Close Guantanamo Now
On July 26, Lt. Col. Stephen E. Abraham testified on Capitol Hill that the Bush administration's legal system at Guantanamo - used to determine which detainees should be held indefinitely as enemy combatants - relied on shaky evidence and pressured officers to rush hundreds of hearings.
This is profoundly damaging to the United States' reputation around the world. And it buttresses my belief that President Bush should close the facility within a year, and come up with a process for transferring detainees and ensuring that they face justice.
Abraham is the first Guantanamo insider to go public, and his testimony is further evidence that the Bush administration has set up a separate and lesser system of justice for Guantanamo detainees. It is clear that the administration's attempts to hold and process detainees at Guantanamo are another example of its efforts to expand presidential authority.
The practices described by Abraham would not pass muster in a U.S. District Court, but they appear to be acceptable procedures at Guantanamo. A system that sets a double standard for detainees, holding them indefinitely on flimsy or nonexistent evidence, is inherently unfair and highly suspect. This is damaging, because it goes against America's legal traditions and values, which are a model for the rest of the world.
Such a system does nothing to make America safer. In fact, it makes the world a more dangerous place for Americans, increasing the odds our troops will be denied their rights when captured on foreign battlefields.
Abraham is to be commended for stepping forward - for taking a move that many consider career suicide.
He is a 22-year Army Reserve veteran, who in civilian life is a respected Newport Beach lawyer. His revelations first hit the news on June 22, when he signed a sworn affidavit describing the Bush administration's separate system of justice at Guantanamo.
Days later, the U.S. Supreme Court - in a move not seen in decades - reversed itself and agreed to hear the appeals of two Guantanamo detainees, who assert that they should be able to challenge their incarceration before a judge in the American federal court system.
Many legal experts believe Abraham's revelations spurred the high court to make its unusual about-face. Just weeks earlier it had refused to hear the appeals.
Abraham's testimony goes directly to the root of the problem at Guantanamo.
Detainee abuses reported during the early years at Guantanamo are presumably a thing of the past. But the continued operation of this separate system of justice contributes to the sustained erosion of America's international reputation.
You do not have to be a lawyer to see Guantanamo for what it is: An evasion of U.S. and international law.
The flawed legal theory behind Guantanamo was drafted by Justice Department lawyer John Yoo, who also authored the infamous "torture memo" that paved the way for secret CIA detentions and interrogation. He concluded habeas corpus and other legal protections do not apply to detainees because Guantanamo is "neither part of the United States nor a possession or territory of the United States."
This extreme theory has had a rocky time in the courts. In 2004, the Supreme Court ruled in Rasul vs. Bush that American courts do have jurisdiction to hear habeas corpus and other claims from Guantanamo detainees. And in 2006, the high court ruled in Hamdan vs. Rumsfeld that the Pentagon's process for adjudicating detainees was invalid.
In response, the Bush administration pushed the Military Commissions Act through Congress. It cleared the Republican-majority Senate last year, 65-34. I voted against it.
This dangerous law gives the president broad power to interpret the Geneva Conventions; severely limits detainee appeals; and permits coerced testimony to be entered as evidence - a first in U.S. history. Its flaws are now on full display.
Two military judges threw out charges against two detainees because they had been incorrectly classified as "enemy combatants" instead of "unlawful enemy combatants," as the law requires. And then came Abraham's revelations.
No wonder Defense Secretary Robert Gates has said trials at Guantanamo would lack legitimacy in the eyes of the world, and former Secretary of State Colin Powell said he would close Guantanamo "not tomorrow, but this afternoon."
Make no mistake: We must track down, prosecute and punish terrorists. But we must never forget we are a nation of laws. This makes us strong, not weak. The Bush administration's failed legal experiment at Guantanamo hurts the United States around the world every day. The time has come to close it down.

Show AllThanks for the info, Hide Behind, on Feinstein. She is a disgrace to the Democratic Party, and big deal, she makes a speech regarding Gitmo. Why didn't she and others call for the overturning of Bush's military commission act. Time after time, Bush erodes our constitution, but you never hear from either Feinstein or Boxer in forcing the end to Bush's many illegal acts. And why shouln't she support impeachment at least in words even though it will take the House to start proceedings which they will not do. We need a complete overhaul of the entire House and Senate and Judicial Department. Feinstein is part of this debacle, and entirely too late in speaking up against Gitmo.
There is nothing wrong with Ron Paul's beliefs. He isn't even opposed to states providing social services, medical services....etc. His whole argument is you can't have a powerful central government that gets the Lion's share of taxes, controls the money supply, has control over all that spending, has control over the military...and not wind up with war. Medicare and social services aren't his cup of tea...but if power and control went back to the states...people could live were they wanted to live. Clearly the Northeast and West would be governend liberally and the South conservatively. We would see who prospers best. Personally I'm not a big fan of Social security and medicare. I think it is all a big ponzi scheme that is going to blow up in our faces...but hey. We'll see what happens when our country goes from 6 workers to 3 workers for every retiree by 2020. Not only will less money be coming in...but the demand for services will be 3 times as large. Nobody wants to listen to mr. David Walker though. Boy are we up sh#% creek.

I think that Diane, for the most part is fine senator. I would also add, that it would be helpful for her to suggest some solutions or legislation to get this mess cleaned up and get Guantanamo closed.

Todd Chretien (Green Party) ran against Feinstein in 2006. I remember going to his website and noticing there wasn't a word on there about Feinstein being a war-profiteer or about her husband Dick Blum and his company, Perini. So I wrote to them about it and got a e-mail back saying "we're just getting started with our website but we will be sure to put that on there."
Yeah right. They never did.
Seems to me if you're running against an establishment candidate one would have that person's record on one's website. Chretien never presented Feinstein's record on his website. And that really told me that he wasn't really serious about challenging the war-profiteer.
I suppose the reason she got back in was because of her name recognition. I doubt most people who voted for her even know her record...they couldn't be bothered. She didn't even have to campaign. I'm in California and I only saw one slick ad for her/by her on the corporate media.

Feinstein has no credablity as a progressive senator and is one of the many slimeball democrats who while posing as a liberal has been feathering her own bed by many of her votes.
What First brought Feinstein in my politcal gunsights was the California Desert Tortoise episode.
A bill, which looked like a normal Democratic attepmt to curry favor of rich Sierra Club and Californian environmentalist, she sponsored was Titled in Defence of the Califronai Desert Turtle and Establishment of some named Desert National Park, and would make an area half the size of of New Jersey of limits except to foot traffic.
At first glance a fairly good cause, and the torise was endangered and the area in the largest portions was used by 4x4 bikers and sand dune runnning for many years and a limited amount of mining.
Of course the bikers and people who used area for recreation got all up in arms but unlike Feinstein in past who was supposed to be a hard heaed greenie she quickly agreed that a portion of desert could still be open to automotive and recreational activitys.
She did this without a fight.
Alarm bells form some of her earlier actions went off but they were very small two faced normal political chicanery every politco pulled.
What she did not mention that in the past she had also voted for alowing mining in that portion of desert that was not openm to the biukers and 4x4 crowd because the military said it needed the strategic minerals.
The fact that nowheres else in US could one find such minerals did have a validity to allowance and protection of the tortoise by mining intrest was in effect but in only a minimal way.
The Bill Passed, the 4x4's and bikers were happy Sierra Club and greeies gave her lots of fuding and votes and the tortoise being a lot like a tortoise just went on about its buisness.
So why and where was the ketch?

MR Diuanne the day the bill closed became a multi millionaire by the fact that he was now the sole provider of the strategi minerals from his partners who happend to be an Indonesian Mining Interest.
As a side note when Clinton made the Utah area a national Monument and eneded coal mining the very same Indonesian firms got coal contracts for delivery to US to make up for losses in park.
Most here know of Feinsteins husbands war contracts and security services since Iraq war began so I'll quit harping on her duplicity in a bit.

That's what I was saying (in another thread). Before the 2006 "election" people were chanting to "vote them all out" of the congress in 2006. The one problem with that slogan is that they are not "all" up at the same time, particularly in the senate since the senate is divided into roughly thirds for re-election purposes and each senator serves a 6 year term.
So Feinstein got back in and at that time I said: So much for the "vote them all out and clean out the congress" slogan because it's already failed when the war-profiteer and pro-war Pelosi got back in, as to examples.

I don't agree with Ron Paul about a woman's right to choose what to do with her body, or about Medicare for all Americans or several other issues. But the guy is RIGHT about the Constitution, the Federal Reserve and the rotten IRS.
It's too bad we can't have a populist candidate who is highly trustworthy, charismatic and the best parts of Ron Paul and the best parts of Dennis Kucinich (minus his AIPAC ties) and Mike Gravel. Who the heck IS that??
Senator Feinstein's record is clear enough:
1. She has repeated enabled Bush / Cheney to prosecute this illegal war;
2. Her family has directly profited from this war, and
3. Obviously, unless this woman has a REAL epiphany, her professional conduct will simply serve to continue enabling these facists to get away with murder, plunder of the public treasury unscathed, and the worst, shredding of The Constitution.
When is her term in the Senate finished? Californians, do your civic duty and start looking for a proper replacement.
One final comment concerning Speaker Pelosi's comments about "impeachment" being "off the table. If Speaker Pelosi (for whatever reason) is unable to fulfill the duties of her office as Speaker by ordering an impeach, then it follows that she would most likely be unable to fulfill her duties as President of the United States. Where do I send a campaign contribution to Cindy Sheehan?

Boxer USED to be a true left/progressive but that is no longer the case.
Boxer is a Traitor to the US Constitution too because she voted "YES" for Bush's USAPATRIOT ACT also. A truly left/progressive person would not have done that.
Also, two weeks ago the Senate (which includes pro-war Boxer and pro-war Feinstein) by a 97-0 vote gave Dictator Bush authority to attack Iran.

Looks like Fienstien is trying to infiltrate the progressive movement. Since she recently endorsed Clinton for President aka GWB in a skirt, what is her agenda. Just so all you folks know, Fienstien is no friend to progressives; she has consistently violated progressive values on the environment, war in Iraq, and CAFE standards. To wit she recently appeared to quip that CAFE standards has been ignored and then takes refuge under an unacceptable standard of 35 MPG. Fienstien is another bought and paid for politician owned by corporate interests now characterizing herself as a champion of progressive values. She was one of the first Senators to visit Gitmo stating at the time the it was an exemplary facility and like the Iraq war now shifting ground. Time to take out the trash people!

Well either you haven't been paying any attention to what this woman has been doing and is about or you and I have two opposite definitions of what makes a "fine senator."

I can't stand pro-war, pro-Bush, pro-corporate, pro-imperalistic Dianne Feinstein. She's repugnant as far as I'm concerned. She is a Repug. I have no respect for this disgusting woman at all. I'm in California. I didn't vote for her.

She said impeachment is not going to happen because the Dems would look like nuts if they were try to impeach Bush/Cheney.
(The fact is she doesn't want them impeached because she has been one-with-them since Day One.)
Of course this woman is more into what things "look like." She has no regard or respect for the US Constitution. If she did she would not have voted "YES" for Bush's USAPATRIOT ACT.
