'Impeach Bush' Sign in Kent, Ohio, Gets Man a Day in Court
Issued a $125 ticket for advertising 'Impeach' Bush on public property
KENT, Ohio - For doing what he believes is expressing his First Amendment right to free speech, Kevin Egler has a trial date in Portage County Municipal Court in Kent.
The South Lincoln Street resident was issued a $125 ticket July 25 by Kent police officer Jerry Schlosser for "advertising on public property," according to court records.
His advertisement? A sign reading "Impeach," urging the impeachment of President Bush placed in a small public garden at the intersection of Main and Willow streets and Haymaker Parkway.
Egler, 45, said he has placed more than 450 anti-Bush signs in the Kent area.
Kent city ordinance 503.02 states "No person shall stick, post or attach any advertisement, poster, sign, handbill or placard of any kind or description upon any telegraph, telephone, railway or electric light pole within the city, nor upon any public building, voting booth, flagging, curbstone, walk, step stone or sidewalk, or write, print or impress or in any manner attach any notice or advertisement of any kind upon any public building, voting booth, flagging, curbstone, step, stone or sidewalk" that is the property of the city.
However, Egler said he believes the message on the sign he posted is at issue, not the act itself. He said he can show dozens of other examples of advertising on public property in the city, including U.S. Army recruitment posters, "for sale" signs and other handbills tacked to public property that have not attracted the same attention.
If he can't place them in Kent, Egler said he will move his operations to the Akron area.
Egler, who is not affiliated with any local anti-war groups, hosted a small gathering Tuesday with Chicago activist and poet Mario Penalver, who has undertaken an 800-mile walk from Chicago to Washington D.C. to protest the Iraq War and inspire dialogues on peace.
Joining Penalver are Denver-based activists Brother Raymond Schwab and Brother Elliott Nesch of Beit Shalom Ministries, an evangelical Christian ministry dedicated to protesting the war, who left Denver March 1 on their own mission to Washington D.C.
All three men attended Egler's hearing Wednesday, picketing outside the Kent courthouse with signs saying "Honk for peace" and "Impeach Bush."
The three activists said they are disturbed by what they believe is a political motive behind the ticket.
"We need to be more vigilant in times of war to protect our liberties," Schwab said.
"We can't let fear compromise our Constitution," Penalver said.
Judge John Plough set a pretrial for Aug. 9 and a trial for Aug. 16.

A sign placed on the rear window of a car or pick-up truck would also work and might just give better exposure since it could be moved from time to time from parking spaces.
Follow his example. Do what you can...

George has always wanted to be a dictator but both the above are right. They can't put us all in jail---not yet.
They *say* it has nothing to do with the content... but put up some "I'm a fan of Al" or Support Our Commander signs and see what happens.

Spread the word about this to everyone you know! Add your protests to others, in every way you can! If all you can do is scrawl an internet link on a public bathroom mirror, DO IT! If fear keeps you from standing on a corner with a sign, there are LOTS of ways to promote change. The point is to DO SOMETHING! If you can only do a little, maybe your message will trigger a thought in a person that can do alot!

and Shane your are right on, brother and at my age 64, I am tired of taken to the streets,,, it is time for that good ol sit down strike....I remember Phil Ochs singin for us at the Quiet Knight in Chicago and it was around 74 impeachment of Nixon commin up and Phil wanted every one to put graffiti every where on the Walls (* Where the words of the profits are written on the Subway walls) thank you Paul....Impeach tthe rats!

We can be more effective doing this then pissin off the public in the streets.
We can even vote for ourselves for Prez and if enough of us do it , it well become a movement.....and Bush will come arrest me and my cat will get hungry...

If other people are posting advertisements, it seems that he is well within his rights and his day in court should exonerate him....UNLESS there is a Bush appointee sitting on the bench. This is why Bush's judicial shenanigans are so frightening!
I have another strategy that might 'wake people up.' I recently got a request for a donation to my public library. I wrote a letter back in lieu of the donation explaining why I can't spare a dime. I pointed out that I am now helping to support other family members who in earlier days might have qualified for assistance AND I am paying increasingly higher prices for all commodities because of our Iraq misadventure and this administration's policies! I don't have $$ to donate. Taxes DO pay for things!
I said that I WOULD pray for the library and suggested that they apply for 'Faith-based status' since there seems to be money for such organizations. I plan to send similar letters to many organizations that request donations. I suggested that they share my letter with the local newspaper.
Just a thought....it might be an instructive thing to do when people ask for donations!

Why didn't the cops just tell this man that placing a sign on public property is against the law? Why haul him off to court if not to show that any sign of disobedience toward the Bush dog is calls for imprisonment and fines? Maybe this is just the beginning of more oppression. Shutting up dissenters is the wish of the neo-cons and right wing wackos, and Mr.King Tut as well.

Remember all those fellows who would walk around or stand on public sidewalks holding a "Jesus Saves" sign? I never heard of any of them having to go to court or being fined. And isn't anyone advertising on "public property" a member of the public? After all it's the publics taxes that have paid for the parks and streets and public buildings? Where is one left to advertise other than the internet? No, we should be able to get in their face( government officials) and shout our disapproval for all the world to see and hear. The internet doesn't reach everyone when it comes to freedom of speech and live bodies always send a clearer and more definite message. Of course, our streets are being swallowed up as most folks have to go to a mall to shop and in a mall there is private property where you won't have freedom of speech. See the picture? The USA will in our time be privately owned and in time so will the Internet and there will no longer be a "public park or street or road" where one can express his freedom of speech.

I get a ton of mail from the Dems asking for money. Since the buckling on the war and the infuriating
"impeachment is off the table," I've been throwing them unopened into the recycling bin. While it omproves my bank balance, it doesn't do a thing for my soul. So, I printed up a bunchof stickers:
"Take Two Impeachments and Call Me in the Morning".
If they are disappointed when they open their envelopes, it's nothing to what I felt after my high hopes
in November.

A"C" student passed the GRE and got into Harvard--What are the chances someone with A's but no money would get into Harvard Business School? Nil and next to none. I live near Kent and work in Stow, Ohio. I have enjoyed seeing his Impeach sign come and go on a fence by the restaurant where I eat once a week, El Campesino. Though I always wondered who was doing this, I am glad to know who he is though I hate to see that he is being fined for his expressions.
Oddly, Kent is the town where the four students were shot back in May of 1970 and we are having trouble using the newly-built library to show the movie, War Made Easy by Norman Solomon. First off, they want 50 bucks to use the Kent "public" library, and second they said we cannot show the movie there since it is a politcal event.
We are planning to convince them to change their policy since we feel that it should make no difference who uses the "public" taxed supported library, that by the way pays the for the salary of the library head. The Board needs to know what democracy looks like, but as we have seen in many spheres in America since 2000, the chill of suppression is rampant as the pot of fear is stirred in many ways.

What in the world is going on in Ohio? Just Thursday I read on a blog at Huffington Post, that a court in Ohio took away a mothers custody of her child and gave it to the father because she is a pagan. I really don't believe in any religion, but what is the difference between believing a guy that got nailed to a tree is ok, but believing in mother earth is evil! Those folks in Ohio have got a lot of work to do with the people who they elected to make decisions.
Freedom of what?
I played in a band years ago. We did a show in Kent with another band that violated this same law. It wasn't one handbill, but several hundred, stapled to utility poles throughout downtown. The police arrived at the bar demanding to know who was responsible. The appropriate person stepped forward and was grilled about his intentions of wallpapering the town. Here's the point - he wasn't cited. He was given the opportunity to remove the handbills from the city-owned poles.
This man posted one sign in a public garden for a political (protected) purpose. The other instance was someone posting several hundred for a commercial (specifically banned) purpose. One was punished, one was not. It makes you wonder if the Kent PD would have given Martin Luther a ticket for nailing an advertisement to the church door.
My senior park is known for hassling residents if they post political signs on their rented lot sites. I've never directly challenged it. I just park my car with the bumper stickers, including "Impeach Bush", facing the road and fly my flag with a photo of planet earth from the porch. We do what we can.
