Congress Votes to Immunize Lawbreaking Telecoms, Legalize Warrantless Eavesdropping
The Democratic-led Congress this afternoon voted to put an end to the NSA spying scandal by approving a bill to immunize lawbreaking telecoms, terminate all pending lawsuits against them, and vest whole new warrantless eavesdropping powers in the President. The vote in favor of the new FISA bill was 69-28. Barack Obama joined every Senate Republican (and every House Republican other than one) by voting in favor of it, while his now-vanquished primary rival, Sen. Hillary Clinton, voted against it. The bill will now be sent to an extremely happy George Bush, who already announced that he enthusiastically supports it, and he will sign it into law very shortly.
Prior to final approval, the Senate, in the morning, rejected three separate amendments which would have improved the bill but which the White House had threatened would have prompted a presidential veto. With those amendments defeated, the Senate then passed the same bill passed last week by the House, which means it is that bill, in unchanged form, that will be sent to the White House -- just as the White House demanded.
The first amendment, from Sens. Dodd, Feingold and Leahy, would have stripped from the bill the provision immunizing the telecoms. That amendment failed by a vote of 32-66, with all Republicans and 17 Democrats in favor (the roll call vote is here). The next amendment was offered by Sen. Arlen Specter, which would have merely required a court to determine the constitutionality of the NSA spying program and grant telecom immunity only upon a finding of constitutionality. Specter's amendment failed, 37-61 (roll call vote is here). The third amendment to fail was one sponsored by Sen. Jeff Bingaman, merely to require that the Senate waits until the Inspector General audits of the NSA program are complete before immunizing the telecoms. The Bingaman amendment failed by a vote of 42-56 (roll call vote here).
The Senators then voted for "cloture" on the underlying FISA bill -- the procedure that allows the Senate to overcome any filibusters -- and it passed by a vote of 72-26. Obama voted along with all Republicans for cloture. Hillary Clinton voted with 25 other Democrats against cloture. And with cloture approved, the bill itself then proceeded to pass by a vote of 69-28 (roll call vote here), thereby immunizing telecoms and legalizing warrantless eavesdropping. Again, while Obama voted with all Republicans to pass the bill, Sen. Clinton voted against it.
Obama's vote in favor of cloture, in particular, cemented the complete betrayal of the commitment he made back in October when seeking the Democratic nomination. Back then, Obama's spokesman -- in response to demands for a clear statement of Obama's views on the spying controversy after he had issued a vague and noncommittal statement -- issued this emphatic vow:
To be clear: Barack will support a filibuster of any bill that includes retroactive immunity for telecommunications companies.
But the bill today does include retroactive immunity for telecommunications companies. Nonetheless, Obama voted for cloture on the bill -- the exact opposition of supporting a filibuster -- and then voted for the bill itself. A more complete abandonment of a clear campaign promise is difficult of imagine. I wrote extensively about Obama's support for the FISA bill, and what it means, earlier today. With their vote today, the Democratic-led Congress has covered-up years of deliberate surveillance crimes by the Bush administration and the telecom industry, and has dramatically advanced a full-scale attack on the rule of law in this country. As I noted earlier today, Law Professor and Fourth Amendment expert Jonathan Turley was on MSNBC's Countdown with Rachel Maddow last night and gave as succinct an explanation for what Democrats -- not the Bush administration, but Democrats -- have done today. Anyone with any lingering doubts about what is taking place today in our country should watch this:
What is most striking is that when the Congress was controlled by the GOP -- when the Senate was run by Bill Frist and the House by Denny Hastert -- the Bush administration attempted to have a bill passed very similar to the one that just passed today. But they were unable to do so. The administration had to wait until Harry Reid, Nancy Pelosi and the Democrats took over Congress before being able to put a corrupt end to the scandal that began when, in December of 2005, the New York Times revealed that the President had been breaking the law for years by spying on Americans without the warrants required by law.Yet again, the Democratic Congress ignored the views of their own supporters in order to comply with the orders and wishes of the Bush administration. It is therefore hardly a surprise that, yesterday, Rasmussen Reports revealed this rather humiliating finding:Congressional Approval Falls to Single Digits for First Time Ever The percentage of voters who give Congress good or excellent ratings has fallen to single digits for the first time in Rasmussen Reports tracking history. This month, just 9% say Congress is doing a good or excellent job. Most voters (52%) say Congress is doing a poor job, which ties the record high in that dubious category.
The Congress, with a powerful cast of bipartisan lobbyists and the establishment media class lined up behind telecom immunity and warrantless eavesdropping, looked poised to pass this bill back last December, but a large-scale protest was organized -- largely online -- by huge numbers of American who were opposed to warrantless eavesdropping and telecom immunity, and that protest disrupted that plan. Today, Sen. Chris Dodd, the leader of the opposition effort along with Russ Feingold, said on the Senate floor:
Lastly, I want to thank the thousands who joined with us in this fight around the country -- those who took to the blogs, gathered signatures for online petitions and created a movement behind this issue. Men and women, young and old, who stood up, spoke out and gave us the strength to carry on this fight. Not one of them had to be involved, but each choose to become involved for one reason and one reason alone: Because they love their country. They remind us that the "silent encroachments of those in power" Madison spoke of can, in fact, be heard, if only we listen.
Today, the Democratic-led Senate ignored those protests, acted to protect the single most flagrant act of Bush lawbreaking of the last seven years, eviscerated the core Fourth Amendment prohibition of surveillance without warrants, and cemented the proposition that the rule of law does not apply to the Washington Establishment.

I once would have supported Obama. No longer.

Obama still needs to be nominated at the Democratic convention. The delegates in attendance can still vote their consciences. Why vote for a man who has abandoned his?

If you believe in the rule of law not the rule of men and support the constitution and you vote for Obama how can you believe in the rule of law or the constitution? How can you with straight face consider that you have any rights at all derived from the constitution. Only a constitutional amendment that carries in all states can change the constitution.
Obama will rule like Bush and do what he wants. You can stuff it about your rights slave. Go back to your cubicle.
We now know that a vote for Obama is a vote to vanquish our own rights and safety. With posse commitas gone do not complain when jack boots arrive at your door turn you into a refugee and take all you own. You have given up all that would protect you.
Obama can not now place his hand on the bible and swear to support the constitution as president. He has already voted to destroy the fourth amendment of constitution and free those that have broken constitutional law. How can you expect any justice at all from him?

Well, droth, this was Obama's ultimate test, wasn't it? And while he swore what he would do in clear terms, he let us all down. He sure could have started leading before even being elected but now he's shown himself as Yet Another Goddamn Liar.
What is your alternative suggestion, then? The Republicans just screw us faster, McCain is YAGL and clueless too, and a vote for Nader or equal is a vote for McCain, so where do we go from here?
I still keep seeing this pure silliness that somehow Bush\Cheney will cling to power. Even if they wanted to, the powerful forces that put them in power won't stand for it. They've already got a bought-and-paid-for replacement lined up in Obama. If there was any doubt before today about him supported the same policies, surely this ends it.
The role of the Democrats in modern politics is to be corporate America's B-team. When the Republicans wear out their welcome with the American people, the Democrats step in and do the following ...
-- make sure the policies put in place by the Republicans stay in place.
-- protect the Republicans from impeachment and prosecuition
-- continue to expand Republican pro-corporate policies where possible.
They continue this until the Republicans can rehabilitate their image and return to power.
This is the history of the Clinton administration. This Congress has presented only confirmation of this. And Obama is a dead-cinch-certainty to continue it.
So, there's not a chance that Bush\Cheney will cling to power. The system is well designed to handle removing them and replacing them without any loss to the powerful who control they system.
I have a crazy idea, tell me what you think. If the NSA and bush want to spy on the american people why don't we give them something to spy on? You know call a friend tell them bomb this place kill this person, really jam up those NSA computers. Make them understand that we demand our rights and our privacy. Like I said it is a crazy idea.
So, we keep hearing the line of bull that if we elect Obama we can then 'hold his feet to the fire.'
How'd that work out in this case?
And remember, you've got far more influence and ability to pressure 'candidate' Obama than you will have with 'President' Obama.
You get one chance to have a say in the American system once every four years. That's when you get to vote. That's it. Don't waste your vote on Obama.

It is unbelievable that our Constitutional Freedoms could be bartered away in the Senate on a quite summer's day in 2008.

What I find odd is that while Obama supported the bill, Hillary voted against it. What I'm wondering is if she voted against it because:
a) She knew it would pass with or without her vote.
b) To show the 'progressive' democrats that Obama was a bad choice and they "should" have voted for her.
c) To make Obama look bad (Which he's doing a good job of on his own).
Well, as usual, money trumps democracy. Dosen't anybody in Congress have any morals? It just astounds me that these facists so readily cave to lobbyists and campaign money, and so totally ignore what the American people want. What happened to statesmenship and doing what's right? What happened to following the Constitution and preserving America's values and institutions? Why are these ideals so sorely missing in Congress? Is the lure of big money so enticing to these bastards that they trash our country in the process?
Sombody should compute how many votes it takes to equal the effectiveness of one lobbyist (10000 to 1?), or how many votes it takes to have the same affect as $1 million dollars in campaign contributions. THAT would be a telling figure.
And Congress and the Senate claim to represent we the people? I think not. Disgusting, anti-Constitutional and totally disgraceful on the part of both houses. Nice work, ladies and gentlemen - betrayal of the Constitution gets easier each time you do it, don't you find? Sort of like murder.
Also, remember that when the criminals make the laws, they can and will legalize their crimes.

We all vote for third party candidates. It is time to put aside the tired, common excuse "third party candidates never win." If you are Democrat or Republican, change to Independent. We actually do have an option out of this nightmare. Be sure that your family and friends all understand what has happened. Tell them to tell their friends to vote third party. Be sure they vote third party at all levels of government.
ThinkForYourself: I support your idea of flooding the NSA with bogus hits. I suggested a while back on an article here at CD that we all put keywords in the signature of all our emails... Something like "Bomb, Kill, Assassinate, terrorist, attack, murder, bush, plot" etc...
BigStinky ... when the influence of a voter is zero, then attempt to calculate a ratio like you propose goes to infinity. Ie, it takes an infinite number of voters to equal one lobbyist. Or, one well-funded lobbyist can out-weigh any possible number of voters. Or, a computer, which doesn't deal well with vague concepts like infinity, would simply give you a 'divide by zero' error.
When you see a vote like this when Bush has the lowest approval rating of any politician in history, and Congress has an approval rating that's down below Dick Cheney in single digits, then the above is close to proven. The politicians apparently have no fear of pissing off 70%, 80% or 905 of the voters, as long as they retain the support of the lobbyists.

I keep wondering why so many in Congress go against the will of the people. All I can come up with is blackmail. Remember all those Washington parties that made the news about 7 years ago - with gambling and prostitutes, etc? Remember the Abrahmoff scandals? These were going to bring many high-level people down. There were photos taken and placed on desks. There was wire-tapping and recordings. How else can you possibly explain any of this? Who can possibly investigate any of this? No one. The courts are stacked against truth and justice.

Who do these people think they are? It is difficult to express my outrage at the passing of this bill.
It is one thing for a president to break against the constitution and get away with it because no person dares to prosecute him; it is a completely different story if congress actually passes into legislation unconstitutional laws. In doing so, they become an obsolete entity, not fit to rule, pass or enforce ANY laws!
Again, who the hell do these people think they are?! They have no right to monitor their equals without court orders and reasonable suspicion of crime.
My answer to people when they say, "But if you have nothing to hide, then it shouldn't bother you." First, I say, the one thing I have to hide is my radical and unflinching disapproval of laws that allow tyrrany to destroy democracy. Second, all have sinned and come short of the glory of God; there is a reason law enforcement is not supposed to work 100% of the time and it mostly has to do with letting some mistakes slip by, allowing people the space for their souls to grow.

When Clinton did his thing with Monica and lied to us about it, it brought out similar displays of outrage and divisions among us. Did it do any good? It siphoned enough votes to Nader and others (we know the GOP cheated but if we had voted in force like we did in O6, we could have overcomed even that) to enable Bush. In a way, Bush is our fault. Are we going to repeat history and make the disaster-in-waiting that is McCain, our fault again?
I am as disgusted as the rest of you but unless we unite in a workable strategy to get our people elected, all this is just throwing the baby out with the dishwater.
Excuse me, but did you all miss the fact that "they" voted or Did not vote for the end of 'merica quite some years ago. How is it that many of you seem to have an alligeiance to the Democrats or Republicans, those in Washington governing? Again I ask, by what right do they claim to represent and govern if it is not the US Constitution? Sure, they seem to be the only game in town, but when not acting under the auspices of the US CONSTITUTION they are illegal and frauds if not worse.
If not NOW when might it be time disavow these traitors, to call for a new awakening and a new Constitutional Convention? Maybe it is time to rework that "ole piece of paper" into a new beginning? Not to throw out the whole of the original but to rework it into the Living Document it was and is meant to be. Is it not only our right but our duty to do so as stated in the original? Our government has been taken over without a shot........with schock and awe, lies and fear mongering and who dust it serve now?
