Defying the Imperial Presidency
The House Judiciary Committee did its duty yesterday, voting to cite Harriet Miers, the former White House counsel, and Joshua Bolten, the White House chief of staff, for contempt. The Bush administration has been acting lawlessly in refusing to hand over information that Congress needs to carry out its responsibility to oversee the executive branch and investigate its actions when needed. If the White House continues its obstruction, Congress should use all of the contempt powers at its disposal.
The committee really had no choice but to hold Ms. Miers in contempt. When she was subpoenaed to testify about the administration's possibly illegal purge of nine United States attorneys, she simply refused to show up, citing executive privilege. Invoking privilege in response to particular questions might have been warranted - the courts could have decided that later. But simply flouting a Congressional subpoena is not an option.
Mr. Bolten has refused to provide Congress with documents it requested in the attorney purge investigation, also citing privilege, and he has been equally unforthcoming about why he thinks it applies. Together, Ms. Miers's and Mr. Bolten's response to Congress has simply been: "Go away" - a position that finds no support in the Constitution.
If these privilege claims make it to court, it is likely that Ms. Miers and Mr. Bolten will lose. The Supreme Court has held that a president's interest in keeping communications private must be balanced against an investigator's need for them. In this case, the president's privacy interest is minimal, since the White House has said he was not involved in purging the United States attorneys. Congress's need for the information, though, is substantial. It has already turned up an array of acts by administration officials that may have been criminal.
The administration's contemptuous attitude toward the constitutional role of Congress was on display again this week when Attorney General Alberto Gonzales testified before the Senate Judiciary Committee. He repeatedly refused to answer legitimate questions, and he contradicted himself so frequently that it is hard to believe he was even trying to tell the truth.
Congress must not capitulate in the White House's attempt to rob it of its constitutional powers. Now that the committee has acted, the whole House must vote to hold Ms. Miers and Mr. Bolten in contempt. The administration has indicated that it is unlikely to allow the United States attorney for the District of Columbia to bring Congress's contempt charges before a grand jury. That would be a regrettable stance. But if the administration sticks to it, Congress can and should proceed against Ms. Miers and Mr. Bolten on its own, using its inherent contempt powers.
It is not too late for President Bush to spare the country the trauma, and himself the disgrace, of this particular constitutional showdown. There is a simple way out. He should direct Ms. Miers and Mr. Bolten to provide Congress with the information to which it is entitled.

Show AllThe Congressional hearings are just a sideshow. The real battleground is the voting booth, and with paperless voting machines, the Republicans have an excellent chance of remaining in the White House indefinitely.
The New York Times and the Democratic contenders are busy chattering about the issue du jour, and it's all just a joke if the 2008 election is already fixed. The few die-hards who are sticking with this story have already discovered dozens of ways to rig the machines, many of them undetectable after the fact.
If the vote is corrupted, none of the noise from Congress or the New York Times will really matter.
Whenever the NY Times puts out an editorial like this, I picture a man, licking his finger, and testing the wind. It feels like an opportunity to check if their readers want to hear more against Bush or more for Bush, and then make sure that their main stories cover the right topics to appease the majority of their readers.
My my, last week several of us wondered if the powers that be, were closing the door on Cheney and his puppet? Perhaps they have released the dogs of the major editorial boards. If so, we may have a chance.
Love the line,___ it was hard to believe, our Attorney General Gonzales was even trying to tell the truth. What!! How does one TRY to tell the truth? One either tells it ___or they don't, one does not have to TRY. One has to try to lie.

Somewhere in the Constitution it states that Congress alone can make laws and that the President is required to faithfully carry them out. Apparently that law doesn't apply to George W. Bush.
President Bush has devised a way to circumvent the law and short-circuit the system by issuing many Executive Order's that not only contravene the Constitution, but also cover his ass from prosecution. With hundreds of "Signing Statements," and Executive Order's, George W. Bush has created "bush Law."
An executive order only becomes law if Congress doesn't overturn it within thirty days after it is published in the Federal Register. Why has Congress consistently failed to exercise their Constitutional Responsibility to overturn "bush Law."
Until he is removed from office, George W. Bush will continue issuing "bush Laws," much faster than Congress can issue legitimate laws. Perhaps the Democratic "leadership" hasn't considered the ramifications of this fact. Impeachment is the only legal recourse the American people have to check this lawless president. If Congress doesn't Impeach George W. Bush, he can tie our legal system and government into knots, and continue to "bushwhack" our country.
Dennis Kucinich is the smartest leader we have. He realized that Impeaching Cheney first was the surest, quickest means of Impeaching Bush, next. Until that's done, nothing else will get done.

It is all parlor games, charades too make us believe that Congress is actually functioning.
Censure and non-binding resolutions are examples of do-nothing acts. It sounds serious but nothing ever materalizes from this type of hoopla. While Congress plays musical chairs thousands of innocent people die.
You are right Jacob. Of course rigging the votes works both ways, the Democrats are masters of that also. They got beat at their own game the last time, but they've had ample time to round up a bunch of top level computer hackers.
That's one sure reason a third party candidate will seldom, if ever, win a major election. How have we allowed this to happen?
When are people going to realize that there is no "Congress" as we understand it from history? The game is OVER. The takeover of our country has been in the works for over 80 years, and only now are we seeing the raw takeover without window dressing. Folks, it is too late. The stolen elections over the past 7 years should have clued everyone in. THERE IS NO VOICE OF THE PEOPLE ANYMORE. There is no alternative, no fixing this. It is completely broken, and the only way it will change is the entire free world's peoples coming together against corporatism/globalism/fascism. Period.
Unfortunately (for us), the Judiciary Committee has decided to wait until after Congress's August vacation to deal with their ignored subpoenas. This is reasonable if you think President Bush ordering people into contempt of Congress isn't as important as the congressmen taking their month-long vacation. (Where's my month off, you privileged sissies?)
We'll also have to wait until after August to find out what the spineless Democratic-led Congress decides to do about the U.S. Attorney General perjuring himself to the Judiciary Committee. My bet is that they'll ignore that, too. I mean, if they're going to ignore illegal wiretapping, torture, and the worst debt in history, then perjury is just a side dish.

Executive orders can only implement current law, not establish new law. There is no legal time limit on challenges to executive orders.

Evelyn, I so wish it weren't true. I have cried so many times over this. First in 2000 when our Supreme Court decided our president as opposed to the people. Again in 2001 when thousands of lives were lost and three buildings came down without any logical explanation. Again as the media ignored any open discussion of it. Again as our leaders ignored the largest worldwide protests ever against going to war. Again as the war began. Again as our country became torturers. Again as the 2004 election was stolen. Again as our leaders just flat-out told us we are being spied upon, as Congress did nothing. Again as our last hope, a new Congress, immediately after getting into office said "Impeachment is off the table". Again for the continued pleas of our people for adequate universal healthcare which have been ignored for 30+ years.
It is over. Rome must fall before change will happen now.

I believe the Fascist Five were put on the Supreme Court precisely to aid in the transferrence of complete power to the Executive Branch & the elimination of Congress as a competing source of authority. Further, I believe we will see this played out when the Bushthieves attack Iran & declare martial law. If a challenge is even permitted--which I doubt--you will see the Supreme Kourt rule in favor of the fascists.
This is the moment the neoconmen have been working towards for over 30 years. And the corrupted Supreme Kourt is instrumental to their plans. Law, sadly, is no longer the calling of this bunch; the securing of the power of the korporatists is.

I was going to move to Hawaii until I read the blogs a nurse wrote on todays article about Iraq having so many cancer cases from DU. The nurse says our military has scattered tons of DU all over Hawaii when they used it on the military firing ranges over there. Well___ maybe I'll try the Island of Diego Garcia.

Ok folks, I try to be honest so I'll admit I haven't yet read the post yet. I do intend to read this one though. In fact there are so many posts coming up everywhere I simply don't know how anyone can keep up with them all. I like to think the exponential number of posts popping up everywhere is partially a result of the accelerating rate of change in our society and consequential overload of stimuli, predicted many years ago by the futurist Alvin Toffler in his book "Future Shock".
However, it appears to me more likely that even the densest of people can only be fooled for so long. And cracks are appearing everywhere in this paradigm that is the Empire led by by Mr. Bush. The Emperor has no clothes and the rest of us are aghast at the naked truth.
Evelyn I really enjoy your comments. Keep up with those revealing words about how we have radiated the land and oceans with nuclear waste. And how the beating of the war drums by the MSM is well under way for the attack on Iran, the last recourse of a cornered tyrant and his accomplices, betting on the tried and true formula of fear-mongering to rally the masses. But this time they won't rally. At least not behind a madman. Wasn't it Mr. Bush himself that said in his endearing way of creating verbal salad "Fool Me Once, Shame on Me, Fool Me Twice..." well we won't be fooled again. Count on it.

Our bomber fleets have been relocated to Guam and Diego Garcia, a third nuke sub is now based at Guam, its commander relieved and replaced by a buddy of Rummies. There are three carrier groups off of Iran and a few hundred nukes have been removed from the storage bunkers in Germany and shipped out to?? Nancy Pelosi is having brunch with Cheney. Except for all of that__ there is a lot more paranoia to sleep on.

Hi Vanishing Earth, glad to read someone is not tired of hearing about the DU that is gonna kill all of us if we keep allowing its use. Love your sensible thoughts and comments and those of many others here too.
Get over it! It's too late now. Nothing short of a military coup or a revolutionary war is going to change what's coming. Let it go. Send the humans back to the stone age. Maybe they'll make the right choices next time around.

Excuse my ignorance, but what is DU?
I also want to voice my support for the idea expressed here, that there ought to be more outrage about the stolen elections.... Why aren't the Democrats making paper trails mandatory? To me it's about as equal in seriousness as them not doing anything about Iraq.
Today I read a report in a New York paper that they are now pushing a vote on a plan that will require the administration to begin removing troops in two months, but leave it up to the President to decide the rate of removal, and when it is complete... Hello????
Why not just let him do whatever he wants? That is essentially what they are doing... Damn, imagine what might have happened if the Republican Party just capitulated to everything Clinton wanted to do.... what would the world be like if the Republicans just went along with whatever numnuts was in the White House at the time.. I hate those bastards, but at least they fight for their causes...

DU is not just a problem for the Mid-East, it is everyplace, it is scattered all over the United States now. The wind blows the radio-active dust any and everywhere. A single microscopc speck will infect a human and DU does get into male sperm and then into a fetus. The results are tragedy.

Evelyn, you're a bit behind the times on plane basings. Recently our largest bombers have been moved to "undisclosed Persian Gulf bases" (Diego Garcia was deemed a bit too far away to make multiple, quicker attacks). The new giant Iraq bases are filling up with fighters, A-10 Warthogs, and larger bombers. "Collateral Damage" is on the rise in Iraq and Afghanistan. Of course some of the Bushies will do anything they can to bomb hell out of Iran.

Perhaps we'll be in luck and Roberts will have to retire from his stroke. But then we can only hope HOPE that the they will stand up to the Bush and require someone at least leaning towards moderate.
But then again, Congress has total contempt for the people - just as Bush does. They just as soon make it official. They just about already appointed our new president: Hillary - the woman that said if you don't like my stand on this war, find someone else. Cripe!
