First Gonzales, Then Bush: Impeachment Should Be A Serious Option - With An Intermediary Step
In American politics, brave actions are politically unthinkable until someone thinks to act on them. Then public opinion can turn, sometimes with surprising speed.
For several months, I have been arguing with friends and colleagues that impeachment of President Bush and Vice President Cheney should be a serious political option. Just two of their crimes and misdemeanors -- willfully lying America into war and firing federal prosecutors for purely political reasons, then further obstructing justice by stonewalling about the dynamics of the firings -- are more than adequate constitutionally to impeach. There are several other offenses, ranging from defying the lawful mandates of Congress and the courts, to gross invasions of civil liberty, to denying democracy itself by systematically undermining the right to vote. And, in the seventh year of this eerie administration, in which the president is a puppet of the vice president (rendering the usual mechanisms of accountability opaque), the curtain has only just begun to be pulled back on Cheney.
The conversation always goes the same way. Yes, say the prudent ones, to some extent the constitutional assaults are even worse than Richard Nixon's. But we have a cure for this administration -- the 2008 election. And an impeachment proceeding this late in Bush's second term would be seen as playing politics. The people don't want impeachment, they want Congress to do the public's business.
These are fair questions, to which I will return in a moment. But for now, consider the constitutional and political logic of an intermediate step, the impeachment of Attorney General Alberto Gonzales. Given the several counts against him, including his lying to Congress about domestic spying, lies that have now been contradicted by sworn FBI testimony, and his utter stonewalling about the firing of the U.S. attorneys, no reasonable observer could dismiss an impeachment proceeding as merely playing politics. There is no other way for justice to be done. The case for impeaching the attorney general was ripe months ago. I urged that course this past March in a Boston Globe column also published on the Prospect website. [See "You're Fired," March 2007]
Constitutionally, the framers designed impeachment precisely so that Congress would be the final check on out-of-control executive branch officials who broke laws. Politically, many prominent Republicans have already called for Gonzales to resign. An impeachment proceeding would force the issue, and put other Republicans in a double bind of either defending the indefensible or adding to the pressure for his resignation. Either way, the process weakens the Bush administration and strengthens its opposition.
Unlike in the matter of whether to impeach Bush, we have begun to see some congressional leadership on the Gonzales affair, most notably by Rep. Jay Inslee of Washington state, a former prosecutor. The other great benefit of impeaching Gonzales is that it would demonstrate that impeachment is not some screwball idea but a solemnly constitutional process intended for use when all else fails. And an impeachment proceeding against the attorney general would necessarily smoke out more of the role of the White House in the firings of prosecutors. Impeachment of Bush and Cheney would itself become more politically thinkable.
But what about those purely tactical arguments against impeachment of the president? Isn't it just too close to the election? Let's turn that contention around on those who make it. The man is going to be our chief executive for another 17 months. Bush has claimed that even if Congress votes to hold members of the executive branch in contempt, he would direct the Department of Justice not to prosecute them. He has claimed that his powers as commander in chief, a purely military constitutional function not intended to turn the president into a monarch, allow him to selectively interpret laws. What else would Bush have to do before it becomes legitimate to begin an impeachment proceeding? Declare a state of emergency and govern by decree? His actions are not so far off this description.
And what of the claim that the voters would prefer to see Congress go about the public business? Look at how Bush has hamstrung the current Congress and you'll see that little legislation of any consequence is likely to pass until 2009. There is no higher public business than holding members of the executive accountable for lawbreaking.
If the Democratic leadership in Congress works up the nerve to impeach Gonzales, the process would make it less unthinkable to imagine impeaching Bush -- and could well elicit more evidence of impeachable conduct. Even if Bush retained office, public attention would be focused on his misdeeds and those of Cheney. Republicans would be forced either to abandon Bush as they ultimately abandoned Nixon, or to defend odious actions. Either way, they would pay dearly in 2008. At worst, Bush would toss Gonzales overboard before the waters rise around his own neck.

Your argument for impeaching Gonzales appears to be a false dilemma.

The Republicans might abandon Bush, or they might support his "odious actions." The fallacy of your argument, however, is that if Bush did drop Gonzales like a hot potato, it would make Bush look like the hero in this entire mess. That would, ultimately, improve Republicans' chances in 2008 regardless of congressional republicans' actions re: impeachment.

Wow, hmmmm, impeach bush because he lied us into a war hmmmm, it seems to me that congress also had a huge part of that decision, since it is only congress who can approve funding for war. Connections with al queada and hussien are there, you hatred for bush is so great that even if you saw a video of hussien and bin laden hugging each other you would question the "truth" of it. Bush is a fine president, he's the only one who's shown cojones when it comes to dealing with terrorists, and yes johnny there are terrorists. They aren't a new made up enemy, they were here when clinton was prez, when they tried to blow up the twin towers, they were in the phillipines when the kidnaped and killed a lt col, they also let serin gas go in the tokyo subways, terrorism is not a new idea or enemy, it's been around for years. I'm not totaly thrilled with bush, for instance this American of hispanic decent was furious when he tried to pass the amnesty bill for all those illegal aliens. Even my 17 year old daughter couldn't believe that we would reward illegal migration by given these law breakers legal status. O my gawd she said, dad wouldn't they then be legally able to apply for social services. Yep even she knew that amnesty for the 12 million (and more) illegals was just plain stupid.
Now to Mr Gonzalez, it's just a political witch hunt with a a little (or perhaps a lot) of racism sprinkled in. I see those so called white democrats having a hard time with a spic in that position. I am personally offended that they would want to impeach him for firing a few U.S. Attorneys yet have nothing to say about Reno firing all U.S. Attorneys when clinton took over. Again, it was Ms lilly white Reno doing the firing and we can't TALK BAD about her can we! But now we have a spic in the position and he's no good, hell he probably is a wetback from the mejico. According to the WSJ "the dismissals were unprecedented: Previous Presidents, including Ronald Reagan and Jimmy Carter, had both retained holdovers from the previous Administration and only replaced them gradually as their tenures expired. This allowed continuity of leadership within the U.S. Attorney offices during the transition". O and don't tell me that the firing of the 93+ U.S. attorny's by Reno didn't have political motivations. What were the U.S. Attorney's in Arkansas up to before they were fired? Again the WSJ points out the following By dismissing all 93 U.S. Attorneys at once, the Clintons conveniently cleared the decks to appoint "Friend of Bill" Paula Casey as the U.S. Attorney for Little Rock. Ms. Casey never did bring any big Whitewater indictments, and she rejected information from another FOB, David Hale, on the business practices of the Arkansas elite including Mr. Clinton. When it comes to "politicizing" Justice, in short, the Bush White House is full of amateurs compared to the Clintons".

It seems to me that impeachment is the only way to expose the misdeeds of this administration. For almost eight years, I have had to grit my teeth because of this administration. The shenanigans of both Bush and Chaney are enough to merit impeachment. I would support impeachment.This regime must be exposed so that the country knows the truth about their lies and games.
Regarding fears that impeachment might fail:
Nixon was NEVER impeached, and certainly never tried before the Senate. The House COMMITTEE voted his impeachment, but the full House never got to vote on it because Nixon resigned.
Impeaching Gonzalez is a waste of time unless Congress first repeals the spy on America act. A new attorney general can do the same things with the spy on America act as Gonzalez can. An impeachment trial would be the first positive thing the Senate has done since Bush has been in office even if it doesn't get a conviction.
The spy on America act should be repealed first. The new technology argument is completely bogus. In their battles with the courts over search warrants, did the cops ever say that police cars made search warrants obsolete? Hey, it was new technology at one time. Did the cops ever try to say that six shooters made jury trials obsolete? Bush is trying to say that if new technology makes it easier to spy on Americans then the fourth amendment is obsolete.
How is eavesdropping on phone calls and e-mails going to stop terrorist attacks when Bush has left the borders and ports of entry wide open for six years? George Bush went on TV and blabbed to the whole world that he was spying on phone calls and e-mails. Was he trying to warn the terrorists that their phone calls were being monitored? Why did George Bush compromise his eavesdropping program? What good is it now that the whole world knows about it?
Impeachment is the only thing the House can do that bush can't veto. It shouldn't take long to impeach the torture lawyer; everyone has seen his performances before the judiciary committees.
SJC said we can "let Nancy Pelosi be president for a while until we can elect the new Democratic president." If the Republicans succeed in passing the ballot measure in California to change how the state's electoral votes are distributed, it will be impossible to elect a Democrat president. The new law would give at least +20 electoral votes to the Republicans (the equivalent of winning Ohio) and turn California from a solid blue state to a purple state.
They used Florida to hack 2000, Ohio to hack 2004, and they're setting up to use California to hack 2008. We may not be able to get rid of these fascists through the ballot box.
BTW - The idea that Nancy Pelosi can not act because of the position in the line of succession is absurd at best. Impeach Cheny first and let them put one some other bozo in a veep, then go after w. But you know what, it ain't gonna happen.
The Pelosi coup liability problem is a fake problem. There's a reason why there's a 2nd in line, and a 3rd in line. And there are reasons that politicians deserve to be impeached. What sort of crime, if not lying about reasons to go to war and the obvious cronyism with Halliburton, wouldn't rise to the occasion of impeaching this administration?
Ok, let's say someone comes up with a good reason. Then I'll suggest the unthinkable. Impeach Bush, but leave Cheney in charge. With a pack of people around him that basically give him no freedom whatsoever.
Keep in mind people, that there's a larger pattern afoot here. Any future administration might come in with a crazy as president, and an even crazier/more ruthless VP. So you wouldn't want to impeach the pres, lest you get the (worse) VP.
That cannot be a repeatable pattern. The country cannot afford it. The time to act is now.

At least until next month, when the Democrats vote for the "Lying America into War (LAW) Act" and the "Political Firing of Federal Prosecutors Enabling Act".
It is absolutely mandatory that Cheney/Bush undergo impeachment proceedings NOW --because unless they are thrown out or undergoing criminal proceedings, there will NOT be an election in 2008. Considering the voting fraud and voting machine deficiencies, even in the best of circumstances a true election cannot be held in 2008. An impeachment hearing in process for Gonzales might just keep Cheney from attacking Iran. Bush will do as he's told.
If you're going to impeach anybody, impeach Dick Cheney. I guarantee he will resign rather than face public hearings.

Impeachment doesn't have to succeed to be very effective. If hearings are held, evidence will be made available to many more people. I can't believe that many politicians will want to openly approve of the actions of Gonzo, Shotgun Dick, or Bu$h the inferior.
Majority in the house impeaches then the senate must try the case. How many senators want to go down with the Bu$h ship.
One way to eliminate the specious "Pelosi coup" argument is for Pelosi to promise not to run in 08 and to serve as a caretaker Pres post-impeachment.

Impeachment proceedings, both House and Senate, are also a means of CONTROLLING the executive, while in office. So, the argument, about the (assumed) ending of Bush's and Cheney's terms in office, has little force.
I believe the worst of the Bush administration has yet to be dumped on America. 16 months gives them plenty of time to do what they do best. They need to be stopped.
To impeach Gonzales is a right idea, but an intermidiate step should be to dethrone Cheney rather than Bush, because if an impeachment of Bush was successful and one against Cheney was not, we would then have Cheney as President. A prospect too terrifying to consider.
Yet another Democrat plan to do nothing while looking like they are doing something. Try reading a calendar. If you do these successively, then you'd never get to Bush before Jan 09. So this is really a proposal not to impeach Bush.

Remember, "Bush" is a collective. The tendrils of the bad seed have grown through the entire Congress and Military and must be cut out if we are to regain our health as a Nation of the People.
Average the number of people that "Bush" has murdered or maimed since the beginning of this fiasco and then come up with the likely sum of deaths or maimings that will occur if these criminals are not stopped before the 2008 elections. Pelosi acting as president is exactly why she has to oppose impeachment. It would be spinnable as a coup engineered by her to become president. Thats why there's no point waiting for her to act. Impeachment will require enough House Democrats supporting it to force the issue, but that hardly seems impossible, especially with regard to Gonzales. Even Republicans have contempt for him, and while they don't want to remove the roadblock to multiple investigations of Bush and who knows what GOP scandals, they won't fight as hard for him as for Cheney and Bush. The ones with consciences might even support his impeachment. Tell your own representative to cosponsor the impeachment resolutions.
I would impeach Gonzo, then Cheney and then Bush. We can let Nancy Pelosi be President for a while until we can elect the new Democratic President. While we are at it, we should elect another 9 Democratic Senators so that we have 60. That way we can actually get America back on track to real prosperity and not the phony trumped up deficit bloating lies Junior and the neocons have been shoving down people's throats.
Gonzales is a knat and a waste of time to impeach/remove. He's just another Bush toadie who is there to deflect the heat from Cheney/Bush. There is more than ample evidence to impeach/remove Cheney/Bush and make Pelosi, a true anti-war Democrat (though just as cowardly as the rest of her party except for Kucinich and Richardson), the first woman President of the US.
Screw waiting until the 2008 election. That's a ploy to keep the Iraq War going on indefinitely, as all 3 frontrunners support keeping an undefined number of residual troops in Iraq indefinitely. If 160,000 aren't enough, what makes them think that 5 or 10,000 would be enough? Obviously nothing, so they're just lying about being anti-war.
But impeaching/removing Cheney/Bush is critical as a warning to future Executives, regardless of Party, that Congress will enforce checks and balances irrespective of possible results in future elections. But the Democrats want the same powers Bush/Cheney have stolen by committing high crimes and misdemeanors against the US Constitution.
Despite the apparent bleak outlook - envision one thing in detail. They need you more than you need them. Think outside the box, never plan from fear, take the problems - any and all of them as the framework and resourse for the solution. Do no violence.

When wondering why Pelosi won't advocate impeaching Bush the first thing that should be asked is why she and her husband were at a private dinner at the White House with Bush and his wife a few weeks ago.

Dear CD readers, I don't often comment on a CD article but I do read most of them and then read all your comments - great reading and many thanks for your thoughtful responses.
Tonight I stumbled across the DVD "Loose Change" and a lot of things suddenly made sense, a sickening sense. I've never thought of myself as much of a conspiracy theorist, except for the entire JFK thing, but how long can this country of ours survive with the Bush/Cheney/Gonzo trio aided and abetted by the Clinton/Obama/Pelosi trio? No matter which political handle they wear or all the platitudes they mouth the future of our country means nothing to them. The White House and both houses of Congress are seemingly bought and paid for and you and I, dear reader, are supposed to believe we can turn it all around with an election in 2008! Not with any Demo or Repug now on the radar. Can we somehow get this Kucinich guy to join hands with other like minded individuals (Sheehan, Gravel?) to bust 2008 wide open with real candidates.
Keep posting guys/girls, it's going to be a dirty job but if we don't do it...then who will...and when.
