Rethink the Patriot Act
Let's restore constitutional safeguards, protect civil liberties
Remember the Patriot Act?
How could librarian Peter Chase ever forget. In 2005, Mr. Chase, the director of the Plainville, Conn., public library and then-vice president of a consortium of 26 Connecticut libraries, received an FBI demand for library patron records via a National Security Letter authorized under the Patriot Act. The FBI also imposed a gag order prohibiting him from speaking to anyone about the demand - including Congress, when the Patriot Act was up for reauthorization in 2005.
Now, thanks to the American Civil Liberties Union, Mr. Chase has finally won the legal battle and has torn the Bush administration's tape from his mouth. So he's speaking out, and this is what he has to say: "The government was telling Congress that it didn't use the Patriot Act against libraries and that no one's rights had been violated. I felt that I just could not be part of this fraud being foisted on our nation."
Only 45 days after Sept. 11, in an atmosphere of overwhelming fear and uncertainty, Congress rushed to enact the Patriot Act. The law unconstitutionally authorized unprecedented secret spying into our private lives without evidence of wrongdoing and with no checks to correct abuses. The Patriot Act authorized the FBI to send such letters to demand "any tangible thing" - library records, financial records, medical records, books, letters, you name it.
Only three recipients have challenged the gag orders that accompany these letters, and two of them are librarians. Since the Patriot Act, the number of "demand letters" and gag orders of the kind Mr. Chase and others received has increased astronomically. The Justice Department's inspector general reports that between 2003 and 2006, the FBI has issued nearly 200,000 such letters.
Yet seven years later, despite mounting reports of abuse, there is little evidence that the Patriot Act has made America safer from terrorism. Most recently, Justice Department Inspector General Glenn Fine conducted two audits of the FBI's authority to demand business records under Section 215, the "library provision" of the Patriot Act. In testimony late last month, he told the Senate Judiciary Committee, "we found no instance in which the information obtained from a Section 215 order resulted in a major case development."
Keeping America safe and free requires an overhaul of this deeply flawed law. The "library provision" - which also affects many other kinds of personal records - and similar dragnet search and seizure provisions must be narrowed to ensure they apply only to those suspected of terrorism and terrorist affiliation. The courts must regain the right to independent, meaningful review of these operations to check abuses. Congress should get regular reports and must review the security efforts' effectiveness. And the courts must enforce First Amendment oversight of gag orders, so that the FBI does not unilaterally silence Americans.
Key portions of the Patriot Act are set to expire. A group of U.S. senators has introduced the Justice Act (S. 1686) to end unnecessary civil liberties abuses under the Patriot Act and to restore constitutional safeguards to U.S. national security efforts. This time around, Maryland's congressional leaders have important roles to play on the Patriot Act, as they now occupy key positions in the House of Representatives and U.S. Senate in the majority party. Marylanders who believe security and liberty are not opposing goals should urge our leaders to shepherd through reforms included in the Justice Act.
In particular, Maryland Sen. Benjamin L. Cardin occupies a key leadership role as the sponsor of another Patriot Act reform bill, which he calls a "starting point for debate" in the necessary Patriot Act overhaul. And as chairman of the subcommittee on Terrorism and Homeland Security of the Senate Judiciary Committee, Senator Cardin is in a position to add more critical constitutional protections. It is vital that these reforms are included in the bill.
The first patriots acted in justified outrage over British warrants granting broad, intrusive search and seizure powers over colonists. Modern-day patriots must act now to renew the constitutional promise of liberty bestowed upon us by our patriotic forebears. We can - and must - be both safe and free.

As far as I'm concerned, the entire fooking Act should be repealed. It is based upon fraud and clearly unconstitutional.

Judge Gladys Kessler had to "Order" the U.S. Government to release Alla Ali Bin Ali Ahmed after seven years of illegal and immoral torture. He was guilty of nothing and tortured for seven years......The confession he gave was totally false and full of inaccuracies
Then there was Ibn al Shaykh al Libi, he was tortured until he gave the Bush Administration "The Story" that Hussein was giving biological warfare to Al Qaeda and Colin Powell presented that information to the U.N. as fact....it was false and he admitted it long before his "Alleged" suicide May 11, 2009.....Funny how all the witnesses seem to commit suicides without notes.
Now, let's get to Khalid Sheikh Mohammed. President Bush stated, "He (Sheikh Mohammed) told us the operatives had been instructed that the explosives went off at a point that was high enough to prevent people trapped above from escaping." After years of torture, Sheikh Mohammed confessed that he was responsible for planning the attacks of 9/11. Excuse me, the purpose of the torture was to extract false confessions from all prisoners. I believe that it was to continue "The Myth Building" of an enemy that never really existed and that was created by our own CIA during "Operation Cyclone".......
In order to get rid of the Patriot Acts, there needs to be an "Independent Investigation of 9/11" and "The Coverup and Destruction of Evidence" that followed it....

is it any wonder we lost the olympic bid - how many athletes from the middle east would be harassed under both these acts, maybe these foreigners don't want to be surveilled while they are here to take part in as sporting event

I wonder how many people who post on this site are on the no fly list, as a result of posting on this site. If there are any, then CD has provided a great service in exposing lies and fearlessly restoring truth.
The repug neo-nazi dictator regime of Bush and Maddog Cheney only plans were to destroy this country on 9/11 and keep the people under fear. After look at Bush/Cheney. Bush was in fear of the Texas National Guard. Cheney was in fear of any bronch of the Military. Thay did a lot more damage to this Country than any foreign enemy. Because they were the enemy with-in.

This one sentence speaks volumes about how the American people have been trained to cower to authority. Where are the other 199,000 voices against government abuse? Can all of them believe that the government has just cause to probe into every crevasse of daily life?
It is obvious to me that the schools are no longer teaching civics to the youth and Constitutional rights. We, the parents and grand parents are therefore tasked to go out and re-educate our youth about our heritage. (They'll probably turn us in to authorities as 'radical' however.)

Instead of making more rules like that Maryland congressman is doing, why not just push for repealing the bloody act altogether? Listen, even a sizable percentage of conservatives are sick and tired of this act and Ralph Nader said so strongly year after year ! I guess not listening to Ipods unlike most people my age kept me less ignorant about the dangers of the "Patriot" Act.
P.S.:
I don't expect Obama to approve of any legislation that opposes the "Patriot" Act let alone repeal the bloody thing. As a matter of fact, I went back and did a more thorough study of the trends and patterns in the erosion of this country's civil liberties and found out that not only was my friend, Bliss Doubt, correct that if Obama wins a second term that he will push to privatize and turn it into a "faux noise" hole but that he is experimenting with the idea of toying around with people who oppose his bloody "health care" fraud. I had little to expect that Obama would be much better than Dubya but he's turning out to be slicker than Dubya at its worst ! I don't want to hate the man but what he does infuriates me all too often.

Where are all the right wingers who identify as libertarian? Those who are concerned about the erosions of liberty whenever any talk of gun control is brought up, but who are silent when it comes to this?

**The essence here is that the FBI is an absolute worthless organization, and should become a fingerprint storage facility.
**FBI has become the private police force of the King in Power, similar to the SS stormtroops of Nazi, Germany !
**Each FBI Agent swears to uphold , preserve, protect and defend the US Constitution===first and primary==NOT to obey Illegal Orders of the politico powers in charge; or to carry out black bag political operations against the King's enemies.
**For just one example, if King W, or Robert Mueller really believed Osama bin Laden to be guilty of the 9/11 Attacks, then how could any thinking FBI Agent obey orders to Escort the bin Laden family from the USA to their Homeland in the United Arab Republic ???? Siurely a filibuster in the senate would be in order to defeat any renewal of expired portions of the phony "Patriot Act," which has done for patriotism what the House UnAmerircan Activities Committee did for American values, extinguish them. What' the hell is the point in having the Democrats as a party if all they're going to do is kiss fascist GOP booty? Let's get over and kick this damn 9/11 BS damn syndrome of the USA being the "poor victim," we need to get over this damn horse hockey. The health insurance industry probably kills more people every day than died in those 9/11 attacks.

We need to hear from him now, or never. There are things Obama never promised, but which his supporters believed were implied in his rhetoric, but he actually spoke on this issue, and this is his chance to prove he isn't just another corporatocrat shilling for big defense.
