Congress Votes to Immunize Lawbreaking Telecoms, Legalize Warrantless Eavesdropping
The Democratic-led Congress this afternoon voted to put an end to the NSA spying scandal by approving a bill to immunize lawbreaking telecoms, terminate all pending lawsuits against them, and vest whole new warrantless eavesdropping powers in the President. The vote in favor of the new FISA bill was 69-28. Barack Obama joined every Senate Republican (and every House Republican other than one) by voting in favor of it, while his now-vanquished primary rival, Sen. Hillary Clinton, voted against it. The bill will now be sent to an extremely happy George Bush, who already announced that he enthusiastically supports it, and he will sign it into law very shortly.
Prior to final approval, the Senate, in the morning, rejected three separate amendments which would have improved the bill but which the White House had threatened would have prompted a presidential veto. With those amendments defeated, the Senate then passed the same bill passed last week by the House, which means it is that bill, in unchanged form, that will be sent to the White House -- just as the White House demanded.
The first amendment, from Sens. Dodd, Feingold and Leahy, would have stripped from the bill the provision immunizing the telecoms. That amendment failed by a vote of 32-66, with all Republicans and 17 Democrats in favor (the roll call vote is here). The next amendment was offered by Sen. Arlen Specter, which would have merely required a court to determine the constitutionality of the NSA spying program and grant telecom immunity only upon a finding of constitutionality. Specter's amendment failed, 37-61 (roll call vote is here). The third amendment to fail was one sponsored by Sen. Jeff Bingaman, merely to require that the Senate waits until the Inspector General audits of the NSA program are complete before immunizing the telecoms. The Bingaman amendment failed by a vote of 42-56 (roll call vote here).
The Senators then voted for "cloture" on the underlying FISA bill -- the procedure that allows the Senate to overcome any filibusters -- and it passed by a vote of 72-26. Obama voted along with all Republicans for cloture. Hillary Clinton voted with 25 other Democrats against cloture. And with cloture approved, the bill itself then proceeded to pass by a vote of 69-28 (roll call vote here), thereby immunizing telecoms and legalizing warrantless eavesdropping. Again, while Obama voted with all Republicans to pass the bill, Sen. Clinton voted against it.
Obama's vote in favor of cloture, in particular, cemented the complete betrayal of the commitment he made back in October when seeking the Democratic nomination. Back then, Obama's spokesman -- in response to demands for a clear statement of Obama's views on the spying controversy after he had issued a vague and noncommittal statement -- issued this emphatic vow:
To be clear: Barack will support a filibuster of any bill that includes retroactive immunity for telecommunications companies.
But the bill today does include retroactive immunity for telecommunications companies. Nonetheless, Obama voted for cloture on the bill -- the exact opposition of supporting a filibuster -- and then voted for the bill itself. A more complete abandonment of a clear campaign promise is difficult of imagine. I wrote extensively about Obama's support for the FISA bill, and what it means, earlier today. With their vote today, the Democratic-led Congress has covered-up years of deliberate surveillance crimes by the Bush administration and the telecom industry, and has dramatically advanced a full-scale attack on the rule of law in this country. As I noted earlier today, Law Professor and Fourth Amendment expert Jonathan Turley was on MSNBC's Countdown with Rachel Maddow last night and gave as succinct an explanation for what Democrats -- not the Bush administration, but Democrats -- have done today. Anyone with any lingering doubts about what is taking place today in our country should watch this:
What is most striking is that when the Congress was controlled by the GOP -- when the Senate was run by Bill Frist and the House by Denny Hastert -- the Bush administration attempted to have a bill passed very similar to the one that just passed today. But they were unable to do so. The administration had to wait until Harry Reid, Nancy Pelosi and the Democrats took over Congress before being able to put a corrupt end to the scandal that began when, in December of 2005, the New York Times revealed that the President had been breaking the law for years by spying on Americans without the warrants required by law.Yet again, the Democratic Congress ignored the views of their own supporters in order to comply with the orders and wishes of the Bush administration. It is therefore hardly a surprise that, yesterday, Rasmussen Reports revealed this rather humiliating finding:Congressional Approval Falls to Single Digits for First Time Ever The percentage of voters who give Congress good or excellent ratings has fallen to single digits for the first time in Rasmussen Reports tracking history. This month, just 9% say Congress is doing a good or excellent job. Most voters (52%) say Congress is doing a poor job, which ties the record high in that dubious category.
The Congress, with a powerful cast of bipartisan lobbyists and the establishment media class lined up behind telecom immunity and warrantless eavesdropping, looked poised to pass this bill back last December, but a large-scale protest was organized -- largely online -- by huge numbers of American who were opposed to warrantless eavesdropping and telecom immunity, and that protest disrupted that plan. Today, Sen. Chris Dodd, the leader of the opposition effort along with Russ Feingold, said on the Senate floor:
Lastly, I want to thank the thousands who joined with us in this fight around the country -- those who took to the blogs, gathered signatures for online petitions and created a movement behind this issue. Men and women, young and old, who stood up, spoke out and gave us the strength to carry on this fight. Not one of them had to be involved, but each choose to become involved for one reason and one reason alone: Because they love their country. They remind us that the "silent encroachments of those in power" Madison spoke of can, in fact, be heard, if only we listen.
Today, the Democratic-led Senate ignored those protests, acted to protect the single most flagrant act of Bush lawbreaking of the last seven years, eviscerated the core Fourth Amendment prohibition of surveillance without warrants, and cemented the proposition that the rule of law does not apply to the Washington Establishment.

What people like jonjoe and PFunk don't seem to get is that we can't vote in Obama, even though he SEEMS to be the lessor of the two evils, and then hope to influence or reform him, because he is one of them. (He's just playing the game the way he needs to play it to get himself elected.) Wanna know why?

I on the other hand will not call a single one. I don't feel it is necessary to thank someone for doing their duty. Their duty is to uphold the Constitution not trample on it as Democratic-lead Congress has just done.
I also do not thank the mailman for delivering my mail. It's his job and that's what I'm paying him for.
I think it's worth repeating what elmysterio stated previously:

Thanks for the link. I'm proud to note that Sen. Bingaman of NM was one of the nay voters. I've become disgusted with Obama of late. How is he any different than the others?
On another note, I'm one of the millions of Americans without health care; I've gone heavily into debt because of a surgery. I still have a condition that has caused pain daily for several months, but I'm unable to get a diagnosis or treatment because I've maxed out my access to indigent funding.
Aside from Nader, no one talks about single payer healthcare. I'm sorry, but Nader will not win. Conservatives will never vote for Nader; even progressives will swallow their pride and vote for Obama.
What do we do if we can't afford to move to another country? I'm thoroughly disgusted with what's happening to this one, even more disgusted with my fellow citizens' lack of concern. Everyone just carries on, distracted by pop culture news and the like.

Adolf Hitler tried an armed coup in Bavaria in the early 20's. It failed, and he ended up in prison. After that he vowed that what he did afterwards would be 'legal'. And it was, including the death camps and the wars and everything. It was all 'legal', because he got the Reichstag to vote him the powers to do it.
Today, our Congress essentially established the precedent that the President can make his own laws. And when others object to working with him because its 'illegal', then all he has to do is to give them his personal get out of jail free card, and then they are free to act 'illegally' with him.

Hell no. If people get mad enough, this is the year to elect some other choice and really change things. This sort of thinking only makes sense if you believe the bull from the Democrats that there are only two choices. There are other names on the ballots, lets elect one of them! I saw something the other day that gave the relative net worth's of the candidates. Hillary and McCain are both worth over $30,000,000.00. Obama is worth a bit over $2,000,000.00
The question is, how did Obama get to be worth $2,000,000.00. The story we are told was that he used to be a street organizer. I've never met a rich street organizer before. Then he went into politics in the Ill state house. That's a nice job compared to many, but I think the pay is in the tens of thousands a year. Enough to live ok, but not enough to become a millionaire from it. Then he became a US Senator. The pay for that is a couple of hundred thousand a year. Again, nice work if you can get it. But you also have to pay to maintain two homes in two expensive cities (DC and Chicago). And he's only been there a few years.
So, how is Obama worth $2,000,000?
Of course, the same can be asked of McCain and Hillary about how they became worth $30 million plus from a career in public service. But I ask the question of Obama because he's supposed to be different. He's supposed to be an agent of change.
So, how did this street organizer who went into politics become a millionaire?
PS ... maplight.org will tell you that through May, Obama has about $275,000 in his campaign accounts from the telecom companies.

I thought if you were going to change the Constitution there was a whole process that you had to go through? Constitutional Amendments and all....state by state vote,
agreeing and ratifying. But, I guess when there is no longer a functioning Constitution people can do whatever they wish and call it whatever...as in these are the new laws retroactive to when we broke the laws of before.
People who is it that you think you owe an allegiance too? Mine Is to the US Constitution which these criminals in Washington and in State Assemblies around the nation have broken faith with. 2. What are you going to do with the private companys that collect data from phone conversations and private email if they can't collect data on a random 24/7 basis?
We have spent 500 billion dollars over 5 years on private corporations building spy computer networks to capture and keyword search millions of phone calls and emails per day.
In other words, warrantless data collection is how and why these companys exist. If they had to wait for a proper FISA warrant for every tap, they would be out of business in a week.You wouldn't be able to get approval at the speed of millions of phone taps and emails a day ? Would You?
The answer to this Constitutional delima is under our noses, its huge, its the reason they don't want the lawsiuts to hit the light of day.
Our elected officials are in it up to their eyeballs and they have been shaking in their shoes wondering how they can keep this huge attack on our 4th amendment rights quiet, and save these company's from going out of business.

I think if one were to dig up, say, LBJ or JFK and describe George Bush to them -- not letting on that he now occupies the White House -- they'd probably say: "Nah, are you kidding, an idiot like that, he wouldn't have a chace in hell of being nominated or elected president. ... And what's that: the Democrats would enable him in virtually everything he'd do. hahahahahahahahaha ARE YOU OUT OF YOUR EVER-LOVIN' MIND?!"

wsws .... the most interesting thing that came to my mind when you mentioned LBJ and MLK Jr in the same post is the memories of the FBI wiretaps they had on Dr. Martin Luther King Jr.
There was a man openly preaching peace. He also preached resistance and struggle to achieve change. But he always preached to do it peacefully. Remember that he was constantly wiretapped by the government.
The Congress in the 70's attempted to put some restrictions on this sort of wiretapping of a peaceful citizens who is only trying to exercise his rights to be active politically. Obama basically just voted in favor of overturning those reforms.
I used to live not all that far from the King Center in Atlanta. If I still did, I'm pretty sure I'd hear the good Doctor turning over in his grave. And my personal guess is that if Dr. King were still alive, he'd be out here in Denver next month leading a protest march against the Dems and Obama.
The FBI was always careful to wiretap MLK Jr's phone, but they somehow managed to overlook a redneck sniper lying in wait for several hours behind his hotel in Memphis, Tennessee.
Come to Denver next month in the millions and give the Democrats heck to their face! Or at least their rears as they hustle into luxury hotels behind barricades and walls of riot police placed to make sure no real citizen can speak to them.
I want so many people here that we can stand in the millions around the 'Tin Can' and even after being pushed back by the fences and the storm troopers we are still so loud that they can here us inside of the arena and over the sound system. I want to hear such a noise that even when they try to air their four-day infomercial of lies known as a 'convention', what the world hears is our voices in the millions drowning them out.

Kaila is getting elected more important than upholding the very Constitution you swear an oath to protect?
Kaila do all ends justify all means? Would it be alright for a priest to steal a Bible in order to quote the 10 Commandments in a sermon? Does an ethical issue arise when he gets to: "Thou shalt not steal"?
This just makes me think something else is at work here. What would you think if, say, Muhammad Ali in his day, continued to loose match after match to 3rd rate amateurs? You wouldn't call him a sorry excuse for a boxer, you think he was either being paid off or blackmailed. You're right. The Cloture vote would be a somewhat better guide.
It seems like I read somewhere that Ted Kennedy left the hospital (against the wishes of his family) to be there for a vote. I'm not clear what vote that was, but his name is not on that list. I'll have to do some digging for more info.
It's been said that in the runup to total fascism in Germany, the honest legislative branch of government tried to function and was so weakened it couldn't and it had to die. But in that case, they were up against a so-called "charismatic" leader who had the entire nation enthralled. That's NOT where we are. If the Dems don't give Bush what he wants right now, Bush could and likely will stage a false flag attack (likely on Port of Houston). He would then blame the Dems for restricting his ability to have thwarted said attack. Major electoral blowback on the Dems occur and we get a Repub prez and lose seats in Congress.
The Dems are compelled to give Bush what he wants now to avoid getting blamed for such an attack before the election. After the election they can undo what's happening now regarding immunity.
So give baby Bush all the tools he needs right now so he can't blame the Dems and Congress for any false-flag attack he and Cheney contrive and execute before the elections and all the blame falls on the Repugs if one occurs. Undo it after the election.

Big Brother George with the help of his Big Sister, Nancy, are conspiring with the new House approved FISA revisions to take away our privacy giving the government the legal right to spy on citizens without warrant and providing telecom companies (i.e., Pelosi donors). This bill was passed by the Senate today and will go to a joyful Big Brother for signing.
In 1984, Orwell outlined a vision of an all observing government that uses constant surveillance to keep its citizens under police state control. How did his fictional society of Oceania come to that fate: through constant war. Now in 2008 America, constant surveillance is dawning on a non-fictional day of an extremist US government using constant war, threats of war, and profound propaganda to keep our nation under control.
In Orwell's Oceania, the "Ministry of Truth" disseminated propaganda. The protagonist of the story, Winston Smith, had the job of being a revisionist for the "Party" and one of his main duties was to fit news stories to the current Party Propaganda of the day. Does this sound like news in today's America where war profiteers not only own the news, but the Pentagon sent agents to our TV screens to propagandize for war? Scary.
Our current Department of Defense was more appropriately entitled the Department of War before the Pentagon was built after World War II, but in Oceania, the war department is called the "Ministry of Peace," because as in the book and as in Bush World, "War is Peace."
The most insidious and frightening ministry in 1984 is the "Ministry of Love" which uses physical and psychological torture to punish or re-program back sliding party members. At the end of the book, Winston is tortured until he admits that "2 + 2=5" and that he loves "Big Brother." Nancy Pelosi was briefed on Big Brother George's torture policies and methods back in 2002, and she did nothing. NOTHING!! Humans are being tortured with the consent of Big Brother George's Big Sister, Nancy Pelosi.

Let's get beyond the general term "lobbyists" and see some names, faces and addresses.
Wrote Obama and said i wouldn't vote for him if he voted Yes on this. He's lost my vote and nothing he does will get it back. Unless Cynthia pulls something similar (unlikely) she has just got my vote.
So, the corporations have won.
There is nowhere to go but down now. So be it.
All empires end. At least the reality of the situation cannot be denied by the true believers anymore. Rupublican = Democrat = Corporation. There is no difference.

It was my post. Kennedy went to Capitol Hill to give a critical vote to end a Republican filibuster on an important Medicare bill. Here is a guy battling cancer who goes to fight for a bill that will protect an important service for people. I am not a Democrat and never will vote for one, nor will I ever ever ever vote for a Nazi, excuse me Republican, but I just thought it was interesting to see a rare glimpse of political leadership.

This would be acceptable if we had a benevolent dictator. Instead we have a corporate guided zealot who manipulates science and other issues to suit their agenda. He was handed the presidency by five politically motivated justices, and then allowed a free reign by
an apathetic populace and defaulting legislators.

If the Dems had any political sense, or sense of opposition to Bush, a terrorist attack right now should be a godsend to them and guarantee their victory in the fall. The key would be for the Dems to immediately use that to visciously attack the Bush administration and the Republicans for failing to protect the country. A terror attack at this point should be used by the Democrats to prove the complete failure of the Republican policies.
The problem is of course that these are also the Democrat policies.
But still, the Dems should not be quacking in their boots over fears of some 'false-flag' attack. They instead should be viewing such an event as the political opportunity of the decade.
And in general, I'm tired of this whole 'the Democrats don't act because they are afraid' theme. That con may have worked right after 9-11, although even then I think a strong voice standing up to Bush would have been very popular. But by now its obvious that its complete bull.
The Dems keep voting for these policies because these are the policies they want and support. Its that clear. Its that simple. Forget all these contorted explanations about how the Dems have to do these things that they don't want to do. That's just propaganda which has the purpose of hiding the true nation of the Democratic party.
The Democrats voted for the Patriot Act. They voted for all sorts of extensions to the Patriot Act. They've voted to expand FISA already. They've already voted to give Bush retroactive immunity for these crimes (today only extended that to the telecoms). The Democrats had no problems with the parts of this bill that expand FISA even further. And they've been aggressive in making sure that this administration is not investigated by Congress and not impeached over all of this.
Face facts, these policies that are abhorrent to us are the policies that the Democrats support and have enthusiastically been helping to implement. Quit hiding behind all these bs theories. This is exactly what the Democrats want.
btw...Senator Rockefeller was one of the Democrats to be briefed on spying in 2002...along with Pelosi.
Come on people...ROCKEFELLER...did you think anyone named Rockefeller would stand up for the people?
Today is a bad day...but we can't give up.
Vote 3rd party, vote independent and call Obama's campaign
and ask for a refund of your contributions...if I had given
him any money, I would.
