Silencing Occupy: Big Protests Are Planned. Will Suppression Follow?
Get ready for the protests. Get ready for the warm American spring — and maybe a hot summer and fall. Vast economic inequality has not disappeared and, in a presidential election year, the supremacy of money in politics will be extravagantly displayed.

But if you protest, also get ready for "free-speech zones," "pop-up" restricted areas, National Special Security Events, and — with the signing on March 8 by President Barack Obama of HR 347 — a suddenly sharper federal anti-protest law. Despite American constitutional rights to speak freely, to assemble, and to petition for redress of grievances, suppression of protest is just as American.
HR 347's title, the Federal Restricted Buildings and Grounds Improvement Act of 2011, suggests court-house landscaping, but its true impact cuts much deeper. Without debate, it flew through the Senate with unanimous consent. In the House, only three members voted against it, all Republican, most notably presidential candidate Ron Paul. The brief debate featured jokes about the Super Bowl.
But after its February passage, HR 347 caught the attention of lefty and libertarian bloggers. They saw it as the end of the right to protest and the beginning of outright fascism — with Occupy in its crosshairs. Their reaction reflects a political atmosphere in which the Obama administration is justifying assassinating American citizens without trial as a necessary part of the War on Terror.
The reality of HR 347 is more nuanced, say civil-liberties lawyers. Many months before Occupy Wall Street materialized, the bill had been introduced in Congress at the behest of the Secret Service, which protects the president, vice-president, and other dignitaries. And HR 347 doesn't make protest illegal. It just makes it riskier.
"Fairly histrionic," says Mara Verheyden-Hilliard, co-chair of the National Lawyers Guild Mass Defense Committee, of the blogs and e-mails she has seen on HR 347. Although she thinks "a significant crackdown" on dissent is taking place, a "crescendo of fear" is the last thing that should happen because of HR 347. "People should be in the streets."
What's important to know, Verheyden-Hilliard says, is that HR 347 only makes worse "a terrible law" — Section 1752 of Title 18 of the United States Code. It's been around since 1971 and was strengthened in 2006.
Section 1752 prohibits people from "restricted" areas around the president, vice-president, and anyone else protected by the Secret Service. These other protectees — including presidential candidates, former presidents, and foreign heads of state — are common protest targets. The law also can be used at "special" national events like presidential nominating conventions. Violators could get a year in jail, 10 years if a weapon is involved.
Gabe Rottman, a Washington attorney for the American Civil Liberties Union, says HR 347's most important provision makes it easier to prosecute protesters. Formerly, to be convicted of being in, or blocking the access to, a Secret Service–restricted area, or of engaging in "disorderly or disruptive conduct" inside or in "proximity" to a restricted area (or conspiring to do these things), the person had to do it "willfully and knowingly."
Now, it's only necessary to prove that the individual did it "knowingly" — that is, that the person knew she or he was in a restricted area, even if the person didn't know it was illegal to be there.
Although a spokesman for the Secret Service wouldn't comment to the Phoenix on the elimination of "willfully" in HR 347, he says the new law represents only "a technical change."
Protest Pens and National Special Security Events
How bad the amended Section 1752 is, of course, depends on how it's enforced. Occupy Boston activist-attorney Deborah Butler is struck by the "deliberately ambiguous" language in the law, which allows for "selective enforcement."
"Disrupt the orderly conduct of government business." Is being noisy disruptive, she asks? "Proximity." "Is that 15 feet or 50 feet? Or so close that we can hear you?" And conspiring to do something also can be very ambiguous.
These aren't academic questions. Butler recalls demonstrating at a New Hampshire Republican presidential primary debate in January when the 500 protesters — including a 12-piece marching band — were herded into a "protest pen" in a back parking lot far from the candidates.
In an Orwellian phrasing, the authorities call protest pens "free-speech zones," though they often are far from the news media as well as the objects of the protest. Butler calls them "unfree-speech zones of temporary incarceration."
Protest pens and restricted areas aren't only used where the Secret Service is present. Local police, using trespass or disorderly-conduct laws, commonly use them to restrict protests. And they can be instant and unadvertised, in which case they are known as "pop-up" restricted zones.
On October 1 in New York, 700 Occupy Wall Street marchers on the Brooklyn Bridge were herded into buses and taken to jail. Many said they had been led onto the roadway by the police and then arrested. Verheyden-Hilliard, who is legal director of the Partnership for Civil Justice Fund in Washington, is suing the city on their behalf. Nationally, more than 6700 people have been arrested in Occupy actions since last September.
The big protest targets this year — like the Group of Eight (G-8) and NATO meetings and the presidential conventions — are likely to see the greatest use of protest pens and pop-up restricted areas. Such big events are usually designated National Special Security Events (NSSEs) by the Secretary of Homeland Security, the Secret Service's boss.
The ACLU's Rottman says Homeland Security has huge discretion in designating NSSEs. And the restrictions of the newly revised Section 1752 anti-protest law apply to these events regardless of whether a Secret Service–protected dignitary is present. In fact, every Super Bowl since 9/11 has been declared an NSSE.
Here come the people
As the weather warms up, big and small protests — not just Occupy re-encampments — are being planned and already are taking place. Occupy Boston has called for a "national day of action" on April 4 to support public transportation. Occupy Providence recently demonstrated for a financial transactions tax. Occupy Augusta protested outside the offices of Maine's most prominent corporate lobbyists.
Nationally, Occupy Chicago is celebrating after forcing the May 18-19 G-8 summit to be abruptly switched to Camp David, the president's wooded Maryland retreat, in order to minimize the protests. But Chicago's May 20-21 NATO meeting still gives activists a big bull's-eye.
In what could herald a dramatic turn toward radical action within the progressive mainstream, moveon.org and the 99% Spring coalition of more than 50 groups, including big unions like the United Auto Workers, have announced they will train 100,000 people in direct action and nonviolent civil disobedience.
Training sessions will take place at 550 locations around the country beginning April 9. The coalition's first big protests will be on Tax Day, April 15.
Occupy provided the inspiration. Jeff Hauser, a spokesman in Washington for the AFL-CIO, a 99% Spring coalition member, says the labor movement has been "extraordinarily impressed by Occupy." John Cavanagh, director of Washington's Institute for Policy Studies, says of 99% Spring, "We're building a new infrastructure of the progressive movement."
Potentially, 2012's biggest protest targets are the national presidential nominating conventions — August 27-30, in Tampa, Florida, for the Republicans; September 3-6, in Charlotte, North Carolina, for the Democrats. Congress has appropriated $50 million for security for each convention.

Show AllThe Congress of the United States has shredded our Constitution and flushed the bits into the toilet. The elected Representatives who made an oath to uphold the Constitution must be charged with TREASON for voting to delete our Constitutional rights. Treason is "any betrayal of trust or confidence" (American Heritage Dictionary of the English Language). The movement of our nation from democracy to fascism is evident by the vote for the Patriot Act, the NSAA 2012 and HR 347. These laws are aimed at Occupy and our rights to peacefully assemble and to petition the government for redress of grievances.
Members of Congress have voted to fund the endless and expanding wars. They have not voted for a health care system for all of us without the controlling profit motive of the insurance companies. Congress votes massive cuts in the tax rates of the very wealthy while not voting for funds to put people to work when so much is needed to be done. The whole infrastructure is crumbling while Congress heeds the voice of their contributors over the concerns of their constituents. This is not a matter of Democrats or Republicans. The two (or is it really only one?) Corporate parties must be tossed out of our government.
Don't send these corrupt, unethical, immoral greedy people back for another term. Don't worry about the replacement being bad too---we can kick that one out too. Let's not vote for the lesser evil. Let's try to get something better!
Although Congress has "appropriated $50 million for each convention", there is no limit to how much money will actually be made available for "security".

The mayor of St. Paul agreed to let our city host the 2008 Republican convention on the condition that the Republican Party purchase a policy insuring the city against claims filed by demonstrators or others who had been mistreated by police or federal officers. Our sheriff (replaced at the next election) and the 3,000 imported cops arrested over 800 persons, charged 48 or 49, and took a few to trial. I believe we needed the whole amount. Charlotte and Miami should do the same.
Local police departments all over America have been militarized and the enemy is US, ordinary citizens who may happen to disagree with governmental policies or who happen to be in the wrong place at the wrong time. This is nothing short of paranoia and gets worse every day -- including the announcement a few days ago of a new crowd control that can shoot microwaves at a "troublemaker" from blocks away. It makes your skin feel as if it is on fire, and who knows what it might do to eyeballs.

the implication here is that suggesting the US has become authoritarian bordering on corporate fascism, where representative government has become a sham perpetuated by hidden elite interests, is hyperbole.
isn't this merely a matter of nuanced definitions of authoritarianism at this point ?
your electronic correspondence can be monitored w/ out judicial oversight, your phone is tapped, your neighborhood is under increasing police surveillance (including drones at this point), the military can/is participating with local law enforcement, groups that articulate public displeasure with the status quo can be/are defined as terrorist organizations, both political parties in the US (composing 533 of 535 seats) are beholden to the same corporate interests (same politicians who vote for these negations of civil liberties - h347,ndaa,patriot act), the corporate MIC program is assassinating political opponents around the world and conducting 2 illegal military occupations.
sure, H347 - restricting access to places where secret service is present, and expanding the purview of the secret service (ss) - is just one serious breach of the rights enshrouded in the first amendment.
the right to assemble to address grievances is critical for a functioning democracy to exist.any restriction of this right should be suspect. however, placing the 'trespass bill' in the context of other abridgments of civil liberties leads a person towards using language such as authoritarianism and fascism (especially in the context of corporations internecine relationship w/ government).
the call to action by the afl-cio and the renewed call to action by occupy activists this spring is encouraging. the political culture of america (R's and D's across the US) is never going to resolve the political crises that confront us as a people. we must - despite the risks - take our demands into the streets. we can plea for mercy (and we should continue to sign petitions and express angst w/ politicians) until we're blue in the face - and they still will proceed w/ operation destroy the earth and enslave the people. it's their modus operandi - steal, murder and enslave (ever closely examine a dollar bill ?)
there are many functional models of governance that have emerged from the depths in the past 250 years. perhaps we - as a people - should find one and try a new experiment.
p.s. - private cops and free speech zones... sounds like eternal the war on the poor..

Subsection (a)(4) of HR 347 allows arrests even when the protestors had no idea they were in a restricted building or on restricted property:
‘‘(4) knowingly engages in any act of physical violence against any person or property in any restricted building or grounds;
"or attempts or conspires to do so, shall be punished as provided
in subsection (b)."
The "knowingly" in this subsection modifies "engages in any act of physical violence against any person or property." But it does not modify "in any restricted building or grounds."
And "ANY act of physical violence" leaves a lot of room for interpretation.

Rhetorical question. You *did* see the US Military public rollout of the microwave 'Pain Ray' (Active Denial System - Also known as MADS: Microwave Area Denial System), during which they touted it's impending use for 'crowd control'.
Count on these weapons of collective punishment, along with the LRAD (Long Range Acoustic Device) to be used with an increasingly free hand in the coming months. Between PATRIOT ACT I & II, NDAA and HR347, and rampant Police surveillance and intimidation of Occupy organizers, dissent has been criminalized in the US, and Democracy(tm) is deader than last Thanksgivings turkey.
FYI, the same lo-tech used for fouling tasers is just as good against the microwave death-beam! (wrap heavy "restruant grade" alluminum, or tin foil over a tee-shirt wind it around your body.. the heavy foil catches the taser spines and the foil shorts out the taser! the same can be said for radio-wave beams they resonate in the foil and around your body "insolated by the tee-shirt" rending the beams harmless!

All of those who will vote for obama be mindful that NDAA, HR347 and a raft of other constitution-busting laws have been either enforced more vigorously or signed into law since 2009. With our militarized police forces, protest could become quite bloody and the DOJ under holder will do nothing about it.

Where have you been during the massive suppression of the Occupies, the railroading of Bradley Manning, the suspension of the Constitution in Muslim neighborhoods, the suspension of the Constitution in minority neighborhoods, the historic misuse of the Espionage Act, Guantanamo, the treatment of immigrants, etc., etc., etc.?

Let's cut to the chase here. As I wrote so long ago, the so called Patriot Act is mis-named, illegal and unconstitutional!
We are, or used to be, governed by the Constitution of the United States and its first ten amendments, usually referred to as the Bill of Rights.
That Constitution cannot be changed by legislative or executive fiat! There is a means of changing the Constitution, which is spelled out in the document itself. The only way the Patriot Act could be a legal, binding document would be if an amendment to the Constitution were proposed, wherein We the People gave up the protections of the Constitution and passed all authority to the government, reserving none for ourselves. That would have to be ratified by 3/4ths of the population to become law.
Every time I see one of these endless discussions about the effect of the latest use of the Patriot Act, I wait for someone who has read the Constitution and Bill of Rights and really understands it to declare the Patriot Act illegal, rip it up, and return the Constitution to the Halls of Government, intact and functioning. I don't even see that mentioned, but it would certainly sever the Gordian Knot which has been used for over a decade to subjugate and render powerless, the American People.
Unfortunately, the Legislators, the Executive, the Judiciary, and the merchants of greed and death in the MICC really enjoy this illusory power and will do anything to perpetuate it, and denigrate the Constitution they have sworn to protect and defend.
This is the oath sworn by every Senator and Congressman when they are sworn in, and at the start of each session:
I do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter: So help me God.
The President takes an even briefer vow:
I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my Ability, preserve, protect and defend the Constitution of the United States.
The Constitution is not a "quaint document made by a bunch of people a couple of hundred years ago." Rather it is a carefully worded document intended to keep American Citizens free from despotic power, which they had ample opportunity to experience as subjects of the Georgian Empire.
If you read the Bill of Rights carefully, you will note that it does not give us permission to do anything. It forbids the government from interfering with those rights!
Since that is exactly what the government is doing, using an illegal and unconstitutional document as its basis, the entire United States Government is an illegal, unconstitutional, enterprise and should be removed in favor of a constitutional government.
Sure "Constitution cannot be changed by legislative or executive fiat!" and three buildings in NYC can't fall straight into their basements in the same day!!! it beats the odds for commerical demolition companies!!!

Word of warning to protesters always move in groups of three or more, have the batteries in your cameras charged and and your attorney on speed dial. I suggest wearing a bandana around your neck or in your pocket to be repurposed if necessary to protect your eyes, nose and mouth. Carry at least one bottle of water with you, you never know when you'll have to rinse your eyes. Ear plugs are cheap and easy to carry and may save your ear drums. A note pad and pencil are great for documenting events as they happen. Keep an inventory of your personal effects in case they are confiscated and leave a copy of it with someone off site. I am sure others can add valuable tips.
And be sure to have your SS number tatooed on your forehead as a UPC. Makes herding easier.

Oh, I cant wait until the Conventions!! By then the frustration of being ignored by the powers that be will have stirred a lot of Americans to want something to take away at summer's end.
Disturbing that election process can only serve democracy, not hinder it.
Meanwhile, it is up to us, the 99% - don't forget the way it is SUPPOSED TO BE - we ARE the people, and government is there to serve the people. It is up to us to try to get it back. Stand up for "ourselves"!!
Otherwise, they will just take more and more... things will get WORSE until we stop the 1%.
Speaking of the 1% - they are so deluded that they need us to save them from themselves... they don't believe toxins cause cancer, for eg.., and the 1% makes up the bulk of AGW deniers. We can save them, they are people too, in a way...
It is important now that the people know where are political leaders are. We have to plant micro-chips into everyone who is in office. We need to know where they are at all times.. so we don't assemble near them of course. We need to know what they do, who they talk with, who the visit with late at night, who their bankers are, all the good stuff. If you are running for political office, then you are going to get micro-chipped.
