Immunity Likely For Phone Companies in Spy Bill
WASHINGTON - U.S. phone companies would be shielded from potentially billions of dollars in lawsuits under an anti-terror spy measure that appears headed toward approval, congressional sources said on Wednesday.
House of Representatives Democratic Leader Steny Hoyer, a lead negotiator on the bill, said, "We're very close to having an agreement," and a House vote could come as early as Friday.
Democratic and Republican aides and a lobbyist familiar with negotiations said the House would likely approve the measure overwhelmingly. Despite opposition from its top two Democrats, the Senate would then likely give it final approval, clearing the way for President George W. Bush to sign it into law.
Bush has been pushing for retroactive immunity for any telephone company that participated in warrantless domestic surveillance program he began after the September 11 attacks.
One Democratic aide said the backers definitely seem to have the votes. Other Democratic and Republican aides, all speaking on condition of anonymity, agreed.
Senate Democratic Leader Harry Reid and Assistant Senate Democratic Leader Dick Durbin oppose immunizing telephone companies from lawsuits and voiced opposition this week to the proposal. "I will not support that, but a lot of people will," Reid said on Tuesday.
Hoyer argued the bill would provide greater protection of civil liberties than one the Senate approved in February.
House Democratic leaders have refused to bring the Senate bill up for a vote in their chamber, forcing compromise talks.
The Senate bill would grant retroactive immunity to any phone company that participated in Bush's spying program.
The proposed compromise would allow a federal district court to dismiss a suit if the company was provided written assurances that Bush authorized their participation in the spy program and that it was legal, sources said.
About 40 civil lawsuits have been filed accusing AT&T Inc, Verizon Communications Inc and Sprint Nextel Corp of violating Americans' privacy rights in helping the domestic surveillance program.
Damages could total billions of dollars.
The White House and Democratic-led Congress have been trying for months to reach an agreement to modernize the 1978 Foreign Intelligence Surveillance Act, or FISA, which requires the government receive secret-court approval to conduct surveillance on foreign targets in the United States.
Critics charge Bush violated the law in authorizing warrantless surveillance. Bush maintains he had the wartime power to do it. He later put the program under FISA jurisdiction but its terms remain secret.
As part of any law to update FISA, Bush has demanded retroactive immunity for any telephone company that participated in his spying program.
Critics, including civil rights groups and many Democratic lawmakers, argue it should first be determined what the phone companies did before deciding whether to give them immunity.

JCrumb...actually, I am getting SOME of what I have paid in the form of F.I.C.A. taxes over the past 40 years back...I'm disabled. I am not even required to file tax returns each year. Funny thing about it...I can't work (I've tried, but I am allowed only 9 mos. forever, to be on any payroll, and may not earn more tha $900/mo. during that 9 months and qualify for disabilty "benefits." My disabiity prohibited my continuing the job I was at, but I tried and will again when able) and can't afford to buy groceries, pay rent, etc. A recommendation: don't get seriously injured if you live in the U.S. and depend on working to survive.
As far as withholding taxes from the government, I'm all for it.. income tax from labor is unconstitutional (as if that matters in today's U.S.), but if you buy ANYTHING or use any services such as telephone or internet in the U.S., it's impossible to not pay taxes...they come in more forms than just income taxes, they are imbedded in virtually everything you purchase, in other words, they get your money as it comes in and as it goes out.
just called hoyer's office, was told hoyer does NOT support retroactive immunity. said that wasn't what i understood and asked if it is in included in the compromise he is pushing and was told that information was not available. what a crock. give a call 202.224.3121 and ask for hoyer.

Look, I'm no legal scholor to be sure, but if in the future (if and when this natioanl nightmare of fascism is over and the rule of law, ie. the Constitution, is restored) cannot most of the damage done by this Corporo-Christofascist administration and complicit congress be undone simply because it is in fact unconstitutional and thus ILLEGAL? If the program is legal, why do they need immunity? Isn't this a tacit admission that the whole thing was unconstitutional from the beginning?
Well, at least Obama finally stopped the rope-a-dope campaign business as usual to step up and in no uncertain terms light the fuse on the Democratic Party's vast reserves of dry powder.

A few key things to understand. In Congress, the majority has a great deal of control over the agenda. Especially in the House. In the House, if the Speaker doesn't want something to reach the floor, then its hard to get it there. It takes a majority vote of the full House to override that decision.
So, just the fact that is even being considered without the Republicans having to push for such a majority vote from the full House indicates the Dem leadership is supporting this. The same is true for war funding and all the other things the Democrats lie about not supporting but which get shepparded through the congress and passed anyways. Anytime you see something like this even coming up for a vote, that means Pelosi and the Dem leadership support it. Even thought Pelosi might then do something tricky like cast a meaningless symbolic vote against it.
The other thing to note is that the corporate media and the Democrats are only telling half the story. This bill also includes language that expands the government's powers to conduct illegal warrantless spying on Americans.
The Democrats never disputed this. They all just stood up and saluted and said great idea to this part. They've been conducting this political theater about pretending to oppose the retroactive immunity for acts everyone knew were clearly illegal at the time. Its now obvious they were never going to really stop it. They just used some time till this Aug expiration date to put on a phony little show.
But the key thing to know is that this expands Bush's (and Obama's) domestic spying powers and the Democrats have loved that idea from the beginning.
There's also a strong underlying issue here. It goes to the very root of our processes in this country. We've all heard the civics class explanation of how a law is made. By granting Bush this authority, they are establishing the precedent that a President can just unilaterally make a new law on his own without going to Congress. That's essentially what Bush did in this case. He didn't like the existing FISA law. But instead of allowing our republic to function and to let our so-called elected representatives debate it, he just made up his own law. He got his pet lawyers that work for him to right a rigged 'opinion' that said Bush could do what he wanted, and then he did it.
This is exactly the reason why impeachment is in the Constitution. The whole system is built on checks and balances, and impeachment is the remedy available to Congress when a power-mad President exceeds the limits in the Constitution. Instead, what we see is that instead of impeaching Bush, the Congress (led by Dems in the last two years) gives Bush retroactive immunity, then changes the law to give Bush want he wanted, and now gives anyone who worked with Bush immunity solely on the basis of a note from the President saying its ok.
So, what they are really doing is ceding the Congressional role in the law-making process to the President and establishing the precedent that any President can just make this stuff up as they go along. Ie, put Constitution into the shredder and press the ON button.

Reps do "give a damn" about calls and letters, emails, and faxes. They figure each one represents the concerns of xxx more constituents. PERSONAL messages are more powerful than signing petitions online; although I do both.

The proposed FISA deal is not a compromise; it is a capitulation. The House and Senate should not be taking up this bill, which effectively guarantees immunity for telecom companies alleged to have participated in the President's illegal program, and which fails to protect the privacy of law-abiding Americans at home. Allowing courts to review the question of immunity is meaningless when the same legislation essentially requires the court to grant immunity. And under this bill, the government can still sweep up and keep the international communications of innocent Americans in the U.S. with no connection to suspected terrorists, with very few safeguards to protect against abuse of this power. Instead of cutting bad deals on both FISA and funding for the war in Iraq, Democrats should be standing up to the flawed and dangerous policies of this administration."

I just heard that criminal coddling Pelosi say she didn't like the war funding bill the Democrats just helped pass in the House.
She said it was important to pass a bill Bush would sign. She said it gives the troops what they need and doesn't tie the hands of commanders in the field.
Why the f*#& not! Since when do commanders in the field set the policy and not the Congress. Why is so important to have Bush sign a bill that keeps our troops fighting and dying to prop up a colonial-style puppet governments and keeps the profits flowing to Big Oil, Big Profits Inc. and the Military Industrial Complex?

I was watching Olbermann tonight and he was talking to, I think, his name is Turley, a scholor on law. He said it was a dangerous precedent. He said the Democrats knew about the Bush's wiretapping from the start before the public ever found out. Olbermann said Democrats are covering their butts so they don't get in trouble from the courts if lawsuits were allowed to go forward.
I am very,very disgusted with the Democratic Party. They are as bad as the Republicans. They said vote for them in 2006 and they will clean up the swamp! They haven't done anything. They bend over backwards to do whatever Bush wants. No impeachment, no accountability, nothing. It doesn't do any good to call them. I have. They do what they dam well please. some do try to stand up for what is right but there is not enough of them.
On Obermann's program tonight, Turley said, that when the bill was first put forth about the immunity, there was a big outcry (Of course) by the people, so they let it die down before they brought it up again. I wonder when Pulosi and Hoyer are up for election? Their people better think twice about electing the traitors.

The entire premise of this piece is part of the propaganda. The government could, if it wished, easily shield the companies from monetary losses in exchange for testimony about criminal wrongdoing.
This is about protecting the Chainy-bush criminal syndicate and the congressional enablers from accountability under the law and about keeping the truth from the American people.
What they should do is give W and themselves retroactive immunity and cut out the middleman.

there are exceptions, but only a few...kucinich, wexler, lee, woolsey. if they were in the senate, you can bet they would stand up for what they believe with many filibusters.
