Mukasey Defends Author of So-Called Torture Memos
Attorney General Michael Mukasey is defending former government lawyers who drew up the legal basis of the Bush administration's use of harsh interrogation methods against terror suspects.
Mukasey told Boston College Law School graduates Friday that lawyers doing their part to protect the country in the aftermath of the Sept. 11 attacks should not now be held liable or face criminal charges for doing so.
Mukasey did not mention any specific lawyers by name.
Former Deputy Assistant Attorney General John Yoo is facing at least one civil lawsuit and demands for his firing from Berkeley Law School. Yoo worked in the Justice Department's Office of Legal Counsel from 2001 to 2003.
While there, he wrote several memos legally defending the use of harsh interrogation tactics which are now under criticism by human rights groups and members of Congress. Yoo's memos concluded that President Bush has broad, unfettered wartime authority that cannot be limited by domestic law or international bans on torture.
One memo defined torture, as recognized by U.S. law, as covering "only extreme acts" causing pain similar in intensity to that caused by organ failure or accompanying death.
An internal Justice Department investigation is now considering whether such advice was improper.
At the Friday ceremony, Mukasey lambasted critics seeking to bring lawsuits or charges against the lawyers. "The rhetoric of these discussions is hostile and unforgiving," Mukasey said in his prepared remarks.
Mukasey's confirmation as attorney general briefly stalled over the issue of waterboarding, an interrogation method simulating drowning that critics call torture. He has since refused to say whether waterboarding is illegal since it is no longer used by the CIA or military interrogators.

Show AllMukasey was confirmed by the Senate. Those senators who voted to confirm should be harshly criticized and then replaced.
Unforgiving. Right. Torture is the simplest issue there is. One is against
it or one is for it. And the ones who are for it need to be shot in a rocket toward
the Andromeda Galaxy. That includes you,
Mr. Attorney General.
Chuck Schumer and Diane Feinstein, both Jews, are primarily responsible for the support and confirmation of Mukasey. These cloaked right wing Jews have now uncloaked and should be treated accordingly. It's time to eliminate the influence of Likudnicks in American domestic and foreign policy.
Right wing Jews are atypical, but all powerful. It is OK to refuse to vote for someone because they are a member of a sociopathic cult - namely Zionism
Yes, every time one hears of a fresh outrage from Mukasey-- who's doing such an outstanding job ensuring that the Department of Justice rigidly adheres to the standards set by his predecessor, Alberto "I Can't Recall" Gonzales-- it's impossible not to credit Schumer and Feinstein for enabling this sterling icon of jurisprudence to become Attorney General.
When, not long ago, Schumer opined that Congress wouldn't really have time to get around to health care reform, it underscored his true priorities.
Meet the new abomination, same as the old abomination.
The servants of the elite are very forgiving of the other servants of the elite that misbehave to fulfill their master's commands. Petty criminals - send them away for long term punishment. Their cohorts - defend them as they themselves may one day need defending.
"Mukasey told Boston College Law School graduates Friday that lawyers doing their part to protect the country in the aftermath of the Sept. 11 attacks should not now be held liable or face criminal charges for doing so."
I hope those newly minted lawyers didn't fall for that crap. Giving cover to superiors to mitigate their prosecution for illegal activity does nothing to defend the country. The FBI concluded that rapport building is far superior to torture in obtaining reliable intelligence. The book, A Question of Torture, does a good job of elucidating the harm torture does to the cause employing it. All those promoting torture should go straight to jail.
The basic problem is that no one in Congress (except Kuchnich) has wanted to hold any part of the Bush judiciary to standards set in the Consitituion. Consequently, we have Attorneys General who support torture and a Supreme Court which affirms supreme power of the president. And, speaking of discrimination as a couple of the previous writers were, we currently have five conservative (traditional) Catholics on the Court. What if we had five conservative Mormons (under Romney) or five liberal Jews?
All hell would break forth!

Firing was good enough for Ward Churchill-and it's good enough for John Yoo, as well. Why Berkley insists on acting as if it wouldn't recognize an ethic, if one bit them in the arse, is beyond me!
it's curious that schumer and feinstein think that torture is crucial. why is the survival of israel dependent on a policy of torture by the US? can someone explain this?
People doing their part to protect the country in the aftermath of the Sept. 11 attacks by sacrificing America's first born children to overfill the Merchants of Death treasure houses with warbucks should surely face justice. Short rope, long drop.
"The rhetoric of these discussions is hostile and unforgiving,
As it should be for those who work in a Department called "Justice" and say that laws against mutilation don't really have be followed. From googling "Mukasey Boston College", remarks from Boson college via Boston.com:
"If you do your job well, there will be times when you will have to advise clients that the law prohibits them from doing things that they want to do . . . [or] the right thing to do," Mukasey said. "And there will be times when you will have to advise clients that the law permits them to take actions that you may find imprudent or even wrong."
"You must do law even - you must do law especially - when the stakes are high and the pressures to do something else are tremendous," he said. "Nowhere are the stakes higher and the pressures greater than when the subject is national security, where . . . the questions are as complex and consequential as they come."
Which is why Yoo must be punished. Doh. Majorie Cohn's May 6th testimony applies here.
John Yoo has been "teaching" at Berkeley year after year after year after year, and finally there's a little protest.
Who says progressives and liberals are total wussies?
If they were total wussies, there wouldn't be a little protest at Berkeley after John Yoo "taught" there year after year after year after year.
If this were 2004, when John Yoo started "teaching" at Berkeley, and there was absolutely no protest, then somebody might think that progressives and liberals are total wussies.
If this were 2005, after John Woo had been "teaching" at Berkeley for a year, and there was absolutely no protest, then somebody might think that progressives and liberals are total wussies.
If this were 2006, after John Woo had been "teaching" at Berkeley for two years, and there was absolutely no protest, then somebody might think that progressives and liberals are total wussies.
If this were 2007, after John Woo had been "teaching" at Berkeley for three years, and there was absolutely no protest, then somebody might think that progressives and liberals are total wussies.
But here we are in 2008, and there's a little protest at Berkeley, so nobody can say that...
Progressives and liberals are total wussies!
Let's not be in a rush to blame Jews. The vast majority of right wing hawks in this country are Christians, and there are many Jews who vociferously oppose these policies. Yoo is not a Jew, nor are Bush,Cheney, Rice, Ashcroft or Powell.
Such a display of judicial mercy - for people who advocate torture. Good thing we have Democrats in office to prevent bad political appointments from happening (sarcasm).
Nothing's obscured. Officials break the laws, and then other officials rewrite those laws.
AlexLawyer,
Anyone who blames "Jews" as a group are mistaken bigots who should watch their words; they only serve to empower Abe Foxman and his ilk, who are always overeager to pounce on anything and attach the old faithful moniker "New Anti-semitism". The left (and the paleo-right for that matter) should be careful with their words. I notice in the posts above that Doom n Gloom and hetzer focus their anger on "right wing Jews" and "Likudniks". It's important to take careful aim at those that cause the problems; it's not the average American Jew causing the blind support for Isreal that we see in America. It's a small group of hyper-wealthy, super-organized Israel-firsters. While they exercise their mighty influence in government, media, etc., they drum it into the rest of the tribe that the goyim are out there waiting to get you, so you'd better do everything you can to protect Israel, you may have to make aliyah someday to save your family, by G-d!! The biggest irony is that the actions of this group are actually detrimental to hopes for a stable, peaceful Israel.
The progressive American Jews also have a responsibility to speak out more often against the injustice they see in Israel, as well as the coopting of American policy by a dual-loyal elite - no, let's not even say "dual-loyal". The loyalty of this group of hyper-wealthy, hyper-organized Jews lies with Israel only.
Fortunately and hope-inspiringly, this blooming of progressive American Jewish public speech is happening today, and we see blogs like Philip Weiss's Mondoweiss, Richard Silverstein (Tikkun Olam), and The Magnes Zionist breaking new ground and influencing thought.
Keep up the good work, my heroes.

I find the Jew bashing very ugly too. It comes off like a neo-nazi diatribe. Schumer and Feinstein deserve harsh criticism for naively backing Mukasey but they don't deserve it because they are Jewish. That's just nuts.
Feinstein and Schumer should be called to task because they were prime players in getting Mukasey confirmed period. To pull out the tired lie of jewish / zionist conspiracy theories is counterproductive at best. In case anybody has noticed, the majority of the members of the Bush crime family are christians, with the born-again types as the preponderant ones. Now on the to subject at hand, if there is to be a Bush crime tribunal after January 20, 2009, Mukasey's name needs to be added to the defendants list for being an accessory after the fact and aiding the cover-up.
" lawyers doing their part to protect the country in the aftermath of the Sept. 11 attacks should not now be held liable or face criminal charges for doing so."
would he also argue that German Soldiers who gassed Jews were only doing there part to protect "der homeland" and should not face charges??
I'm really sick of the phrase "harsh interrogation methods." This euphemism allows a touch of doubt in the mind: "Well... when does 'harsh' become 'torture?' Maybe this is just a blown out of proportion lefty, liberal, bleeding heart issue."
Uh, uh. Get a spine, AP. Call it what it is: torture.
'... Mukasey lambasted critics seeking to bring lawsuits or charges against the lawyers. "The rhetoric of these discussions is hostile and unforgiving,"
What is not rhetoric, but patently criminal, for it was not a matter of free speech, when a top Justice Department and White House lawyer, proclaims as public policy that it is OK to, "Crush a child's testicles in front of his father, to induce him to confess, sign, or whatever else, which is sadistic depravity in the bogus name of national security.
HERE IS THE AUDIO LINK of John Yoo confirming that policy statement
What is unforgivable is John Yoo, George Bush, Dick Chaney, Donald Rumsfeld, Micheal Chertoff, Elloit Abrams, Condi Rice, Colin Powell, and those who gleefully carried out and will carry out their unlawful directives.
Will somebody here look up his role in killing lawsuits filed by widows and victims of 9/11 and make that report.

The "Unbreakable Bond" with Israel of the Zionist Judges Controlling the 9-11 Litigation"
'Mukasey...has a long history of obstructing justice, preventing discovery, and covering up the evidence of Israeli involvement in the terror attacks of 9-11... The Zionist judges controlling the 9-11 litigation have acted like the Israeli bulldozers after the massacres in the Palestinian refugee camps of Sabra, Shatila, and Jenin. Like judicial bulldozers, the mission of these orthodox Jewish judges is to bury the evidence of Israeli involvement in the "false flag" terror attacks of 9-11.
And we can draw attention to all who voted for Mukusey's confirmation as US Attorney General.:

5 of 7 were willfully absent running for president, but failed to uphold the office of US Senator, at that critical moment, they ducked period. Not wanting to run afoul of offending potential and real campaign contributions, and vote and delegates, secondarily.
We, the people are a serious problem, that existed before Bush Jr, or Clinton, got into the white house. And our good nature and love of friends, has blinded us to trouble we are in with the neocons as dual-citizens Israeli agents, militarist comprised of nut-jobs like McCain, and plutocrats like Rockefeller and his gang of policy monsters like Kissinger and Brzezinski.
Talk about people who wear their religion on there Shirt sleeves. We hear people of All faiths, giving their own take as to what God says in there holy books. And according to them, god says they are right and everyone else is Wrong. I would like to remind them that God tells us the Truth always, So even though our Minister, Priest or Rabi, tell us what we want to hear, to get us in the Door on Saturday or Sunday, and get us to come back next week. we need to realize these people are human, they often have mouth's to feed at home, and people who depend on them for financial support. no one can afford to loose their Job. And often there words, are their own.
i still would like to know why it is that schumer and feinstein think that they are helping israel when they vote for torture?
i am not trying to say that only jews voted for mukasey. but why do senators who sort of are "liberals" vote for mukasey. and i do not think that their jewishness here is coincidental. nevertheless i honestly don't see how an easy torture policy is good for israel? or why schumer and feinstein think that it is.

If the US does it, then the finger pointed at them, has to go against the US too. The Wall of the temple is US military power.
The torture techniques are as was described, that the Israelis did all along. The wanton destruction is the same, the weapons are the same, and the US military were trained by Israelis for their house to house outrages.
So, the sycophants in uniform knowing the neocon influence in policy from the Pentagon at the start of this administrations continuation of the larger grand plan, the geopolitical strategics of following MacKender by Brzeinski behind the mask of Obama. It started long ago, at least with Lyndon B. Johnson after he assassinate JFK, with compelling information of the Mossad involvement, at least of helping handle the patsy, Oswald.
You have Operation Northwoods turned down by JFK, and he messed-up big-time with getting involved in the first place going along, albeit limited, in the Bay of Pigs covert invasion in April,1961 - resulting in the Missile Crisis the following year, and one year later he is dead from a shot to the right-side of his forehead.
Well, JFK would not have conspired with Israel for a US nuclear attack on Egypt, after Israel under a False Flag scenario, attacked the USS Liberty, but failed to sink it, and the crew got the word out to the fleet, the mission was scrubbed - killed.
We, the relationship of wars, assassination, covert actions, political intrigues, bribery, blackmail, and partners in crime.
These politicians are in hock, their office has high rent, foreclosure is always a threat, to they compromise everything for another fix, they are political animals, junkies, and few get the sense, to just walk away. Government is a terrible place, and the people in it, make it that all the more so. These are rotten people, no integrity to even admitting what others are saying. They will not co-sponsor the truth, but do the lies from 9/11 on, and that goes for the politicians of Europe, hell the world. Who are the dozen exceptions on planet Earth?
Muck-it-all-up, you're a rat & should never have been confirmed just like your predecessor crook psychotic deviant Gonzales. When you refused to answer during the joke of your confirmation hearing waterboarding is torture we saw your true colors. All these perverts who put party before country should be lined up against the wall & shot. I can't say it any plainer than that. I think you are going to have to carry many more millions of us away you don't have capacity or resources to accomplish because your days are now numbered and the American people at last (thank any God) have found all of you out. Good riddance to bad rubbish.
