Lawsuit to Challenge Salazar's Wholesale Disregard of Marine Mammal Protection Laws in Gulf of Mexico
400-plus Oil Projects Illegally Approved by Salazar Without Permits to Harm Endangered Whales
SAN FRANCISCO - The Center for Biological Diversity today filed a formal notice of intent to sue Interior Secretary Ken Salazar for ignoring marine-mammal protection laws when approving offshore drilling operations in the Gulf of Mexico. Since Salazar took office, the Department of the Interior has approved three lease sales, more than 100 seismic surveys, and more than 300 drilling operations without permits required by the Marine Mammal Protection Act and the Endangered Species Act that are designed to protect endangered whales and other marine mammals from harmful offshore oil activities.

Seismic exploration surveys, which are used by oil companies to search for oil, generate sounds loud enough to cause hearing loss in marine mammals, can disturb essential behaviors such as feeding and breeding, and mask communications between individual whales and dolphins. A single seismic survey carried out by scientists in the Gulf in 2007 was estimated to expose more than 3,000 whales and dolphins to dangerous sounds. More than 100 such surveys by the industry have been approved by Salazar since he took office in January 2009, all without any authorization to harm or harass marine mammals.
Similarly, noise from drilling operations can displace whales from important feeding areas. More than 300 drilling operations have been permitted by Salazar, all without authorization under the Marine Mammal Protection Act or the Endangered Species Act. Offshore oil activities also can harm marine mammals through pollution, vessel strikes, marine debris, and oil spills.
While certain adverse impacts on whales and dolphins are unavoidable if offshore oil development is allowed, mitigation measures that would be required if Interior complied with the law, such as seasonal limitations on seismic surveys during times of the year when endangered whales are present, could greatly reduce impacts on the species.
"The Department of the Interior is well aware of its obligations under the law, as well of the harm to endangered whales that can occur from oil industry operations, yet it has simply decided it cannot be bothered," added Sakashita. "You and I have to follow the law, but Interior Secretary Salazar seems to think that he and the oil companies he is supposedly overseeing do not. That is unacceptable."
The Marine Mammal Protection Act and Endangered Species Act prohibit private entities, such as oil companies, as well as federal agencies, such as the Minerals Management Service - the branch of the Interior Department responsible for managing offshore oil activities - from killing, harming, or harassing marine mammals, unless they have received authorizations and take measures to minimize the impacts of their activities. The Endangered Species Act protects species such as the sperm whale, which is listed as endangered, while the Marine Mammal Protection Act applies to all marine mammals, such as the bottlenose dolphin and the Florida manatee.
Today's 60-day notice of intent to sue, sent by the Center for Biological Diversity to Secretary Salazar and the Minerals Management Service, is a legally required precursor to filing a lawsuit under the Endangered Species Act.

This is just another example demonstrating Obama is in the hands of corporatists and is another anti environmental president. Obama talks a good game, but as the facts pour in on his agenda we discover that his talk is light years away from his actions.

I don't understand why those who voted for the Manchurian candidate say he’s changed. A rigged election process that excluded other candidates. The Center for Biological Diversity and all such organizations and efforts may be merely scratching at the dungeon walls, but it's arguably worth doing. There are more 'good' people than bad, and eventually the majority does rule.

Salazar is also purposely destroying the Mustang herds by removing them from their set aside sancturies and inhumanely penning them. Leaving herds of less than one hundred members which are not viable in the long term, even though the sanctuaries are over 100,000 acres.

Salazar seems to be continuing actions undertaken by BushCo's MMS and Interior Dept., so why wern't they sued previously?
As I've stated before and often, the whole regulatory artiface of the federal government must be removed from the executive branch, which is why it's so damn corrupted. And while we're at it, lets get rid of the Executive comepletely and return to a modified form of our first constitution--The Articles of Confederation.
They didn't sue BigOil previously because, sadly, when taking on a cartel as powerful as BigOil, they were likely waiting for just the right opportunity.. timing, if you will.
Apparently, there is no better time to litigate than after an environmental catastrophe of near Biblical proportions.

After all, Opensecrets.org reports that Salazar received more than $323,000 from the Energy and Natural Resources sector during his career as a Colorado politician.
I expect the nearly $2.8 million that his boss, Barry received during the presidential election might have had some influence as well.

Wikipedia has an interesting entry for Mr. Salazar that I think helps reveal how people like him get into positions of power. For example, he actively supported Lieberman against Lamont, and had a very mixed environmental record during his Colorado politics. I would call it "opportunist."

BP and its corporate brethren gets carte blanche to operate with impunity and void of any consequences to their actions to make obscene profits. One report suggest that BP has lost one days profit to date in the 'so called' clean up effort. So what then is their incentive to take this seriously? Drill another well?

If the Center for Biological Diversity is going to sue Salazar for failing to enforce the mammal protection laws, then someone needs to sue several thousand federal officials hundreds of times over for all of the official contempt for the laws of the land over the past ten years in Washing-town.
The Center for Biological Diversity pursuing its lawsuit in a lawless environment may seem better than nothing. But it really only feeds the apathy of the 100 million junkies stoned on the petro-opiates, if they even bother to notice.
It would be far more effective for the Center for Biological Diversity to join with all progressive groups for a major showdown in Washing-town, something to send a wake-up call to the junkies, something they cannot ignore.
This lawsuit won't even get mainstream media coverage. Considering that Exxxon hasn't paid a penny in fines for the Valdez spill, this spill is already being buried and it's not even plugged.
I'd like to see an international campaign to boycott the USA, to extract some concessions on behalf of Cuba which is going to be devastated by this spill.
