Jackson Browne Sues McCain For Using 'Running on Empty'
Jackson Browne's "Running on Empty" could be considered the crown jewel in Browne's '70s repertoire of deeply personal songwriting. It was never meant to be a political song, least of all for a conservative candidate; in fact, the leftist connotations with the song itself and Browne's own liberal political history are well entrenched in pop culture. In 1988, Sidney Lumet's "Running on Empty," written by Naomi Foner (a.k.a. Jake and Maggie Gyllenhaal's mom), follows a fugitive couple who, with their two sons, bounce from town to town in order to thwart FBI prosecution for blowing up a laboratory in radical protest of the Vietnam War. It earned a couple of Oscar nominations, including one for River Phoenix. Also, the video below is from "No Nukes," a 1979 concert where Browne performed "Running on Empty" to protest, well, you can figure that out. More recently, Browne has made appearances at rallies for Ralph Nader and John Edwards -- not exactly a GOP scene.
So then it wasn't a surprise to hear that Browne is suing John McCain for using the song "Running on Empty" in a campaign ad. Geoff Boucher at the Top of the Ticket blog has more on Browne's lawsuit and the response from McCain's camp:
Jackson Browne is suing John McCain for using the song "Running on Empty" in a campaign ad -- and the veteran rocker is also calling the candidate a great pretender when it comes to standing up for constitutional rights.
Browne, one of rock music's most famous activists for liberal causes, is "incensed" that the presumptive Republican candidate for president has been using Browne's signature 1977 song "Running on Empty" in campaign commercials, according to the singer-songwriter's attorney. Browne filed a copyright infringement lawsuit against both McCain and the Republican National Committee on Thursday in U.S. District Court in Los Angeles seeking a permanent injunction prohibiting the use of the forlorn arena anthem or any other Browne compositions, as well as damages.
They may be suing the wrong people. McCain spokesman Brian Rogers tells our colleague Seema Mehta in Colorado that the ad in question is not a McCain campaign ad but one put together by the Ohio Republican Party.
But Browne's attorney, Lawrence Y. Iser, says they have the right defendants. "We have sued the Ohio Republican Party as well, and we have been informed and believe that McCain and his campaign were well aware of the ad. We are also informed and believe that the ad was broadcast on television in Ohio and Pennsylvania.... The fact that it appears on the Internet means it also reaches an audience well beyond those states."
Iser said the lawsuit "is not politically motivated. It's a copyright infringement lawsuit, pure and simple, but the fact that Sen. McCain has used this song in a hit-piece on Barack Obama is anathema to Jackson."
Iser claims the McCain campaign has a track record of using music without permission.

Show Alllbcanuk,
You're right. There are many artists fighting the good anti-fascist fight, and I admire Cockburn. My key words were "rock star." It is rare for someone already of rock star status to take a stand against imperialism. I wish Cockburn were better known here in the US. He's a great talent ignored by corporate radio.
Typical Republican strategy: Do whatever the heck you want, whether it's invading a country, stomping on civil rights, or stealing a song. The party of "family values" is only fitting if the "family" is a crime family.
"McCain campaign has a track record of using music without permission."
We ought to expect better JUDGEMENT from and EXPERIENCED MAKER of LAWS.
Jackson should file suit against the Ohio Republican Party. They ought to know better than to violate intellectual property laws too. Plus a legal battle, or an out of court settlement, could divert resources from tampering with the vote.
If there was a law against the right being this oblivious to irony the Straight Talk Express would be a paddy wagon.
I love the video shots of David Lindley playing the lap pedal steel guitar too. Hey, he's a liberal for sure, and worth pointing out here.
Yes, "The Pretender" is definitely "Running on Empty," and even "The Rebel Jesus" isn't going to save his hypocritical a**!
Marxymark, with all respect lots or artisits have tackled the RIGHT/FASCISTS/GARBAGE...have you heard or Bruce Cockburn, a Canadian who has been into Central and South America and has written some pretty powerful stuff. I am real proud of Jackson, he is made of the same stuff, and I think he should DEMAND McCain apologize. Isn't THE BIG GUY/ GENERALISSIMO/HEAD CHEESE (whatever he calls his important ass) as the "leader" of his thugs, goons, hacks, gits, twerps, con artists, creeps,a-holes and so on...RESPONSABLE????...for anything...anything...
his NON-apology will help show him in his true light, worth a shot, right!
I wuz robbed. CD's weekend edition covering 8/16 & 8/17 didn't reach my inbox until 1152am on Sunday, 8/17 whereas I see that some people had it available to post comments a full 24 hours earlier.
It's not that I ever use CD on a "chat room" basis, but what's the point of posting a comment if not as many people as possible see what an ass I'm making of myself.
In any case, I remember the movie "Running on Empty" which had Judd Hirsch playing River Phoenix' father (don't remember who played the mother) but didn't pay much attention to Jackson Browne's song.
I hope he's asking for a pretty penny from the McCain camp and hope he gets it. Someone sent me an article about the late writer and cartoonist Shel Silverstein a short while ago. I wish he was around to write a song about my own creation of a McCain campaign slogan, or maybe Jackson could fill in for him.
I'm not much of a lyricist but the name of it would be "McCain ain't no Audie Murphy, he just thinks he is".
I don't know how many of you watched that televised question and answer period with McCain and Obama having to kiss ass with the born-agains and evangelicals last night. I would imagine it to have been too repulsive to bear.
Did catch Condi with David Gregory on this morning's "Meet the Press". She was not in the studio but rather Dubya's guest at the Crawford ranch. DG spent a full 15 minutes asking her questions concerning the Russia/Georgia matter. In true political tradition, she replied to him but never actually answered directly any question that he put to her.
David's no Tim Russert but his experience as NBC's White House correspondent qualifies him for dealing with Dubya, Tony Snow, Dana Perino and certainly Condi, so she obviously came up looking like the loser and I enjoyed it immensely.
I understand that Tom Brokaw volunteered his services as MTP host through the national election; so far he's hosted 2 programs past the Tim Russert memorial program and then taken 2 off, with Brian Williams and David Gregory filling in for him.
I'm not complaining about the way they host the program. I like them both; anybody but Joe Scarborough.
right, Viva Jackson, knew you in 70's with AMUSE

g
Go JB! Right marxymark and even older.Never mind millions or even billions of dollars Bucks don't mean anything to guy and his babe.If you win How about public service like.....changing bandages at Walter Reed Hospital 5 days a week until he croaks!
Some of us are old enough to remember the 80s, when Jackson was the only rock star to write and sing about US war crimes in Central America. Keep rockin' the boat, JB!
Dear bfriesen, why won't you see Edwards at the Convention, on the ticket, nor in the Cabinet?
HOORAY for JACKSON BROWNE! At last, someone is standing up and telling these morons in the McCain camp and the RNC that you cannot infringe on copyrights or plagiarize other people's work with impunity. Too bad Rachel Ray did not have the same guts to sue dear old Cindy on the recipes!
The thought of the Republicans in the White House under the likes of this moral degenerate and mental defective is just horrifying, but as was pointed out by randolfski, they act from the premise that Americans are too stupid for the truth and will vote against their own interests. Sadly, this assessment seems to have been fairly accurate, but like Admiral Yamamoto noted after Pearl Harbor "I fear we have awakened a sleeping dragon.", the Republican party may find that if they steal another election, enough people have awakened that they will have a civil, if not revolutionary, war on their hands and it will not be pretty.
So GO JACKSON! Show the rich and degenerate that they are not above accountability and the law.
"The Dem's this year say it's a toss up between Michael Jackson's "Billie Jean" or Diana Ross's " Love Child"."
I fail to see your point, or your humor.
"I wonder how much he is asking? He should remember that the super rich as well as war mongers think only in terms of billions."
I don't think it's about money. I think it's about telling the right wing liars, "hey, you're NOT going to use my art to sell your lies and deceit!"
Right winders have NO creative people because by their very nature they stifle creativity and thought.
McCain is running to fill the shoes of the imperial president who needs no permission to do anything - so what if he steals a song or two, that will be nothing compared to the riches he has in his sights.
And you know what you get when"the men come around and lay their money down".
In Jersey we say "BOHICA"
The Dem's this year say it's a toss up between Michael Jackson's "Billie Jean" or Diana Ross's " Love Child". Maybe one of the parties should ask Cher for "Gypsies, Tramps, and Thieves"
Could he sue him in Civil court for Defamation of Character? And demand a Public Apology?
McCain's honesty in saying he was unaware of the Song's being Ripped-Off is simply shocking.
I mean, he is a man of integrity.
PS - Don't miss "our pride of ignorance":

"Iser claims the McCain campaign has a track record of using music without permission."
I'll bet the alleged "inexperienced" Senator Obama knows that "copyright infringement" is illegal.
Just think.....if John McCain knew how to use the internet he probably would have realized that copyright law actually exists and that there is a copyrite company in that liberal state of Massachusetts that actually protects creative intellect from the likes of such thieves. Duh!
http://www.copyright.com/
Is this the level of intellect you want making critical, life-challenging decisions for you in a f***ed-up globalized world? Are you kidding????
from barbara ann to running on empty...
go jackson!
dont let the bastards grind you down...
The elites want the people to associate an empty gas tank with the political left and a FULL gas tank with the political right. A full tank of relatively cheap gas on election day will take you to the polls to vote for elites, to reward them for dropping the gas price just in time for the election season. God Bless the United States of America!
Couldn't the McCain campaign find an appropriate country ditty from types like Toby Keith? How clueless are these morons?
This frickin country is "runnin on empty" at the moment. Empty on critical thinking,
empty on responsibility for harm it has caused others, empty on any real values
outside of immediate gratification and greed. John McCain, one of the ultimate
deniers of reality is a strange bearer of this obvious fact. McCain's campaign is
being managed by Karl Rove who is known for doing whatever it takes to get his
candidate elected. Rove engineered both of Bush's election wins and now uses
the same strategy for another talking republican head named McCain. This strategy
is effective in getting 25-30 % of the American voting electorate to vote against its own interests. The idea
came from Leo Strauss, the neo-con's guru, who believed that the majority
of people are too stupid to handle the truth so the only alternative is to constantly lie to
them while keeping them in fear of the evil "them." Let's send em packin in November and
then stay organized and on Obama's tail to make sure he doesn't continue his swing to the right.
The right-wing dummies didn't understand "Born in the USA" either.
All monies gained from this law suit should go to third parties.
Yahoo . . . . One can hope.
but jackson, but mcwhackjob some slack
he is truly "running on empty"
Clearly McCain is running on empty.
85 million seem about right!
I haven't seen or heard the ad but it seems that it should be McSame that the song is directed at, if anyone's "Running on Empty" it's him.
Empty the US treasury to prop up an illegal war
Empty the middle class
Empty the taxpayer's pockets
Empty the 'soul' of the country
I wonder how much he is asking? He should remember that the super rich as well as war mongers think only in terms of billions.
