House Judiciary Committee Chairman Rep John Conyers Plans Bush Impeachment Substitute
WASHINGTON - House Judiciary Committee Chairman Rep. John Conyers said his panel will explore a variety of George W. Bush controversies, including manipulation of prewar Iraq intelligence.
Rebuffing Dennis Kucinich's calls for impeachment hearings on George W. Bush, the House Judiciary Committee instead will hear testimony about Bush's "imperial presidency" and several of his administration's scandals.
In a press release issued Thursday, Rep. John Conyers, House Judiciary Committee chairman, said his panel will explore a variety of Bush controversies, including manipulation of prewar Iraq intelligence, politicization of the Justice Department, and refusal to cooperate with congressional investigations.
But the Michigan Democrat also left little doubt that the committee's review was meant to fend off demands from Rep. Kucinich that Conyers initiate impeachment proceedings against Bush and Vice President Dick Cheney.
With impeachment ruled out, it's unclear how much the Judiciary Committee's inquiry can accomplish, given Bush's broad assertion of executive privilege when his subordinates are faced with congressional questions about criminal and other wrongdoing.
Conyers's committee faced just that dilemma earlier Thursday when former Attorney General John Ashcroft refused to answer an array of questions about his role in decisions regarding warrantless wiretaps and harsh interrogations of detainees in the "war on terror."
In effect, President Bush keeps broadening his claims of executive privilege - even citing it Wednesday to cover testimony that Cheney gave in 2004 to a federal prosecutor about his role in exposing a covert CIA officer.
Bush knows that Democratic leaders, including House Speaker Nancy Pelosi and Judiciary Committee Chairman Conyers, have long ago rejected impeachment proceedings, the one instrument included in the Constitution for Congress to wield against a President who has abused his powers.
With only six months left in his term, Bush can easily wait out any court challenges to his privilege claims, cases that might take years to litigate.
Nevertheless, in announcing the July 25 hearing, Conyers said his committee would address "possible legal responses" to Bush's "imperial presidency."
"As Chairman of the Judiciary Committee, I believe it is imperative that we pursue a comprehensive review commensurate to this constitutionally dangerous combination of circumstances. Next Friday's hearings will be an important part of that ongoing effort," Conyers said.
Abuses on display
Among the topics cited by Conyers for the hearing are:
- The forced resignation of nine U.S. attorneys allegedly because some balked at politically motivated prosecutions.
- The misuse of the "unitary executive" theory, which involved Bush's presidential signing statements to negate laws passed by Congress.
- The abuse of the government's powers to investigate and detain U.S. citizens and to harm administration critics, including disclosing the identity of CIA operative Valerie Plame after her husband, former Ambassador Joseph Wilson, challenged Bush's use of bogus intelligence to justify invading Iraq.
- The assertion of executive privilege to prevent Congress and the public from overseeing the administration's actions and decisions.
Kucinich, D-Ohio, cited those issues and others, such as sanctioning torture and invading Iraq under false pretenses, as part of his 35 articles of impeachment, which were introduced in June.
The House sidetracked Kucinich's resolution by voting - 251-166 - to send it to the House Judiciary Committee. At the time, Kucinich said he expected Conyers to hold hearings within a 30-day deadline Kucinich had imposed, but Conyers chose not to act.
Kucinich rankled Democratic leaders last week when he stated that he would reintroduce impeachment articles if Conyers and other top Democrats tried to derail his efforts.
Last week, Conyers told Congressional Quarterly that his committee's actions will be limited to a public hearing.
"We're not doing impeachment, but [Kucinich] can talk about it," Conyers told CQ.
While continuing to rule out any attempt to oust Bush, Conyers said Thursday he was alarmed by many of the President's actions.
"Over the last seven plus years, there have been numerous credible allegations of serious misconduct by officials in the Bush administration," Conyers said. "At the same time, the administration has adopted what many would describe as a radical view of its own powers and authorities."
Responding to questions about Kucinich's impeachment resolution, House Speaker Pelosi told reporters that "this is a Judiciary Committee matter, and I believe we will see some attention being paid to it by the Judiciary Committee. ...
"Not necessarily taking up the articles of impeachment because that would have to be approved on the floor, but to have some hearings on the subject."
Before Election 2006, Pelosi declared impeachment "off the table," in part, to avoid alarming centrist voters. Now, with Democrats hoping to gain additional seats in Election 2008, a similar political calculation applies, fearing a backlash against a last-minute drive to impeach Bush and Cheney.
It wasn't disclosed who would appear before the Judiciary Committee, but Kucinich said one interested party is an unidentified foreign official.
"I've been contacted by representatives of a U.S. ally who are seeking an opportunity to appear before the Judiciary Committee," Kucinich told CQ.
"Legislative leaders of a foreign capital" have a "new angle that I haven't thought of before but is relevant," he said. "This interest in whether we've been told the truth has extended to other countries."

With all due respect, the most we can expect from virtually every well-meaning "progressive" are statements like, "You're dragging your feet, John!"
Wow! They have found a "substitute" for the constitution. Perhaps it is separate but equal.
That's right, it wouldn't do to take any actions that smack of "retribution", as one of the Republican talking points would have it.
The Democrats will pretend to hole hearings and their colleagues the Republicans will try not to be laughing too hard at this inside the beltway joke.
Meanwhile many of you will pretend that giving them your vote is change you can believe in.

Conyers and other dem leaders cite all the misconduct and abuse of power but won't seriously do anything about it. Did cheney lay a manilla envelope on his desk as well with incriminating evidence of some sort?
Unbelievable that probably 70% of this country and 99% of the world know that bush and cheney should be ousted or jailed, yet they continue each day to abuse even more power. Can't (or don't want to) imagine where this will lead by the end of the year.

This move by the Democrats is nothing but politics for November. The object will be to paint the whole Republican Party as pariahs.
If it is successful, it will be a greater accomplishment than trying to impeach Bush, and perhaps look like fools in the process.
Besides, it is much too late for them to redeem themselves on the issue of impeachment.
As many of us, such as Glenn Greenwald, now know, more than a handful of Congressional Democrats will never support impeachment because such hearings would expose their complicity, along with that of most Congressional Republicans, in the many war crimes, violations of international law, and violations of our Constitution committed by the Cheney/Bush administration.
These treasonous members of Congress who have chosen their political careers over upholding the oath they took to "protect and defend the Constitution against all enemies, foreign and domestic" have betrayed that Constitution, their constituents, and what remains of our democratic republic.
After we email and call them to tell them this realization, we should then refuse to continue to vote for them. Rather, they want something new and different; they want an independent candidate to run for president. A Washington Post/Kaiser Family Foundation/Harvard University survey in the summer of 2007 found that 58 percent of voters said they would seriously consider voting for an independent in 2008. Furthermore, in recent polls, 60 to 80 percent of registered voters say they want an independent presidential candidate in the upcoming election. The 2008 presidential election offers an unprecedented opportunity for the right third-party ticket.

Why cannot the Committee accept Kucinich's Resolution, which was formally read into the Congressional record? Is there a legal/Constitutional reason for this, or is Conyers just being a pr*ck?
The Democratic Party would rather win elections than protect and defend the U.S. Constitution. Rep. Right now I am starving for answers. It is truly mind-boggling that the Democrats are laying down and playing dead here, throwing us only a milkbone of a hearing to answer questions about "controversies" in the Bush Administration. Tailcap nailed it by pointing out the semantics here. Not crimes, but "controversies." This is incredible.
So, I want to know why. Last night Keith Olbermann had constitutional law Prof. Jonathon Turley on, and he is usually right on the money. He told Olbermann it was astonishing that Congress has not begun impeachment hearings with the plethora of evidence that abounds. Turley said that unless Congress acts, the real truth of what has been happening these last eight years will be lost to us forever.
But even Olbermann missed the mark last night. At that point, he had the perfect opportunity to ask Turley, "So, in your opinion, WHY isn't the Democrat-controlled Congress choosing to abide by the Constitution and begin impeachment hearings?" He didn't ask, Turley didn't offer. It seems that our MSM will go only just so far...dip the toe in the water, and then run away for fear of getting really wet.
I generally don't look for the boogeyman under the bed in every issue, but I am at a loss to explain why this is happening. CD'ers have offered many theories about it, but I want more than theories. I want to know the truth. Where have all the real journalists gone, that will help us sort this out?
So what's the reason? Is it that the Dems are truly complicit in some of these crimes, or is it that they are being blackmailed? Or has some dark, secret deal been made between both parties' leaders, to deliberately keep us in the dark and preserve their own positions?

In addition to the reasons you have listed, this is an election year for the Dems and they feel they have all the momentum in their favor, especially with Dubya's low approval rating and McCain's endless gaffes. From what I have been told, they do not want to lose the momentum and so they are willing to sweep this mess under the rug so they can get elected. Where the action will take place is when enough voters gather and relentlessly keep the pressure on politicians and the media. Change will have to come from the people. We no longer can trust our Congress to serve us. It only serves the wealthy. The adage "the best Congress money can buy" is a very appropriate one. We either need to replace these people with others who will do their jobs or overhaul the system or strongly encourage people to vote third party.
For those of you out there who wish to research this opinion please do so; and then share it with as many of your friends as possible.
Impeachment Proceedings are simply a manner in which to eject an unwanted politician from office. They have no real meaning, no real value as a threat to offenders such as this administration who is laughing at all of you this very moment because you would even entertain such a thought as impeachment.
After their terms expire, they will all retire to their "ranches" or for some others move into high paying jobs with the industrial powers they did all of these favors for. Nothing of any real meaning will have taken place except that a "few" Americans will think that "justice has been served"---even after those convicted would receive pardons from the next president---whomever that would be.
True justice cannot possibly be served without these members from the top to the middle, that is the President's cabinet present and past members, as well as the high level military officers who participated in these illegal wars of aggression----be handed over to the world court for trial as WAR CRIMINALS------in the same manner as Karadzic was just this week.
All of the other "high crimes and misdemeanors" they have committed from lying to the public to rigging court cases against their opponents, are simply small petty crimes. Unless compared to the War Crimes Commissions definitions: then these people are "Master Criminals"
Their "place in history" would remain some what in question, until the next generation takes up the banner and teaches the "revisionist story" of their "hardships" while they did so much for the American people. They could even end up with their images on currency like Grant who over saw the most corrupt administration of the 19th century by many accounts. If convicted as the War Criminals they actually are, they would spend the rest of their lives either in prison, or "living under a bridge near you".
Anything else short of that would be a mockery of justice.
But then when you take American history into consideration they have been mocking justice for their entire history.
Nothing the Americans do surprises me any more; nor the rest of the world I would think.
The irony of all ironies of history will be that a people who could take so much from so many, become the most powerful people on the planet and then collectively be so naive and gullible. It is amazing to me.
I like the reasoning that inaction is due to ALL congressmen have been eavesdropped on AND have been blackmailed into inaction on abuses of power and coerced into support of Cheney/Bush shredding of the constitution.
Sounds like Conyers is a bought out, pathetic, un-American patiot. Was he bought out, intimidated, blackmailed, or compromised? Was he pragmaticaly enticed by other ELECTED reps to tow the line and enbrace the powers that be?

Dear ACLU Supporter,
Here they go again. On Monday, Bush's Attorney General, Michael Mukasey, called on Congress to take dramatic steps to subvert the Constitution.
Mukasey is demanding that Congress issue a new declaration of war that would make the entire globe -- including the United States itself -- a "battlefield" where the president decides who will be locked up forever.
Instead of ending the Bush system of injustice, he wants Congress to make it permanent.
Tell Congress to reject the Bush/Mukasey plan to subvert the Constitution.
Not only has Bush's Attorney General called on Congress to issue a new declaration of war, but he is also asking Congress to:
1. Gut habeas corpus -- the freedom that protects people from being thrown in prison illegally -- with no help, no end in sight and no due process.
2. Cover up the Bush administration's systemic torture and abuse of detainees. Judges would not be allowed to see evidence of torture and abuse and would instead simply have to trust that a president is holding the right people as "enemy combatants."
With only five weeks left in the congressional schedule and only six months left in the Bush presidency, Mukasey's power grab should be laughed out of town. But, given this Congress' track record, the Mukasey proposal is no laughing matter.

Too many times, we've seen Congress cave in to the most outrageous Bush demands for out-of-control powers: The Patriot Act. National Security Letters. The Military Commissions Act. The Protect America Act. And, most recently, the congressional sell-out on FISA.
Four times the Supreme Court has rejected the Bush administration's efforts to design a war on terror system of injustice that defies the Constitution and mocks the rule of law. In the past, the administration has responded, not by respecting the Constitution, but by counting on Congress to legitimize its indefensible conduct.
There is no way we can let that happen this time. Even as the House Judiciary Committee investigates whether high-level Bush White House officials may have committed crimes of torture and abuse, the Bush administration has the arrogance to ask Congress to give it the power to detain people without trial and hide torture and abuse from the courts.
Tell Congress to reject the Bush/Mukasey plan to subvert the Constitution.
We can't take for granted that Congress will reject the Bush/Mukasey plan. We have to meet this outrageous proposal with an immediate wall of protest that says to Congress: "Don't you dare."
I urge you to join defenders of freedom all across the country in raising your voice against Attorney General Mukasey's dangerous proposal.

I tried emailing Conyers via his web site. It wouldn't go through. I just got an error message. I tried emailing the Judiciary Committee and it wouldn't go through. When I clicked on the send button nothing happened. Coincidence?
What a load of bull from the Democrats.
The key point to take away is that its the Democratic leadership that is blocking any move towards impeachment. Since there is clearly evidence, including Bush's own statements, supporting impeachment, its clear that the only thing propping up Bush and Cheney and keeping them in power to the end of their term is the Democrats.
The Democrats are clearly willing to shirk their duty and their solemn oath to the nation, but instead just want to score a few cheap political headlines. No one should ever vote for a party that is so willing to sell the country down the river in exchange for a grab for political power.
The approval rating of this Congress is down in the single digit range one normally associates with Darth Cheney.
The key is to realize that these policies and decisions are very unpopular with the American people. So, the Democrats are not doing this because of a lack of popular support. Instead, follow the money, follow the hundreds of millions of corporate money flowing into Dem party coffers, then you'll understand why the Dems do this.
The Dems do not represent us. The Dems do not represent our interests. A 'win' by the Dems is not a 'win' for us.
I can't stand our Dems, Reps or Progs much longer. Is this all some attempt to wreck our country by keeping everything up in the air so that we can no longer find out anything. We can't trust our leaders, banks, our churches. This must be the chaos theory that some people prefer. We can't even find out anything in court because apparently everybody has executive privilege including congress-persons.

Back in the late 1980's, the Dems abandoned the model of the party they'd been using since FDR. Instead they shifted to a model exactly like the one the Republicans had been using of relying on big bucks from contributors and then consultants and big ad campaigns during elections.
Of course, in becoming reliant on big bucks contributors like the Republicans have been also made the Democrats need to deliver the goods to those contributors just like the Republicans.
So, its not secret spying that 'scares' the Democrats into inaction. Its the very basic fact that the Democrats represent exactly the same constituency of big bucks contributors as the Republicans do.
Note very carefully that Reid and Pelosi openly promised there would be no impeachment months before the last election. They did not do that for the voters. The voters had long been signalling support for impeachment IF Bush had broken the law. Instead, that was a promise Reid and Pelosi made to the big bucks contibutors in order to fund the 2006 campaign.
Since then, they've simply delivered on that promise.
The key is to realize that they don't represent us. They lie to use to con our votes from us. But they represent the people who fund their party. They don't have to be blackmailed into doing that. They've willingly agreed to do that to get the money into their bank accounts.

This is exactly the core of my argument. The Constitution gives them a DUTY to perform. Our freedoms and liberties are based on dividing power between three co-equal branches of government, and then making sure that each branch has checks and balances to restrain the others.
What the Democrats have done is basically say that they are willing to sacrifice this, which in tern sacrifices all our protections from a runaway power-hungry government, in order to gain a temporary political advantage.
I believe that such behavior is close to treason, as they are willing to sell our constitution, our freedoms, and our liberty down the river to grab power for themselves.
Plus, each member takes an oath at the beginning of each session of Congress to 'uphold and defend the Constitution against all enemies foreign and domestic'. This is an oath of office to the American people. They put their hands on a bible or otherwise solemnly swear to do this duty.
That they would shirk this duty for a short-term political advantage is disgusting, its treason against us, and in my mind it completely disqualifies them from holding any public office of power and responsibility.

Step one ... vote for independent candidates that are not corporate-bought. You can easily identify them as they will be the ones that you only see on corporate TV when they are being ridiculed and smeared.
Step two ... don't just go home after voting. Instead, every single person who votes against corporate rule should gather at their local city hall. The key is to make it very, very obvious from the size of the crowd that we won no matter what the voting machines (and more importantly, the VOTE COUNTING MACHINES) say.
If there is a town of a hundred thousand voters, and there is sixty thousand people gathered outside city hall saying they voted for real change, it will be hard for the machines to claim otherwise.
People in the rest of the world know that sometimes you have to fight after the election for the results to take place. Americans need to learn to do this as well.
