ACLU Demands Information on Military Deployment Within US Borders
Deployment Erodes Longstanding Separation Between Civilian and Military Government
NEW YORK - October 21 - The American Civil Liberties Union today demanded information from the government about reports that an active military unit has been deployed inside the U.S. to help with "civil unrest" and "crowd control" - matters traditionally handled by civilian authorities. This deployment jeopardizes the longstanding separation between civilian and military government, and the public has a right to know where and why the unit has been deployed, according to an ACLU Freedom of Information request filed today.
"The military's deployment within U.S. borders raises critical questions that must be answered," said Jonathan Hafetz, staff attorney with the ACLU National Security Project. "What is the unit's mission? What functions will it perform? And why was it necessary to deploy the unit rather than rely on civilian agencies and personnel and the National Guard? Given the magnitude of the issues at stake, it is imperative that the American people know the truth about this new and unprecedented intrusion of the military in domestic affairs."
According to a report in the Army Times, the Army recently deployed an active military unit inside the United States under Northern Command, which was established in 2002 to assist federal homeland defense efforts and coordinate defense support of civil authorities. This deployment marks the first time an active unit has been given a dedicated assignment to Northern Command.
Civilian authorities, not the military, have historically controlled and directed the internal affairs of the United States. This rule traces its origins to the nation's founding and has been reaffirmed in landmark statutes including the Posse Comitatus Act, which helps preserve the foundational principles of our Constitution and democracy.
"This is a radical departure from separation of civilian law enforcement and military authority, and could, quite possibly, represent a violation of law," said Mike German, ACLU national security policy counsel and former FBI Agent. "Our Founding Fathers understood the threat that a standing army could pose to American liberty. While future generations recognized the need for a strong military to defend against increasingly capable foreign threats, they also passed statutory protections to ensure that the Army could not be turned against the American people. The erosion of these protections should concern every American."
In order to assess the implications of the recent deployment, the ACLU requested the Departments of Justice, Homeland Security and Defense today to immediately make public all legal opinions, executive orders, presidential directives, memos, policy guidance, and other documents that authorize the deployment of military troops for domestic purposes.
Since the terrorist attacks of 9/11, the Department of Defense has dramatically expanded its role in domestic law enforcement and intelligence operations, including the National Security Agency's warrantless wiretapping programs, the Department of Homeland Security's use of military spy satellites, and the participation of military personnel in state and local intelligence fusion centers. The ACLU has repeatedly expressed concern about these incremental encroachments of the military into domestic affairs, and the assignment of active duty troops to Northern Command only heightens these concerns.

Show AllThat is a total knee slapper...
We have THOUSANDS of Troops from ALL branches of the Military already here...
in a National Emergency do these morons think they wouldn't be utilized?
If the US would treat other nations and people they way it would like to be treated, the world would have half the present problems. Do unto others...
Know what would be REALLY cool?...
To see the ACLU set up an Office right on the Afghanistan/Pakistan Border and see how long it took (measured in hours) before they were on Youtube in a beheading video
A scenario that keeps playing in my head:
The Republicans (once again) steal the election. The difference this time, though, is that the crime is so blatant, the evidence so damning, the perpetrators don't even bother to deny that a coup has taken place. On November 5th, outraged Americans begin trickling into Washington D.C. The trickle becomes a torrent. By the weekend millions of Patriots surround the Capitol, the White House and the Supreme Court. Bush "reluctantly" deploys the soldiers of Northern Command in order to defend "Democracy, Freedom and the American Way of Life". What happens next is anyone's guess, but it's certain to be HUGE....
Only one thing I am certain of - I will be there. Wouldn't miss it for the world.
Remember, Remember the Fifth of November....
What we need now is a "V" for Vendetta on the Fifth of November. Protest zones behind barbed wire fences, but still subject to spraying and tasering. Government ignores will of the people. Media will not report on real issues of voter supression, theft of past 2 elections, phony 9-11 story. "Have one doubt, they call it treason". Same old. Even the falun gong people in China surrounded their capitol. Who could organize a few million people to surround DC and shut it down? Bushvilles, leagues of homeless veterans?
Wondering what the unit is doing "here"? Ponder this: the Military Oath has recently been changed from "loyalty to our nation" to "loyalty to our President." As I've said before, the Republicans will stop at nothing to maintain power. I foresee a domestic calamity (think 9/11) occuring just in time to prevent elections. When "the people" riot, the troops are ready to obey "our President" and shoot to kill. Shades of Kent State!
Vote Mckinney.
"I, _____, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; and that I will obey the orders of the President of the United States and the orders of the officers appointed over me, according to regulations and the Uniform Code of Military Justice. So help me God."
(Title 10, US Code; Act of 5 May 1960 replacing the wording first adopted in 1789, with amendment effective 5 October 1962).
"Get your head out of your Butt"...I took that oath FIVE times beginning in 1977 and its ALWAYS said "PRESIDENT OF THE UNITED STATES"...He is the Commander in Chief of the Armed Forces
Evil has only one tool - that is the disruption of peace - it is applied in infinite ways but it is always the same tool - JC
Well, IT TOOK YOU LONG ENOUGH! The ACLU has spent a great deal of time defending the rights on non-citizens while totally ignoring what has been happening to this nation and the civil rights of all of us. This deployment took place weeks ago, and only now they are demanding proof - so what do you do when your worst fears are realized? You started out defending the rights of our people against actions that were Unconstitutional, but you seem to have devolved into protecting those who are not citizens, who are not honorable or decent individuals at the expense of victims. You will not address the incredible numbers of parents who are decent hardworking non-custodial parents who are harassed by ex-partners for unfair child support collections while being denied access to the courts by corrupted court systems, because you do not handle civil rights in child support cases. You will not address the rights of free speech of anyone who is threatened across state lines by state officials or corporations that conspire with insurance companies to protect workers' rights to worker's compensation fraud because it is not "significant or within your purview". As far as I can see, your group is just late to the party of what the Republicans have been doing to citizens and you have plenty of excuses for turning a blind eye rather than actually doing what your founders intended. So get your information on this deployment, but I doubt if you will do anything to protect anyone before martial law is declared and these troops are deployed, and then you will not be able to do anything! Thanks for nothing!
So, djnoll, just what is your point? You apparently have a beef with a child support issue and are apparently also fearful of noncitizens. Get a grip, the ACLU is there to represent all those who are fighting for their civil rights. Last I checked dealing with your child support didn't rise to a question of Constitutional rights.
I am very concerned however about this latest erosion of all our rights and believe it is only a matter of time before the military is turned on we the people.
Thank you to the ACLU for addressing this issue.
Peggy, a proud member of the ACLU
