Students Protesting Pesticide Use Tasered
Two University students and a Eugene man were arrested at a downtown rally Friday afternoon on various charges, including resisting arrest and disorderly conduct, after police officers' use of a Taser on one provoked angry reactions from the other two.
Ian George Van Ornum, 18, and Anthony Jameson Farley, 22, both students, were arrested. Friends paid their bail and they were released from Lane County Jail on Friday. The Eugene man, David Alexander Owen, was also released.
Ornum organized the rally as a demonstration against the Oregon Department of Transportation's use of pesticide spray on the highways. Ornum was marching with a sign in Kesey Square at the corner of West Broadway and Willamette Street dressed in a white hazardous materials suit, spraying water from a pesticide can and asking onlookers, "Do you know you're being poisoned?"
At about 12:15 p.m., two police officers approached him because he was "in the intersection, blocking traffic, and spraying liquid out of the can on the ground," said Eugene Police Department Capt. Pete Kearns, who did not witness the incident.
According to a police release, Van Ornum said, "Do you want poison in your face?" when an officer approached him, and according to Kearns, the officer then told Van Ornum he needed to leave the street because blocking traffic was considered disorderly conduct.
The release said Van Ornum "was blocking and impeding traffic for more than two blocks," but onlookers and friends of Van Ornum told a different story.
"He stood on the corner holding his sign and not doing anything," said fellow student David Parziale, who was participating in the rally and saw the scene. He said Van Ornum was crossing the street when the police officer came up to him and "dragged him to the other side of the street."
Van Ornum tried to resist arrest and told the officers he was 17 to avoid charges, said Kearns. Police escorted him across the street, and when he continued to try to push himself away, they wrestled him to the ground and handcuffed him.
"He pulled away and was swinging the handcuff around," Kearns said, "so they Tasered him. After the first Taser, he continued to struggle. The Taser was used one more time, and they were able to control him."
Parziale said he didn't see the same struggle police saw. He said Van Ornum "kind of just had adrenaline and was kind of moving around a bit." The Tasers seemed to come out of nowhere, said Parziale, who added that watching the two hits was frightening. "They Tased him once and he screamed and he started having seizure-ish movements," Parziale said. "I saw his eyes roll into the back of his head. He was in so much pain."
Farley and Owen tried to protest against Van Ornum's arrest, police said. According to the police release, Owen "ran at the officers in an attempt to interfere with the arrest" and Farley "swung his fists at the officers." Because Farley was reportedly acting violent, police deployed a Taser once to try to subdue him. About 20 minutes later, police arrested Farley and Owen, said University student Isobel Charle, who witnessed the incident.
Parziale and other friends of Farley and Van Ornum went to Lane County Courthouse later that afternoon and said they posted a $3,040 bail to release the two.
The University's Survival Center has organized a rally for this Thursday in support of Van Ornum and Farley, to take place in the EMU amphitheater at noon. By Sunday, nearly 100 people had confirmed attending on a Facebook event page for the rally.

2. a person who engages in, or displays the intent to engage in aggressive physical resistance to a lawful police action
Mr. van Ornum was HANDCUFFED when he was tased. Therefore, we can conclude that Captain Kerns believes that a handcuffed teen poses a physical threat to an armed EPD officer.

Do they still teach civics or is it more like a meeting of the Junior Chamber of Commerce? It has been over forty years since I took civics in high school where an exciting and dynamic process was presented without passion in a very boring way, process without examples.

My father would talk about how cops (in 1950's DC) used to walk around carrying nothing more than a billy club. No tasers, no guns just a flying piece of wood to take down a criminal or rowdy drunk.

There used to be elected Civilian Review Boards that monitored police abuses in hundreds of cities across the country in the late 1960's and early 1970's. Most of these early review boards were instituted in response to widespread police brutality against peaceful demonstrators during the civil rights protest of that vintage. Almost all of these independent boards no longer exist or have been transformed into Police Commissions whose civilian members are currently appointed jointly by municipal CEO's and police department executives.
TASERS have been medically and forensically documented to be potentially dangerous enough to a statistically average range of human subjects, to require classification as lethal weapons under FFACA and other federal statutes. However, manufacturers continue to claim that all civilian TASER models, including the commonly replicated design of the x26 model, are not weapons at all, but what the manufacturers instead call Sublethal Law Enforcement Assist Devices -- SLEADS. To date, no federal statute, or administrative ruling, or court ruling has resolved the FFACA classification issue of TASER use at local levels.
About 200 accidental civilian deaths in the US have been attributed to municipal and state police uses of TASER-like devices since 1999. In addition, about 32,000 cases of non-fatal, variously debilitating non-resolving neurological damage to TASER victims have been reported over the same period of about nine years. These statistics are verifiable from public police records; national summary data are accessible through most medium-depth search engines with use of appropriate search terms.
Insufficiently regulated uses of TASERS and similar lethally-loopholed weapons constitute a de facto supression of freely exercised, individual and group civil liberties. Therefore, these weapons need to be defined as such, and their uses restricted accordingly.
One way of doing this is for people to demand, by legal petition if necessary, that their local and state governments re-insstitute elected Civilian Police Rewiew Boards. This is hardly a perfect solution to police abuse, but such elected civilian oversight does begin at least to allow popular control over police conduct and policy.

Police are using tasers now with the frequency of a bored teenager channel surfing with a TV remote. Can you imagine any parent today telling his/her child "the policeman ids your friend". It's more likely that they'll tell them the policeman is a fiend!
In my judgment it is physical, mental and moral weakness on the part of police officers that results in the indiscriminate use of tasers. In the past rogue cops pummeled their victims with their 'billy clubs" or saps. Then there came the choke holds rendering the victim unconscious or dead. Of course an unconscious victim created just more physical work. Control, however, could be maintained be terror. i.e. incredible pain.
There is a protocol that I believe would make police officers
a little more judicious in the use of tasers. Each time an officer uses the taser, such officer shall be subjected to be tasing at the same voltage level and the same number of times lsuch officer used on a victim. Just a thought.
Where are the videos? No one should be protesting without someone a little distance away to take videos (with sound), which can then be posted to the internet and news stations.

but, we are all on the same team. Policemen, like the military, are working against their own interests in their current professions. They are upholding the very structure of society that is designed to keep them from those who have the most of what there is to get. They are protecting the few from the many, for a very very small reward of mild prestige and mild economic benefit. They are far from bought off.
Once they realize their situation (of course, this is the hard part), the whole choosing sides part becomes easy. They are part of the many, not the few. If only we could get the policemen themselves to see that they are being used to prop up an unjust system, things may change.
And when I say fuck the police, I am calling out an institution. It is inherently corrupt, abusive, and authoritarian. The people who work within it are not inherently monsters, but are actually on the side of the many. They just do not know it.
Those cops who tasered this man are already working against their own interests. The pesticide used, (most likely unnecessarily), could very well be linked to many types of cancer, and this policeman tasers a man trying to do something about it. How sad. He should be thanking him for speaking up about the waste of taxpayer dollars to spray a harmful chemical. Many cities spray the public parks as well. The policeman tasers a guy who wants the policeman's daughter to play in a park that will be free of cancer-causing chemicals. I wish the cops would wake the f up, and see how f'd up a lot of their actions look.

This is true to a point, enough critical mass will tip the scales the other way, they can't imprison all of the consumers that keep the economy going.
Organize before you protest.
Devise a plan of action to put in place when this occurs; perform simulations of one of your crew being tasered and respond as a group; 50 cops with tasers can't take down 1000 people.
Overrun them with sheer numbers.

Thank you, you are right, I know that in my soul, though I am not sure if all of your assumptions about the luckylefty are right (I take ideas at face value, and don't mind if "agent provocateurs" promote the cause of justice in the United States. They might not have won the tactical battle, but think just how much more expensive it was for the companies to repress armed men. And look at the horrible publicity they got as a result. No one would remember those coal miners if they had simply struck, been fired, and went home.

I also live in Eugene, and we now, after ferocious resistance from the police department, have a civilian review board. And after equally ferocious resistance from the city manager, who oversees the police department and wanted to retain power over the auditor, a police auditor who reports to the city council instead of the city manager. We will see where this goes.

City cops have become total pussies, unable to "subdue" a kid without shock torture. Unreal. And, no matter what, the "resisting arrest" charge is almost always tacked on, even if a "suspect" goes limp, which is considered "passive" resistance.
Of course, now that it's okie-dokie to shoot unarmed men (and, supposedly, women) fifty times without consequence, a little shock torture seems almost quaint...

I WAS AN EYE-WITNESS AND THIS IS WHAT I SAW:
I watched 2 officers approach Ian as he was standing on the sidewalk and though I did not hear the verbal exchange, I saw them grab Ian by the shoulders and arms, drag him across the street, I believe throw him against the wall, then another 2 officers arrived and one (possibly Officer Willis, Badge # 26) took out and deployed a tazer which knocked Ian to the pavement, the officer then kneed Ian in the back, grabbed his long hair and slammed his head down on the pavement and then tazered him at least another two times with Ian lying on the ground face down with hands already behind his back, writhing in pain and screaming "why, why?"
The police always rationalize these things as saying that if they didn't have tasers their only other response would have been to murder the guy. To me, that leads to an easy answer to keep this under control.
That is that the police force should treat this just as if the officers had pulled his weapon and fired. That usually means time suspended and off the street while there's an investigation, an appearance before a police review board, and maybe some appointments with a counselor. Ie, make it enough of a hassle for the officer that they become reluctant to use tasers all the time like they seem to do today. And if that review board were to occaisionally fire an officer for improperly torturing a citizen, that's even better.
And, if it turns out that the police version is incorrect (someone's spinning tall-tales between the police version and the witness version), then that sort of false reporting should be an automatic firing offense.
I love the way the paper always treats the police version and credible and keeps coming back to it. Even in the face of witnesses who say otherwise. So, you get this strange flow to the article where it describes the police version. Then an eye-witness says that the police version is all wrong. Then the article goes right back to the police version as if there's nothing in dispute.
People are just cattle to the cops...please MOOOOOve along..ZAP!!

I can say that I myself had a close brush with those men in uniform in Penn Station, NY, did you know its private

I was waiting for a train, which was an hour late in Penn Station with a foreign friend of mine. We happened to have a video camera and thought it was funny to video everytime an ambulance, firetruck or policecar went by (keep the action up in the tourist video).
So we hear one guy who had been waiting in the Amtrak line (hour long) saying "Why is this happening to me!", and we looked and saw a tall black man, with a white stick...
So I naturally took the video, and started recording because there are so many police and army in the station, something seemed bound to happen. As one, two, three police started arrive and the blind man was kneeling on the ground, I sensed something amiss behind me, turned to look and who do I see, but a shaky Marine, hand at holster, looking at me. So, I naturally turned around and kept filming.
I hear a voice, "You can't film here, this is Private Property," so I stop the camera as we engage in discussion.
I reply politely, "Why are you, a Marine, on guard on Private Property, isn't that strange for you?" says I.
The marine says, "You have to erase that video tape." So I go to my friend and tell him to erase the tape, as I gather our bags (you don't want to leave unattended bags in front of 15 police and 20 marines, its an invitation for disaster).
I come back and the Marine says, "Where you from? Italy too?"
"No," says I, "I am American, and I can't believe I am paying taxes for you to guard private property, you are a public servant, are you not?"
"What?"
"I do pay your salary with my taxes, do I not?"
"Well, I guess so." says the Marine.
I reply, "So what are doing?"
Marine says, "Its not all fun and games, you know, you think it might be funny,"
Me, "I didn't think it was funny."
Marine, "but we're here trying to help you guys out."
Me, "Yeah, I know I was..."
Marine, "but you're trying to record something, trying to embillocrate (sic), trying to get uh... the police officers into some jam."
Me, "No, I'm not trying to... (pause, thinking about the word embillocrate) I'm just hoping the blind guy doesn't get into a jam, that's all, The blind guy, the blind, black guy."
Marine, "Yeah I understand he blind."
Me, "That's why I took it (the video), I mean if it was just a normal guy, I wouldn't take it, but it was a Blind Guy, you have to be careful with that, can we go now, our train is here?"
And off we went.
The end of this conversation will appear on Youtube as soon as I figure out how to get that video off the camera, it was recorded as we recorded over the harrassment of a blind black man due to the extreme amount of persuasion a Marine from Mexico has when he is shaking from the adreline rush that can only be caused by a blind man and a confident man with a video recorder.
So now I have some questions:
Why are there Marines standing guard in Penn Station if it indeed is private property?
If it is private property, why is it private property?
If it isn't, why are the Police and Marines under the impression that it is?
How can a Marine have his hand on the holster ready to shoot a blind man, (Everyone watch out, there is a blind man in the building)!?!
Why put 45 potentially high value sitting ducks into a small area with a lot of civilians, is that not a recipe for disaster, wouldn't people actually be safer if the Police and Marine unit were not in there?
Why are we allowing George W. Bush to teach Mexican Marines how to speak English?
Real Patriots speak the truth and fight for freedom, even if they have to die for it; please don't get me wrong, I do not believe a real patriot has to fight in the physical sense unlike tricky some politicians claim.
Today, powerhungry individuals think fighting for freedom involves physical involvement, but real fighting involves sacrifice even to the death for a cause you believe and should not behoove aggression. The problem is getting worse fast too. More and more veterans of urban warfare return crazy and vicious from the violent streets of Iraq, and they sign up then as police officers in the U.S. They're out of their minds, they're brainwashed to think they're the good guys and that various large classes of people are worthless degenerates - and they are primed to kill.
It's no wonder that so many television news reports from Iraq mention that the "insurgents" attacked a police station. These insurgents know their enemy: the police. They are only the police who keep Bush in office when 70% of the people are against him and his crimes. What's wrong with these cops? They should part ranks and let the people take Bush to trial.
Now, I am not recommending that anyone attack police stations or police, and I am not making this admonition disingenuously: We are not in open warfare with an invader as are Iraqis, not quite, so Do not attack the police.
But I believe that every opportunity should be taken to deal with the police on a personal level when they are out of uniform and let them know that they are barbarians and neobrownshirts. If your neighbor is cop, let him know over the fence that he needs to clean up his act. If a cop comes into the donut shop, a smart waitress will offer poor service. And when they call you at 9pm asking for money for their stupid "athletic league," speak your mind. Most cops believe that you have no rights at all; they have no problem expressing their contempt for you and your rights. I don't think many of them can be shamed into learning some humanity, but we must not show respect for a barbarian and we should not be intimidated.
Obo, my FN 5-7 can shoot through body armor like butter, and is easily concealed. :) I think you have a good point regarding participation in the policial process. I DO participate, and do not just cower at home clutching my guns. However, if any cop ever tried to tase me for peacefully protesting (not likely since I am white and have short hair and have money and dress nicely) they would get the suprise of their lives.
But on a serious note, of course guns can help get the police under control. We don't have to "beat" them anymore then the VC needed to defeat american troops in vietnam. We just have to make this kind of repression too painful for them to carry out.

For once, JB is actually correct. Am armed citizenry is more difficult to control, and giving up your weapons when the other side does not is nothing short of suicide. To them, "moral and peaceable" = easy target. The left needs to stop being a weak target and be more like Billy Jack, quiet and peaceable to he innocent, hell on wheels to the aggressors and bullies of the world.
No one should be taser for engaging in civil protest; I think the protesters need to have a good, long, loud talk with their community and local elected representatives and get this practice abolished. The police are out-of-control; especially with regard to drugs and car chases in traffic.
It may have something to do with all the cop shows on TV and the totally unprofessional conduct and demeanor the actors take in portraying their roles. These shows just enstill a lower theshhold for conduct that is unbecoming, especially the CSI shows. Afterall, on TV, the ends justify the means [and they get away with it].

There's irreparable cleavage between the cops (thugs in uniform) and the citizenry - they have become a force unto themselves and can no longer be trusted to protect and serve anyones interets other than their own. What I find the most amazing about this article is that several police officers were apparently unable to deal with an 18-year-old without having to taser him. What would they have done with a situation like this back in the days when tasers weren't invented, shot him? Or would they have just wrestled him to the ground and handcuffed him?

Well, it's been close to 60 years since I took high school Civics. Even then, it did not amount to much. I can remember better teaching of this in Jr. High.
In college, large important parts of U.S. History completely ignored anything resembling populism and glorified a series of wars.
I think we have had several generations now of this kind of preparation of the population, beginning probably with the jingoism of World War II.
(that was when I was in grade school. Pearl Harbor happened when I was in First Grade).
