State of Emergency: The US in the Final Six Months of the George W. Bush Administration
In short, we are living in an on-going state of emergency whose exact limits are unknown, on the basis of a controversial deep event -- 9/11 -- that is still largely a mystery. - UC Professor Emeritus Peter Dale Scott
Unhindered by a neutered Congress and a compliant Court, President Bush has six months remaining to pursue his agenda of expanding the war in the Middle East and ensuring the continuation of the Global War on Terror (GWOT) beyond his tenure in office.
The current administration has taken unto itself unprecedented, nearly hegemonic powers since the events of 9/11. On that day, George W. Bush issued his "Declaration of Emergency by Reason of Certain Terrorist Attacks" under the authority of the National Emergencies Act. This declaration, which can be rescinded by joint resolution of Congress, has instead been extended six times. In 2007, the declaration was strengthened with the issuance of National Security Presidential Directive 51 (NSPD-51) which gave the president the authority to do whatever he deems necessary in a vaguely defined "catastrophic emergency" including everything from canceling elections to suspending the Constitution to launching a nuclear attack.
Despite time constraints, there are clear signs that the president, the vice-president and their neocon collaborators are not finished. The constant saber-rattling toward Iran, with strong support from Israel, should send a chill down the spine of any peace-loving American. Military chiefs who oppose the president are "retired," as observed most recently with the March dismissals of CENTCOM commander Admiral William Fallon and 6th Fleet commander Vice-Admiral John Stufflebeem. Public opinion counts for nothing. In a March 24 interview with ABC's Martha Raddatz, vice president Dick Cheney responded to a question about the war weariness of Americans with a languid "So?"
According to J. Scott Carpenter, former deputy assistant secretary of state for Near Eastern Affairs, Cheney pushed hard for airstrikes against Iranian Revolutionary Guard bases last summer. He was deterred by Pentagon officials who insisted that retaliation might be difficult to contain. Now, with Cheney ally General David Petraeus poised to take over Fallon's command, a significant obstacle has been removed.
It seems clear that there is a deadly struggle going on within the US government, a struggle that could well determine not only the election of the next president, but the survival of the republic. On one side are the neocons, the fanatics who led us into Iraq and who believe they alone possess the strategic acumen to usher in a "new American century." On the other is the Republican Party old guard ostensibly led by Defense Secretary Robert Gates. Gates was brought into the administration at the end of 2006 to replace the disgraced and despised Donald Rumsfeld, and generally to ride herd over the neocons.
The conflict between these factions has broken into the open over the past eight months. The first public signal came in October of last year, when the sixteen US intelligence agencies issued a consensus National Intelligence Estimate (NIE) that cut the legs out from under the administration's argument that Iran was on the verge of developing a nuclear weapon. The NIE stated that the Iranians had stopped work on the project in 2003.
Just before Labor Day last year, a B-52 Stratofortress bomber carrying six cruise missiles armed with nuclear warheads flew an unauthorized mission from Minot AFB in North Dakota to Barksdale AFB in Louisiana. Due to anonymous, high-level tips to the Military Times, the warheads were recovered. After several seemingly inconclusive investigations of the incident, Pentagon chief Gates fired Air Force Chief of Staff Michael Moseley and Air Force Secretary Michael Wynne last week, without revealing the role either man played in the nuke heist. Given the volume of evidence that this unprecedented transfer of live nuclear weapons was not an accident, the question remains: what individual or individuals within the government have the authority to commandeer nuclear bombs?
Conservative pundit Patrick J. Buchanan recently suggested that the neocons might be tempted to go to war with Iran in order to improve John McCain's chances of winning the presidency. As audacious as that seems, we want to go one step further. We believe that this administration is so zealous, so determined to hold onto power, that they may well stage a "false flag" attack, creating just the kind of "catastrophic emergency" to which NSPD-51 refers.
On April 29 of this year, CIA veteran Roland V. Carnaby was shot dead by police officers after a high speed chase through the streets of Houston. Carnaby, who had been the CIA's Chief of Station for the Southeast Region headquartered in Houston, was involved in conducting security surveys of the Port of Houston and had discovered that the Department of Homeland Security was tolerating gaping holes in port security. Carnaby and Houston intelligence and law enforcement personnel were also investigating the presence of "Middle Easterners" who were conducting surveillance of the Port of Houston. The "Middle Eastern" designator is the term used by the FBI for Israelis (typically Mossad agents) in order to avoid "political" problems with superiors.
Former National Security Agency analyst and naval intelligence officer Wayne Madsen has been in Houston investigating the Carnaby case at great personal risk. Madsen believes Carnaby was involved both in heading off a potential war with Iran (by leaking Mossad plans to assassinate Hezbollah leader Hassan Nasrallah just days before Carnaby himself was killed) and in trying to forestall a potential terrorist attack on the port.
According to Madsen, "federal agents in Houston fear that 'another 9/11-type part false flag' attack is imminent, perhaps as early as July 4." Such an attack along the twenty-five-mile Houston Ship Channel, site of more explosive materials, toxic gases, and deadly petrochemicals than anywhere else in the country, could create an environmental and economic catastrophe that would dwarf 9/11.
How will the struggle within this administration be brought to an end? Will courageous military men like Adm. Fallon speak out before the next national tragedy befalls us? Will Congress act decisively to remove the president's emergency powers, challenge NSPD-51, and defend the Constitution? Will Defense Secretary Gates hold the line?
With just a half year left in what many believe has been the worst presidency in American history the possibilities are many, and some of them are truly frightening. As citizens of this country, we must do everything in our power to ensure that there is no expansion of war in the Middle East, no "false flag" attack at the Port of Houston or anywhere else, and a peaceful and constitutional succession to a new administration.

It's not just impeachment that is off the table . . . it's sanity itself. Thank you, Pelosi/Reid and nearly all congressional Democrats. War is the total negation of rational behavior and that is exactly what and who George Wanker Bush is . . . he is the Death Wish; he is self-destruction. But don't worry, America; you can still scratch your ass with your right hand and pick your nose with your left.
The short answer to the article's final questions are all the same: no.
The ridiculous and oft-repeated argument - by both Rethugs and Dumbocrats alike - that impeachment is a "waste of time because there is no way a majority of Senators would convict Bush" is the key to why nothing will ever be done. Everyone - and I do mean everyone - misses the bigger picture. And that is that if Congress doesn't impeach these criminals NOW -while they are still able to be impeached - and begin investigations into all the long, long list of crimes and abuses of office and Constitution-shredding and abuses of power - then a precedent will be established for every President and Congress to come in the future:
Namely that it is OK to shred the Constitution, it is OK to curtail civil liberties, it is OK to break the law, to illegally wiretap American citizens, to arrest and indefinitely detain anyone, anywhere in the world, without a trial, to use signing statements to ignore laws passed by Congress, to commit torture on detainees, etc, etc. Only by shedding the bright light of impeachment investigations on these criminals - whether it actually results in removal of office or not - will their crimes become daily news stories, and the American sheeple finally have no choice but to admit they elected - twice - a criminal mafia cabal into the highest office of the land. The impeachment proceedings would expose tons of evidence and new information about crimes already committed, and most likely other crimes we know nothing about yet. They would set a very loud precedent to all future administrations and Congresses: you are NOT above the law. You can try doing the shit Bush did, but by God you will be called on it and have it all exposed to the light of day.
Without impeachment....future presidents can literally do anything they want and get away with it: because we let Bush do so. And then we can really say bye-bye to our democracy.

With this kind of authority granted him by Congress we all need to contact our Elected Officials in the Senate and The House and demand they rescind the "Declaration of Emergency by Reason of Certain Terrorist Attacks" under the authority of the National Emergencies Act. We need to let them know we are serious about the Articles of Impeachment Dennis Kucinich has introduced in the House and Congressman Wexler into the Judiciary Committee... if "We The People" stay quiet, we get no where and will, as Demonstorm said, "say bye-bye to our democracy" as well as our liberty and freedoms. We also need to petition them to rescind the FBI's authority to detain any US Citizen who stands up for the Consititution..

Impeachment would be nice. But I really believe it ain't gonna happen. Nancy and Harry would block that. How about we move for a criminal trial of premeditated, mass murder against George, Dick and the gang? This, ladies and gentlemen, is what you get when the people do not get to elect their president directly. When the prople cannot choose their president by popular vote, it's not a free and fair election. It's a sham election. Imagine somebody offering you a choice of card in a gambling game. You pick one but then they tell you that you actually picked a person to pick the card but they don't have to pick the card you want. That would be called fraud. In the Old West sombody would have been shot for running a game that way.
My prediction from 4 years ago--any kind of "attack" in the Houston ship channel would have a lot of "bang for the buck" due to all of the hydrocarbons stored, processed, and transported in the immediate vincinity. Scary that someone else would think in those terms, but all I had to do was think like a monster. That's the kind of thought process at the top levels of our government. Scary. Very scary.

They have rubber stamped two extreme Supreme Court Justices: Roberts and Alito.
They have suspended Habes Corpus.
They have allowed search of personal records without warrant.
They have taken impeachment off the table.
After promising to end the Iraq war they instead have FUNDED IT since we the people put them in control of both houses of congress.
They have banned investigations of criminal wrongdoing of the Bush Admin.
THeir front runner while paying lip service to doing things differently instead looks like the John McCain: Nothing but party insiders. One look at Obama's VP list confirms this, not to mention the people running his search committe including Johnson who just resigned. Obama despite his rhetoric looks a lot like what we are currently getting.
Along with their Republican counter parts they never seen a pork barrel spending they did not like.
They throw money away faster than a drunken sailer without accountability to investigate the spending of the Iraq fiasco.

bush II has set a precedent for preemptive war, its time we call on congress to begin preemptive impeachment.
The only way to stop this evil is to take away it's power (money) and impeach and imprison the evildoers. A fire needs to be built under Congress immediately, a hot fire. Something needs to happen to make the people wet their pants and Congress wet theirs too. If hijacked nukes don't do it, what will? It may take a picture of Cheney in his underwear.

The Constitution itself declares that the penalty for public officials who are impeached and convicted shall extend no further than removal from office and forfeiture of future federal financial benefits. Future criminal prosecution for the same high crimes or misdemeanors is authorized, but that would be an entirely separate proceeding in an ordinary federal District Court like any other criminal prosecution.
The idea that the House and Senate could both act an any of Dennis Kuchinich's proposed articles of impeachment prior to Bush and Cheney being term limited out in January 2009 is extremely far fetched. Sure, Conyers should start the investigative process and hold hearings so that whistle blowers can step forward or be subpoenaed forward. But don't hold your breath that this exercise would accomplish anything meaningful beyond adding some fuel to the fall 2008 partisan bonfires.
I see no reason why the new Congress after January 2009 can't launch a whole series of needed investigations into war profiteering, warrantless NSA wiretapping, torture, rendition, obstruction of the 911 Commission investigation, systematic abuse of the National Security Act's standards on classified materials (ie., "fixing intelligence around the policy"), and other related crimes. The Department of Justice, with a new Attorney General, could then indict and prosecute former office holders under already existing federal felony statutes.
The time for impeachment to have been put squarely on the table was right after the November 2006 elections, but that's now water under the bridge. Dennis Kuchinich certainly deserves our praise and support for his current effort. I share your anger, but say don't despair.
There are plenty of legal tools left in the toolbox to use after January of 2009, and plenty of time to use them, if the political will is there, and the facts are developed in appropriate Congressional hearings.
If your goal is deterrence of future Presidential lawlessness, impeachment and conviction of Bush, Cheney, or anybody else at a Senate trial is neither a necessary, nor even a sufficient remedy, as I see it at this point in time.

People thought the theft of our government ended when Bush was appointed president by the partisan supreme court in December 2000. Then they thought it ended when Bush stole the Ohio vote to defeat John Kerry. The next time people of our country will think the theft of our government ended is after invocation of NSPD-51 between now and the scheduled election.

The folks who state that it would be a waste of time to impeach Bush are correct. There are 40 plus Republican Senators who have forgotten their oath to uphold the Constitution and in their zeal to thwart the will of the nation, will stop at nothing to protect an empty suit of clothes because the suit wears the Republican label.

Even if Bush and Cheney are not impeached, when they leave office we should demand citizen's arrest so there is at least some modicum of accountability.

Instead of checks and balances on the executive, the other two branches are assisting it like medics assisting an injured patient. With Obama having his policies as described above, ie Milton Freidman\Wal-Mart economics and a foreign policy that's pledged to the same goals as Bush\McCain, why would they bother cancelling an election?
Cancelling the election would only risk waking up people to the fact that their democracy is gone. Why bother when the whole process is so tightly under corporate control that only corporate-endorsed candidates can win, or even be considered 'serious'? They've already won. Why cancel the election?
I'm deeply concerned, indeed frightened that we have sunk so low in this country to the point where I see us going more and more towards a Hitler like government. I don't believe we've gotten to the point where we need to fear the 3Am knock on the door,yet I wonder when that will occur. These people, like Bush,Cheney,and the other neo-con creeps need to be stopped. I wonder if this is the opening gambit to a new Civil War. The whole thing to realize about Kucinich's impeachment bill is that its too late.
The Democratic leadership pledged before the last election that Bush would not be impeached. They've successfully run out the clock.
To me, this is the only reason why DK is even permitted to do this now. In fact, why now? is the question that jumps to mind when seeing this. Few if any of the charges he lays are recent. Most happened years ago. So, why wasn't DK on the floor of the House last year doing this? The only answer I can come up with is that the Dem leadership wouldn't allow it.
Now its perfect for the Dems. They get some cheap headlines critical of Bush. And they don't have their names attached to they let any opponents attack DK instead of them? And it is indeed way too late for anything useful to come of it.
Except, there should be a precedent established. Even if its too late, as a message and a warning to future power-hungry Presidents we should impeach Bush even if it only happens on the last day of his term. So, don't get me wrong, I've favored a start of impeachment for a long, long time.
To me, when you state that it is too late, which is true, you should be asking why is it happening only now when it is too late? And, why didn't it happen earlier, like early in this Congress, when it wouldn't be too late? Warning, asking such questions might lead to the realization that the Dem leadership has been actively protecting Bush and actively working to make sure he finished his term of office.

Impeachment is not a 'political' choice. It is a solemn duty to the nation that each member of Congress has sworn to perform when its required. Thoughts on how it effects the next election are meaningless. For members of the House, thoughts on how the Senate will vote are meaningless.
When a President has exceeded his authority under the Constitution, it is required of the members of Congress that they impeach such a President as a part of upholding this oath to uphold and defend our Constitution.
Many are asking "why now" regarding impeachment?
Could it be that the door of accountability has opened a tiny crack with the securing of Obama's nomination? A small crack, admittedly, but certainly more than the absolute zero chance of accountability offered by either Clinton or McCain.
Like in "V for Vendetta", symbols are powerful if enough people believe in them.
If we start a war with Iran it will probably go like this: Isreal will hit Iran's nuclear sites and Iran will retaliate. The US will enter the war to protect Isreal. Of course lost in all this is the recent National Intelligence estimate that Iran is not moving to develop nuclear weapons. Isreal's Likkud and the US Neo-cons (the axis of evil)have already discarded that expert assessment because it stands in the way of a war they want.
Tommytoons, I am scared too. My plan is to keep a low profile, pay attention to what I am doing, and keep my courage screwed up. When it comes time to do the right thing it's not likely to be safe or popular or easy.
I know what it feels like to run away, and I know what it feels like to fight alone. It would not be seemly at this stage of my life to act out of fear.

If the Democratic House members backed impeachment, it would probably result in Bush being driven from office. Once evidence was presented in a trial in the Senate, it is likely that very few Senators would risk their political careers by voting that Bush is innocent.
I think that another possible target is the port of Oakland, CA.

Which is why I suggest things like 'Sweep out the House' 'Don't re-elect'. Congress's approval rating is lower than Bush's. A catchy phrase can grab the sheeple's attention, to our advantage.
We need numbers, we need bi-partisanship, we need unity.
There is a lot of scary stuff in this article. Especially the "false flag" scenarios.
If this stuff is for real. If the insiders know what is going on. If there is a Republican schism, and many are distancing themselves from the radicals, they should facilitate back door communications between McCain and Obama, and the professional military, FBI, DHS and FEMA leadership. The purpose would be a bipartisan constitutionally valid orchestrated plan to remove Dubya and Cheney from power if necessary.
At least DK made a stand for impeachment in Congress. It is important that all who care keep talking about it. It will certainly not happen if we just let it go. I don't know what will happen, but please keep talking, writing your reps, etc., to let them know that we are paying attention; that we don't care if it's the end of the B. admin. We will never forget how we've been duped and lied to. Keep on keepin' on. Never forget. It does matter, it always will.

Nancy Pelosi has acknowledged that she knew of the illegal domestic wire tapping shortly after Bush took office and she was in on the torture discussions. She is as involved with Bush's torture operation as Gov. Elliot Spitzer's drivers and money launderers helping him with hookers. She is an accessory or co-conspirator and Bush is lucky that John Murtha didn't become Speaker. We might wonder how much wiretapping was of congressional people to gather blackmail dirt.
So how can Nancy risk allowing impeachment when she could be asked to testify or could be prosecuted as a result of an investigation? Yup, off the table and under the rug.

Impeachment proceedings will tie their hands and that in itself would be great. I do believe that once started, it would succeed because there is so much to impeach them on. Just start it and it will happen!

Once again, I think the most likely scenario is for Israel to do a small pre-emptive airstrike on Iran's nuclear project. Iran will then retaliate against Israel and US troops in Iraq. This, in turn, will justify the US to enter the war and do its "shock and awe" attack on the Iranian military and civilian infrastructure. They won't have to invade. It will simply decapitate Iran's military threat--but not without some damage being inflicted around the Middle East. Indeed, I fully expect it to turn into a major regional war giving Israel the opportunity to blast both Syria and Lebanon back to the dark ages. Hatred against Israel and the US will increase proportional to the damage and civilian suffering.
I'm more scared than Tommytoons and intend to keep the lowest of low profiles. Soon I'll have a long-winded explanation of how I understand all this and no one else does. Once everyone else wakes up to my level of consciousness we'll be on the road to recovery, and not before.
The "peaceful and constitutional succession to a new administration" seems kind of remote, given the quality of the "prospective" nominees (Obama's AIPAC biz, Senator McCain). And is it kind of creepy that there's a big
power failure in D.C. and Kerry's Nantucket neighbor Russert -- who declared Obama the Democratic nominee way back in May -- drops dead there on the same day?
Who controls Barksdale, anyway? Is it the Gates faction? Barksdale is where Dub was snaffled off to on 9-11 -- and from his remarks at the time, he didn't know where he was, or how he got there.
The US and the Saudi's desperately need to find a way to cut Saudi oil output without crashing the world financial markets. Once it becomes absolutely clear that Saudi oil is in the steep decline that it must eventually go into all financial bets are off as the world tries to figure out what to do with millions of big box stores, auto repair shops and tire and stereo sellers.
The 9-11 attack(by Saudi's note) and the Iraq war were a failed attempt to do this by diverting Iraqi oil through Saudi Arabia and then selling it. The Iraqi's refuse to co-operate.
The new plan should look something like this:
A major oil importing port is destroyed by the hijacking and detonation of a LNG tanker next to a refinery. This forces two things; an attack on Iran due to convienently discovered Iranian passports in a Motel 6 and mandatory and immediate fuel rationing.
The attack on Iran mysteriously destroys all sorts of things but not the oil port or the missile launcher that heavily damages Saudi Arabia's main shipping facility. The Straights of Hormuz are closed but rapidly cleared by US Navy demolition teams.
The result of all this would be that the world would go on a new reduced fuel regime with rationing in the first world and price driven demand destruction in the developing world. The GOP would get control of the Congress and the Presidency due to staged events that make it appear John McCain is in control. Vice President Jeb Bush takes office in July 2009 when McCain resigns due to health problems. US financial weakness is papered over in the following chaos by rapid changes of paper money and/or other means of diversion.
It would be like a huge car crash where the people who caused the crash emerge with new detailed, Mercedes. Things won't happen exactly like this but it will be close.

Bottom line being, forced drought conditions, food shortages, Monsanto in charge of our food supply (very scary) Genetically altered food, tainted water, animals, etc., etc., etc. We are in a lot of trouble. We've taken too long to open our eyes. I believe that Georgie boy and Dickie have no plans of leaving this administration for fear of being sought out like Hussein, who by the way, was found in a Rat Hole. Fitting place for these two good ol' boys wouldn't you say! Who knows what they have in store for us prior to November. They've already engineered a 7.8 earthquake in China,(HAARP)Katrina, 911, etc., etc., etc., latest killing innocent boy scouts with a tornado that just came out of nowhere! They have no remorse, dignity or any other human traits. They are truly monsters in control of our LIVES!
The law is no longer held to be sovereign by the global triggermen of deception posing as Princes and Masters unbound by the will of free people anywhere. If you have a parachute get ready to pull the rip-cord.
Disease, famine, war, and death are quickly answering the bells toll; our family of nations is dead; all that awaits is their burial under a heap of destruction. Out of the chaos of orchestrated revolution will march Blackwater type enforcers claiming sovereign immunity.
From here on out it is imperative to think, feel, and act out the principles inherent to the bright side of the coin irregardless of how much you lose including your life.
