Feingold to Filibuster Warrantless Wiretapping Bill
Sen. Russ Feingold, D-Wis., will take steps this week to filibuster a Foreign Intelligence Surveillance Act (FISA) reform proposal that provides retroactive immunity to telecommunications corporations that violate the privacy rights of customers by sharing information with illegal spying programs.
Feingold and Connecticut Sen. Chris Dodd -- both longtime critics of the immunity provision -- indicated they would take steps to block the bill after members of groups such as TrueMajority.org on Tuesday urged senators to use all procedural strategies available to them to stall the rapid progress of Bush administration-backed legislation that would bar consumer lawsuits against telephone companies that are guilty of spying on Americans.
"This is a deeply flawed bill, which does nothing more than offer retroactive immunity by another name," declared Feingold and Dodd. "We strongly urge our colleagues to reject this so-called 'compromise' legislation and oppose any efforts to consider this bill in its current form. We will oppose efforts to end debate on this bill as long as it provides retroactive immunity for the telecommunications companies that may have participated in the President's warrantless wiretapping program, and as long as it fails to protect the privacy of law-abiding Americans.
"If the Senate does proceed to this legislation, our immediate response will be to offer an amendment that strips the retroactive immunity provision out of the bill. We hope our colleagues will join us in supporting Americans' civil liberties by opposing retroactive immunity and rejecting this so-called 'compromise' legislation."
Speaking with Amy Goodman on the radio program "Democracy Now!," Feingold elaborated on the plan to fight the immunity scheme.
"We are going to resist this bill," he said. "We are going to make sure that the procedural votes are gone through. In other words, a filibuster is requiring 60 votes to proceed to the bill, 60 votes to get closure on the legislation. We will also --- Senator Dodd and I and others -- will be taking some time to talk about this on the floor. We're not just going to let it be rubber-stamped."
Goodman pressed Feingold, specifically asking him to confirm that he would attempt a filibuster.
"That's what I just described," said the Wisconsinite, who chairs the Constitution subcommittee of the Senate Judiciary Committee.
To be maintained, a filibuster must be supported by more than two-fifths of the 100 senators. If opponents of a filibuster can muster 60 votes, Feingold and Dodd will fail -- a distinct possibility as key Democrats in the Senate have made moves to compromise with the Republican White House on this issue. (Dodd's attempt to filibuster an earlier version of the legislation in February gained only 29 supporters, far less than the 41 required to prevent a bill from advancing.)
But the news that a filibuster effort would be made was cause for celebration among activists who were worried that no senators would be willing to take extraordinary steps to battle an extraordinary assault on the Fourth Amendment to the Constitution.
"We spoke; they listened," TrueMajority online director Matt Holland said of the decision to filibuster. "Senators Dodd and Feingold understand that we don't have to break the law to keep America safe. It doesn't take secret surveillance to understand that the greatest threat to our liberty comes not from foreign elements but rather from those would undermine the basic principles and values that keep our nation strong."
Holland explained that "the White House guarding our right to privacy is like the fox guarding the hen house. We're pleased that Senators Dodd and Feingold are standing up to this inanity. Now it's time for others in the Senate to join them and remove the immunity provision. Americans just don't like being spied on."
TrueMajority had urged Feingold, Dodd and Sen. Barack Obama, D-Ill. -- all past champions of efforts to block the immunity provision and related assaults on the ability of citizens -- to challenge corporate and governmental abuses.
Abandoning a previous commitment to lead the fight to protect privacy rights, Obama has indicated that he will vote with the Bush administration to undermine those rights.
Feingold describes Obama's choice as a "wrong vote" and "regrettable."
Instead of aiding George Bush's attack on the Fourth Amendment, Feingold said of Democrats in the Senate: "We should be standing up for the Constitution."

Give the telecoms immunity only if they disclose everything they know about bush's spying program. Remember that bush said the only "spying" was done between someone in this country and someone (a terrorist) in another country. The evidence will show without a doubt that the dragnet covered just about every American. bush will be caught in another lie and impeachment hearings will follow. Wishful thinking.
And if they knew there was a terrorist on the other end of the line, why not just trace the call and arrest him?

I will be sending my "Honorable" Iowa Senators my thoughts and hope, but lets see, they have it set up that only one of them is up for election (every 6 years), let me guess which one will vote for this trash legislation and which won't. It' become just a freakin game for those honorable employees of ours. Each state should have to elect their 2 senate representatives at the sametime. I believe that would help the system.

Well, for my money, Obama's behavior since he won the nomination has proven that despite all his rhetoric of "change," he is just another cowardly politician more interested in maintaining the perks of public life than in standing on principle. As I asked my friends and all of you on Common Dreams when Obama started this campaign, when has he ever put his career on the line to stand for anything? What would it take for Obama to put his career on the line? Answer: nothing. Nothing can make him put his career on the line, because, to him, nothing is more important than he be elected president.
Once upon a time the Speaker of the House, Henry Clay, was told that his stand on the Missouri Compromise, of which he was one of the principal brokers, would cost him the presidency. He answered: "Sir, I would rather be right than be president." No matter what you think of the Missouri Compromise, his response was the response of a true statesman. We have such men among us now--Kucinich, Feingold, Dodd(?)--but by our votes we have told them and the world that we no longer want statesmen. We want those who will compromise with evil to further their own ambitions. Shame on us. Shame on the U.S.A.
It is sad to have to admit that a politician whom one has admired and gradually come around to enthusiastically supporting is, in the end, nothing more than another craven sell-out. Today he sells us out on the 4th Amendment; tomorrow . . . who knows? Change? Hmmmmm.
I will vote for Ralph Nader in November. I urge you to do the same. To those who say that under McCain things will get worse, I say that maybe things will have to get worse before they can get better. Maybe life in the USA will have to become intolerable before the American people will cease tolerating. I pray that that day will come soon.
We should not even be discussing who we will vote for in November! The fight for our Bill of Rights and the Rule of Law is now!

What I don't understand is why any Democrat, for any reason, should feel there's a need to compromise with lame duck George Bush at all on this matter. He's got a 20% popular approval rating and will be gone in less than seven months. Why compromise at all?

Assuming he follows through, we should ENcourage Feingold's itty bitty courage to also blossom among his colleagues.. More courage needs to spread to more issues, like impeachment and war defunding, etc.

Hmmm, maybe I am wrong as I have seen many votes of confidence for Feingold here.
Keep calling though, lefties, otherwise they don't care. We managed to get amnesty for illegal immigrants off the table through a hige grassroots effort. The same thing could happen again here.
I called Feingold (office was too busy), and Reid (they answered and I told them I support him and Senator Feingold). I called both of my Senators, Bob Menendez, who supports a filibuster and Franky Lautenburg, who probably does--his office sounded unsure. New Jersey is in the house ( AND the Senate). We are lucky here, our reps are mostly good.
I apologize, I called Reid--and I would BET he folded on FISA like a cheap suit!! Anyway, i guess it's good that I thanked his flunky for his support of Feingold...must've have made his head spin a bit. I'll call Dodd now. My BAD.
This is the best explanation of the horrible "Revised FISA" bill that I have found. It's from Politico by Bresnahn and O'Connor and very good. Yes, funds going to the candidates might help, but not that much.
"Hoyer said that if House Democratic leaders failed to reach a FISA deal with the White House and GOP leaders, as many as "30 Blue Dogs and another 20 to 30 members" could have signed onto a Republican discharge petition calling for a floor vote on the Senate version of the FISA bill, which was even more anathema to House Democrats than what eventually passed."

If any of those Representatives are yours, you should call them daily and demand why they consider our civil rights less important than Bush's PROFESSED reasons to sift through everybody's email and phone calls. Even Schumer has been turned to vote against this. And Reid too. The important thing is to NOT get cloture. So call your senators! Forget how they stand on FISA. Tell 'em to vote AGAINST cloture and kick this can down the street. Maybe it will even die after the July 4th recess!

In comparison to what needs institutional doing by congress, across the board, Feingold's courage can only weigh-in as itty bitty.
In comparison to what 95% of his colleagues keep failing to do, Feingold's personal courage to at least TRY, is more often than not outstanding.

Homeward-angel. I have to disagree, not in spirit but in emphasis.
Here is the dillemma as I see it.
1. If we blame the media, the elites, the establishment, etc. then we tend to see people as powerless and sheeplike. This is not the case and to believe it would be the stillbirth of any real progressive movement . [Of course the people don't have the power of the media-- the elite do. But the people are, in some sense, responsible for not exercising their collective power.]
2. If we blame the people, we see individuals as too lazy, ignorant or passive to find the truth for themselves. But the responsibility cannot be on individuals it is on the dissenters to make their voice heard and to organize the collective power of the masses.

Altho Obama has always seemed to me to be more Clinton than Kennedy, I had decided to vote for him for two reasons--avoiding a Scalia on the Supreme Court, does anyone think a Dem Senate would fight it?, and for the fact that the Republican Party and the Bush Administration need to be repudiated. Now I don't know what I'll do but I intend to try to call the Obama offices and let them know they will likely lose my vote over this.

Just got off the telephone with Senator Feingold's office. He is dead set against the bill. However, I was repeatedly advised that his comments on Democracy Now were misinterpreted. Oh? Thereafter, I was told that the senator is " not yet " committed to undertaking a filibuster. This is horrific. Thx for all you do.
Senator Obama has also yet to change his position and Senator Feinstein has yet to commit. Civil Rights for who?

Well that lasted... what? All of a day? So they had there little stage play, pretended that FISA wasn't a sure thing. They had to make a show of it, otherwise they might really piss off all the liberals. At least they can say they tried. I hope you're all satisfied, not thinking of defecting to a 3rd party are you? You have to wonder what Congress is up to (or down to, as the case may be). It appears we have one party -- Republicans, and Republicans-in-drag. Except for Chris Dodd, Russ Feingold, Robert Wexler, Dennis Kucinich, Maxine Waters, and a handful of others -- approximately 1 percent of our Congress -- the rest simply are too weak, self-interested, deluded, or corrupted to stand up and do the job they were elected to do and that they took an oath to do: uphold the Constitution and the laws of the land. We are a democracy-in-pretense. Our government is broken. The Republicans failed to protect us leading up to 9/11/01; and if they need to, they'll fail us again. And the idiocracy who vote in this country will vote to return them to office so that they can continue to protect us as they have protected us til now. (That is dripping with sarcasm, in case you can't tell.)
Obama may be a neocon dressed as a sheep. All you really know about him is what he says, and even that seems to change as the months go by. Look back at what Bush said in 2000 to get elected. Read Obamas Dreams From My Father. That was one mixed up dude. Kind of felt bad for him, but not enough to want him as President. Now maybe he changed, but he was 33 when he wrote it. He could be anything, and the fact that Big Money is backing him over McCain is telling. Having these 2 as the choice proves our system is broken. It's no surprise to me, but hopefully some people are waking up.
He is like Clinton, young, decent looking, nice personality, smart, gives a nice speech. Clinton screwed this country upside down and every which way and made those not paying attention feel good while he was doing it. My bet is Obama does the same. Only difference between them and Bush is Bush was kind of in your face with it telling blatant lies with a grin thats says "heh-heh, you know I'm fibbing you, but what you going to do about it?". And Cheney gives you his infamous "So?" when told the people are not happy about Iraq. So the best you can hope for is a bit more foreplay than the necons give you before they slam it home, and maybe some antibiotics to deal with the bugs (provided you have insurance).
