Finally, after more than 19 years, the Supreme Court has put to rest litigation over punitive damages in the 1989 Exxon Valdez oil spill in Prince William Sound. As a fisherman involved in the litigation, I have dedicated one-third of my life to observation of this "David vs. Goliath" conflict.
Naturally, since I was an oil-damaged fisherman who lost an entire season of salmon fishing - who waded with hip boots in knee-deep oily mousse along pristine Alaska shoreline while picking up bird carcasses with a stick; who observed firsthand the comedy of horrors as Exxon hired the VECO Corporation to waste millions in a pathetically ineffective response; who has replayed a thousand times in my mind the voice of the drunk Joe Hazelwood slurring into the microphone his report to the Coast Guard: "We have fetched up hard aground on Bligh Reef ... ." - I expected this case to be a no-brainer, and that the U.S. justice system would prevail on behalf of the little guy.
Little did I know in 1989 that I would be sitting at a keyboard nearly 20 years later reflecting on the failures of the U.S. justice system. Little did I know that, as the years went by and I attended funerals of many of my fishermen friends who passed away without seeing closure to this agony, that I would grow to be so angry and disheartened by the success that Exxon has had with their methodical manipulation of the justice system.
Way back in 1989, it was rumored that Lee Raymond, the CEO of Exxon at that time, was saying privately that he would dedicate every resource of the corporation to making sure that fishermen never received a dime in compensation.
I find it interesting to note that Raymond's severance package when he retired from Exxon some years ago was about $400 million. Now, nearly 33,000 plaintiffs must split an amount only slightly higher than that!
A Pyrrhic victory is a victory with devastating cost to the victor. The recent Supreme Court decision for oil-damaged fishermen certainly meets this description. Fishermen/plaintiffs have lost 20 percent of our members while this conflict has been waged from one courthouse to the next. Many of us have been converted from participating patriots to grouchy skeptics.
We have watched Exxon contribute heavily to campaigns with what we suspect was part of their strategy to manipulate the system and ultimately tilt the Supreme Court to the right far enough to achieve their Machiavellian goal of preventing a payout to fishermen.
Some fisheries in Alaska never truly recovered after 1989. You can still find oil buried on beaches. Fishermen have been "on hold" financially with regard to retirement planning, and have forgone scores of unquantifiable opportunities while Exxon has played the court system to its own end.
When my fishing season was canceled in 1989 due to the oil spill, my oldest daughter could not understand why I had to break my promise to take her out on my boat with me as a deckhand. No amount of money can compensate for the destruction to the environment. No amount of money can ever heal that broken promise, or dry the tears of 20 years shed by fishermen, Alaskans and the world.

Those that have the "Gold" get to make the "Rules"----
The "Supreme Court"------- all political appointees ---is merely a tool of those who have the "Gold".
The logical answer would be to put the "Gold"---or at least the power of the "Gold" into the hands of those who are directly impacted by the decisions of the "Golden Rules"-----
Until more people----who are better informed and empowered take action to assure they are "governed" by a "just system " these and so many other injustices will continue as they have from the beginning of this "noble experiment in self governance".
One move that could be made is a "boycott" of Exxon products. This however would be self defeating since all of us to one degree or another are heavily dependant upon their products. HOWEVER, the list of "Stock Holders" is public. The "Stock Holders" are responsible for the behavior of the corporation as well as its ruling body. Boycotts upon THOSE people would have an impact upon THOSE people. Publishing the names of the stock holders of Exxon as those as responsible for Exxon's short comings would in a short period of time cause those people to either sell their stock----or act responsibly. As it presently is structured---the stock holders were the winners and contributed to the influence of the political corruption now expressed by a corrupt Supreme Court in this latest of many biased decisions.
In fact, an organization dedicated to the very principle proposed here could be formed as a non-profit organization. Taking donations from the public, to serve the public in cases where the legal system victimizes the public. In this manner, when "Muppets" such as the current administration come to power (I am sure that Kermit and the others will forgive the comparison----after all they are only muppets)
the "people will have the Gold" and "can make the rules". In a consumer society--the consumers have the power---the decision makers dance to the tune of those who pay the musicians.............
Taking this into consideration-----there may be more "Gold in the hands of the People than is obvious".
Individuals or Corporations or Political Systems who are forced to resort to corruption to survive are at the mercy of the masses who in reality control the entire system. Giving up in the face of what appears to be insurmountable tasks---is what the corrupt systems all throughout history have depended upon to exist.
If any readers of this comment enjoy the very lucrative return of their investments in Exxon wish to remain silent on how the corporation is managed----will they mind having their names and addresses published?
Try not to forget that the CEO's who have made millions off the escelating gasoline prices-------are simply "hirelings"-----employees who can be terminated and replaced.
True power is never concentrated with a few---it lies with the masses; but only if they exercise it.

We're sorry. We fucked up. Industrialization was so much fun, at least in the short run. We fast laned, fast fooded, bargain shopped, and fastly got deluded. Sorry we left the place worse off then we found it, we just didn't have time to remedy the polluted. We got scared and built ICBM's. What an "Outrage".
We all witnessed this past week the very disgraceful decision by the Nation's Supreme Court to lower the EXXON oil spill settlement to the ridiculous amount of $15,000.00 per person hurt by the oil spill that happened over 15 years ago. That oil spill took the livelihood & lives of many hundreds of hard working Alaskans. As Don Shelby of WCCO Channel Four pointed out, the Supreme Court's ruling of $500 million amounts to only ONE WEEK'S profits for EXXON. EXXON probably spent many times that amount fighting the case in court for over 15 years. The Number One reason to support a Democrat for President this fall is to have a more friendly Supreme Court. By electing a more Democratic Congress & President we can achieve that.
Many ask why are we not getting things turned around in this country now when we have had a Democratic majority in Congress the past two years. The reason being is we still do not have a large enough majority to over ride the Bush veto pen or enough majority to stop the unrelenting Republican filibusters. In the next 8 years, there is a very real possibility there will be four Supreme Court vacancies, if "McSame" gets in working people in this country will get hurt even more. This Supreme Court has become a pawn to Big Business.
We need a larger majority to make real changes possible. We also need to replace Bush's lap dog Norm Coleman right here in Minnesota. Coleman was hand picked by Cheney, Bush & Rove to run against Paul Wellstone, if Wellstone had not been killed right prior to the election six years ago Coleman would never have been elected. Coleman's claim to be a 90% improvement over Wellstone is an outrage. Coleman voted in lockstep with Bush over 90% of the time, yet claiming to be independent is a JOKE ! ! Al Franken would make a great US Senator for working people, for the retired people of Minnesota & for all Americans.
Vote Democratic this fall & change the direction of America for a much better America.

Exxon Mobil is merely a group of greedy bastards who are accountable to nobody. They use the name Exxon Mobil to cloak their immoral actions and limit their real liability to all. What good to they do our country? They are a blight on our nation. Nationalize them.
Exxon who netted over $10 BILLION last quarter, will not even feel this. It's less than a month's profits. Windfall Tax on Oil companies.
The punitive damages end up to be puny alright. This was no punishment for Exxon. I wonder why you couldn't get at least interest added on for the 19 years. No justice, No peace. I will continue to boycott Exxon for the rest of my life.
I can understand your pain because my daughter lost her house due to a fuel oil spill, 230 gallons. The Minnesota Pollution Control Agency was way more than a disappointment.
Mr. Mullen, I am so sorry for your loss. I am so sorry that you were unjustly harmed and that it has taken nineteen years for you to get resolution and then for the resolution to be so inadequate. I am sorry that the S. Court denied you justice. I am so sorry for all thirty three thousand plaintiffs. I am sorry for the untold losses from the Exxon Valdez tragedy. It is not just the plaintiffs in this case who lose, right? We all lose when wrongs are perpetrated.
I am sorry for all of us, come to think of it. I want to live in a world where justice rains upon us daily like manna from heaven.

Sorry to be pedantic, but the fisherman's quote at the start of this article is misguided. We all know the upset victory in the David vs Goliath confrontation was to the little guy. No-one (who grew up in the system) can have been surprised by this, or could ever have thought that the "justice system" could deliver any other result. The one with the money can drive the other guy into the poor house, or the grave, and appeal until he gets the result he wants.

Republican George Bush's administration installed the Republican Supreme Court judges. Alaska is a Republican state. Republicans don't allow the ordinary working people to sue. Lifetime earnings for them all over 40 years:200 000 000
Total penalty for ruining their livelihood after adding punitive damages: four hundred million
Now I don't have my abacus but I reckon that this means that after paying the slap on the wrist, xyz inc. makes 99 600 000 000
