International Criminal Court Faces Big Test With Israel
It should look into the allegations, not the least to refute the assertion that the court is an instrument of the West.
The International Criminal Court soon faces a big test-a test that could reveal whether it is truly an independent institution.
The Palestinian Authority has asked the court's chief prosecutor, Luis Moreno-Ocampo, to examine if Israel was guilty of war crimes during its recent Gaza operation. Moreno-Ocampo should take a look into the allegations, not the least to refute the assertion that the court is an instrument of the West.
I have been a big supporter of the court and have written in its favor for a decade now, ever since it was being formed. But an article a few months ago in The Nation by Professor Mahmood Mamdani of Columbia University gave me pause. Mamdani insists that the International Criminal Court can be seen as the legacy of a tradition of Western paternalism toward the rest of the world, in some sense displaying a continuity with colonialism. While Mamdani overreaches in his argument and downplays the Bush Administration's opposition to the court (for more on that see my January 2007 piece in The Progressive), he does make some interesting points.
"The fact of mutual accommodation between the world's only superpower and an international institution struggling to find its feet on the ground is clear if we take into account the four countries where the ICC has launched its investigations: Sudan, Uganda, Central African Republic and Congo," Mamdani writes. "All are places where the United States has no major objection to the course chartered by ICC investigations. Its name notwithstanding, the ICC is rapidly turning into a Western court to try African crimes against humanity. It has targeted governments that are U.S. adversaries and ignored actions the United States doesn't oppose, like those of Uganda and Rwanda in eastern Congo, effectively conferring impunity on them."
Mamdani limits his analysis to Africa, not delving into the obvious issue as to whether the International Criminal Court should have considered a case against the Bush Administration for its illegal invasion of Iraq. (In fact, Roger Cohen points out in a New York Times column that Moreno-Ocampo rejected pleas to try British forces in Iraq.)
Mamdani exposes a basic structural flaw with the International Criminal Court: The U.N. Security Council can refer cases to the court (even regarding a non-signatory) or, conversely, block any such attempts. This gives an inordinate amount of clout to the five permanent members, including the three Western powers. This explains to a large extent the hesitance of the court's chief prosecutor to take on the West or its allies.
In the case of Israel, Moreno-Ocampo faces a number of legal and procedural hurdles. Israel is not a signatory to the court. And the very legitimacy of the Palestinian Authority is in question, especially after Hamas's takeover of Gaza. Nevertheless, Moreno-Ocampo has indicated-after initially declining the case-that he is considering whether to go ahead, possibly including a review of any war crimes that Hamas may have committed.
The Obama Administration has already signaled its approval of the International Criminal Court. U.S. Ambassador to the U.N. Susan Rice two weeks ago called the court "an important and credible instrument," indicating that the United States is moving from confrontation toward co-optation.
Now is the time for the International Criminal Court to assert its independence. Opening a case against Israel would be a good start.

Procedurally there may genuine reasons why the prosecution of the zio scumbags would not happen.
More significantly, though, there will be fake procedural "reasons" why the investigation/prosecution will not happen.

These institutions UN, WTO, HRW, amnesty Internations, are critical appendages to western/European control of all others. They offer false tensions against western influence. They are the modern equivalent of the colonial missionaries.
The degree to which the ICC "investigates" Israel is the degree to which it makes tactical feeble concessions to keep the peasants perpertually fooled. Yes you can fool all the people all the time, its a matter of how you do it. Remember the Pinochet case, what structurally changed? regardimg the ICC ability to go after the real criminals.
Following the military intervention in Afghanistan in 2001, US Secretary of State Colin Powell commended representatives of humanitarian nongovernmental organizations (NGOs) for their role as a "force multiplier" for the US government. In his view, humanitarian organizations expanded the reach of the US government and helped achieve the political goals of the intervention. Most NGOs responded to the force multiplier claim with outrage and denials. Yet examination of the Kosovo, Afghanistan, the Iraq interventions and many adventures in africa going way back reveals a not so complicated relationship between military and humanitarian actors.In fact, humanitarian activity appears to further the aims of politicians and soldiers in many situations. Colin Powel was correct.
Back to Human Right Watch. For example one of the recent vocal supporter of so called humanitarean intervention is Mark Galasco. Before coming to HRW, Marc Galasco spent seven years in the Pentagon as a senior intelligence analyst covering Iraq. His last position there was chief of high-value targeting during the Iraq War in 2003. Marc was on the Operation Desert Fox (Iraq) Battle Damage Assessment team in 1998, led a Pentagon Battle Damage Assessment team to Kosovo in 1999, and recommended thousands of aimpoints on hundreds of targets during operations in Iraq and Serbia. He also participated in over 50 interrogations as a subject matter expert” Motherjones magazine( Marc was an “estimator” who authorized the cost/benefit implementation of US death machines on USA defined enemies.
As is said if there is a law that equally forbids both the rich and poor to sleep under bridges, quess who will eventually populate the prisons.

What made her change her mind?
A charge has been made to the world court that Israel committed war crimes. I hope this charge will be made in court. How do we get Bush and Cheney charged with war crimes? I want them in court too.

A little correction to Pal's article. Echoing the lies of the mainstream media, he refers to "Hamas's takeover of Gaza," when in fact Hamas, whether one likes them or not, legitmately won a fair and democratic election to lead the Palestinian people. Only after the U.S. and Israel, under the knowing guidance of Eliot ("Iran-Contra") Abrams, began arming the ousted Fatah and fomenting strife between them and Hamas was the latter forced to take by force what they had legitimately won by the ballot. Why someone writing for a magazine called "The Progressive" chooses to perpetuate the patent lie of a Hamas "takeover" is beyond me.
The courts are just a joke at this point. There's no justice when the damage is done. Nothing can replace those precious innocent lives. Justice, at best, will be too little too late if it even comes.

Why hasn't our own government stripped from it people such as Abrams, Emanuel (who joined the Israeli Army 1989) while truly American boys were in "our" army. Can you folks give me any names of soldiers of the Jewish faith who died in the Iraq war? Just name me one or two. I have been searching the death records and by names only I cannot identify any. Also how many do you know that are financially strapped?

assjoe where can I verify that? Since you popsted it I have tried to find out something about each one. And you said to name a few. How about more and they truly went to kill Iraqis for their beloved America. They are Liebermanesque.
Since the Arab League was founded to fight the Jews in Palestine (see: the Arab League web page), they have not had much success in Jew-fighting. What they've been good at, is corrupting neutral international organzations into nominal allies. The ICC is yet-another.
