Strip-Searches: Obama Wants You to Bend Over (Or Squat) and Spread ‘Em
Humiliation is the law of the land. When you fall into the clutches of the police, for any reason, or no good reason at all, you can be compelled to bare your private parts before being placed in the general jail population. Five of the nine U.S. Supreme Court justices ruled that Constitutional prohibitions against unreasonable searches end at the jailhouse door, even if there is no reason to suspect that the person under arrest is in possession of anything that could be called contraband.
The decision throws out laws against unreasonable strip searches in at least ten states, and overrides federal law enforcement regulations against intrusive searches. The High Court decision also flies in the face of international human rights treaties to which the United States is a signatory. In effect, the Supreme Court majority ruled that the whim of the local jailer trumps any standard of reasonableness. The American Correctional Association, which represents jail guards, is pleased that its members now have the “flexibility” to look into virtually every human orifice that enters their domain, even though the association’s own standards currently discourage blanket policies of strip-searching everyone.
The casual observer might conclude that the ruling is more evidence of a rightwing court on the warpath against what remains of the Bill of Rights. But, on this issue, the Obama administration is marching in lock step with the High Court’s rightwing majority. U.S. Justice Department lawyers spoke and filed briefs in favor of blanket strip searches. Indeed, the oral argument put forward by Obama’s lawyer was, perhaps, the most curious of all. Most of the discussion about the smuggling of contraband into jail settings involves drugs or crude weapons and other petty criminal concerns – the day-to-day stuff of life in a jail. But the administration’s lawyer chose to use hypothetical political protesters as the bad guys of his argument. In this weird scenario, a protester with a gun, traveling in a car that was about to stopped by police, would hide the gun on his person in hopes of avoiding a pat-down search, and then bring the gun into the jail when he is arrested – presumably for some minor offense connected to the demonstration.
This is quite strange reasoning, and shows what kinds of conversations the Obama folks are having at the Justice Department. Crushing political dissent, not safety in jails, is what motivates the Obama administration to ally itself with the most reactionary wing of the Republican-dominated U.S. Supreme Court. The Left is not paranoid; the Obama administration really is preparing its legal arsenal to smash dissent in the United States. They are getting ready for a “full spectrum” assault on civil and political freedoms, ranging from the big hammer, suspension of all due process through preventive detention, to the intimately chilling effect on potential protesters of knowing that Uncle Sam wants to look into all of your bodily cavities if you get arrested at a demonstration.
Obama’s lawyer was not talking off-the-cuff before the U.S. Supreme Court. This administration is obsessed with political protesters. They want you to bend over, and spread ‘em – literally and politically.

Not one crimminal indictment or prosecution of any Wall Street Huckster/Bankster by Obama's Eric Holder...But they are busy finding ways of looking up innocent peoples asses..What kind of LUNACY have we elected here????
Stub:
I think you coined the adage via your own post:
Historians will look to this era as The Phase of Assinine Justice (instead of, say, a chicken in every pot.)
I like it SR!!! {and most appropriate}
I know that this has everything to do with discouraging OWS, but I honestly feel that Obama and company along with the 5 stooges on the SCOTUS should be more concerned with getting their heads out of their own asses-Please pardon my language but just had to tell it as i see it...."Phase of Assinine Justice Indeed!!!!
But you know Sioux, this really, really tells me that OWS has them worried to the point of becoming small and assinine, and that is somewhat of A trade off type victory!!! LONG LIVE OWS!!!!
RE:
SR: "Is there a cartoonist in the house? Someone needs to sketch something along these lines to really show this "law" for what it is, or how it can be soon abused."
I am strongly considering sending this to "Mr Fish"-If anyone can get this one rolling into A graphic cartoon production, I think he is the one....
"The Phase of Assinine Justice"
Heh. That's funny. Good one Sioux.
I have a saying, El Mysterio... that every Leo woman is 1/3rd Luceille Ball (our comical side), 1/3rd Madame Blavatsky (our mystical side), and 1/3rd Mae West (our sexy side). I see you gravitate to the Lucy part most. That's Okay. Different strokes for different folks. Don't forget, only the FOOL can tell the king/dom the Truth... and that's the ideal I answer to.
Stub: Feel free to pass it onto Mr. Fish. I have some other good ones I tried to promote years ago, but they got no where.
My favorite one has a woman being burned as a witch in the foreground, with the town's people gathered to watch (that era's version of Reality T.V). As a spoof on the self-help legion of Calvinist retakes that pass for Psychology Today, two women in the viewing audience share a comment. And the cartoon's caption reads:
"Do you think she had a problem with self-esteem?"
That's my thumb-nail sketch of all the ATTEMPTS by mainstream media and its experts to make all the unfair trade policies, socially-engineered caste system, lack of privilege and access into a FLAW in the individual. My noticing how this insidious blame-the-victim dynamic works explains my impatience with those in the forum who either reinforce this meme because they are Left posers; or they otherwise have inadvertently internalized the language of the dominant culture and regurgitate its insidious self-fulfilling narratives. As in ad nauseum.
A picture can indeed tell 1000 words.
SR: Done deal-I copied and pasted the article with the post so as not to claim credit for your works..I hope he follows through...I even stated that it would be A plug for OWS to my way of thinking..I also related that Michael Moore suggested that some good satire and humor would be tools that would help OWS in his "Unrigging the System" recent speech....
Maybe you should submit that one to Mr. Fish-Sounds like A ringer to me...
About witches, what is your take on Ergot mold on Rye as A possible exlanation of some cases on the insanity of burning witches???
More and more are awakening to find the obomber admin IS a reactionary right wing bunch of fascists at war with humanity ! Sadly there are still lots of obomber bots !
Is there a cartoonist in the house? Someone needs to sketch something along these lines to really show this "law" for what it is, or how it can be soon abused.
Based on the concept of "racial profiling" as faux cause to stop drivers in certain (overtly racist) communities, in this case we'd see Highway Patrol making it a point to stop young, busty blonde female drivers...
In a nation where Porn is a huge selling item, where torture photos taken from Guantanamo involve scenes of sexual humiliation, and where airport security agents now routinely look at naked X-ray scans... here local police departments can enjoy all the benefits of a Playboy centerfold without having to leave the office/station!
What a country.
Ted Rall is a cartoonist!
I know that, as I get older, anybody invading my rear is likely to encounter Farts of Fury. Perhaps, like Le Petomane, we can train to break wind at will.
That'd get you beat... but it's probably worth it.
As long as you don't wind up like that poor Jamaican fellow in NYC A few years back who got sodomized with A night stick and was damaged to the point of hospitalization...What A bunch of perverted people some cops are...
Torture before jail via pepper spray, beatings, "flash bang" grenades, then torture by the jailer... poking, probing, humiliating, freezing. This is definitely being put in place to terrify would be dissidents, but this will never stop us!
Those five justices should be stripped, tarred and feathered!
Death to the banksters and their political lackies!
No surprise for me. If you look at the executive orders written during the last 30 plus years, you will see they knew Merikans would reach the boiling point and steps were made for these reasons.
Merikans freely gave up their Rights to the TSA too.
Anyone still think the Fema camps are CT?

With two conventions coming up and with this mind set, we can expect a huge amount of police brutality before November. I imagine Obama's undercover agents in OWS will carry guns and we will see some set pieces designed to destroy the credibility of OWS.
Well we do know that the authorities have employed agent provocateurs in the past. I'm sure you've all seen the video of them being outed as cops at Montebello Québec. If not, here it is:

As well, an excellent article about police agent provocateurs at the G20 in Toronto by GlobalResearch:

OWS y mas,
The simmering pot is ready to boil over, fueled by crimes against the People ! The fascist amerikan empire fears more than OWS; they fear open Rebellion ! Get ready, it wont be long now.
There's seemingly no end to the sickness perpetrated by the mass murdering psycho's running this demented empire. Go figure...
I don't think the SC ruling specifically nulled the laws limiting these searches in ten states - those laws still hold - rather the SC held that there is no constitutional basis for requiring limits. So the option to strip search has been given legal cover.
It's probably safe to assume that this option will be used against persons exercising first amendment rights. It was a terrible ruling, and commentators have noticed that Justice Kennedy never attempted a constitutional argument (i.e how this is not contrary to the fourth amendment), or acknowledged that the the ruling completely inverts the Bill of Rights. Even more disturbing, the military and intelligence community have known for decades that techniques of forced nudity have a powerful psychological effect on detainees. Much of the scientific observation which led to these understandings was developed by the Nazis, who routinely used forced nudity when processing civilians. That the US government is determined to make these techniques routine is a horrendous development.

Well considering that the elite in the US were huge fans of the Nazi party in the 1930's, one could assume that sentiment would persist in certain circles. Do you not recall the fascist plot against FDR? The underlying fascist tendencies have been there among the elite for a long time and now, since the population is totally cowed, they are able to act upon them.
There is a remedy to alleviate stage fright when giving speeches, where you imagine members of your audience naked. Clearly prison officers will feel empowered by having their prisoners naked.
I love Glen Ford! As i have mentioned here in the past, he was my solace on the day after Obama was elected and the world (including CD i may add), was celebrating the new saviour and chief. I found his site and was grateful that he saw things much the way i did. We corresponded all morning. I told him i felt uncomfortable in a way, since i am a 'white' female, so perhaps i didn't have the 'right' to 'see' what i was seeing and sense what i had been sensing. And he assured me that i was right on target and that i had no need to feel badly about it at all.......I have never been so sorry to have been so right.
First they came for Bradley Manning - then they came for us.....
Had enough yet????? Still glad you voted R or D???
People get the government they vote for.
Vote NADER 2012
"The Hangman"....Appropriate words RJ and something that is quickly becoming A reallity..We won't even know what we had before they come kicking our doors down....
I hope enough people wake up and realize that the nightmare is soon to be visited on us all...
Well, there was one presidential candidate who talked about civil liberities.
I'm very sorry the Left did not, at least, support him in the primaries; despite the fears, among some, that his was a bogus pitch to divide the Left. Maybe Obama would not be quite so bold if there had been more discussion about this a few months ago, when it mattered. And speaking of a shill to sucker the Left.....
And those who think universal heath care or abortion rights are more important than the rule of law, are in for a sad awakening. Sometimes you have to have priorities.
Sorry, my last rant on the subject unless someone else brings it up.
Glen, dear brother, democracy is not a list of offerings, democracy is a list of demands - and there isn't even any possibility do make one.
NATIONAL PETITION TO PASS THE DUE PROCESS GUARANTEE ACT AND REPEAL THE NDAA
We need one million signatures to sway members of Congress.. It is an election year, so this might do it. Here is the petition. Please circulate it. Many thanks

The whole "justice system" in the USA is "assinine". Why does the law need to intervene in people's private lives because a drug has been declared illegal and therefore a war must be waged on any user of it? The US has such extreme definitions of crimes, so that real criminals rule the country while millions cost a fortune to incarcerate for "crimes" which hurt nobody. Prisons, pornography, pentagon seem to be the jobs available, and the POTUS and SCOTUS (sounds a bit like scrotum!) care not at all about real human beings.
Good story from what's been solid source for progressives!
They'll be a lot of heated protest about this which will lead to a compromise solution, Installation of full body scanners in the jails. Chetoff is heavily invested in this industry.
Jails are a huge untapped market for his product!

Great Dave Lindorff article on the subject:

Glen Ford
You're simply the best -- BRAVO!
This is one of your most biting, visceral, and incisive pieces to date, and I want to thank you and your fellow writers and activists and commentators at Black Agenda Report for your great work at this pivotal time when your voices and critical analysis are needed more than ever. I've linked to this piece more than once in recent days in various threads at CD, because nobody has expressed the outrage that inheres in this latest travesty of justice better than you have done.
Also, thanks to the great Paul Street, whose first book, Barack Obama and the Future of American Politics (2008), made it impossible to harbor any illusuions about Mr. Hopey Changey, and his second book, The Empire's New Clothes: Barack Obama in the Real World of Power (2010), which only serves to validate the thesis of the first book regarding what to expect from the profundly conservative politician who is now the First Black President of the United States.
That said, just when you think things can't get any worse....
