Senators Should Press Napolitano Tuesday on Local Immigration Enforcement, Says ACLU
DHS Should Terminate 287(g) Program
WASHINGTON - April 26 - When Secretary of Homeland Security Janet Napolitano testifies at a Department of Homeland Security (DHS) oversight hearing Tuesday before the Senate Judiciary Committee, senators should press her to terminate the 287(g) program, said the American Civil Liberties Union today. 287(g) is a federal program that allows certain state and local law enforcement agencies to engage in federal immigration enforcement activities.
Tuesday's hearing comes on the heels of the passage last week in Arizona of the most extreme anti-immigrant law in the country. Several Arizona law enforcement agencies are allowed to participate in the 287(g) program, which, combined with the state's new law, creates a disastrous intertwining of police with immigration enforcement in that state.
The ACLU has strongly opposed the 287(g) program, believing it has led to illegal racial profiling and civil rights abuses while diverting scarce resources from traditional local law enforcement functions and distorting immigration enforcement priorities. A report released earlier this month by the DHS Office of Inspector General (OIG) affirmed the concerns with the 287(g) program, and the ACLU calls for its immediate termination.
"Secretary Napolitano has been conspicuously silent in the wake of a report which brought to light the many failings and abuses which have occurred under the 287(g) program. It's time for Congress to step in now that it's clear DHS oversight has failed and call for an end to this truly dysfunctional program," said Joanne Lin, ACLU Legislative Counsel. "Senators must hold Secretary Napolitano and DHS accountable for the untrained, unsupervised and unmonitored state and local law officers across America - many of whom are using federal immigration authority as a cloak to engage in racial profiling. The program should be terminated and de-funded."
The DHS OIG report found a lack of oversight, training and other failures in the 287(g) program and made it clear that the program does not have adequate safeguards against racial profiling and other civil rights abuses. Many state and local agencies accepted for the program have a documented history of serious allegations of constitutional violations. Sheriff Joe Arpaio of Maricopa County, Arizona has led a campaign of terror against the immigrant community. The Department of Justice is conducting a civil rights investigation of Sheriff Arpaio's department, and the ACLU has sued to stop his illegal racial profiling practices.
"The 287(g) program tosses American ideals of due process and equality under the law out the window and encourages racial and ethnic profiling," said Laura W. Murphy, Director of the ACLU Washington Legislative Office. "Congress must ensure that DHS and its immigration enforcement programs respect civil liberties. The current 287(g) program runs contrary to American values and must be abandoned."

Show AllLocal, state and federal law enforcement agents ALL take an oath to uphold the Constitution of the United States and to uphold all laws. I'd almost bet that the ACLU would be one of the first organizations to berate a local law enforcement agency IF that agency failed to uphold ANY law. The tact taken by the ACLU is much akin to saying that local police have no authority to enforce speed limit laws on STATE roads. Or that state agencies have no right to enforce federal EPA regulations if they witness a violation.
This article states that the "ACLU has sued to stop his (sheriff Arpaio) illegal racial profiling practices", but gives no other information as to how successful the ACLU has been in this endeavor.... win some, lose some eh?
The sad truth is however, the US government has never had any intention of enforcing immigration laws. Many industries depend upon immigrant labor, and the immigration laws are only there to allow the US to pick and choose who will or will not be prosecuted for violations. IF the laws are on the books, they should be obeyed, but I WILL agree, that if we're NOT going to enforce these laws 'across the board', than they should be repealed.
If they build the original fence as originally designed by Rep. Duncan Hunter (R-CA) Any person trying to creep into America would be caught between the two fences--in the no mans-land--where they would be arrested by the undermanned Border agents. Before they could even scale the--SECOND--fence, they would already be exhausted from scaling the first fence and the flying patrolling drones would pick them up immediately. It's one downright lie that the single line fence even covers half the distance, as its made up of vehicle barriers and ancient rusted barbed wire. Instead the so-called legislators paid millions of dollars for virtual equipment that is malfunctioning and probably received monetary kickbacks for the contracts..Politicians going back years have the deaths of Robert Kruntz, Rancher-US Border Patrol, Sheriff and deputies who have been murdered along the region. Those crummy idiots who we vote for a bunch of corrupt lawmakers are to blame for the carnage in Arizona and have blood on their hands. Kick out Sen. Reid as he tried to destroy the only immigration enforcement too--E-VERIFY.Get the facts--not lies and propaganda distributed by Liberals hiding under Democratic skirts. NUMBERSUSA
TWO THINGS THAT MUST BE DONE IMMEDIATELY, TO REMOVE THE GROWING FEAR IN AMERICANS FROM CRIMINAL ALIENS. Station federal troops on the border as the fence has been constructed in such a way, that it will not stop those who are determined to violate our sovereign law. Build the fence in two separate sections with open ground in between for the rapid flow of US Border Patrol and the Guard. There should be roadway inside the two fences, as a no-mans-land for observing illegal entry according to the original design. As I said before--Congress spend 435 billion dollars on the protection of foreign people in Afghanistan. But taxpayers are incredulously short-changed by our own government, who obviously believes we shouldn't be protected from the illegal alien occupation of our country? In D.C. they spend all these billions of dollars across the water and then argue over funding money for border protection that would save American lives. Only through the rural press, blogs or independent newspapers would the public even know about the deaths of Rancher Robert Kruntz. Only after the word got out did the national newspapers find room, to add this atrocity in some insignificant corner. Same with the deaths of US Border Patrolman, Sheriffs and deputies who remain exposed in border towns and marked for death
Now we have the propagation of terrible crimes in Arizona, because principally they are a border state. Janet Napolitano told the national press that the borders were secured? Any investigative reporter would find this a downright lie. In mountainous regions and even flatlands there is nothing but rusty barbed wire fencing that anybody can cross. In these places it’s open season on cattlemen and land owners who must be armed wherever they go. Now the drug dealers have brought their carnage to Phoenix and other cities. That's why Governor Jan Brewer had no alternative but to enact her own enforcement laws. And now Andrea Christina Nill, Michael Hethmon, general counsel for the Immigration Reform Law Institute (IRLI) — which helped draft the language of SB-1070, is being contacted by other states, who have asked for advice on how they can author the same thing. California--is measuring up to out-of-control crime and a place of sanctuary for illegal alien families, who are bankrupting the public welfare system.
It’s incomprehensible that taxpayers will pay for foreign wars, where they desire to or not. But our own borders remain open to marauding criminals, who have settled across the country and made a filthy niche for themselves. No president has sealed the border just in case they upset the sensitivities of foreign governments. NAFTA and CAFTA spelt doom for the small landowner in Mexico, unable to compete with huge American corporations. So they had little choice but to break our laws to feed their families. In the interior of America we have a national emergency from drug dealers, who kill without provocation, home invasion robberies, and the worst that the slums of South America can descend on us. Every day there are hit-and- runs from drunken illegal aliens killing American family members, who disappear quietly across the border. Then vicious degenerate gang members our country has ever seen, who have moved in.
If the politicians had half a brain--instead of worrying about their anemic reputations, they would build the wall to protect the most vulnerable people in our nation. We must employ the power of the vote to discharge Sen. Harry Reid, Nancy Pelosi, John McCain--who has just decided we need to enforce the border--Janet Napolitano who is poor representative to enforce our laws and national security. Chuck Schumer and Lindsey Graham who are insisting we give 20 to 30 million illegal aliens a path to citizenship. More politicians than I can count, who one way or another has placed us in direct peril from terrorists slipping through our ports, terminals or border. Starting with Sen. Reid, we should dismiss him and his majority gang in the next elections. Also be sure that illegal immigrants don't violate federal law by voting, as they have already broke the law by entering our country without inspection. We can stop forever the travesty of Amnesty played on the American people, by voting for patriotic American lawmakers who will do the bidding of the majority of the people. In addition, there is also a website for Arizona's Governor Jan Brewer who is very vulnerable from the open border organizations. I will of course be donating to any lawsuit against any repercussions to stop this law of last resort.
