House Balks at Bush Order for New Powers
President Bush this month is giving an obscure White House office new powers over regulations affecting health, worker safety and the environment. Calling it a power grab, Democrats running Congress are intent on stopping him.
The House voted last week to prohibit the Office of Information and Regulatory Affairs from spending federal money on Executive Order 13422, signed by Bush last January and due to take effect July 24.
The order requires federal officials to show that private companies, people or institutions failed to address a problem before agencies can write regulations to tackle it. It also gives political appointees greater authority over how the regulations are written.
The House measure "stops this president or any president from seizing the power to rewrite almost every law that Congress passes, laws that protect public health, the environment, safety, civil rights, privacy and on and on," said Rep. Brad Miller, D-N.C., its sponsor.
"OIRA has quietly grown into the most powerful regulatory agency in Washington," the House Science investigations subcommittee, chaired by Miller, said in a report in April.
The administration contends Bush's order merely strengthens a similar directive issued by President Clinton in 1993 giving the White House budget office oversight of federal agency rulemaking.
Andrea Wuebker, a spokeswoman for the Office of Management and Budget, which manages the White House regulatory affairs office, said the order, along with an OMB good guidance bulletin, "will help increase the quality, accountability and transparency of agency guidance documents."
Bush's executive order:
- Requires agencies to identify "market failures," where the private sector fell short in dealing with a problem, as a factor in proposing a rule. The White House regulatory affairs office is given authority to assess those conclusions.
- States that no rulemaking can go forward without the approval of an agency's Regulatory Policy Office, to be headed by a presidential appointee.
- Directs each agency to provide an estimate of costs and benefits of regulations.
- Requires agencies to inform the White House regulatory affairs office of proposed significant guidance documents on complying with rules. Critics say this will create a new bottleneck delaying the issuance of guidelines needed to comply with federal regulations.
"This can only further delay implementing health, safety and environmental protections," said Gary Bass, executive director of OMB Watch, a private watchdog group that joined numerous labor and good-government groups, including the AFL-CIO, Public Citizen and the Union of Concerned Scientists, in opposing Bush's order.
Miller tried unsuccessfully at a hearing in April to persuade the White House regulatory affairs office's former acting administrator, Steven Aitken, to reveal what private groups might have been involved in rewriting the Clinton-era order.
Aitken stressed that the Clinton order also used market failure as a criteria in advancing new rules and directing agencies to appoint regulatory policy officers, many of whom were political appointees. Rep. Dana Rohrabacher, R-Calif., backed Aitken up at the hearing.
"The pattern is that we are challenging the president's authority, hoping to find a mistake and then making a lot of political hay about it," Rohrabacher said.
The nonpartisan Congressional Research Service noted in an analysis last February that President Reagan made the White House regulatory affairs office the central clearinghouse for substantive rulemaking, reviewing 2,000 to 3,000 proposed regulations per year. With Clinton's 1993 order, White House reviews of proposed regulations dropped to between 500 and 700 a year, the researchers said.
Bill Kovacs, vice president for regulatory affairs with the U.S. Chamber of Commerce, said the White House's regulatory affairs office now has about 35 people to keep track of the 4,000 rules federal agencies issue every year.
"It's only reasonable that you have some way of monitoring what your agencies are doing," Kovacs said, adding that the White House needs to assert control over the process.

The U.S. Chamber of Commerce is not a Government Agency.
The US chamber of Commerce is a lap dog to government agencys, and has never seen a law or ruling that would put money into its members pockets that it did not like.
Local chambers of Commerce are micro examples of GOP management and governmental mentality.
That some of its members in small communitys may profess to be liberals and sell hippy beads and tie dyed shirts does not mean they dislike legislation that profits them the most to be emplaced.
In a Nation that is Corporate run it is only right that the Chief CEO should have the pwoer to run country as he and his peers deem right and proper.
When and if the Demos get in the head chair they too will enforce the same rulings that Bush now wants.
They are not so much against the philosophy of Bush Edict but the personalitys of those who are presently seated at head and around that table.
It has little to do with the people they are supposed to represent but their own power trip that matters.
Ask one candidate, other than Ron Paul and Kuscinich if they would recind all the powers now granted to the Presidency and what answer do you think they would give?
Ask them if they would take away the Pentagons new powers over and in American civil affairs and what answer would they give?
For that matter why is it not one media or Presidential Candidate even broaches these subjects?
Why are Americans satisfied with living in a nation that now has police powers vestd in one ofice, the Executive Banch, that has been the most corrupt and detrimental to Liberty in Nations History, and does not question why every candidate wants those same powers?
Could it be that "Americans" is no longer a term known in these lands and instead of Representatives we want 'Leaders"?
The cowards refuse to impeach Bush. They even gave him 100 billion to continue with with the colonization of Iraq. 95% of our top politicians have been bought off by corporate America. Our political & enconomic system is rotten to the core. We're in desperate need of a revolution.

Read the Declaration of Independence. If you pay attention to the grievances of the Colonies against the last King George, you will be astounded to see history repeat itself.
We separated ourselves from the last despot by revolution. We have the opportunity in the 21st century to do it through impeachment.
The people of the United States have become merely "Consumers" not citizens. We are told to go into massive debt and keep buying stuff we do not need to keep the corporate coffers filled. The hell with fair wages and US manufacturing. Outsource all the jobs, put the Bushie's feet upon our necks and keep us all down.

Thank goodness for a little backbone in Congress; can they keep it up? Bush/Cheney would never have amassed their autocratic powers had Republicans in Congress valued principle over party. Congress has allowed this unhealthy centralization of power - - now it must stop it and begin dismantling it. I can hardly wait until 2008 when Bush goes and a Democrat replaces him. It's a terrible shame that Congress won't impeach the rascals.

executive pardons and commutations have changed the landscape, and we the people are poorer for it. if there was ever a time for george w. bush to invoke clemency, it would have been while carla faye tucker was sentenced to death and he was the governor of texas. instead, your christlike george w bush chose to mock her last pleas for life. what is christlike about that?
if george w. bush believes what he says he believes, he must know that a flaming hell awaits him.
On the surface this type of regulatory unit is laudible. But we can't afford to allow this tyrant, "W," to turn a good idea into his own fascist tool. No corporation has ever fallen short of pleasing W. If we were still a democracy I would go for it.
But "we the People" have given up our ability to govern. So we should fight against this power grab as if our lives depended on it! WHICH IT DOES!!

Come on, Congress, give the man what he wants, and while you're at it, give him a raise in salary, too. Once you've turned everything over to Bush, you can cut back on big government spending by dissolving yourself. The Capital and congressional office buildings could then be turned into low-cost housing.
The fact that charges have not been brought forth against Cheney and Bush shows how weak Congress is. Only We the People can remove these thugs from power.

Does anyone know what the outcome was after Congress reviewed the new DOJ, "McNulty Memorandum" guidelines which essentially gives corporations more protection from Congressional oversight under the guise of "privileged material"?

The concept that anything like good government management will come from Bu$h the inferior is beyond laughable.

One can rail against Corporations but the true state of our country lies in the ignorance of people to choice; and those choices may of already been denied once and for all.
