NEW YORK - One of the nation's most respected counterterrorism experts is predicting that Congress will take action to rein in the 'unchecked power' of the Federal Bureau of Investigation to spy on U.S. citizens without court approval -- and then forbid them from publicly protesting the violation of their civil liberties.
He is Mike German, a 16-year FBI veteran who resigned as a special agent in 2004 to make Congress and the public aware of the continuing deficiencies in FBI counterterrorism operations after the implementation of the 9/11 Commission's reforms.
German told IPS that following passage of the USA Patriot Act in 2001, FBI operations have been conducted 'with unchecked power, hampered by mismanagement in its counter-terrorism unit, and facilitated by lack of Congressional oversight.' The FBI, he added, 'is obtaining personal and business records they're not entitled to'.
He also called attention to so-called 'third party error'. This occurs when the government targets a particular telephone number or email address, and then not only continues to tap all who call into that target, but the calls and emails sent to and from the addresses of these 'secondary targets', and calls to and from these secondary targets, creating groups of tertiary targets.
He also told IPS that there is little evidence that the FBI is systematically purging its databases of telephone or email records unlawfully or inadvertently obtained during these electronic surveillance operations.
German's charges come on the heels of a report last month by the Department of Justice Inspector General (IG), which concluded that the FBI was continuing to issue so-called National Security Letters (NSLs) unlawfully.
The IG's report suspended judgment on the effectiveness of reforms put in place by the FBI following a 2006 IG report that found widespread abuses in the agency's use of NSLs. But others are less charitable.
Michael Ratner, president of the Centre for Constitutional Rights, a civil liberties advocacy group, told IPS, 'DOJ's reforms have clearly not fixed the problem; despite these fixes, the misuse of NSLs continues. It is far past the time when Congress ought to mandate judicial approval of such a significant invasion of privacy. Without such approval any claimed reforms have little meaning.'
NSLs are a form of administrative subpoena used by the FBI and reportedly by other U.S. government agencies, including the Central Intelligence Agency, the Department of Defence and the Department of Homeland Security. They are letters issued to a particular entity or organisation compelling them to turn over various records and data pertaining to individuals. They require no probable cause or judicial oversight. They also contain a gag order that bars the recipient of the letter from disclosing that the letter was ever issued. The USA Patriot Act, passed in 2001, greatly expanded the use of NSLs, allowing their use in scrutiny of U.S. residents, visitors, or U.S. citizens who are not suspects in any criminal investigation. The Patriot Act reauthorisation statutes passed by Congress in early 2006 added specific penalties for non-compliance or disclosure. In his most recent report, the IG, Glenn A. Fine, reported that the FBI twice ignored the constitutional objections of the special court established under the Foreign Intelligence Surveillance Act (FISA) to obtain private records for national security probes.
The IG's latest review follows a report last March that concluded that the FBI had misused its powers between 2003 and 2006 to obtain business records with private data. He said it filed improper requests for records and collected e-mail data without proper authorisation. Fine's 2007 report found 48 violations of law or rules in the bureau's use of national security letters from 2003 to 2005.
Fine's 2007 report concluded that the FBI sought to cover its acquisition of phone records on thousands of U.S. citizens from 2003 to 2005 by issuing 11 improper, retroactive 'blanket' administrative subpoenas in 2006 to three phone companies that are under contract to the FBI.
While acknowledging that the FBI took significant steps to correct the problems after his report last year, the IG added that implementation of the steps was not yet complete, so 'it is too early to determine whether these measures will eliminate fully the problems.'
The IG's 2008 report came as Congress continued to debate legislation governing federal powers to conduct electronic surveillance of foreign terrorism targets. A principal bone of contention in that debate is whether telecommunications companies -- whose technology and customer records are key to the government's ability to obtain and track phone calls and email traffic to and from specific numbers -- should receive 'retroactive immunity' from prosecution for assisting the government during a time when the Bush administration had no Congressionally-mandated authority to do so.
The administration contends the telecommunications companies were simply doing their 'patriotic duty' to help their government following the terrorist attacks of Sep. 11, 2001. Critics of that position say the government's action was unlawful because it circumvented the 1978 FISA law, and claim the warrantless wiretaps began long before 9/11.
The House of Representatives last week passed legislation denying retroactive immunity, while the Senate continues to debate two bills, one granting such immunity, the other denying it. President George W. Bush has said he would veto any legislation that failed to grant immunity.
The IG's most recent report noted two occasions in which he FISA court rejected FBI requests to obtain records. The court was concerned that doing so could interfere with rights protected by the First Amendment of the Constitution which guarantees freedom of speech, religion and association and the right to petition the government.
But following the FISA court's rejections, the FBI used separate authority to get the information without the court's approval, relying on NSLs, even though that authority also had First Amendment guidelines.
The NSL issue has drawn attention both from Congress and from the civil liberties community.
Vermont Democrat Sen. Patrick Leahy, chairman of the Senate Judiciary Committee, said the IG's report 'outlines more abuses and what appears to be the improper use of National Security Letters for years in a systemic failure throughout the FBI ...Legislative action may be necessary to correct these abuses.'
Legislation to correct the abuse of the National Security Letter authorities has been introduced in the House of Representatives by Rep. Jerrold Nadler, a New York Democrat, and in the Senate by Sen. Russ Feingold, Democrat from Wisconsin.
And the Centre for Constitutional Rights' Ratner told IPS, 'We have never believed that National Security Letters should be issued without court approval and find it unacceptable that those targeted by such letters are muzzled. The poisonous fruit of the current practice is what could have been expected: FBI agents and other secret police running around without any suspicion of criminal activity grabbing not only the records of so-called targets but of all persons who have had any communications with the 'targets'.'

If you do the right thing, there's always some one in a million chickenshit going to take a shot at you for it.

A Mr. Lawton, but I'm not sure if that name was correct, or if that is a real name, or for the national "broadcast," maybe a pseudonym.
He was really pissed. A smart and strong looking man, seventy years perhaps, said,
"I LOST FRIENDS in that ......." and more,
I can't quote I don't remember, but it WAS REAL.
Oh yes, he said,
"I'll search until the end of biblical time, until I find out who the rest of those folks are that murdered my friends." That was real.
Lawton is a city in OKC, area. There seemed to be a Lawton Real Estate Co. with a Lawton family in the mix.
That's the kind of person I always thought would find my information about the Kingman group. Among others, I would have thought, but it never happened.

I can, as you can, tell when the truth is being told.
It is the certain originality, focus on details, not by anything other than perhaps the mental imaages relived, in vivid detail.
When you talk about, "I could tell you about the blast of sound,IN MY YARD, cutting through the trees, the branches and leaves," and so forth, I know this happened.
You mentioned what I'd call a good item, for Plan B, denial of reality by INCREDULOUS OCCURANCES. Vis a vis, for a defence or rebuttal in your face, vis a vis.
Sure, a mental patient, a stained glass window; the short of breadth, slow or dubious, easy, dumb, or smart, ......Try to explain "chemtrails" to your relatives, objectively, and WITHOUT taking a position.
But if I've had similar, or just
as weird, I could only imagine what a limited scope of mind might infer.

There are so many details in this I've got over a hundred pages on it give or take.
One of those details:
Yank the "mining engineer and explosives expert" (and the mention above about using loose cannons and independant contractors fits in with this) gave me the impression his
time on the planet was limited.
The report in one of my referances stated that there was an "unidentified human leg found that didn't match any missing or unaccounted for individual."
One seen with McVeigh on numerous occasions according to witness matched the description of Yank.
I know the other guy survived because we met in Oatman, AZ. withing days of the incident.
Yank was inexplicably and for the first time not with him. I believe he committed suicide by detonating the truck while he was sitting in it.
Federal Agents hit Oatman and fought someone into the street out of the Historic Oatman Hotel that was alleged to be Colburn. It was not Colburn.
Paul was actually Colburn and I talked to him for the last time and said good bye personally on April 22, 1995, in Oatman, before he disappeared himself, probably back to Spokane WA, or Hayden Lake,Idaho, where they intended for me to take them.
Yes to the above, especially in light of my experience, and what I have become forced to believe is possible.

were both explosive experts, a mining engineer, and the "Chemist."

Yes it was weird for us also. We would pay the bill but our payments only showed as credits plus, at the same time, the charges were zeroed out. We called and called ATT month after month and could not fix billing nor change our service to other carriers. Now knowing what we did not know then about the illegal phone taps, we think maybe that ATT was attempting to remain legal, by paying the bills it became their phone service thus they were tapping their own phones. A year later we heard recordings of our phone conversations and it became clear more than billing was involved at ATT. Our lawyers dug up a lot of stuff that wound up in a Federal tort.
That relates to my theory of who's paying
for the Long Distance phone bills.
As I mentioned above, after notifying Sprint
and Verizon, one of the assistance operators casually mentioned,
"I guess they don't want to be paid."
I'm figuring that my phone calls have been
"rerouted" elsewhere, through the NSA switch-board perhaps, and Sprint can't legally
charge the customer, if this is the case.

Marat I believe you. I know what it means to have a chance meeting with a terrorist, something none would believe, and the private reaction to read everything available about that person and his organization. I did the same thing after a chance Spring 1979 meeting with Osama bin Laden in the US when he was recruited to destabilize Afghanistan. The Saud royals and I talked about him for the first 10 minutes after introductions. He never spoke a word of English and I was mistaken in thinking he was a tag-along and in need of a translator.
A couple of other notes, and I regret making the paranoid more so. The intelligence community is largely handled by private contractors employing "retired intelligence officers" who are now perhaps less disciplined, less patriotic than they were under government employment during the Cold War, and often reveal their knowledge to targets. We learned a lot from them.
Finally this, I survived an assassination attempt outside my back door. The first bullet was so close that the sonic boom stunned me and I walked in circles, dazed. The second shot missed by 20 feet and I could hear the rifle and see the trajectory of the bullet through the branches and leaves of the forest trees. Twenty local cops, some with K9s, searched but he got away from them. Later he was in the forensics ward of a state mental hospital and his psychiatrist violated HIPAA by telling me that his patient was given a high powered rifle and told where to find the pentagram to shoot the devil and free the goats. We have a pentagon shaped widow on our home deep in the forest. Mental patients make lousy shots.
Marat I believe you are correct, these organizations that become involved with loose cannons and get blow back are interested primarily in protecting their own tribe. They may consider you a public information liability. Your best protection is lack of credibility.

I'm afraid that a lot of what you say is right. There are a lot of tattle-tale types out there who like nothing better than to destroy dissenters. But I can't believe that all firefighters and paramedics are brainwashed stooges of the religious right any more than I believe that librarians in general will gleefully hand over library records to J. Edgar types. You're right about the impending fascism, but there are still a lot of people in authoratative positions who will resist, I hope.
Somebody needs to snap a leash on the Bureau.

Well yes, so I'll try to at least tell you some of it, and where to find these kinds of things out, or all you need to know really.
I've covered pretty much all of what you mentioned about Carol Howe, Elohim City, etc. What has me puzzled are the numerous reports of multiple explosive devices inside the building, as well as a considerable amount of evidence that McVeigh's ANFO bomb simply could not have done the damage attributed to it.
General Partin is certainly qualified to assess the damage, and his conclusion is that one or more very powerful explosive devices were inside the building. Anybody who has looked into this knows that there is something terribly wrong with the official account of what happened.
The most sinister use of FBI NSL power has been to create local,state, and Federal spy network watch groups.
They come into a community,pick out a suspect,real or not, use NSLS to create fear in the community about an individual, then help the community build an organized ,24/7 gang stalking survielence unit. You can not have a Nation wide spy network if you do not build one from fear.
Thier goal is to indoctrinate,train, and build a loyal group of brain washed SUPERMAN type followers.People who feel they are helping to keep America safe.These people are not very bright or independent, and can easily be fooled into false service

Firefighter and Paramedics are a logical choise for thier leadership, they are trained as first responders, natural super hero types, they have the time to orchestrate the survielence when they are not serving the public .
I believe if you check the USA Patriot Act , they have been given the power to do what I have described above.

Out of caution and fear initially I was very apprehensive about what to do, who these people were, and what actually happened to me. It took at least the first four or five years before books and periodicals began to publish the background, and inside information that put the puzzle pieces together that I apparently knew so much about already.
You must look up or Google, "Elohim City, Oklahoma" follow along and you will
learn about "Christian Identity," Reverand Butler and Rev. Mullar, Strassmeyer "The German" and Carol Howe. You should also find articles on McVeigh's Kingman hideout, Fortier, Colburn and Rosencranz.
Strassmeyer was the son of a European diplomat, a criminal and a militant of some "philosopy" apparently, and was also alleged to have been a double agent or US Government informant, as were the allegations with Carol Howe. Their arena of opperation was The Christian Identity Camp, self-proclaimed and called "Elohim City," outside of OKC someplace. There are virtually no photographs of Andreas Strassmeyer or Stephen Colburn "The Chemist, Mathemetician, Micro-Molecular Biologist," with a Master's or the equivalent, many photos, of rat Fortier, and only one or two of Rosencranz,"The Meth Dealer," of Kingman.
I am only personally familiar with the individuals that were part of the operation in the Kingman and Golden Valley, Arizona areas, Colburn, Rosencraz, and Fortier.
I can say this unconditionally, considering the amount of information they enthusiastically supplied me with, Fortier should be in for life, but they cut a deal for his candor, which was a crock in that
he didn't give anyone up. He's been out of prison, and probably back in Kingman for many years.
I don't think they intended for me to escape from them at the time as part of "the plan," but they never took the opportunity when they had it to eliminate me, before I tactically out-manuvered them by disappearing in plain sight more or less.
Terry Nichols brother wrote a book with SOME degree of accuracy, and some of it deceptive to cover his brother's ass, is my assumption. A more relevant book, which contained chapters that applied, or that supported my, at last coming together puzzle pieces was,"Others Unknown," by McVeigh's
initial attorney Stephen Jones.
I grew tired of these details once I realized not only what I was up against, but when I eventually figured out who these characters I had become involved with were, and were about, that they were out of the loop for the time being or being protected, I lost interest, especially when it became obvious nothing was going to come of it.

Speaking of OKC, has anybody ever heard of Andreas Strassmeir? There is something very strange about what happened with McVeigh and this guy. I've never sorted it all out, but he clearly knew far more than a disinterested observer could have known about the OKC bombing and McVeigh's connection to it.
I strongly urge anybody interested in how the fraudulent War On Terror is being manipulated to dismantle the US Constitution to read Catastrophic Terrorism: Elements of a National Policy By Ashton B. Carter, John M. Deutch and Philip D. Zelikow. It was far from a mere coincidence that Zelikow headed up the egregiously flawed 9/11 Commission.
This is a Blueprint for exploiting a major terrorist attack in order to impose authoritarian rule in place of our Constitutional Republican form of government. I find it chilling.
This is so important to me, having this opportunity, and realizing this might be the time it costs me my life I will carry on with it.
They're NOT LOOKING FOR "terrorists," or people of a certain religion or viewpoint on the level I'm thinking about.
They're looking for the individuals that already have the goods on them. It's probably the most massive group of solitary individuals, agents, and politicians NEVER ASSEMBLED. The spys, assassins, snipers, scientists, politicians and technicans included.
They can't afford to let former and current "insiders," go public if they can help it. People like those that set up the OKC incident and 9/11, and the various other "events." The Bhutto assassination comes to mind.
And for those like me that fall into something on a bad assumption or by accident, and UNEXPECTANTLY don't TAKE THE BAIT, surprising everyone AND BY DOING THE HONORABLE THING, scrape out of it alive.
For example, Rosencrans and Colburn carried a symbolic "crystal," on their key rings. That was part of it for them. A familiar symbol, and was used as a come on for meth that wasn't my thing. No matter what they tried, that didn't work, only clued me in to something was going on and it wasn't good. I had to play them back to trust me, and that surprised me, and to keep them talking, just enough, which was too incredible to believe.
The Power Shots ALWAYS ASSUME they can make their potential victims "take the bait."
The trick is DON'T!!!! You can't or you're sunk. You've got to see that way in advance.
They'll wait to use what they get, LIKE ON SPITZER, or me, if I ever did do anything they could use. I don't ever intend to give them what they can wait until hell freezes over for. They can't trick me.
They made a movie about this with either Jaime Fox or Martin Lawrence where some CIA operators needed a "set-up" for something and kept throwing out briefcases of money, or babes, always watching with cameras and surveillance, expecting the cool (former miscreant) black dude would DO THE EVIL thing. But Martin, each and every time told himself, "I'm tired of this flim-flam life and I will try to be righteous," and did that to the assassins dismay.
I thought it was hilarious.

I forgot to mention, and I think it is relevant.
When I noticed there was no long distance charges on my local phone bill I called both
offices and notified them, at first out of curiosity. I didn't want to end up paying
for several months of charges at a later date.
They told me they'd look into it and call me back in a short while. They didn't, so after the following month I called them again. One side causally mentioned,
"apparently they don't want to be paid."
I figured that sooner or later the several months of charges would eventually appear on my local bill, as was the custom. Hasn't so far.
I realized they wanted me to take advantage of them and go overboard with it. Calling Washington, CNN, or MSNBC.
That wasn't my inclination or basic nature.
I figured out what they were up to. So taking advantage to insure they wouldn't charge me, I cut my political criticism and long distance calling almost entirely.
Unless, and only until they PISSED ME OFF.
However, not to be greedy as they would have assumed, not increasing my criticism, but cutting it by a large proportion.
Therefore I'm still at it to a limited extent.
Tsunami, I agree wholeheartedly. Merely outlawing already illegal practices and granting de facto immunity to those who wilfully, systematically, repeatedly and routinely violate the Constitution and laws is purely cosmetic. If Bush and his allies are serious about doing away with evil, they should resign, confess and plead guilty to the hundreds of thousands, perhaps literally millions, of individual felony counts of which they are manifestly guilty. Of course that won't happen, so it falls to Congress to take action by holding hearings, impeaching and convicting the wrongdoers. To the Democrats' argument that there would not be enough Senate votes to actually remove these criminals, I disagree. If public hearings clearly brought home to the American people the extent of the crimes, a good number of Republicans would be forced by public opinion to act against the administration.

Please forgive me for the excessively vituperative nature of my last correspondence. I must remember my own advice, "to complain only in
fair proportion to the offer of viable solution," so I'll try to get to the point.
First though, I must start with an inquiry, "What is intelligence?" What does the Federal Bureau of Intelligence do? How much do they get paid to do what it is they do? And the same questions for the Central Intelligence Agency.
If you REALLY want to find out "who knew what, when," then I suggest you try to do the following. Ask your affiliates within these two above named organizations, primarily the FBI, about my journal of testimony regarding the co-conspirators in the OKC bombing, ask them who I am, or what is the status of my report. You may then wish to consult me personally, especially if you are not enlightened by their answers. Ask them if their agencies (ie.the bomb squads) swept the Murrah Building the morning of April 19, 1995. According to Kathy Wilburn they did. You do know that (it was the CIA offices I think) federal law enforcement people were suspiciously not in the building that day.
I have always maintained that whoever concealed the involvement of Paul and Yank, co-conspirators in the OKC bombing, must have had real high connections. What Governor, Congressman, or Federal Agent had authority to nullify my testimony? Everyone wanted to know who else was in it? For seven years I've been trying to tell them. No one has ever bothered to convince me that something was done about it.
Are the above named people in any way related to those that have hin-
dered, or otherwise mucked up, the September 11 terrorist warnings (especially the Mossaoui part), that should have initiated some great precaution, but didn't?
You may find this part a real stretch. It may be, or may not be. I do not believe any of the moralistic bush that he Republican persecutors, or any of them, profess to emulate.
Was Republican Persecutor Olsen happily married to that little chipmonk of a gal? What a coincidence, but wasn't she on the plane that was supposed to hit the White House, which was also conspicuously un-occupied by the Executive Staff? As you know they were on a Dr.Suess reading mission in the Homeland of the Carolinas. I wonder who arranged the flight for Olsen's wife, and who paid for it. In case you don't see where I'm going with this, then let me be more obvious.
Disregarding the sanctity of their political affiliation, I suggest that Olsen was not happily married, had pre-knowledge of the flight numbers for planes NOT to be on, and made sure his spouse, just coincidently, was on the wrong plane (or right plane, as the case may be).
This hypothesis may or may not pan out, but I am firmly convinced and it is truly a grave concern, that at the core of this so-called Administration, is a Pandora's Box of "evil," more corrupt and despicable than anything they claim is worth fighting against.
Marat: Your story sounds extraordinary. And even for a cynic like myself, a bit hard to believe. I guess that's just what they want.
I've told my story here before: I did volunteer work in a Muslim country for two years and sent snail mail letters to a friend who had an FBI file because of a stupid stunt she pulled over 30 years ago. 80% of those letters never arrived to her. None of my other friends / family who don't have an FBI file had problems getting my letters.

Like "Adel" we have had an undisclosed benefactor paying communication utility bills for us for several years. We canceled cable in spring 2002. Even got back the deposit on a box we had for an older TV. So obviously the cancellation was well documented. But our cable has never gone off. Made me wonder if the urban legend about cable being 2way[able to 'listen' and transmit] were true!?!
Before 2001, we chose not to choose a long distance company when local and long distance service became separate. We just used calling cards. But around 2000 a LD company showed up on our bill. But we still just used calling cards. In 2003 we had a $40 ATT calling card that got mysteriously recharged for $200.and it never expired. Same benefactor?
Our family is half Turkish and makes international phone calls/trips due to business/family. I could also go on about recorded phone calls, tailing, being spied on in our own yard with insect-like gadgets that try to act like lightening bugs, but look very UNnatural. [Light from real lightening bugs does not 'linger' when you close your eyes after they flash. But camera flashes do, and so did these 'bugs'].
The truth about life in the good ole US is slowly leaking out at least when the intel-infested newspapers choose to do so.
This is going to be a real bombshell. I find myself both courageous and stupid enough to bring information to the public forum, at greater risk now than ever before.

Thirteen years ago I innocently and inadvertanly had made contact with the real organizers and perpetrators of the Oklahoma City Bombing in Kingman Arizona. They referred to themselves as the "Kingman Patriot Movement."
They discussed with me in detail their plans to overthrow the United States Government,
using explosives, and to establish
something to the effect of a "Christian," New World order.
I had no familiarity with these kinds of people and didn't really take them seriously at the time. They used names other than those I later determined to be Colburn and many referred to afterwards as "others unknown."
I challenge them to sue me for libel if that's what it will take.
After the morning of April 19, 1995 and seeing the actual event on television that morning, exactly in the terms they kept describing to me and was going to occur on THAT DATE, I waited a short period of time, then determined, made hundreds of phone calls, and wrote dozens of letters, and more recently e-mails, to Sen. Diane Feinstein, The Southern Poverty Law Center, even Bill O'Reilly, the FBI, the ATF, and every law enforcement agency between OK. City, and San Diego.
They never formally interviewed me, called back or contacted me. I expected to at least be shown a photo lineup so that I could identify these, "others unknown."
I kept at it for years, at first thinking that I wasn't convincing enough, that they didn't receive my letters, and/or that later they had "lost" the infamous "302 Reports."
They didn't care, so I gave up.
Recently I have made additional phone calls to the Main Stream Media and Members of Congress, regarding my suspicions, the causes of war, and my sorrowful sense of injustice, after all of this, and current events.
SO NOW I'M WONDERING WHY MY SPRINT LONG DISTANCE PHONE BILL IS BEING PAID FOR by someone other than myself.
For anyone interested I will respond candidly and without fear. I believe that I have an incurable disease, and sometimes I think that life is little worth this anxiety when everything you ever believed in is now worthless, except the truth.

Good to see some reporting that this domestic espionage predates 9-11-01. We were a pre-2001 target due to our technology threat to heavy carbon industries. We were given (covert) access to recordings of our phone conversations, verbatim dialogs that occurred in our yard, and knowledge of our intercepted mail.
When we tried to change carriers from ATT to (as it turned out later a carrier not cooperating with illegal phone taps) our service was slammed back to ATT more than a half dozen times. Most remarkable, our ATT phone bill was being paid by an undisclosed benefactor. When we scheduled a press conference they lowered the hammer on us three days before the meeting. Now way say nothing to the press and do nothing with technology, too dangerous in the USA.
