Tenant Banned from Flying Flag Upside Down, Gets Death Threat
Meet Dale Decker, 31.
He lives in Manitowoc, Wisconsin, about an hour north of Milwaukee.
On June 25, he decided to fly the American flag upside down on the patio of his apartment.
Decker is upset about the Iraq War, he's upset about the loss of civil liberties in the United States, he's upset about the plans he says are under way for a North American Union with Canada and Mexico, and he's upset about our economy. He himself is unemployed.
"People in power are not looking after the people's best interests but their own interests and their corporate cronies' interests," he says. "It's really sad. I've got two children, a six year old and a five year old. I love them to death, but I fear for the future that beholds them."
He says he wanted to signal to his neighbors that this country is in distress, so he started flying the flag upside down.
Two days later, Manitowoc police officer Jason Delsman came to his door. But Decker was at Wal-Mart, so, Delsman left his business card with a handwritten note, "Call ASAP."
Decker decided to go down to the police department, but Officer Delsman was out, so Decker called him on the phone from there.
"He told me I was committing a criminal act and could face fines or imprisonment," Decker said.
When Decker asked for the statute criminalizing this, he says Officer Delsman responded: "I'm sure that it is somewhere."
According to Decker, the officer also said: "You fly your flag at night with no light on it. The next time I see that I'll have to do something about it."
Decker says he stood his ground: "I told him, 'I know I'm not breaking the law, but if you can come to my house and show me the statute, I'll take my flag down. Otherwise, I'll keep flying it.' "
Sarah Millard, who covered the story for the Manitowoc Herald Times, reported that "Deputy Chief Bridget Brennan said Delsman was responding to a complaint received from the public. She confirmed the request was made to remove the flag, but said Decker was not warned or threatened with a citation or criminal charges. No paperwork was filed on the incident, she said."
About fifteen minutes after Decker returned home from the police station, he says the manager of the apartment complex came over and knocked on his door.
"She proceeded to berate me," he says. "She called me an asshole. She proceeded to explain to me that I was disgracing my country, my fellow citizens, and the soldiers who so valiantly fought and died and are now fighting and dying for our freedoms."
He says she told him that "the owners of the complex, Premier Real Estate, have demanded that all flags on the property have to be take down, even those that are rightside up. She showed me the lease that says you can't attach anything to their property."
Paul Lee, regional manager of Premier Real Estate, told the AP: "We certainly have no objection if it [flying the flag] was done properly. . . . We would have a problem with anyone showing disrespect."
Decker says the one other tenant who was flying a flag, rightside up, no longer is.
Decker isn't flying his, either.
"I had to take it down because I can't afford to have my family evicted," he says.
But he hasn't given up on expressing himself with the flag.
"I just put my flag union down on my pole and walk around town," he says.
The reaction has not been positive.
"I didn't know that in the land of the free that a peaceful act of patriotism could bring out such violent tendencies in people," he says. Decker says he's been called "asshole, dickhead, cocksucker," and a lot of other names.
He says one man, with a kid between the ages of 8 and 11, went after him in the parking lot at McDonald's, saying, "I'm going to come over to your house and kick your ass right now." The man also said, according to Decker, "If you keep up what you're doing, a vet is going to find you and put a bullet in your head."
Nonetheless, Decker says he's determined to walk around town again with his upside down flag.
"Because it's my right," he says. "I am doing it to upset people. You've got to get down to their core."

Show AllIf I'm going to piss people off with flags, it's going to be by sending positive message--like flying a red flag on May Day--rather than a purely negative one like flying the U.S. flag upside down. :) Advocating what you would like as an alternative is a lot better way to communicate your views than simply dumping on what you hate.
Of course, I realize this Dale Decker guy might not have had any specific alternative in mind. But if not, he should have been ready to get a lot of hate. People *do not* want to hear you bitch about problems in the absence of solutions. That's something you learn real quick if you engage in any serious debates over fundamental aspects of our political system, like its inherent white supremacy or the way that it respects capital over human beings.

It is hideously inappropriate to show the Flag as a background for any politician or any of the psychotic monkeys trying to destroy what the Flag really should mean.
Anyone who feels like it has the right to fly the flag sideways if they like. Maybe a show of upside down flags all across the nation might scare a few politicians straight.
I always have found this uniquely USAn flag-fetishism/idolatry to be both hilarious and more than a little creepy.
This US flag worship is uncannily like the old pre Vatican II stuff surrounding tratment of consecrated eucharist wafers in the Catholic Curch (must NEVER be chewed - it would be like biting Jesus; must ONLY be handled by a priest, and NEVER allow it to fall on the ground!)
As a young Catholic kid, I used to notice these similarities, and it really reinforced my belief in those days in the God-chosenness and divine exceptionalism of Amerikkka.
And so, my county has special flag cemetaries in two of it's parks for proper cremation and burial of USAn flags that are soiled (never put a US flag in the laundry - VERY blaspemous) or touch the ground.

However, I consider the display of an American Flag bearing Gold-Fringe (as can be seen in any Courtroom, or political-Ad/Speech/Congress today) a FAR greater insult to our country (and what it "stands-for") than displaying the Flag upside-down, as a "distress-signal".

I see what you mean. But the false patriotism of the Bushies and their use of it doesn't mean that you condemn the whole country or stop loving its freedom.
Our troops in the field are being misused. Of course its about the oil. Who would give a darn about Iraq unless there was oil there. But once again, its not their fault. So please don't disrespect them.
As to Mr. Decker flying our flag upside down as a sign of his protest or using the extremely weak resasoning that it symbolizes our country is in distress...flying the flag upside down is done to signal personal danger and the need for help, not to be done for political reasons.
Its a symbol of contempt for America, perhaps acceptable in a very small circle, but most Americans will take it for what it appears to be, symbolizing hate for our country and contempt for its laws and customs.
I truly don't know whats in Mr. Deckers heart, I have to go by his actions and his statements as to what and who he is. What else do we have to go by?
That said, I could be wrong as you say, but I hope Mr. Decker decides to do his protesting in a proper way in the future so it won't be misconstrued.

Significantly missing from this story is the realiation that flying a flag upside down is an internationally recognized sign of distress. This is not an issue of disrespect but, rather, one of free speech protected under the first amendment to the Constitution.
You are absolutely correct about the first amendment protecting your right to do this. That doesn't mean its the right thing to do. And it is not.
If nothing else, if you want to be effective or make a real point, don't do something that offends well over 95% of the people you are trying to change. Not too successful usually.

I live in a very small town in North Dakota. My husband and I decided to fly the flag upside down this weekend to show how we feel about the horrible mess our country is in. My husband is a Vietnam veteran. He has done his duty in the service of this country. Mr. Bush not only got out of serving this country when he should have, but has now done more harm than any other single person has ever done to this country. North Dakota is a very red-conservative Republican state. There were alot of people around here this weekend. Nobody said a word about our flag.

Thanks to cactuspie for doing the homework for us. This is important information for all of us to know. It is especially important to tell any "patriots" when they complain about our flag that it is not to be worn as a sweaty piece of clothing, hat, or shorts.
I live in a neighborhood where American flags are frequently left outside in the dark without a spotlight shining on them (you may not know this but our flag is afraid in the dark). That is a violation of flag treatment by people who certainly consider themselves "patriots."
What was it again? Ah yes: "he who is without sin cast the first stone."

Robert Bellah's concept of "civil religion", promulgated c. 1967, ought to be recognized as equivalent to the work of Pasteur and Koch, insofar as he formally identified a form of mental illness which had plagued the nation since its inception, then metastasized into successively more virulent and lethal forms.
The symptoms described in the article have been extensively documented elsewhere. In general, it involves self-proclaimed Patriotic Citizens and/or law enforcement officers bumptiously confronting a person or person lawfully exercising Constitutional rights in a manner which challenges jingoistic orthodox pieties held by the Offended.
A characteristic of this pathology is that when duly appointed law enforcers initiate or are drawn into the confrontation, they do so without citing any legal basis for their intrusion. Instead, the law enforcer reverts to lizard-brain aggression and bullying. Or perhaps assumes the color of law by simply making pretextual and self-serving charges, e.g. Violating the Flag Code, Resisting Arrest, Creating a Public Nuisance, Aggravated Mopery...
This dynamic is not the social behavior of a Solid Citizen and a Dispassionate Professional Law Enforcer coping with a troublesome scofflaw. Rather, it is the social behavior of a devout orthodox Amerikan Patriot and a Priest consecrated to Enforce Civil Order by ruthlessly and righteously eradicating Civil Sin, wherever it may manifest. Such eradication is commensurate with the gravity of the Sin; sacrelegious displays of dissent merit harsh reprisal. To permit such flagrant disrespect for the Civil Religion is a dereliction of unspoken duty and a prescription for social decay.

If you watch the video, the flag is attached to a balcony railing.
All this guy needs to do is mount his flag on two free-standing poles. It would then no longer be "attached" to their property.

"To ensure that the right of an individual to display the flag of the United States on residential property not be abridged." Whether this applies to renters, I'm not sure.
It amazes me that these dolts rant about what the flag represents all the while trying to restrict those rights for people they disagree with.
Anyone in the area of Decker's town should document all the flag violations that have been ignored like those used by business and individuals. Use their own tactics on them but overwhelm them with what THEY are doing that is disrespectful.

I would think that a United States citizen clearly has the right and "obligation" to indicate to fellow citizens that we ARE in an instance of extreme danger to life and property -- and to signal with the flag "Union down" that it is a time of "dire distress".

I used to burn ugly, worthless American flags just for a bit of excitement, but nowadays, by the time I get around to doing this, my flags are usually too soaked in vomit and excrement to catch on fire. What is a radical to do?

Technically Mr. Decker is right to fly the flag upside down as a signal of distress but wrong about flying it at night without proper lighting. But I would argue that most uses and displays of the flag these days are a violation of Title 4; flags attached to plastic sticks in car windows (especially frayed and dirty), clothing with the flag on it, using the flag as a graphic background on TV sets or putting words on top of it and even the flag lapel pin violates the spirit of Title 4. The colors are meant to fly freely. But it is sad indeed that so many self righteous hypocrites immediately resort to threats and violence against those who don't follow their beliefs. The flag represents something different to each individual and at different times. Mr. Decker should keep a few copies of the pertinent parts of Title 4 around to hand to these ignorant false patriots. And I believe ignorance leads to fear, which leads to anger, which leads to hatred, which leads to violence. There are many stories like this of people flying the flag upside down and being attacked. Freedom of speech and expression are nearly dead in America. But I like the idea in the first post, a National Day of Distress where flags are flown upside down across the land!

Upside-down, right-side up, sideways, or backwards, flags are nothing more than nationalistic propaganda condensed into a symbol on a worthless scrap of fabric.
The US flag just happens to be made out of Wonder Woman's panties.
I'm impressed that someone Decker's age is doing this. Most people who came of age since 1980 are so brainwashed by right-wing values that they would never even conceive of doing such a thing, even people who consider themselves "liberal."
And to the commenter who said that American fear "does not change", I say it certainly has since 1980, and I'd also say that it's not so much fear as hostility. In the 60s and 70s, before Reagan created today's aggressive and violent right-wing culture, flying a flag upside down did not attract the kind of violent, even murderous aggression that it does now. Nor was the flag regarded with the quasi-religious reverence that it's lavished with today even by Americans who consider themselves liberal. That irrational reverence is the result of another feature of the post-1980 US social landscape: extreme religiosity.
And about putting flag postage stamps upside down, I once had an office courier rip a stamp off a letter I'd posted and throw it on my desk because I did that. And I got nowhere protesting his behavior to him; he was scarlet with rage and impervious to reason. Later found out he was a Rush Limbaugh acolyte. No fear in people like him, only hostility. Gosh, those right-wingers are sure preserving our freedom, aren't they?

I don't know why you (veterans above) think a couple of tours in Vietnam give you any rights. This is Amerika! By the way, those assholes doing the most yelling probably never did a tour of duty anywhere. That seems to be a trait of the Neocon chicken-hawk crowd. Chicken shit would be a better discription. emkay, I also lost the thrill of seeing our flag flying during my years in the Army, sometime during the Vietnam years. After awakening to the fact that our government is just as corrupt as any third world ruler. Folks, it's all about MONEY. If it makes the rich folks richer it is a good thing, and to hell with the common man. So a
few thousand get killed, they didn't contribute to
the election funds anyway.
This makes me want to fly Mark Twain's version of the American flag more than ever.

Americans as a whole are afraid and intimidated. Fearful and cowed people react with anger and violence. This does not change.
It's a practice of many to stick US Flag postal stamps upside down on the envelope...is that against the law? Maybe it will be soon...
Who says you have to fly one upside down on your own property? Flag stickers are pretty cheap.
I'm part of a small group of people who demonstrate locally every Wednesday after work against the occupations and the illegitimate Cheney-Bush junta. (I'm not there every week, but the group is.)
Our main organizer showed up a year or so ago with a large banner with a picture of the U.S. flag upside down. Nothing that we had done at that main intersection of our little town prompted more outrage--not having someone in an orange jumpsuit and a black hood stand on a carton with wires attached, not hanging a piñata of Bush--nothing. We even had people shout that they agreed with most of what we were saying, but that we needed to turn the flag back rightside up. One such guy was practically in tears.
I yelled back once, "That flag represents our country and its government, which are currently upside down. When they are back rightside up, we'll turn that flag accordingly", but this made no difference.
Is it any surprise that most of the sheeple are brainwashed? Kids are forced to worship that flag each day that they attend public school. In Boy Scouts it's even worse. Sporting events begin with a flag worship ceremony. In the U.S.A. symbols and words are everything; reality is nothing.
By the way, one of our guys brings a folding chair, as he can't stand up more than 20 minutes or so at a stretch, because he still has schrapnel in one calf from Vietnam. Still he gets no respect from the sheeple.
Americans who cannot think seem to be the real disgrace. Too bad they are also the ones who do not want YOU to.

Flags are rags, it's that simple. I don't own one, won't fly one and sure as hell won't salute or pledge to one. No different than the colored headbands or other clothing gang members wear. It's just a mindless rallying point for jingoism and nationalism--'our gang, the Murkins'.
BTW, I did two tours in Vietnam so I don't let any sunshine patriot and chicken hawks give me any shit about my stance either. I figgered I've earned the right to complain! Hahaha!

I use this sort of thing against human supremacists who try to say that humans have a tenacious moral instinct common to all species about sticking together. Yeah right. Wanting to kill a fellow human over a piece of fabric debunks it thoroughly.
A lot of us would fly the flag upside down, but don't. We know that those who fly the flag right side up are often thugs and we are scared to antagonize them. It is as simple as that.
A friend of mine purchases stamps with the American flag on them. She puts them upside down on her mail, and has had no problems with her mail being delivered.
Let's have an upside down flag national holiday in honor of "Old Gory."
