No Immunity, No Testimony
WASHINGTON - Jose A. Rodriguez Jr., the former Central Intelligence Agency official who ordered the destruction of interrogation videotapes in 2005, will not be required to appear on Wednesday at a closed Congressional hearing on the matter but may be called to testify later, an official briefed on the inquiry said Monday.Mr. Rodriguez, who led the agency's clandestine service in 2005 and recently retired, has demanded immunity before he will agree to testify before the House Intelligence Committee. The Justice Department is conducting a criminal investigation into the destruction of the videotapes, which recorded harsh interrogations of two suspected Qaeda figures.
The committee has made no decision on a possible grant of immunity, so it postponed Mr. Rodriguez's appearance. He remains under subpoena, however, and the committee may call him later.
The only C.I.A. witness currently scheduled to appear Wednesday at the closed hearing is John A. Rizzo, the agency's acting general counsel, who held that job when the tapes were destroyed.
Committee members want to ask Mr. Rizzo what guidance lawyers inside and outside the agency gave on the possible destruction of the tapes. They also want to question him about why the House and Senate Intelligence Committees were not officially informed of the destruction when it happened, and whether agency officials deliberately concealed the existence of the tapes from the Sept. 11 Commission, as the commission's leaders have said.
Mr. Rodriguez has told colleagues he consulted two agency lawyers, who told him that he had the authority to destroy the tapes and that it would not be illegal.

Show AllWill this be like Iran - Contra? Give a rat immunity and he says "I did it all - goodby suckers"!
DON'T give him immunity and all you are going to get is a recitation of his 5th amendment rights.
Two lawyers said it was OK to destroy evidence of crimes committed, so he did? This sounds like 'Bush Think' alright. Torture is legal. Militarism is democracy. Wrong is right. Lies are truth. When will Americans finally get fed up with this crap?
what fools these (gullible) mortals be.
Business as Usual.
Oh-oh, was afraid of this, another hope dashed.
KEM PATRICK
but at least he's still alive..........
'All the evil needs to succeed is for good men to do nothing'
I would like to add an addendum.
'For evil to thrive requires active participation and concealment.'
Evil has truely found fertile soil in the USA.
And to think that this cynical asshole actually has FANS on commondreams.
I called him the way he smelled weeks ago.
Is there such a thing as perception on this ersatz progressive site?
None of these hearings are going to go anywhere! The leading Dimms, especially Pelosi, are up to there necks in this whole torture mess and are complicite. The don't want the evidence uncovered that they are directly involved. Period.
The only way we the people are going to get around these political hacks is with impeachment hearings. It is the only way that the truth will be heard by the American people. Impeachment MUST be put back on the table NOW.
Rep. Wexler will call for impeachment hearings for Cheney tonight on the floor of the House. It will be telecast on C-SPAN between 7-9pm EST. PLEASE call your Congress Critters TODAY to support Wexler's efforts to protect and defend the Constitution. Toll free at 800-828-0498. Just ask for your critters office and they will put you through. Then call again tomorrow. If you have the time, call Conyers and Pelosi also. Below is a link to what Wexler posted over at DKOS today with lots more info. The comments are also interesting.

Tomorrow Wexler will be delivering his petition calling for impeachment hearings to Conyers and the Judiciary Committee. He has over 190,000 signatures.
PLEASE help! Start with Cheney. If that succeeds, the rest will come down like dominos.
why would you demand immunity if, as we've been told by bush, cheney, foxnews and all the rest, nothing illegal happened?
seems like a good enough reason to keep moving forward.

'why would you demand immunity if,as we've been told by bush, cheney, foxnews and all the rest, nothing illegal happened?
good question. shut up.
Is there nothing you can do wrong while working at the CIA? Quit paying taxes, distill your own whiskey?
Speaking of cynicism.....as an ignorant outsider observing from the sidelines......
I suspect from the standpoint of strict self-interest the only thing you can do wrong is upset those "above you" - unless you plan on having them all whacked, but that is usually too risky. Plus it is very crude because these days there are much better "social engineering" techniques. Otherwise, the sky is the limit - literally; and the best deceivers and manipulators will rise to the pinnacle.
Integrity and foolish concepts such as that are dropped off upon entry. Remember those agents are saving the country, and don't forget the code words. Anyhow, those with any humanity need not apply.
Boy it must be a lot of fun to work there. Thank goodness they are keeping the country safe from threats. Wow, what a country.
For example, take a look at that attorney picture. Would you play poker with him? I might, but I wouldn't believe one word that emanates from either side of his mouth or even one thing that he writes.
Oh well, these CIA doods have had their fun. Seems to me pretty soon they can watch with the rest of us as this country breaks into little pieces.....one way or the other. Seems that way to me.
".....Mr. Rodriguez, who led the agency's clandestine service in 2005 and recently retired, has demanded immunity before he will agree to testify before the House Intelligence Committee."
Eat shit and die!
Rodriguez is trying to avoid being the fall guy, 'cause you know everybody upstream is paddling like h3ll to get away. And he doesn't trust 'em to Libby him.
"The only way we the people are going to get around these political hacks is with impeachment hearings."
Excuse me rebelfarmer, who is going to hold the hearings if not these "hacks"?
If Congress is so totally broken, how do you figure to get them to agree on impeachment?
60% of the Republican Party think things are going splendidly and that includes almost every Congressional R. They can't conceive of impeaching a pResident that's doing so well. And any trrrrrrrrrst sympathiser that suggest it should be locked up.
If Congress is broken, find another avenue and lead on!
BTW, Rodriguez was a player in Iran/Contra/Coca, back in the Reagan/Bush years, with the Agency a long time, he has a lot of dirt on a lot of influential (dirty) people, that could translate into a lot of clout.
Or a dirt nap.
Time to break out the waterboard? After all, it isn't torture. The United States does not torture.
AlexLawyer January 15th, 2008 8:03 pm
I agree.... at this point, if waterboarding isn't torture, isn't cruel and unusual, is fully consitutional and legal, than some of these guys shouldn't have any problem being waterboarded every now and then. It'll be like a trip to the waterpark in the summer.
"It was an agency decision -- you can take it to the bank," CIA Director Michael V. Hayden said in an interview on Friday. "Other speculations that it may have been made in other compounds, in other parts of the capital region, are simply wrong."
"Hayden, who became CIA director last year, acknowledged that the questions raised about the tapes' destruction, then and now, are legitimate. "One can ask if it was a good idea, or if there was a better way to do it," he said. "We are very happy to let the facts take us where they will." "

Current CIA Director Michael V. Hayden, and Bush sycophant, is celebrating.
It smells like payback for the NIE report on Iran, etc.

When evil is gleeful good must be somehow suffering.
Good timing too; almost distracted us from telecom immunity.
Everyone is so clever; no wonder Congress and the American people are misled.
Naomi Wolf is right; impeach, prosecute, rid America and the world of this scourge.
Alright. I am finally won over. Raise arms. Fight. Kill. Overthrow the government. It is time. I am hereby advocating revolution. I fully realize this will put me on watch list. No-fly lists. DHS rendition lists. But I can not endure the subjugation of the Constitution any longer. I don't live in the U.S. But should I deign to visit again, keep an eye out for the ex-pat radical who says something publicly that gets him squirreled away. I'll make a big enough stink to penetrate the alternative news media, I promise, but I will be counting on all of you to save me from obscurity.
thewonderingyou - I'm wondering too.
As I said elsewhere: I refuse to be a serf, a slave, or an indentured servant. Wasn't it Jefferson who said something about blood?
Buffalo Ken,
You all may quote me on this: "If you don't ask yourself why, you know nothing."
""The tree of liberty must be refreshed from time to time with the blood of patriots and tyrants."
It bore repeating for those who may be unfamiliar. Perhaps a fuller text is even more appropriate: "God forbid we should ever be twenty years without such a rebellion.
The people cannot be all, and always, well informed. The part which is
wrong will be discontented, in proportion to the importance of the facts
they misconceive. If they remain quiet under such misconceptions,
it is lethargy, the forerunner of death to the public liberty. ...
And what country can preserve its liberties, if it's rulers are not
warned from time to time, that this people preserve the spirit of
resistance? Let them take arms. The remedy is to set them right as
to the facts, pardon and pacify them. What signify a few lives lost
in a century or two? The tree of liberty must be refreshed from
time to time, with the blood of patriots and tyrants.
It is its natural manure."
You know what you have to do.
thewonderingyou: wise words indeed.
You can quote me on this:
"I refuse to be a slave, a serf, or an indentured servant. I will fight for liberty. My own and that of others. For if liberty is relinquished, so goes freedom and democracy."
