feeds our complacency and the monster feeds on our complacency.
How do we change our mindset? And at what cost? When does that cost become unacceptable?
