The far-right Republican's track record shows complete fealty to corporate polluters, Big Ag, and the chemical industry—those responsible for most of our toxic pollution and a food system that puts profits over human well being.
While it is rarely a top campaign issue, Americans care deeply about our health and well-being, the food we put in our bodies, and what corporations put into our food—especially when it comes to our children. We all want to know our food is safe and free of dangerous chemicals and additives that can cause serious health problems.
This electoral season, many Americans are asking: Who will make America healthier, Vice President Kamala Harris or former President Donald Trump?
The difference is stark: Widespread evidence shows that Trump’s presidency rolled back many regulations governing toxic chemicals, while the Biden-Harris Administration acted to reduce our exposure to toxic chemicals.
In July 2017, a few months after taking office, Trump reversed a pending ban on the insecticide chlorpyrifos—a brain-damaging chemical linked to ADHD and autism. Chlorpyrifos is so toxic there are no determined safe consumption levels for infants and children. The reversal came after Trump met with the CEO of Dow Chemical, chlorypifos’s biggest manufacturer—and after the company donated $1 million to Trump’s inauguration ceremony.
The Environmental Protection Agency (EPA) found levels of this pesticide are up to 140 times the limits deemed safe for adults in foods kids regularly eat.
On taking office, Biden-Harris restored that ban to protect our health.
Trump’s EPA approved more than 100 new pesticide products, many containing ingredients so toxic that they have been banned in other countries. Half a dozen new products, for example, contained the chemical paraquat, a substance so deadly that ingesting a spoonful can be fatal. Seventeen of these products contained the potent hormone disruptor atrazine, and several other Trump-approved products included the dangerous airborne fumigant methyl bromide.
Trump’s EPA also failed to act on PFAS, known as “forever chemicals,” found in our food, air, water, and even breast milk. These substances are linked to cancer, birth defects, thyroid disease, weakened immunity, and reproductive harm.
In contrast, Biden-Harris issued the first-ever drinking water standard for PFAS, investing more than $1 billion to protect Americans from these deadly chemicals.
The Trump Administration appointed a former chemical industry lobbyist to head the EPA’s division on chemical oversight. Under Trump, the agency rolled back a whopping 112 environmental protections, including regulations protecting our air and water and controlling many toxic substances. The Biden-Harris Administration has revived and strengthened many of these critical protections.
Trump further endangered our food and health by abolishing stronger organic animal welfare rules aimed at making our meat supply healthier for both people and animals. The Biden-Harris Administration restored these protections. Trump caused additional harm when he reversed limits on bee-killing and neurotoxic neonicotinoid (or “neonic”) pesticides in national wildlife refuges and signed an executive order scaling back regulations on GMOs.
Now, as if to magically erase these truths, Robert F. Kennedy Jr. has launched a “Make America Healthy Again” (MAHA) campaign on Trump’s behalf. Kennedy insists Trump would end Big Food’s influence over federal health policies, “ban the hundreds of food additives and chemicals that other countries have already prohibited,” change policies and regulations to reduce processed foods, and “clean up toxic chemicals from our air, water and soil.”
While Kennedy raises important points about the corporate capture over food and health policy, the facts show these claims have no basis in reality. Kennedy’s MAHA bid is completely contradicted by Trump’s track record and the interests of his biggest corporate backers, including Big Agriculture and the chemical industry.
And Project 2025, a blueprint for a second Trump term authored in large part by Trump’s former staffers, is a repudiation of Kennedy’s “MAHA” goals—calling for massive deregulation that will only exacerbate the problems Kennedy rightly identifies. This includes removing GMO labeling and federal inspection requirements for meat and poultry processing; weakening the Endangered Species Act; reducing the influence of EPA science on pesticide approvals; and undermining or even eliminating the science-backed Dietary Guidelines for Americans.
That’s not a recipe for a healthier, less toxic America. For all Americans, especially parents, who are rightly concerned about toxic chemicals in our food and environment, Kamala Harris is by far the better choice.

The lead author of a new analysis of flame retardant pollution said she was "blown away" by the amount of chemicals that have seeped into the environment, contaminating more than 100 wildlife species across every continent on Earth—even as other studies have found that ubiquitous anti-flame products have been found to be ineffective in most applications.
"Flame retardants don't actually make TV enclosures and car interiors more fire-safe, but they can harm people and animals," said Lydia Jahl, a scientist at the Green Science Policy Institute (GSPI), which published the study on Thursday. "Though these product flammability standards may seem protective at first glance, many cause widespread and lasting harm for no real benefit."
A 1975 California regulation required furniture to withstand a small open flame for 12 seconds, leading manufacturers to widely use flame retardants. But according to GSPI, "in a real fire the cover fabric will ignite first, leading to a large flame which will quickly ignite the foam, even if it contains flame retardants. In fact, furniture with and without flame retardants burns similarly."
Jahl led the analysis of 20 years of flame retardant research, finding high levels of chemicals that have been banned since the 1970s, including polychlorinated biphenyls (PCBs) and polybrominated diphenyl ethers (PBDEs). Other flame retardants that have been introduced in recent decades, including chlorinated parrafins, were also found in high levels, and are hardly less toxic than the banned substances.
"Though known to cause liver, thyroid, and kidney cancers in laboratory animals, chlorinated paraffins are still commonly used in consumer products, with more than one million tons produced annually," said GSPI. "Similarly, use of organophosphate flame retardants is proliferating, though even low levels may harm IQ, attention, and memory in children."
The chemicals can affect wildlife in similar ways, the group said.
Large marine animals including orcas were found to have some of the highest levels of flame retardant contamination, including from PCBs. The banned chemicals are believed to be linked to shrinking orca calf populations, and scientists have predicted the persistence of PCBs in the environment could be a major factor in wiping out half of the world's orcas.
"Killer whales shouldn't have to swim in a sea of flame retardants. The science is clear that these chemicals harm their development—as well as that of our children," said Arlene Blum, executive director of GSPI. "We need to update ineffective flammability standards to stop these toxics from entering the environment, wild animals, and us."
Other animals found to be contaminated with high levels of flame retardants include:
Flame retardant pollution has also been linked to endocrine disruption, neurodevelopmental effects, decreased fertility, and some cancers in humans.
"It's heartbreaking that human advancement doesn't take health impacts into account for ourselves and for wildlife," Jahl said. "The people who pollute are not the most impacted—it's fenceline communities, turtles, dolphins, foxes, and butterflies."
The chemicals travel quickly through air and water and become widespread in soil as well as humans' and animals' blood, making the contamination difficult to mitigate.
California has taken recent steps to ensure the problem doesn't get worse, passing Senate Bill 1019 in 2014. The law requires upholstered furniture to be labeled as containing or not containing flame retardants. The state also banned the sale of new upholstered furniture and children's products containing most of the chemicals.
Other U.S. states and countries that have not yet revised decades-old flammability standards should do so promptly, said GSPI, in order to cut down on the chemicals contaminating wildlife.
"Instead of this endless cycle of regrettable substitutions, we need to evaluate whether many of the flammability standards that drive the use of flame retardants are even helpful," said Jahl. "Some standards—such as California's old furniture standard—have already been proven ineffective and revised. Many more wouldn't stand up to scrutiny either, and they are wreaking havoc on wildlife and people alike."
The sheer quantity of chemicals being dumped into the environment is quickly growing—and we may only be seeing the beginning of the harm they are doing to us.
We’ve had a summer from hell, with July 2023 temporarily claiming the title of hottest month on record. But while the klaxons of Earth’s climate system have riveted nearly everyone’s attention, something else is silently happening to us and other species that could turn out to be just as big a disaster.
Nature is increasingly stewing in air- and water-borne toxins originating in industrial processes. Tens of thousands of chemicals, only a tiny proportion of which have been tested for safety, are making their way into the environment—from pharmaceuticals that have passed through human bodies, to plastics, pesticides, solvents, fire-retardants, and chemicals used in making cookware coatings.
Recent research shows that whole classes of these chemicals are affecting sexuality and disrupting reproduction—not just in humans, but in a host of other animal species as well. But the whole subject is controversial and is getting far too little attention, partly because reproduction and sexuality are culturally sensitive topics, and partly because the chemicals industry wields considerable political power. In this article, we’ll explore both the science and the controversy, and see why 2 percent is such a scary number in this context.
Sperm Counts, Testosterone Levels, and Women’s Reproductive Health
Multiple studies have shown that male sperm counts have fallen dramatically in the past 50 years. That decline appears to be accelerating.
The fact that both human sperm count and insect biomass are estimated to be declining at about 2 percent per year may be just a numerical coincidence. Nevertheless, it’s a number that should grab our attention.
While the reasons for falling sperm counts are still being investigated, it is clear that the fetus is particularly susceptible to the effects of pollutants, and that impacts at the fetal stage of life can significantly shape the adult. The pollutants most likely to have widespread impacts on reproductive health have been identified—hormone-mimicking chemicals that have become widely dispersed in the environment, many of which persist for decades or longer.
Two meta-studies (i.e., studies based on a review of all relevant research to date) by a team led by Hagal Levine of the Hebrew University of Jerusalem provide the most reliable and broad-based scientific information about sperm counts. The first of these papers, published in 2017, covered data from North America, Europe, and Australia/New Zealand. It found “a significant decline in sperm counts . . . between 1973 and 2011.”
A more recent paper by Levine et al., published in November 2022, confirmed these conclusions and expanded them to include Africa and South America. Among men from all continents, the authors concluded, “the mean [sperm count] declined by 51.6% between 1973 and 2018.” The study also found that the decline rate, currently about 2 percent per year, is increasing. The trend, if extrapolated, would result in near-universal male sterility by about 2060.
Having a low sperm count reduces fertility, though if the count is above zero it does not exclude the possibility of an affected man impregnating his partner. However, a low sperm count is frequently associated with reduced sperm quality, including less motility and abnormal shape.
Testosterone levels in males are also falling. Several reasons have been suggested, with environmental toxins again one of the more likely culprits. Low testosterone levels in men can lead to obesity, low sex drive, and symptoms of depression.
Women are likewise experiencing puzzling and worrisome trends in sexuality and reproduction. Studies in dozens of countries since the 1970s have shown that girls are experiencing puberty earlier and earlier, with the average age of onset declining by about three months with each passing decade (a similar, though less extreme pattern, has been seen in boys).
In her book Countdown: How Our Modern World Is Threatening Sperm Counts, Altering Male and Female Reproductive Development, and Imperiling the Future of the Human Race, reproductive epidemiologist Shanna Swan (a co-author with Levine of the two studies linked above) cites research showing an increase in difficulties in childbirth, increasing incidence of endometriosis, increasing risk of miscarriage, increasing incidence of ovulation disorders, and increasing use of in vitro fertilization.
Swan also explores links between chemical exposure in utero and later gender-related sexual behavior, citing dozens of relevant studies. She writes:
In addition to influencing the physiology of reproductive development, environmental chemicals may be affecting gender identity and sexual preference. These forms of flux aren’t inherently good or bad, but they may present a silver lining: with such trends arguably on the rise, we, as a society, are gradually becoming more open-minded toward accepting people, however they present and identify themselves in terms of gender.
Meanwhile, Americans are having less sex, and young people in particular are reporting less sex drive.
Why Is This Happening?
There are several possible reasons for these ongoing shifts in human reproduction and sexuality. Researchers have explored environmental toxins, obesity, diet, smoking, medications, diabetes, marijuana usage, and aging as factors. It’s difficult to establish perfect cause-and-effect relationships between culprits and outcomes, but all of the worrisome impacts and trends are linked, to one degree or another, with environmental toxins.
Since the 1990s, many researchers who are trying to understand the accelerating increase in reproductive problems have focused on endocrine disrupting chemicals—compounds that either block the action of a naturally occurring hormone or intensify the effects of a natural hormone by eliciting the same physiological response as the hormone itself. Endocrine disruptors include:
Traces of PFAS endocrine disrupting chemicals have been found even in the remotest locations on the planet, and a study released in July 2023 revealed that they contaminate up to half the US water supply.
Public concern over environmental toxins has led the chemicals industry to withdraw certain of its products and replace them with substitutes. Unfortunately, the result is often what anti-toxics activists call “regrettable substitution,” in which substitute chemicals have similar toxicity effects to the chemicals they replacing. For example, GenX and PFBS are being used as replacements for PFOA and PFOS, the original Teflon chemicals that were forced off the market due to their decades-long persistence in the environment and their links to serious health harms to people and wildlife. But GenX and PFBS are also toxic and persistent in the environment. In some cases, the substitute has been found to be even more toxic than the chemical it is replacing: bisphenol F, which is widely used as a substitute for BPA, is even more dangerous to people and the environment.
The sheer quantity of chemicals being dumped into the environment is quickly growing. UNEP counted the annual release of toxic chemicals in 2006 at 6 million tons, but Worldometer estimates the current release at 10 million tons—a 67 percent increase in a little over a decade.
As I was doing research for this article, I came across an opinion piece in Scientific American by endocrinologist Geoffrey Kabat, who claims that there is not enough proof of causal links to justify naming endocrine-disrupting chemicals as the main source of declines in sperm counts. Kabat quotes fellow endocrinologist Richard Sharpe as saying: “Given that we still do not know what lifestyle, dietary or chemical exposures might have caused this decrease, research efforts to identify [the causes] need to be redoubled and to be non-presumptive as to cause.”
Curious, I asked Dr. Pete Myers, founder and chief scientist of Environmental Health News and coiner (in 1991) of the term “endocrine disrupting chemicals,” about Kabat’s and Sharpe’s doubts. Myers told me, “While there is always uncertainty in any scientific hypothesis, the weight of the in vitro, in vivo, and epidemiological evidence strongly supports the involvement of phthalates in the sperm count decline.” Myers also alerted me to an article that traces funding links between the Genetic Literacy Project (which publishes Kabat’s opinion pieces and lists him as an adviser) and Monsanto (now Bayer).
Of course. Just as Big Tobacco once hired PR firms to assure smokers that cigarettes were safe, and just as Big Oil created a network of non-profit think tanks to argue that fossil fuels don’t cause climate change, now Big Chem (Bayer, BASF, Dow, Dupont, and Syngenta) is following the same playbook. And lobbying by the chemicals industry appears to produce results: in just one instance, the US Environmental Protection Agency (EPA) has recently changed how it defines PFAS for regulatory purposes in a way that excludes many known persistent toxins.
It Gets Worse
Perhaps the most frightening biological impact of many endocrine-disrupting chemicals is their tendency to alter DNA expression in ways that can be inherited by subsequent generations. It’s long been known that environmental factors (food, air, water) can cause genes to be switched off or on, or dial their expression up or down. Sometimes the effects are transgenerational, and continued presence of chemicals in the environment can amplify biological impacts from one generation to the next.
For example, a 2017 experimental study on mice found that in utero exposure to phthalates resulted in the first subsequent generation being born with slightly damaged sperm; however, with continued phthalate exposure, by the fourth generation the mice’s capacity to produce sperm was virtually gone. Pete Myers refers to this intergenerational amplification of impacts as a “male fertility death spiral.”
Because chemicals can revise the ways DNA patterns are expressed in cells and body systems, chemical impacts on human reproduction could become permanent. According to Shanna Swan, “It’s as if the new pattern becomes etched in stone and cannot be altered or erased for either that man or possibly his future male heirs.”
As if to add injury to insult, low sperm counts and testosterone levels in men, and poor reproductive health in women, have been shown to be associated with poorer health overall, including shorter lifespans and greater likelihood to develop cancer and heart disease.
But Aren’t There Too Many People Anyway?
Some ecologically minded folks’ initial reaction to the news of falling sperm counts is nonchalance or even elation. After all, population growth makes nearly all environmental problems worse and harder to solve. Human population has risen from one billion at the start of the Industrial Revolution to eight billion today, and for the past several decades we’ve been adding an extra billion to our numbers approximately every twelve years. One might well ask: If humanity will have more difficulty reproducing in the near future, is that just nature’s indirect way of trimming the over-abundance of a particularly destructive invasive species?
It’s bad enough that chemicals could result in a human population crash this century, but other species are being impacted too.
Unfortunately, this way of mentally turning looming tragedy into possible benefit is shortsighted. Only the most misanthropically minded would want humans to go extinct due to an inability to reproduce. However, if some of the accelerating trends cited above were to continue, near-universal sterility would indeed be the result. Even if some people could still reproduce, we might be trapped in a real-life version of The Handmaid’s Tale.
Unsurprisingly, companies, governments, and think tanks that encourage population growth are using news of falling sperm counts to encourage more growth now, while it’s still possible—ignoring the ecological impact of higher human numbers as well as the decline in global human carrying capacity.
It’s Not Just Humans
It’s bad enough that chemicals could result in a human population crash this century, but other species are being impacted too. Take insects, for example. A 2022 metastudy led by Veronika Hierlmeier noted that “The ongoing decline in the biomass, abundance, and species number of insects is an established fact.” Ecologist Bill Rees recently told me, “We may not notice, but insects are the glue, nuts and bolts of many ecosystems. Remove the ‘bugs’ and the rest of the system falls apart. Oh, yeah, the human enterprise is part of ‘the rest of the system’.”
The most recent estimates suggest that insect biomass is declining by up to a startling 2 percent per year. This frightening trend is no doubt partly due to habitat loss. But another major cause appears to be the same chemicals associated with increasing reproductive problems in humans—“forever” chemicals, BPA, phthalates, etc.
The story is similar with other animals. Studies of farmed mink in Canada and Sweden have linked industrial and agricultural chemicals with lower sperm counts and abnormal testicular and penis development. A similar effect has been seen in Florida alligators, in UK crustaceans, and in fish downstream from wastewater treatment plants around the world.
Even species in the remotest regions of the planet are suffering serious chemical contamination. A female orca carcass that washed up on a beach in Scotland in 2017 was found to have “shocking” levels of PCBs. Scientists who examined the whale’s ovaries say she had never been reproductively active, though she was at least 20 years old. Orcas usually start mating at 14.
It’s hard to argue that these reproductive impacts to insects and other animals are due to diet, obesity, or lifestyle choices (which Geoffrey Kabat implies might be largely to blame for falling human sperm counts). Rather, for most humans and other animals that are affected, the obvious and likely culprit, once again, is toxic hormone-mimicking chemicals dispersed throughout the environment.
Death Spiral
The fact that both human sperm count and insect biomass are estimated to be declining at about 2 percent per year may be just a numerical coincidence. Nevertheless, it’s a number that should grab our attention. It may help to visualize what such a decline looks like over time:
Unless the chemical load on the environment is radically reduced, and soon, the stakes may be existential. If sexually reproducing animals, including humans, lose the ability to yield offspring, then in the future the biosphere may host a radically reduced roster of higher life forms.
Meanwhile, we humans must come to terms with a confusing reality in which we face the seemingly contradictory risks of both overpopulation, which is contributing to environmental ruin, and a population crash due to chemical-induced reproductive problems. It’s easy to dismiss one by pointing to the other, but we must somehow grapple with both. The outcomes for all life on Earth will be far better if we support reproductive choice and education for women, and ban phthalates and other toxic chemicals.
Unless the chemical load on the environment is radically reduced, and soon, the stakes may be existential.
Meanwhile, the public should be warned more explicitly and urgently about the perils of chemical exposure, and provided with information about the products most likely implicated.
With regard to climate change one often hears the refrain, “We don’t need to ‘save the planet’; the Earth will be fine, it’s just humans that will suffer.” In reality, some environmental trends now in motion, including the widespread release of endocrine disrupting chemicals, are imperiling all of nature. Are rubber duckies and other plastic crap, overly manicured lawns, throw-away packaging material, and cheap cookware really worth that level of risk?
"When you burn people's belongings, vehicles, and boats, we don't necessarily have a good understanding of what those chemicals are," said one expert.
Scientists and health officials in Maui County, Hawaii on Monday urged residents to stay away from the island's western coast if possible to avoid exposure to potential toxins that may have been released following the wildfire that killed at least 96 people and destroyed the historic town of Lahaina.
Officials have not determined exactly what toxins were released as last Tuesday's fire tore through the island and exposed an estimated 86% of Maui's 2,719 structures to the flames, but officials have taken note that a wide array of buildings and objects were burned by the fast-moving wildfire.
"When you burn people's belongings, vehicles, and boats, we don't necessarily have a good understanding of what those chemicals are," Andrew Whelton, director of Purdue University's Center for Plumbing Safety, told the Associated Press on Monday. "When much of that infrastructure burns, it's transformed into other materials that are never meant for human contact."
Hawaii state toxicologist Diana Felton is helping to assess the damage and told Hawaii Public Radio (HPR) on Saturday that the U.S. Environmental Protection Agency and other federal officials will work to remove propane tanks and other clear hazards from Lahaina and the surrounding area.
"It's going to be a long time" before the devastated town is safe for people without protective gear, she said.
On social media, Whelton said that based on previous fires and the toxins that have been released, authorities will need "at least three months, possibly longer," to remove wildfire debris and that soil testing will be needed afterward.
In addition to propane tanks—one of which created a cloud that looked like a "gigantic mushroom" when it exploded in the fire, as a resident told the AP—officials have raised alarm about lead paint and asbestos in the historic buildings that went up in flames, as well as arsenic, which was used in the last century as an herbicide on some sugar and pineapple plantations and may have been released when an estimated 2,170 acres burned last week.
At The Conversation, Whelton wrote Saturday that chemicals including benzene and polycyclic aromatic hydrocarbons are frequently detected in ash following large wildfires. Exposure to high levels of those toxins can cause nausea, vomiting, dizziness, rashes, and respiratory problems.
Whelton told the AP that anyone entering the area is advised to wear protective gear that covers their arms and legs as well as a well-fitting face mask such as an N95.
"If you go back into some zones even where maybe all the fires have been put out, you can then be really exposed," he said. "If there's dust and debris kicked up, you can get it in your eyes, on your hands, or you can inhale it."
The county issued an "unsafe water" alert for parts of Lahaina and the Kula district, warning that tap water could have contaminants even after being boiled. Residents who are not among the 46,000 people who fled the island should rely only on bottled water for cooking and drinking.
"Strange things can happen to the water," Felton told HPR. "I'm optimistic that the water system will be able to be restored, but until we have a better sense of how much, if any, contamination is present, we won't have a timeframe on that."
The safe drinking water branch of the Hawaii Department of Health told HPR that it's planning to conduct testing on drinking water across western Maui.
The Maui fire is just the latest to raise alarm about the after-effects of wildfires, which scientists say are becoming more common and harder to get under control due to environmental factors like dry vegetation and long droughts, driven by the climate crisis.
Earlier this year much of the eastern U.S. was placed under air quality alerts as smoke from wildfires in Canada drifted to the region, raising the risk of exposure to particulate matter pollution, which is linked to heart and lung disease.
One 2017 wildfire in Northern California, which destroyed about 1,200 structures, generated 300,000 tons of debris that included toxic levels of arsenic, cadmium, copper, lead, and mercury.
"In Maui, debris may have to be taken off the island for disposal," Whelton wrote.
Maui County Mayor Richard Bissen told residents in a press conference Saturday that at this point "it is not safe" to return to the parts of the island affected by the blaze.
"We're not doing anybody any favors by letting them back in there quickly, just so they can get sick," he said.
"It's stupefying that the last time the EPA updated its toxic pollutant list, the 8-track was considered an advanced technology and Gerald Ford was president," said one group.
According to the U.S. Environmental Protection Agency's official documentation, no toxic pollutants have emerged in the United States in nearly five decades—and two advocacy groups on Monday demanded that the agency add more than 1,000 chemicals to its list to bring the inventory up to date.
Northwest Environmental Advocates (NWEA) and the Center for Biological Diversity (CBD) filed a formal legal petition with a list of industrial and commercial pollutants—many of which have been outlawed in other countries—that they want the EPA to formally acknowledge as toxic.
Per- and polyfluoroalkyl substances (PFAS)—also known as forever chemicals because they break down very slowly and have been found in human breastmilk, the summit of Mount Everest, and 97% of U.S. blood samples in one study—are among the substances that have been left off the EPA's inventory so far, even as they have gained wide recognition as a public health threat in recent years.
The EPA currently recognizes PFAS as "nonconventional," but not as toxic, "resulting in no regulation under water quality-based permitting," according to the groups.
Hannah Connor, environmental health deputy director at CBD, accused the EPA of "acting like we're frozen in the '70s."
"It's stupefying that the last time the EPA updated its toxic pollutant list, the 8-track was considered an advanced technology and Gerald Ford was president," said Connor. "Our world has changed dramatically over the past 50 years... The agency has turned its back on the deluge of new, dangerously toxic pollutants that have poisoned our waterways and permeated our lives."
The groups noted that a number of pollutants on their list of more than 1,000 omissions have been banned in other countries.
More than 35 governments including the European Union have outlawed the herbicide atrazine, which is linked to an increased risk of cancer and reproductive issues and has been found to "chemically castrate male frogs" at concentrations currently allowed in U.S. drinking water.
Despite the risks it carries, atrazine is the second-most used weed killer in the country.
"Where has the EPA been for the last half-century?" asked Nina Bell, executive director of NWEA.
In a statement, Bell called on the agency to "grant our petition and launch itself firmly into the science of the 21st century."
"For nearly 50 years, EPA has been ignoring the growing mountain of science about the more than 1,000 unregulated toxic chemicals contaminating our rivers and drinking water, at a tremendous cost to human health and the environment," said Bell. "The American people count on EPA to keep our drinking water clean, remedy environmental injustice, and protect fish and marine mammals from toxic pollution, but the agency has betrayed that public trust."
The EPA's toxic pollutant list was created in 1976 as the result of litigation. It was incorporated into the Clean Water Act the following year, and Congress ordered the agency to update the list over time as new data about toxins became available.
"Congress has repeatedly exhorted EPA and the states to move swiftly to improve and carry out regulatory programs to keep toxic pollutants out of the nation's waters," wrote the two groups to the agency. "Instead, EPA's program has become obsolete, languishing for decades and in many instances without any improvements."
Adding toxins to the list "is an essential first step to enable EPA to meet its statutory duties to update and adopt new requirements to control the discharge of these pollutants," they added.
Other toxins that have not been added to the list include nonylphenols, which are endocrine disruptors and have been banned by the E.U. while being "virtually unregulated" in the U.S., and manganese, which is found in coal mine runoff and has been detected in high concentrations in low-income communities, particularly in Appalachia. Manganese is linked to impacts on memory, motor skills, and intellectual development.
The groups asked the EPA to establish a system for accepting proposed changes to the list every three year and to identify pollutants that are not susceptible to treatment and can pass into drinking water, including many named by CBD and NWEA in their petition.
They wrote that the petition gives the EPA an opportunity to update its toxic pollutant list and priority pollutant list, "to develop rules to ensure that the lists do not become outdated again in the future, and to bring the pretreatment program into the 21st century."

Officials in the city of Richmond, Indiana said Wednesday that a fire that broke out at a plastics facility Tuesday is expected to continue burning for several days, sending huge plumes of black smoke—that doubtlessly contain toxins—into the environment there.
Authorities have not released the name of the business owner or company, but The New York Times reported that the complex was formerly owned by Hoffco/Comet Industries, which produced garden and lawn motors before closing in 2009. The facility is now used to store large amounts of plastic for resale and recycling.
"The smoke is definitely toxic," said Indiana State Fire Marshal Steve Jones in a news briefing on Tuesday. "There is a host of different chemicals that plastics give off when they're on fire, and it's concerning."
About 2,000 people in a half-mile radius of the blaze were ordered to evacuate the area Tuesday, and officials don't know when the order will be lifted. The Richmond Community School District cancelled classes for the entire town on Wednesday.
The smoke was drifting toward the east and northeast on Tuesday, and Richmond residents whose homes are in the path of the smoke were advised to "shelter in place, turn off HVAC units, keep windows and doors closed, and bring pets inside."
The U.S. Environmental Protection Agency (EPA) and Indiana Department of Environmental Management began taking air samples in the area on Tuesday to help determine what toxins have been released from the fire.
Chemicals that can be released from plastic when it burns include dioxins, furans, mercury, and polychlorinated biphenyls (PCBs). Dioxins, furans, and PCBs have similar toxicity levels, according to the Centers for Disease Control and Prevention (CDC), which says that "people who have been unintentionally exposed to large amounts of these chemicals have developed a skin condition called chloracne, liver problems, and elevated blood lipids."
Animals exposed to the chemicals in lab studies have developed cancers and reproductive problems.
Exposure to high amounts of mercury can rapidly cause serious lung damage, and low concentrations can cause "neurological disturbances, memory problems, skin rash, and kidney abnormalities," according to the CDC.
Richmond Fire Chief Tim Brown told CNN that firefighters who arrived at the scene Tuesday afternoon found a semitrailer behind the facility engulfed in flames that spread to piles of plastic on the property and to several buildings in the 14-acre complex.
"We knew it wasn't a matter of if, it was a matter of when this was going to happen," he said at the press briefing.
Richmond Mayor Dave Snow told the Associated Press that the owner had been "under a city order to clean up and remediate that site," but had not obeyed the order.
Philadelphia Inquirer columnist Will Bunch argued that the disaster would not have happened without the fossil fuel industry "foisting plastics on the world as its 'Plan B' to sustain its profitability."
"Worldwide production of plastic has nearly doubled since the start of the 21st century, as oil and gas giants look for profitable uses of their fossil fuels while a climate-change-weary world looks increasingly to transition toward wind or solar power or electric cars," Bunch wrote late last month after several environmental disasters threatened drinking water and the environment in communities across Pennsylvania.
"I've had fear and now this just put the anxiety over the top," said one local resident.
The collapse Friday night of a makeshift dam designed to hold back wastewater and new concerns by local groups and residents about the nearby incineration of contaminated soil from last month's train derailment are the latest anxiety-producing woes to beset the community of East Palestine, Ohio.
Watchdogs on the ground reported that the dam broke after heavy rains in the area on Friday.
According to local Channel 19 News:
Residents tell 19 News heavy rain has caused Leslie Run Creek to rise, and spill over the makeshift dam, near the derailment sight. 19 News was able to obtain several photos of water from that manmade dam covering the Main Street area of town.
Residents fear the contaminated water may seep into homes or businesses—causing another level of fear for those who live in the area.
Local resident Eric Cozza told the news outlet he was scared of what the released waters could do to the community. "I fear that now the chemical is in the ground, it's going to leech towards the water ducts, our aquifer for drinking water," Cozza said. "I'm concerned that the park is now contaminated. Kids won't be able to play there or walk through there on their way to school."
Status Coup News, which has been reporting from East Palestine and speaking with residents since the disaster occurred, reported Friday night that flooding from the breached dam was going "into The Original Roadhouse restaurant parking lot where a lot of locals eat and drink."
The outlet also reported that the pictures of the broken dam posted to social media were taken by local resident Neko Figley, who was told by contractors to leave the area because it was "super dangerous to be here right now.”
River Valley Organizing, a multi-racial, working-class group active in the Ohio River Valley region, said in a statement Friday that residents of East Palestine are still being ignored a month after 38 rail cars of a Norfolk Southern train went off the tracks on February 3.
"It's been one month since our lives were turned upside down," the group said, "but we still aren't getting what we need from the government or Norfolk Southern. We heard the people of this community loud and clear: they want safe homes, and independent environmental and health testing—now."
On Saturday, The Guardian reported on fresh fears over the incineration of contaminated soil that was taken from the crash site, not least because one of the nearby facilities where the material is being taken has a history of EPA violations. According to the Guardian:
The new plan is "horrifying," said Kyla Bennett, a former [EPA] official now with the Public Employees for Environmental Responsibility non-profit. She is one among a number of public health advocates and local residents who have slammed Norfolk Southern and state and federal officials over the decision. [...]
Incinerating the soil is especially risky because some of the contaminants that residents and independent chemical experts fear is in the waste, like dioxins and PFAS, haven't been tested for by the EPA, and they do not incinerate easily, or cannot be incinerated.
"Why on earth would you take this already dramatically overburdened community and ship this stuff a few miles away only to have it deposited right back where it came from?" Bennett asked.
She further told the Guardian that the "most important thing in my mind is the human health and health of the environment" and that burning this toxic material under such conditions flies "in the face of basic human decency and science."
Penn Future, a watchdog for air and water quality in neighboring Pennsylvania, said the incineration plans are very worrying.
"The plan to incinerate dioxin and PFAS contaminated soil from Norfolk Southern's toxic spill deeply troubles us and will continue to build distrust and anxiety," the group said. "It's not clear the plan will work and puts communities down wind at risk of contamination."
According to an update from the office of Ohio's Republican Gov. Mike DeWine, the Ohio EPA has reported that approximately 1,700 tons of solid waste have been removed from the disaster site in East Palestine as of Friday.
Of that waste, reports The Chronicle-Telegram, 660 tons has gone to Heritage Thermal Services—the company with a litany of past violations—in East Liverpool, Ohio, which is in Columbiana County not far from East Palestine. Another 190 tons was hauled to the Giles incinerator for in-state burning and 880 tons of the solid waste was shipped out of state to landfills in Michigan and Indiana.
Meanwhile, 3.2 million gallons of liquid wastewater have been collected in the area with the large majority going out of state, to facilities in Michigan and Texas, for deep-well injection.
Amanda Kiger, director of River Valley Organizing, said one of her concerns was the incineration of toxin-laden materials so close to the residents still reeling in East Palestine.
EPA and other government officials, she told the Guardian, "are just dumping more shit on Columbiana county,” Kiger said."They say, 'We already poisoned them so it doesn't matter if we poison them more.'"
As for Cozza, who spoke with 19 News about the dam breach and whose family has already been diagnosed with skin irritations, he said the odor of chemicals is now back in the area.
"I have fear," he said. "I've had fear and now this just put the anxiety over the top."
In a groundbreaking settlement (pdf) reached on Monday in a response to a suit brought by Columbia Riverkeeper, the U.S. Army Corps of Engineers agreed to finally be subject to federal oversight by the Environmental Protection Agency and to disclose the details of the pollutants it releases into two rivers in the Pacific Northwest.
"This is a huge day for clean water," said Brett VandenHeuvel, Columbia Riverkeeper's executive director. "For years, the dams have discharged harmful oil pollution into the Columbia and Snake rivers, and finally that will stop. With the dams coming into compliance with the Clean Water Act, hopefully we will see an end to toxic spills and chronic seepage of pollutants that have been harming our community."
The settlement could potentially impact how federal oversight of Army Corps dams is performed nationwide.
"Columbia Riverkeeper's settlement has implications for dams operating without pollution permits across the country," stated Melissa Powers, environmental law professor at Lewis and Clark Law School and expert in the federal Clean Water Act. "Like any industrial facility, dams are prohibited from discharging pollution until they obtain pollution permits."
While the Corps was already required to report spills that occurred, before the ruling it was not required to track the amount of oil going into the water as part of its regular operations, nor did it give information to outside groups concerning how much oil was generally going into the water.
The Corps had previously claimed in letters to state agencies that the EPA did not have the authority to regulate it.
According to the AP "the EPA had the authority to regulate the dams' pollution before the settlement, but it could not compel the Corps to file for a pollution permit."
Now the Corps will regularly notify Columbia Riverkeeper concerning daily discharges from a total of eight dams into both the Snake River and the Columbia River, and is required to apply for EPA pollution permits within the year. The settlement will also "require the Corps to use environmentally-friendly oils, such as biodegradable oils, if it's feasible," according to VandenHeuvel.
In 2009 the EPA found a number of harmful toxins in fish in the Columbia River, most notably PCBs, a potentially carcinogenic synthetic that was banned from production in the U.S. in 1979.
The Army Corps of Engineers is the largest owner-operator of dams in the country.
