Bringing the 'Bush Six' to Justice
If those responsible for the Bush administration's torture policy will not face charges in the US, then in Spain it must be
Today, the Center for Constitutional Rights filed papers encouraging Judge Eloy Velasco and the Spanish national court to do what the United States will not: prosecute the "Bush Six". These are the former senior administration legal advisers, headed by then US Attorney General Alberto Gonzales, who violated international law by creating a legal framework that materially contributed to the torture of suspected terrorists at US-run facilities at Guantánamo and other overseas locations. 
Friday's filing provides Judge Velasco with the legal framework for the prosecution of government lawyers – a prosecution that last took place during the Nuremberg trials, when Nazi lawyers who provided cover for the Third Reich's war crimes and crimes against humanity were held accountable for their complicity.
CCR would prefer to see American cases tried in American courts. But we have joined the effort to pursue the Bush Six overseas because two successive American presidents have made it clear that there will be no justice for the architects of the US torture program, or any of their accomplices, on American soil.
Thanks to the US diplomatic cables recently released by WikiLeaks, we now know why seeking justice abroad has also been fraught with difficulty – why there have been so many delays and even dismissals. The same US government that will not pursue justice at home, not even when the CIA destroys 92 videotapes that show detainees being tortured, has put a heavy thumb on the scales of justice in other countries as well.
During the Bush presidency, the US intervened to derail the case of German citizen Khaled el-Masri, who was abducted by the CIA in 2003 and flown to Afghanistan for interrogation as part of the U.S. "extraordinary rendition" program—until they realized they had kidnapped the wrong man and dumped el-Masri on the side of an Albanian road. A leaked 2007 cable reveals the extent both of U.S. pressure and German collusion. In public, Munich prosecutors issued arrest warrants for 13 suspected CIA operatives while Angela Merkel's office called for an investigation. In private, the German justice ministry and foreign ministry both made it clear to the US that they were not interested in pursuing the case. Later that year, then Justice Minster Brigitte Zypries went public with her decision against attempting extradition, citing US refusal to arrest or hand over the agents.
Will this toxic combination of American pressure and a European ally's acquiescence derail justice in Spain, as well?
This 1 April 2009 cable, released 1 December 2010, shows Obama administration officials trying their best to stop the prosecution of the Bush Six. They fret that "the fact that this complaint targets former administration legal officials may reflect a 'stepping-stone' strategy designed to pave the way for complaints against even more senior officials" and bemoan Spain's "reputation for liberally invoking universal jurisdiction". Chief Prosecutor Javier Zaragoza reassures the US that while "in all likelihood he would have no option but to open a case", he does not "envision indictments or arrest warrants in the near future", and will "argue against the case being assigned to Garzon" (a notoriously tough judge, who has since been removed from the case).
Judge Velasco, who has since been assigned to the case, has been scrupulous in his oversight. The Spanish court has thrice asked the US, in accordance with international law, "whether the acts referred to in this complaint are or are not being investigated or prosecuted", and if so, "to identify the prosecuting authority and to inform this court of the specific procedure by which to refer the complaints for joinder". Of course, no response to any of these requests has been received, because the Obama administration has no intention whatsoever of pursuing justice on this matter.
Democracy demands a fully functioning legal system – one that does not bend to hidden pressures and political agendas. We have faith that Judge Velasco will justify the US officials' concerns about Spain's independent judiciary, and its respect for international law, and move forward with the Bush Six case.

Show AllI'd like to see action against some of the lower-level people, too: the federal prosecutors and other government counsel who knowingly hindered due process of law, in open defiance of their codes of professional responsibilty. These lawyers acted unethically, and the institutions of justice require that they be held to account for it.
No need to go after the "lower-level" people. Indicting the bosses would send a clear-enough message. Indicting lessers would eventually have most of government behind bars.
Wrong. The lack of prosecution of all players in Nixon, Ford, Carter, Reagan, Bush, Clinton, Bush the inferior and now Obama administration has led to criminals and their assistants showing up in the next administration their party wins with a brief and extremely lucrative private sector avalanche of cash (usually fake jobs or evil ones).
Right now we have war criminals and assistants from each party who have violated human rights in any way they please and are free and rich. They will be appointed to kill and maim. This is the chief reason every administration panders to the idiots while they trample the rights of the people and nothing changes.
I believe that had Nixon not been pardoned and had served time, we would not have had subsequent Presidents as such egregious law-breakers. Alas, the precedent has been set and no sitting President will ever "look backwards".
Torture is part of the core problem: "unnecessary wars.. based on a series of lies". Over a million people, mostly women and children, were killed in Iraq alone, according to the Lancet study.
We must arrest and severely punish all those who pushed and lied us into these unnecessary wars, or the serial criminals will do it again. Many of these unpunished criminals are even now actively pushing and manipulating the US into war on Iran.
Who among "we" will go into the halls of power and perp walk the Highs and Mightys while being sure that reading them their rights is documented?

If indeed, it comes to pass that these illegal inguisiters should be tried in Spain, what better place than the original Inquisition's home country.

For me, one of the most disgusting outcomes of the Obama presidency has been its insidious validation of Bush era crimes. During the last two years, our new American morality has been accredited and reinforced by presidential acts of commission and omission--each carefully calculated by Mr. Obama and his subordinates.
And what about those at the top--Bush, Cheney and now Obama???
I wonder how long the U.S. would deny trials to those Bush six if the rest of the world started joining Spain in calling for justice? I guess that would make Obama's decision easier.

I would like to encourage Spain to do what this country is too cowardly to do. Come over here and DEMAND that these scum be turned over to FACE JUSTICE. We in this country have NO justice system, anymore, when hedge fund managers get off for leaving the scene of a hit and run (nearly a deadly one, at that) because it would "hurt his ability to earn money" when those of us caught with a plant get 2 years of probation, drug tested incessantly, breathalyzered even though we AREN'T drinkers, made to pay thousands of dollars we DON'T have and not ONE thought given to OUR ability to earn ANY kind of a living afterward.

Bush & Company violated International Law... the International courts should pursue justice by any legal means.

Sounds like this applies to another attorney besides Yoo. Namely, Nancy Pelosi, who provided cover for Bush's war crimes when she said " impeachment was off the table" and refused to prosecute and impeach Bush for war crimes.
No wonder the USA will not be party to the International Criminal Court. No Mercan can ever be guilty of anything unless the US "justice" system deems it so.

If Bush et. al. were to be convicted of war crimes in this or some other country, it would be expected that the prosecutors would also press charges against Obama et. al. for directly commiting similar crimes and/or as accessories after the fact.

The "Bush Six", in my prosecutorial portfolio, should be George W. Bush, Dick Cheney, Donald Rumsfeld, Alberto Gonzales, John Yoo, and David Addington. This is three top civilian executive branch policy makers who conspired and manipulated classified national security information behind closed doors to create Gitmo, Abu Ghraib, and the global torture/enhanced interrogation system run by America's soldiers and spies, plus three top neocon lawyers who labored long and hard in secret to erect a facade of legalism as cover for the conspiracy.
Interestingly, it is Gonzales who wears two hats. As OLC legal advisor to President George W. Bush, in February of 2002 Gonzales and Addington dreamed up the "enemy combatant exception" to the Geneva Conventions POW protections, attempting to create a jurisdictional black hole at Guantanamo beyond the reach of international law, the US Constitution, habeas corpus, and federal anti-torture criminal statutes. He was rewarded for his loyal efforts by being elevated to be Attorney General for Bush's second term. From that position, he insured that the rule of law (as the unitary executive branch ideologues interpreted it) would shield the law breakers from prosecution not only for torture, but on the warrantless domestic NSA wiretapping project as well. Gonzales was first a lawyer-enabler like Addington and Yoo, and then later a key decision maker in carrying out and trying to cover up the conspiracy.
During the first six months of the Obama administration, Eric Holder made some encouraging movement and murmurs in the direction of holding some Bush/Cheney era officials accountable for water boarding and other forms of torture used on detainees, interrogation methods that sometimes resulted in death. The push back from the CIA, the Pentagon, and the neocon media/political establishment in Washington DC was fast, focused and furious. Attorney General Holder quietly went away to study the legal options further, and hasn't been heard from since.
Two years have now come and gone. I guess that means the decision has been secretly made to give the Bush/Cheney regime a complete pass on torture. That's why George W. Bush felt safe enough to admit in his recently published memoir that he personally approved the use of waterboarding, and the Decider had no regrets or moral concerns whatsoever about that decision.
As a result, belated prosecution in a Spanish court forum, purely under international law, is preferable to no prosecution or no accountability at all. Three cheers for the Center for Constitutional Rights, and good luck to the European effort.
On the domestic front, the torturers and their enablers will evade the long arm of the law. No wonder Bush keeps smirking and Cheney has a twinkle in his eye.

I agree 100% with your sentiments. The list of "A" Grade War Criminals is unfortunately bigger, much more so now with Obama's crimes. And we shouldn't forget the crimes of Clinton, GHW Bush, Reagan, and their abettors. Perhaps 150-200 US government officials ought to be up for War Crimes carrying the death penalty.

Rummy is on my Six Pack list. I left Ashcroft off because he did, at one key moment while he was recouperating from serious surgery, refuse to sign off as Attorney General on a Bush/Cheney White House request to rubber stamp warrantless wiretapping of Americans by NSA. I'll cut Ashcroft some slack as a reward for that one single moment of ethical courage under trying circumstances.
You are right of course that there are numerous other figures - Colin Powell, Condoleeza, Wolfowitz, Pearle, Bolton, Rove, Doug Feith, General Miller, General Boykin, George Tenet, etc. - who are potentially indictable coconspirators. Internally within the Bush/Cheney cabinet inner circle, Powell and Rice were kept somewhat out of the loop by Cheney's cabal of true believers. As anyone familiar with the dynamics of federal conspiracy prosecutions can tell you, there is some utility in limiting the focus to ring leaders. The more peripheral characters are the folks you can selectively offer immunity to in exchange for truthful testimony that helps convict the really big fish.
What I find most attractive in narrowing the field two these six codefendants is the symmetry. Torture could never have been rebranded as enhanced interrogation techniques without lawyer enablers willing to "fix the law around the policy", in the terminology of the Downing Street memos. Yoo, Addington, and Gonzales should be held accountable for the unique role they played in facilitating rather than deterring the systematic trashing of international law, federal criminal statutes, and the US Constitution. Bush, Cheney and Rumsfeld will argue in defense that the lawyers signed off, so that magically made it legal. Let the show begin.
Give all six a fair trial, and let them try to sell that one to a jury. Good faith reliance upon the advice of legal counsel should not pass the smell test. Even if it ultimately did create a reasonable doubt, that's how the criminal justice system is supposed to work.
Personally, I think it would be self-defeating to stir the prospect of a death penalty into the mix. Far better in my opinion to stick with incarceration, plus recapture back to the federal treasury of the royalties on memoir book sales and other ill gotten financial gains flowing from the defendants' crimes.

Hi Bill, and thanks again for your reply. Sorry about missing Rummy for some reason. Yeah, super-max incarceration for their remaining days and confiscation as you suggest would probably be best. I think enough evidence now exists to nail Obama for Obstruction of Justice. The question dogging me is When do us citizens form posses to enforce the law and accountibility?

John Dean comes to mind in the Watergate conviction of Nixon, but do not forget that Nixon, even though found culpable, was exonerated and pardoned by President Ford. One has to believe that even if Bush and Cheney were convicted by a jury, they would eventually also, be exonerated and pardoned by the sitting President. Also, the really big fish are the people behind Bush,Cheney and now Obama. They will never be known, let alone brought to trial.
Good summary, Bill. As others have said, we have no justice in the u.s. for war criminals in the executive branch. They have carte blanch to do what they want, and Obama's failure to prosecute the Bush Six has now effectively codified it. We live in a fascist country, a rogue state that is out of control. Sadly, probably the only thing that will bring this rogue nation to heel is the crash of the dollar, which will happen when it loses its status as global reserve currency. Even more sadly, the criminals like Bush and Cheney will not be the ones to face the brunt of pain when that happens--it will be the regular folks, the remnants of the middle class and lower classes, who will see their dollars suddenly worth one-third or one-half of what they were.
I've said this once before. We are living in the most corrupt society known today. Two hundred million people were murdered and deliberately starved by their own governments during the 20th century. And the world stood by and did nothing except fight the 30 year war against Germany and Japan(1914-1945).
Mao murdered and starved seventy million Chinese on his totalitarian movement to subjugate that country and the world. Stalin did the same to thirty million in the USSR. After WWII Mao and Stalin set out on their murderous mission to dominate the world. America stood against the world communist movement in Korea and Viet Nam. Communism has failed. The Soviet Union collapsed and China is moving towards democracy along with its successful venture into capitalism.
George W. Bush stood against terrorism that had continually attacked America and other free world nations, until 9/11/01 finally convinced us that the terrorists meant business.
Bush quickly attacked Afghanistan and easily defeated the repressive Taliban rulers that had given the terrorists a training and planning base for their attacks on the free world. That base has been denied those that want do destroy us. Obama is keeping the pressure on in Afghanistan and our military is learning how to fight and win this new kind of assymetric warfare. There have been no successful terrorist attacks on American soil since 9/11/01. Bush rebuilt our crippled intelligence and national security agencies, and an estimated 5,000 planned terrorist attacks have been identified and stopped world wide in these past nine years.
Then GW Bush went after a thug in Iraq that had invaded two neighboring nations and was murdering his own people. He looked like another Mao or Stalin - given the time and opportunity.
Saddam had easy access to atomic weapons. (I'll never understand the "no WMD" thing) A.Q. Khan of Pakistan had learned how to build an atomic bomb and did so for Pakistan. Then Khan opened a Wal Mart off the shelf business offering the material and technology to any thug that had 250 million dollars and wanted atomic bombs. North Korea was a taker and have atomic bombs. Khadafi wanted ready made atomic bombs for Libya, but was dissuaded by America. An atomic program was offered to Saddam but he was too busy invading Kuwait and murdering his own people. Saddam even had 550 metric tons of yellow cake ready to convert to weapons grade uranium. And then there's the matter of the missing suitcase sized atomic bombs built for the KGB, and the weapons grade uranium also missing, available after the break up of the Sovie Union.
Iraq now is safer statistically then here in America. In 2009 there were 4500 violent deaths in Iraq out of a population of 31 million. In America during that same period there were 50,000 violent deaths out of our population of 310 million.
Let's look at the score. 20th century - 200 million killed in wars and intranational genocides. After WWII and Mao's death - murderous communism stopped and terrorits on the run at the cost of four border wars - Korea, Viet Nam, Afghanistan and Iraq.
What we'll never know is how many lives have been saved because we learned the lessons of history and the 20th century and stood against the true murderous tyrants.
The long arc of the moral universe bends towards justice.

If you find this place hard to comprehend, you should spare yourself from encountering the really 'hard' stuff.....Try to sleep well, even though you have stumbled across those who didn't love George W. Bush. I know you are surprised, but there are those out there who didn't share your joy at the wonders of american foreign policy in this, the twenty first century.

Thank you for the invitation to explain. In all the blogs there seems to be no balance - like you are talking to yourselves in a closed loop. Which, of course, is your choice and is what freedom is all about. But the vitriol towards George W. Bush and his foreign policy fails to acknowledge that America was attacked on many occasions by terrorists prior to 9/11/01, and required an appropriate response. In all the blogs, I could find not one acknowledgment that international terrorists armed with atomic weapons pose the greatest threat ever known to humankind. No acknowledgement that we just came out of the most horrendous century in human history where ten percent of the planet's population was savagely murdered and starved by unprovoked wars and intranational genocides. Two hundred million human were killed because of Mao, Stalin, Hitler, Pol Pot, Kim Il Sung and a couple dozen others. That it was America that stood just about alone against the greatest mass murderers of history: Mao and Stalin - with Hitler coming in third. In the blogs there is no suggestion that this level of inhumanity is coming to an end largely through the efforts of America's humanity and journey towards justice for all humankind. To equate Bush and America with these tyrants, to me, is living in a warped universe. Two hundred million dead because the rest of the world stood by and did nothing. They talked about nothings - just as you are. Where is your sense of proportion? The anti war appeasers stood by, let the mass murders happen and now will not even acknowlege it. At least none of you seem to.
Yes, the history of the world has always been the more successful taking from and murdering the less successful. The Europeans did that to the native indians of America - just as the native had been doing it to each other for centuries before we came. Yes, we have our faults - as do all nations and all humans. That is no excuse for the blind denial of recent history and not doing all possible to defend ourselves against this new evil. To me it is suggesting because of our shortcomings as a nation we should not protect ourselves. That would be like an adult not defending themselves or their family against a murderer because they had been naughty as a child.
And America has invented a military stategy for these "border wars" aimed at limiting non combatant deaths and attempting to turn the enemy. We haven't got it completely right, but we're working on it.

It would seem that like minded people tend to discuss among themselves. I suppose there are many closed loops.....And that is a larger issue to be dealt with in our world.
When reading your posts, it seems that your perspective truly does reflect a parallel universe. And, to tell you the truth, we all live in parallel universes. Some are more similar to each other's than others, however.
We are all human, however. There is the connection point. If we don't relate from that 'place' within us, than there is no hope at all. I wouldn't try to change your perspective, as you have spent so many years with your beliefs and most likely aren't interested in having your world view changed in any great way. And that is surely your right.
You might want to try to read Noam Chomsky. Have you ever heard of him? I also suggest that you view Democracy Now, which you can stream daily on your computer. I have a friend who, before i met him about four years ago, had been a 'conservative' republican/fundamentalist christian. And then he decided to read Noam Chomsky, as my friend is a college prof. in the area of computers. But he decided to challenge his world view. He is still a 'christian', however he is also an activist. And he even voted for George W. in 2000. Last election he voted for Nader. So. You never know what new perspective can come about to expand horizons.
The perspective you have expressed on your posts here mirror, what i would call, the mainstream. So, it wouldn't seem to be difficult for you to find like minded people in the u.s. People at sites such as this one are not 'mainstream' as far as the american populace is concerned. We feel that among ourselves (i can only speak for myself of course), that we frequently disagree, although i suppose it may not seem that way to you.
I hope you take my suggestions to heart and allow yourself to be open to more.

9/11 was in inside job, and Bush family has its hands all over it, start using the internet, and read, the rest of the world knows it, and alot of Americans too.

And fredynick, know that there is no constitutionally enforced laws to protect us , what makes you think that American leaders aren't the next Hitlers and Stalin's, 9/11 saw 3000 Americans die to advance the agenda of the insane elitists, the rest of us will be cannon fodder.
Bornfreemen. . . Our constitution and bill of rights are the basis of our laws. Those laws specifically protect us from our leader becoming a tyrant. President Nixon came closest to it and he chose to leave office before being impeached. He should have ended up in prison but for being pardoned by Ford. The separations of power of our branches of government - the legislative, executive and judicial - are designed to be a safeguard for us. As a republic - not a true democracy - we are ruled by laws - not by the majority - and certainly not by one person.
Shortly after 9/11/01, I did extensive research, and there is no evidence or reason to believe that what happened to the World Trade Center is other then exactly what the world saw. Set afire by the jet fuel, the flammable materials contained on the floors caused the temperature to reach the point where the steel beams were weakened and collapsed on each other. There are recordings of phone conversations that took place between the people on the planes and their families. There are videos of what happens to a building when it is brought down by explosive charges. My degree is in mechanical engineering. All the evidence supports the reality I have described. What is your hard evidence to support your theory?
