Two Races, Two Systems of Justice in Louisiana
Last week in Detroit, the NAACP held a mock funeral for the N-word. But a chilling case in Louisiana shows us how far we have to go to bury racism. This story begins in the small central Louisiana town of Jena. Last September, a black high school student requested the school's permission to sit beneath a broad, leafy tree in the hot schoolyard. Until then, only white students sat there.
The next morning, three nooses were hanging from the tree. The black students responded en masse. Justin Purvis, the kid who first sat under the tree, told filmmaker Jacquie Soohen: "They [other black students] said, 'Y'all want to go stand under the tree?' We said, 'Yeah.' They said, 'If you go, I'll go. If you go, I'll go.' One person went, the next person went, everybody else just went."
Then the police and the district attorney showed up. Substitute teacher Michelle Rogers recounts: "District Attorney Reed Walters proceeded to tell those kids that 'I could end your lives with the stroke of a pen.' "
It didn't happen for a few more months, but that is exactly what the district attorney is trying to do.
Jena, a community of 4,000, is about 85 percent white. While the black community gathered at a church to respond, others didn't see the significance. Soohen interviewed Jena town librarian Barbara Murphy, who reflected: "The nooses? I don't even know why they were there, what they were supposed to mean. There's pranks all the time, of one type or another, going on. And it just didn't seem to be racist to me." Tensions rose.
Robert Bailey, a black student, was beaten up at a white party. Then, a few nights later, Robert and two others were threatened by a white man with a sawed-off shotgun at a convenience store. They wrestled the gun away and fled. Robert's mother, Caseptla Bailey, said: "I know they were in fear of their lives. They were afraid that this man was going to shoot them, you know, especially in the back, running away from the scene."
The next day, Dec. 4, 2006, a fight broke out at the school. A white student was injured, taken to the hospital and released. Robert Bailey and five other black students were charged ... with second-degree attempted murder. They each faced 100 years in prison. The black community was reeling.
Independent journalist Jordan Flaherty was the first to break the story nationally. He explained: "I'm sure it was a serious fight, and I'm sure it deserved real discipline within the school system, but he [the white student] was out later that day. He was smiling. He was with friends ... it was a serious school problem that came on the heels of a long series of other events ... as soon as black students were involved, that's when the hammer came down."
The African-American community began to call them the Jena Six. The first to be tried was Mychal Bell, 17 years old and a talented football player who was looking forward to a university scholarship. Bell was offered a plea deal, but he refused it. His father, Marcus Jones, took a few minutes off from work to talk to me: "Here in LaSalle Parish, whenever a black man is offered a plea bargain, he is innocent. That's a dead giveaway here in the South."
Right before the trial, the charges of second-degree attempted murder were lowered to aggravated battery, which under Louisiana law requires a dangerous weapon. The weapon? Tennis shoes.
Mychal Bell was convicted by an all-white jury. His court-appointed defense attorney called no witnesses. Bell will be sentenced on July 31; he faces a possible 22 years. The remaining five teens, several of whom were jailed for months, unable to make bail, still face second-degree attempted murder charges and a hundred years each in prison.
Flaherty, who grew up in New Orleans, sums up the case of the Jena Six: "I don't think there is anyone around that would doubt that if this had been a fight between black students or a fight of white students beating up a black student, you would never be seeing this. It's completely about race. It's completely about two systems of justice."
Louisiana Gov. Kathleen Blanco gained national prominence during Hurricane Katrina. There's another hurricane that's devastating the lives of her constituents: racism. The families of the Jena Six are asking her to intervene. District Attorney Walters says he can end the boys' lives with his pen. But Gov. Blanco's pen is mightier. She should wield it, now, for justice for the Jena Six.

Ms. Christian and Chris Newsom's horrific sodomy, rape, kidnapping and beating over a two day period at the hands of several blacks in Knoxville, Tn in January 2007 is one example of how Louisiana whites are supposed to be slaughtered in the name of political correctness and to correct the wrongs of white christian european males.
Another example is the three Eastern Michigan black students who raped and killed a white female student in her dormn room. HOORAY!!
Recently, the ten teenage black boys in Palm Beach, Fl who invaded a young woman's apartment, raped her, beat her and then made her ten year old son rape her. Isn't this wonderful!!
Haven't you noitced that every missing white woman is the victim of a rape and brutal crime by a black man, with one exception out of 300. Aren't all of you ecstatic at the progress of the black race. Overjoyed must be an undertstaement for you.
I bet all of you on this sight are just happy that blacks, after all these years of political correctness and quotas and ignoring the violence of blacks, have simply not progressed on the human front. The Blacks have not given back. They are becoming excesssively violent. Why are you so insistent that Blacks continue this behavior.

Recent history of blacks in this country does not reflect a compassionate, thankful or tolerant race as many expected when pc began in the late seventies. PC people have forgotten this goal and have now gotten carried away with simply teaching and reiterating hatred of whites by blacks as the norm. But you people ignore the reaction of blacks to your teachings- they are kiling whites in record numbers.
What we are seeing now from a new generation of blacks is that pc has not been successful in stemming black rage against whites. Instead it is encouraging it and you people think its justified by ignoring it. Like the arabs and muslims are not allowed to protest the jihadists, Americans are not allowed to protest the extremely violent black race that has been given every single opportunity to economically improve.
The La officials may simply be trying to protect a race no longer allowed to protect themselves from the excessive and horrific violence at the hands of blacks becuase CNN, ABC, CBS and NBC continuously tell blacks to hate white people because of the moral injustice of over 150 years ago.
You people on this web sight seem to enjoy and celebrate horrrifc crimes against whites by blacks in order to appease your own guilt. These crimes are growing in numbers and in ferocity and you choose to ignore them as if the blacks are supposed to act this way.
Isn't time to teach blacks respect for other races as we have done for our white children.Lets lay off the hate teaching that has influenced and excused the violence of the black race. We have done nothing in this country but allowed blacks to destroy whites in the name of PC.

Where is the Southern Poverty Law Center right now? They had better be out there helping these boys and the Governor of Louisiana had better be flaying the school administrators who allowed this situation to escalate out of control. The censure of the beating and maybe even the expulsion could have been warranted, but certainly not a trial for attempted murder. Somehow, Louisiana is determined to make us understand that racism still flourishes in our country, and now it's time to do something about it. Jesse Jackson, you are still needed!

Yes, the the class system is the ultimate ememy.
But, as someone who lives in the Pittsburgh where poverty is a bit more equal-opportunity, but racism is rampant. I see the profound racism and xenophobia of working-class whites, and increasingly a strange state of denial of the prevalence of racism among working-class blacks, as the barrier to workers uniting.
I'm disturbed by the divisiveness and racial profiling I read in these posts. If we feel we need to have enemies to function as a society
( a notion I absolutely reject ) let's be clear about who the enemy is.
I don't want to wage war against skin color. Skin color like hair color is irrelevant. I would rather wage a war against the class system that uses their power and influence to pit us against each other, teaches us to hate and to fight amongst ourselves or against other nations in a cause that only serves to enrich them, and who hide their faces behind the smoke screen of the media they own and control.

Seems to me the prison industrial complex just found an end run around the abolition of slavery, by creating an inmate population of darker hue to do work for industry at pennies per hour wages. What has massive injustice cost America's soul? This race to the bottom in pursuit of the all important homage to mammon/profit... we haven't even SEEN the price for this travesty in its entirety yet. It's impacting EVERY aspect of our lives--how energy is processes, how the medical machine operates thanks to big pharma and the HMO/insurance companies, education, the criminal "justice" system, etc. EVEN our food!
Ah and it's a sad day for the Irish too when Jena librarian Barbara Murphy claims she doesn't know what nooses hangin' in a tree means. I suppose she's never heard Billie Holiday sing "Strange Fruit" either.

There is no justice system, but a legal system, which is corrupted.
While it is tempting to wish Congress had let the "southern states" secede and thus rid the rest of the nation of rampant racism. The unfortunate truth is the north had its fair share of the same attitudes. I thought we had progressed a bit since the Civil Rights Movement days but we haven't. It shocks one to keep hearing about the violence perpetuated against black people for little, the joke about being arrested for driving while Black is all too true. I thought librarians were our last defense against the intrusions on our civil liberties but there must be librarians and southern librarians, I mean how do you make light of a noose, obviously become a southern librarian? The GOP has not helped one bit in fact they have always put the blind eye to the telescope on such matters, first disenfranchising black neighborhoods to make them "disappear' even faster.
One can join the movements to right the wrongs the Jena students were subjected to but it seems that the issue needs a leader/speaker with some vision that can arouse people to acting with one accord on the larger more general issue of racial misdeeds sanctioned by some states.
There is an "unofficial program" that is followed almost universally by white American juries, prosecutors, defenders, law enforcement officers, and judges: If the defendant is Black, do all you can to make sure that defendant is incarcerated for as long as possible, and if the death option is on the table, go for that. This "unofficial program" is called "white supremacy" and it happens all across the country, not just the south.
Review criminal justice statistics from across the country and you'll see this clearly. The "war on drugs" has always been a part of this "unofficial program" to remove as many Black (and Brown) men from society as possible, and it has absolutely devastated Black communities. Getting "tough on crime" is politically expedient, and in many white minds, "crime" and "Black" are synonymous (just as "terrorism" and "Islam" have almost become synonymous).
If you take a significant portion of the males out of a community, the community will fall apart. While mass incarceration of Black males has always been applauded by conservative constituencies, the destruction this mass incarceration causes Black communities is apparently A-OK and often used by conservatives to bash those same Black communities ("out of wedlock births, black-on-black crime, welfare queens, blah blah blah", etc.).
Because of the persistence of America's "unofficial program", Black people had better seriously consider segregation as the only option to radically alter the future for the better; Black laws for Black people on Black land. Trying to make this "melting pot" work is killing us softly, and white America seems more than willing to lock us all up since they couldn't send us back to Africa after slavery was abolished.
This is what the NAACP should be talking about instead of symbolic foolishness like burying the "n-word".
Black leaders are not needed. Human beings are needed. These are not accidental mistakes in the justice system. This is all very deliberate.
Anybody who actively works to cause this kind of injustice is EVIL.

Ok for the record...stop looking for Black leadership. It doesn't exist. What do I mean? Ill explain.
Black leadership in it's purest form is leadership that is beholden to black interest only. Name a Black elected official who only legislates on behalf of his black constituents? To do so would be un American and racist. Except for that dude who was mayor of Detroit back in the day, black elected officials tend to go out of their way playing both sides of the fence politically/racially.
Now the closest that we have gotten to real black leadership was Minister Farakhan, but this man had three problems.
1.He was crazy.
2.He was never elected by anyone or to anything closely resembling public office
3.He was crazy.
But now let me put aside my sarcasm. There are enough alluent Americans of all stripes who can and should be stepping up on this issue. I would be willing to throw the first cream pie, but I'm busy playing playstation right now. And then I must polish my rims.

If the system allows Judges to come from the same communities that believe their biased viewpoints are fine, then justice is definitely tilting towards one side.
I have been following this sad story quite closely. This is another feather in the "crown of racism" in the US, the "protector and defender of democracy" in the world. The simple definition of democracy (as I understand) is "by the people, for the people, and of the people" irrespective of colour, creed, and class. However, when we see the very public institutions that are supposed to promote equality and justice for all the citizens, become enforcers of apartheid, I do not know how the US is a "democracy" for the minority communities. Sometime back ABC News 20/20 programme showed a similar story where a white judge gave judgement on two persons of different colour in Wyco, Texas. The first one is a "white" male. He is a son of a "white" pastor of First Baptist church. This pastor is wealthy, influential and has links with politicians. He is also on the board of the university. His son one day called home a male prostitute. After some time they had argument over the payment for the prostitute's "services". The son pulled out a revolver and shot the prostitute to death. Then he called police and told them that he shot him in self-defense. But in the autopsy it was revealed that the prostitute was shot from behind and proved that the son's version was wrong. He was sentenced with probation. During the probation he was caught twice using drugs. He hired a good lawyer and his father through his political links influenced the judge. The judge gave a verdict releasing him with surveillance. He had to only inform the police what he was doing and how he was. The second person is an African American from a poor family. One day he tried to rob a pedestrian by pointing a gun. He took that person's wallet and found two dollar bills. He returned the wallet and the dollar bills to the owner. For that he was imprisoned with probation. During the probation he was found once taking drugs. Because of this violation of probation, the judge gave a verdict sentencing him for life. The judge ended written judgment with a wish "Best of luck"!!! ABC's 20/20 program contacted this African American in prison. The "white convict" did not meet ABC. It also met the "judge". It asked how he was able to sleep with this kind of biased judgment based on one's colour, and socio-economic status. This judge did not want to respond. The judge is now contesting in politics.
It is no wonder, because of the "colour blinded justice system", that across the US, black youth are found to be 10 times more likely to receive life sentence without parole than white youth for the similar crime. According to one report 60,000 African Americans come out of the prisons every year in America. (80% of the prisoners in American prisons are African Americans). In Pennsylvania, Hispanic youth are found to be ten times more likely to receive life sentence than their white contemporaries. Jonathan Kazol, the author of the book "The Shame of the Nation: The Restoration of Apartheid Schooling in America", commenting on racism and the US education system, calls it "socially, economically enforced apartheid". He says that in America, the African Americans (and the minorities) are systematically pushed to a corner.
What is apparent is that the public institutions (police, justice, and political) that are supposed to defend equally the rights of all US citizens, have become the institutions that suppress the voice and rights of the minorities. Doesn't the State response to Katrina expose that New Orleans and Mississippi are still treated as the Plantation Regions, which in turn indicate the status and condition of minorities. In the history of America a minority member has never become the president of the US (probably because it is "WHITE HOUSE"), a vice-president, a speaker of the House, and anchor of 6.30 p.m. international news!!!! This reflects that the democracy in the US is "by the white community, for the white community, of the white community". Minorities are ALIENS!!!
Don Imus makes a trivial statement yet gets nationwide condemnation, but the silence on this is truly disgusting, where's all the protests, where's Al Sharpton?
I've been following this story for a few months now and am simply amazed that there isn't more outrage in the US media and political circles than seems to be the case.
What's George Bush's position on this one? Does anybody know? Judging by his inaction in New Orleans I'd take a flying guess that George (quietly) doesn't have much time for poor black folks either. Most of em ain't Republicans anyhow.
It seems clear that there are still some states in the USA where a black man is not a black man. They're all still regarded as ni**ers, and the sooner people start using that word again in connection with this racism the sooner they might get some results.
The people of Jena should be completely ashamed of themselves.

I don't see any justice here. Maybe they should ask President Bush for a pardon, the sentencing is unusually harsh. Why are white americans afraid of tennis shoes? I never advocate violence, but in this case some brothers should go down there and kick some ass.
I write this at the risk of sounding segregationist. I think Louisiana should split up into two states. One with an African-American population and one with a non-African American population. African Americans would be free to run their state as they see fit without white redneck interference. The two states can mutually agree to split up the oil wealth. Louisiana has sadly proven itself to be a failed state. The white run government is totally clueless with dealing with the Katrina recovery and other important issues; especially when it comes to the needs of African Americans. In fact Louisiana continues to behave ultraviolently towards African-Americans. Why the hell would African-Americans want a white redneck like Vitter to represent them? That's insane!!!! I know I will get negative responses, but I really don't see how Louisiana can continue in it's present state.
The silence from the Louisiana Governor's office is deafening.
Reed Walters is another rogue prosecutor, like Mike Nifong, and it really doesn't matter which side of the racial divide these guys may favor at any given moment. Mike Nifong went off the deep end prosecuting white defendants in Durham, which is 44% black. Walters went the other way in Jena, which is 15% black.
The real racial divide in justice is national. Black crime is punished much more often and much more severely than white crime, from Minnesota to Massachusetts. The most dangerous racists control majorities in Congress and state legislatures from coast to coast, and the Southern version of it is just another side-show.
Racism and hatred are alive and well in the South and the rest of country as well. In fact it has been growing by leaps and bounds since the White House feels it's ok to discriminate against people of color not to mention anyone who happens to be Muslim or Arab "looking". "These dark types scare the hell out of me because they scare the President. At least he can bomb people if he wants. Why can't I put up a few nooses to keep the blacks in line?" said the redneck MF. I marched on Washington and in Cambridge and Boston for civil rights in the 1960's. A lot of good legislation was passed but nothing has changed. Most of the gains were undone by the Ronald Ray-guns Administration. The Bush administration is even worse. Did anyone expect something different? These black kids in Louisiana are doomed. They were doomed the day they were born black in Amerika. The defeat of racism can only be accomplished by education. You know, that quaint idea that everyone has a right to go to school AND REALY LEARN SOMETHING, besides some stupid test that is intended to keep them from learning how to think critically.
People from Louisiana should call their Governors office so she makes justice and fire that racist District Attorney. It is so outrageous that the Civil Rights Movement didn't make it to this little town in Louisiana. Shame on their white population.
