Obama's Pick, Sonia Sotomayor, Reflects America
When Supreme Court Justice David Souter announced his planned retirement, the pressure was on President Obama to add a second woman to a bench.
At the same time, Obama was encouraged to pick the first Hipanic justice.
He did both, and a good deal more.
Obama's nomination of Judge Sonia Sotomayor of the United States Court of Appeals for the Second Circuit as his first appointment to the high court, is to made at the White House this morning.
While much will be made of the fact that Obama has chosen a woman of Puerto Rican background to serve on a court that until the 1960s was made up entirely of white man, the president has, as well, chosen a jurist whose specific experience will make her a key player on a court that, in ocming years, will be taking on more and more cases involving financial and economic issues.
Judge Sotomayor's 11 years of service on the federal appeals bench (as an appointee of Bill Clinton) have been served just a few blocks from Wall Street in Manhattan, as were her six years as a federal judge (as an appointee of George H.W. Bush as the recommendation of former New York Senator Daniel Patrick Moynihan).
"As the top federal appeals court in the nation's commercial center," the New York Times notes, "the court is known in particular for its expertise in corporate and securities law."
The daughter of a factory worker who died when she was a child, Sotomayor -- who diagnosed with diabetes as an eight year old -- was raised by her mother, a nurse at a methadone clinic. Inspired by "Perry Mason" television programs, Sotomayor graduated from Princeton University summa cum laude in 1976 and then from attended Yale Law School, where she was an editor of the Yale Law Journal.
Before her appointment to the federal bench, Sotomayor as an assistant district attorney in Manhattan,working with D.A. Robert Morgenthau, who developed a reputation for policing -- or, at least trying to police -- Wall Street.
Obama picked Sotomayor from a slate of women finalists that reportedly included Judge Diane P. Wood of Chicago, Homeland Security Secretary Janet Napolitano and Solicitor General Elena Kagan.
Sotomayor was not the most liberal of the prospective jurists, but that did not matter to conservatives who have been preparing for a fight. Wendy Long, counsel to the right's Judicial Confirmation Network, came out swinging: "Judge Sotomayor is a liberal judicial activist of the first order who thinks her own personal political agenda is more important than the law as written. She thinks that judges should dictate policy, and that one's sex, race, and ethnicity ought to affect the decisions one renders from the bench."
That's a reference to a case involving applications for promotions within the New Haven, Connecticut fire department, in which Sotomayor was a member of a judicial panel that objected to tests used to evaluate candidates for promotion when no minority candidates ranked at the top of the list of those who took the test.
That white male jurists agreed with Sotomayor will be lost on her critics. But her record is generally seen as being very much in the mainstream of legal debates about diversity and affirmative action.
The swift strike at this nominee provides a reminder of how important this confirmation battle will be to conservatives, who see the fight to block Obama's first high-court pick as essential to the renewal of their sagging political fortunes.
But Sotomayor will have plenty of allies.
Even before the nomination was announced, National Organization for Women president Kim Gandy announced that NOW would launch a "Confirm Her" campaign to ensure swift confirmation of the nominee.
"Nominated to serve as the third woman and first Hispanic on the Supreme Court in the history of the United States, Judge Sotomayor will serve the nation with distinction. She brings a lifelong commitment to equality, justice and opportunity, as well as the respect of her peers, unassailable integrity, and a keen intellect informed by experience. President Obama said he wanted a justice with 'towering intellect' and a 'common touch' and he found both in Judge Sotomayor," said Gandy. "What more do women want? We want a swift confirmation in the U.S. Senate, and Associate Justice Sotomayor to join Ruth Bader Ginsburg on the Court before the Senate's August recess."

President Obama, keep up the moderate, negotiating, and compromising spirit. You know what most Americans want and won't back down to extremists on either side. I look forward to President Obama scoring a major landslide reelection victory in 2012 just like Clinton in 1996, possibly as strong as LBJ in 1964, Nixon in 1972 and Reagan in 1984. GO OBAMA !!

Actually over the past eight years the far right extremists did try to create another America being the treasonist fools that they are but thankfully it didn't work. Welcome to the America that was created by our forefathers in those three great documents, The Constitution, The Bill of Rights and the Declaration of Independence. Dear elohim, I am not an Obama worshiper by any means. I know the reps/dems are all in it together. It is rich against poor. That is the name of the game. I believe in the Constitution and Bill of Rights and I am disappointed in what is going on. I do believe that our country has been sold and continues to be sold to the highest bidder. It is global, not just endemic to America. Call me hysterical if you want but you sound pretty righteous yourself. Everyone is just so hip and enlightened to what is going on, it's the latest fad, doncha kno'. Are you the type that only gives word play and does nothing else or are you fighting to make things better? I try to be active whenever I can because I'm not going to give up on the American experiment.
It is certainly not "judicious," so to speak, to fire off knee-jerk reactions to a Supreme nominee whom probably very few of us yet know much about. That relative ignorance seems to hold for John Nichols who, based on his article, seems to know little more in her praise than her judicial experience, her connection to Wall Street, and a position she took on what appears to be an affirmative action issue. Notably absent in Nichols' discussion was another case in which she seemingly sided with the government in allowing a pro-abortion consideration in funds it distributed; not a good omen for the future of pro-choice as we've just come out of the spectacle of Obama's capitulation to the right-wing pro-life nuts at Notre Dame---and the paeans of praise of NOW, about as meaningful to me as the way African Americans lined up beyond Obama as "one of our own" even as his election promised to do damage to the interests of African Americans. For once, though, I'm willing to join the chorus of Obama supporters who say "give the guy a chance," give his nominee a fair and thorough consideration before supporting or opposing her. I only hope that the men and women of our U.S. Senate will maintain that same "judicious" attitude and will not, as so many Democrats did with Bush nominees, say simply that "the President is entitled to his own Court choice," a decidedly un-constitutional attitude that abrogates the "advise and consent" mandate of the Senate.

Exactly. It's always showtime anyway, even with Obama. It's amazing how the population has been dumbed down to the point where this charade actually works. I think there can be hope--just not with any of these political clowns that have been on parade for so many years.
Just as nobody who doesn't kneel at the altar of fascism would be allowed a post in government, no one who fails to kneel at the altar of fascism will be allowed on the Supreme Court. The 'best' judges we ever had were conservatives - and usually appointed by a 'conservative' president - before that label was redefined to include fascists. The only 'activist' judges on the Court today are either ignorant, hold the Constitution, Bill of Rights, and rule of law as quaint anachronisms, or are openly disdainful of same. It would be hard to imagine a fascist government allowing anyone who didn't grovel at their feet to rise to the bench today. Too many Americans are deep in denial - that way they don't have to risk either their property or their lives to defend an idea that once inspired the world. Whoever this woman is - you can be sure she will toe the line - the party line. Call them 'Democrats' or 'Republicans' - but they all still fit the definition of 'fascist' in every respect, and so are but the two sides of the same coin - one party; the ruling party.

The most important movement in the USA, which is finally gaining some visibility and voice, is the movement to end the ridiculous legal notion that "corporations are people" and people are "incorporated" and that both real people and "corporate personhood" should be treated with equality under the law. With someone like Sotomayor on the bench it will not help this movement very much since she is just another Wallstreet lacky like Obama. Thanks, Nichols, for pointing out what is actually bad news for the truly progressive in our nation.

Having said that, I'm not so sure that Judge Sotomajor is all that liberal. No mention was made about where she stands on abortion, religion, corporate fraud, legalization of soft drugs, mandatory sentencing, gun control and a host of other essential considerations.
My feeling is Judge Sotomajor made it as far as she did by exhibiting a record of corporate friendly, right wing judicial decisions. Her ruling in Connecticut hardly constitutes her as a die-hard liberal.

When I was still in the Roman Catholic Church we were all trained to do what we were told, to believe what we were told and to never question authority. Another Catholic on the Court is worrisome.
Good to have a woman, good she's Hispanic, better than either were she progressive.
To the people who are saying we should give Sotomayor a chance to show her progressive credentials, I ask how are we to do that exactly?
The confirmation process is going to be all about reassuring the Republicans that she can be trusted to uphold the status quo. So are we just supposed to wait until after she has been confirmed and turned loose in the Supreme Court before finding out just how "progressive" she is? What do we do then?
Besides, how progressive can she be when she was appointed to the bench by George H W Bush?
How progressive can she be as a nominee of Barack Obama?
