Equality California Disappointed in Ninth Circuit Court's Decision to Grant a Stay in Proposition 8 Case

Today the U.S.
Court of Appeals for the Ninth Circuit issued a stay pending appeal of
the federal district court's decision in the Proposition 8 federal
challenge. The district court had ruled that Prop. 8 was
unconstitutional, and that marriages of same-sex couples could proceed
on Wednesday, August 18, 2010. The Ninth Circuit Court's stay prevents

Today the U.S.
Court of Appeals for the Ninth Circuit issued a stay pending appeal of
the federal district court's decision in the Proposition 8 federal
challenge. The district court had ruled that Prop. 8 was
unconstitutional, and that marriages of same-sex couples could proceed

these couples from marrying until after it hears the appeal in the case.

In response, Equality California Executive Director Geoff Kors issued the following statement:

"We are
pleased that the Ninth Circuit Court is expediting the case against
Proposition 8 and is considering whether the groups that placed Prop. 8
on the ballot have standing to appeal. We are extremely disappointed
that loving same-sex couples will have to wait to marry, and that we are
once again being denied our fundamental rights. However, we are
optimistic for a favorable ruling, and we're hopeful that same-sex
couples will be able to marry as soon as possible."
