Obama Goes to Bat for Bush Wiretap Program
SAN FRANCISCO -- President Obama is adamant about maintaining the secrecy of a wiretapping program authorized by George W. Bush, an administration lawyer told a federal judge in San Francisco on Wednesday.
A US government probe has concluded that a secret wiretap program launched after the September 11, 2001 attacks had a "limited role" in preventing fresh strikes (AFP/File/Saul Loeb) Obama "does not intend to use the state-secrets privilege to cover up illegal activities," said Justice Department attorney Anthony Coppolino. But in exceptional circumstances, he said, the president will invoke secrecy to protect "the sources and methods of detecting terrorist attacks ... the crown jewel of the United States national security administration."
Coppolino said the administration will cite national security in seeking dismissal of a lawsuit by telephone customers accusing the government of illegally intercepting phone calls and obtaining phone company records.
Chief U.S. District Judge Vaughn Walker heard about 90 minutes of arguments and said he would rule later.
The suit is similar to claims filed against AT&T and other telecommunications firms in 2006, following Bush's acknowledgement that he had authorized eavesdropping on Americans' communications with suspected foreign terrorists without seeking court approval.
Walker, in whose court the cases were consolidated, dismissed the suits earlier this year based on a 2008 law that shielded the companies from liability for alleged cooperation with surveillance that Bush had authorized.
That law did not prevent private citizens from suing the government, as long as they could show they were the targets of illegal eavesdropping. The current suit, filed by most of the same customers who sued AT&T, claims that a "dragnet surveillance" program intercepted millions of messages to mine them for suspicious content.
Although both the Bush and Obama administrations have refused to discuss the extent of phone company participation, several members of Congress have confirmed that the government obtained records from phone companies, the plaintiffs' lawyer, Kevin Bankston of the Electronic Frontier Foundation, told Walker.
The judge said in a 2006 ruling that AT&T had helped the government in surveillance, citing statements by federal officials and a former AT&T employee. On Wednesday, he asked Coppolino whether anything had changed that would justify dismissing the latest lawsuit.
The Justice Department lawyer replied that the plaintiffs will have to air classified information in court about "the nature and scope of the government's surveillance program" to prove their case, and the government will have to do the same to defend itself. That "would risk exceptional harm to the national security," Coppolino said.
Walker, however, cited a recent inspector general's report on U.S. intelligence that said the surveillance was far broader than Bush had described and was on legally shaky ground.
An unclassified version of the report was released last week. Walker said the full report might show whether officials had violated private citizens' constitutional rights.

It should also be noted that the surveillance program in question was both 100% illegal and 100% unconstitutional--a top-to-bottom criminal enterprise operating out of the White House. That, alone, should strip away any pretense that revealing it could endanger "sources and methods" relating to "national security." If the previous administration had been operating a cocaine ring out of the basement of the White House, it would be ridiculous to invoke "national security" (a nonsense concept in the first place) as a means of precluding information about it from being made public, and this is no different.

I keep hearing about how Obama's specialty in the legal profession is constitutional law. Perhaps that is a negative since he is apparently utilizing his expertise to defraud the electorate rather than to defend the constitution.
this is exactly what is happening. it is truly disappointing.
it is like a doctor using his medical and scientific expertise to conduct experiments upon people. it is like a lawyer using his knowledge to FOOL people into signing things their life circumstance make very difficult to understand under duress. it is like being a priest using the pulpit to hide his own sins behind. it is cruel . it is madness defined.
and considering that these are the ELITES of america . in their pinstripes and expensive clothes and lifestyles....

Apparently, just because he specialized in constitutional law doesn't mean he supports it. Knowing your enemy thoroughly is the best way to subvert and destroy it.
Once can specialize in Constitutional law and interpret its intent accordingly to benefit the ruling masters. Obama, in this regard, is no different than any other previous occupant of the White House.

Perhaps, not in your mind, nor mine. But certainly, there was in the Bush/Cheney "mind". And that is my point. Power decides what interpretation applies. Obviously, since Bush/Cheney are getting away with "what occurred during the Bush administration" then the de facto interpretation does indeed "apply." Obama continues that interpretation with his policy of "looking forward", i.e., letting the perpetrators of violating the Constitution, and war crimes go. That is Obama's "interpretation".

US war planes have killed and injured dozens of civilians in southern Afghanistan in attempted bombings of suspected Taliban militant hideouts.
The latest incident happened overnight in southern Kandahar province.
Residents in Shah Wali Kot said up to six people were killed and 16 wounded in the air attack in the district.
Another two people were reportedly killed and four others were wounded in neighboring Miawand district when US helicopters fired missiles in the region. (PressTV)
I think it is now obvious to most people that President Obama has bought into the system. He has bought into the powers of the institutional government. He has bought into the paranoia of the war on terrorism. It is the tail wagging the dog.
This is no different than when one buys into the system of institutional financial capitalism on Wall Street, or any corporation for that matter, or education, etc, or even the institutions of religion. Once that happens, institutional group think takes over. You become the status quo. You are no longer capable of self critiquing the system. Once you are part of the system, your whole purpose is to become a team member to help perpetuate the system. This is the downfall of most tightly controlled institutions. It can even lead to unsavory acts to protect and perpetuate the institution. We call such actions “cover-up”.
What is the lesson of all this in regards to the Obama Administration?
Grass roots democracy must constantly be brought to bear on government. As William Greider so often says, there are few problems in the world that more and more democracy cannot solve. Democracy is an act of the human spirit. It is about public spiritual discernment. If “we the people” really want a democracy to promote the common good, “we the people’ cannot be lazy about it. We have got to get off our asses. We have to choose to know through alternate media, not to rely on MSM, …….and act.
This is not meant to be a lecture to CD readers, but to reveal the uncommon truth that true evil, appearing as virtue, can emanate from institutions. Institutional sin is for real. That is why the institutions of government demands the outside critique of democracy.
The human spirit is the only way we can change the world.
The question I have is not whether Obama has "bought into the system," but rather whether he was told in no uncertain terms that he back off and support the criminal behavior or find himself facing a JFK future. Since the time he has taken office, he's pretty much co-opted the Bush position - on Iraq, Afghanistan (spreading now into Pakistan), the bankster bailout, and the lawless and unconstitutional behavior (hidden under the rubric of state secrets and national security). Indeed, Obama seems willing to bend over backwards to protect the criminality of the Bushies.
In short, has he been threatened?
It would be enough to threaten him with ruin. Perhaps the media would report the discovery that his birth certificate is a forgery. Then he would be driven out of office in a uniquely humiliating way.
It is more likely that he is a willing participant, but vulnerable in some way nonetheless.
If he gave it up, it would be what his main man Clinton called "disarming unilaterally" (referring to campaign finance reform).

How long before it is mandated that any "persons of interest" be required to provide cameras in every room of their homes connected to the internet with IP addresses to be supplied to the Department of FATHERLAND Security? After all, we have the technology. We should use it to provide even more security for all of us. Its only logical. And how long before there are 300 million persons of interest in this country? Do you think these ideas have not occurred to those with the power to implement such measures? I give it ten years at most.

You do realize that there is talk of introducing a bill that will force all American vehicles to have GPS and to download to the government their mileage so that appropriate road taxes can be assessed (vs. paying at the pump via a gas tax). True! So the government will track your whereabouts in your vehicle.
Interesting. When these comments about Obama were made BEFORE the election, posters were accused of being Reupblicans and called other dirty names as well. CD banned and multiple times disappeared both comments and those who accused it of being a front group for the savior (Obama) and the Democratic Party. Nader supporters were accused of throwing the election to the Republicans. McKinney supporters were accused of throwing their votes away. We told you so back then. Elections are rigged so that the rich ruling elite can have a pissing match between themselves over who is going to be in control. As for the rest of us, well, they could care less. And, oh! One more thing. In 2012, the sheeple will once again be so dumb as to vote for dweedle dee or dweedle dum. We have, after all, no other choice. Right? Wrong. We can stop sanctioning the duopoly, or not vote at all. A vote for NO-ONE may be, and probably, will be the best choice. Then, perhaps, some of the guilt may subside.
I value a single vote for a third party progressive greater than a million votes for an elite candidate.

I'm in agreement with most of your comments except the suggestion to sit out the next election. Given your apparent support for third-party efforts, it seems self-contradictory; fewer third-party votes obviously won't add up to success.

If there's one thing critical that this article fails to mention, it's that Obama has been doing that ever since last year when he voted yes to Dubya's FISA even when he promised a little earlier before to filibuster it. Obama's conceding to FISA was the biggest disappointment Obama did to his base and it even showed in the national media who had a field day with it. In fact, on that day Obama voted for Dubya's FISA, Nader was long ready to welcome disappointed Obama supporters in but still few listened. I don't think that the electorate is taking civil liberties and privacy rights as seriously as they think they are given last years election results.

Local Telcom companys in your community are using warrantless wire tapping for all sorts of right wing vigilante domestic terrorism , hell, they use there fleet of service techs to follow you in and out of every business you visit if you are a traveling serviceman or business man.
Which means , if you are a person of interest to them, with or with out probable cause, the the phone companys follow you where ever you go, and wire tap each location you visit.
Now, imagine you travel through 5 countys and visit 100 of business's a week, wow , great practice for abuse.
All of which has been granted immunity.
They follow me 24/7 , my phones are tapped, my house is bugged, 24/7 for 2.7 years, and because of immunity, I cant take them to court , ask for thier records to prove my case.
So , no redress of grevinces for me , from an intrusive and unconstitutional government harrassment.
