Bush Commutes Libby Prison Sentence
WASHINGTON -- President Bush commuted the sentence of former aide I. Lewis "Scooter" Libby Monday, sparing him from a 2 1/2-year prison term in the CIA leak case. Bush left intact a $250,000 fine and two years probation for Libby, according to a senior White House official, who spoke on condition of anonymity because the decision had not been announced.
Bush's move came hours after a federal appeals panel ruled Libby could not delay his prison term in the CIA leak case. That decision put the pressure on the president, who had been sidestepping calls by Libby's allies to pardon the former chief of staff to Vice President Dick Cheney.

The United States Court of Appeals for the D.C. Circuit today rejected Lewis Libby's request to remain free on bail while pursuing his appeals for the serious convictions of perjury and obstruction of justice. As a result, Mr. Libby will be required to turn himself over to the Bureau of Prisons to begin serving his prison sentence.
I have said throughout this process that it would not be appropriate to comment or intervene in this case until Mr. Libby's appeals have been exhausted. But with the denial of bail being upheld and incarceration imminent, I believe it is now important to react to that decision.
From the very beginning of the investigation into the leaking of Valerie Plame's name, I made it clear to the White House staff and anyone serving in my administration that I expected full cooperation with the Justice Department. Dozens of White House staff and administration officials dutifully cooperated.
After the investigation was under way, the Justice Department appointed United States Attorney for the Northern District of Illinois Patrick Fitzgerald as a Special Counsel in charge of the case. Mr. Fitzgerald is a highly qualified, professional prosecutor who carried out his responsibilities as charged.
This case has generated significant commentary and debate. Critics of the investigation have argued that a special counsel should not have been appointed, nor should the investigation have been pursued after the Justice Department learned who leaked Ms. Plame's name to columnist Robert Novak.
Furthermore, the critics point out that neither Mr. Libby nor anyone else has been charged with violating the Intelligence Identities Protection Act or the Espionage Act, which were the original subjects of the investigation. Finally, critics say the punishment does not fit the crime:
Mr. Libby was a first-time offender with years of exceptional public service and was handed a harsh sentence based in part on allegations never presented to the jury.
Others point out that a jury of citizens weighed all the evidence and listened to all the testimony and found Mr. Libby guilty of perjury and obstructing justice. They argue, correctly, that our entire system of justice relies on people telling the truth. And if a person does not tell the truth, particularly if he serves in government and holds the public trust, he must be held accountable. They say that had Mr. Libby only told the truth, he would have never been indicted in the first place.
Both critics and defenders of this investigation have made important points. I have made my own evaluation. In preparing for the decision I am announcing today, I have carefully weighed these arguments and the circumstances surrounding this case. Mr. Libby was sentenced to thirty months of prison, two years of probation, and a $250,000 fine. In making the sentencing decision, the district court rejected the advice of the probation office, which recommended a lesser sentence and the consideration of factors that could have led to a sentence of home confinement or probation.
I respect the jury's verdict. But I have concluded that the prison sentence given to Mr. Libby is excessive. Therefore, I am commuting the portion of Mr. Libby's sentence that required him to spend thirty months in prison.
My decision to commute his prison sentence leaves in place a harsh punishment for Mr. Libby. The reputation he gained through his years of public service and professional work in the legal community is forever damaged. His wife and young children have also suffered immensely. He will remain on probation. The significant fines imposed by the judge will remain in effect. The consequences of his felony conviction on his former life as a lawyer, public servant, and private citizen will be long-lasting.
The Constitution gives the President the power of clemency to be used when he deems it to be warranted. It is my judgment that a commutation of the prison term in Mr. Libby's case is an appropriate exercise of this power.

Impeachment is something most liberals can agree on. If we can only agree that conservatives from both parties almost always get us into these messes, then we have a base to build on. The United States has evolved to fascism and If congress does not impeach Bush, Cheney and several others, we will all suffer the consequences. Being a resident of Texas I can remember when the chimp was governor. Thats why I found Bush's statement that "Scooter's punishment was excessive" disgusting. When the littlestmoron was governor he never missed a chance to turn down clemency for death row inmates. Case in point was Carla Faye Tucker. Granted she was convicted of murder but from all accounts she had turned her life around and had devoted her life to helping others in prison and out.
Different religous groups and others pleaded with Bush to commute her sentence to life. Because of pressure from the different groups Bush agreed to speak to her on the phone. When asked later what she had said to him, Bush replied with his stupid little frat boy smirk "she said please don't kill me, please dont kill me". He thought that was one of the funniest things ever. When I heard that I new that Bush was not just a spoiled, incompetent, under achieving little rich kid but he was also evil.
30 months in a minimum security prison is excessive but sticking a needle in someones arm and killing them is aOK.

I've read that the closest this country came to an overthrow was during the Great Depression. I hope our leaders can avert that kind of turmoil.
I am hoping that behind the scenes there is movement by both Democrats and Republicans to get rid of Bush and Cheney. It won't solve the underlying problems but it will get rid of these leaders who are incompetent and very dangerous.

Joe Wilson demanded that Fitzgerald also publicly release the grand jury testimony submitted by bush and cheney during his investigation for the Libby trial. The smarteset thing for Bush would have been to ignore Libby's sentence. Let's hope Bush is being sabataged from within by bad advice. And in the meantime keep applying pressure for impeachment.

There have been many calls for impeachment of the president and the vice-president as a means to remove them from office.
According to the U.S. Constitution, the House of Representatives has the sole power to impeach these officials.
It only takes a simple majority vote to impeach an official. But, an impeachment is not a conviction, it is essentially an indictment by a "grand jury." An impeached president is tried by the Senate (the Senators being under oath or affirmation), with the Chief Justice of the Supreme Court acting as the trial judge. It takes the vote of two-thirds of the senators to convict an impeached president (or vice-president).
What are the chances that sixty-seven of our current senators would vote to convict either the president or vice-president? That is what it would take to remove either of them from office. Even though conviction would be highly unlikely, there is good reason to believe that a vote to impeach (that is, indict) would be successful. An impeachment would force a trial in which there is the potential for a lot of "dirty laundry" to be exposed. It is then possible that the general public would be better informed about what has transpired over the last six and a half year. Maybe, just maybe, such information would be helpful for voters in the 2008 election.

In the view of civil liberties lawyers, the most effective constitutionally protected method of raising your voice is to write a letter to the Executive Enclave clearly stating the reasons for your objections.
The message should be reconstructed using large font letters cut from a national newspaper while wearing surgical gloves, glued to a major brand of 8-1/2 x 11 paper that you have not purchased, and mailed from a mailbox of a major city.

I keep feeling there is a disconnect between Bush and reality, the same disconnect sociopaths have that allows them to keep lying, cheating, murdering and stealing.
If Libby had told the truth, most likely we would have a seen a clear trail of outting Plame all the way up the ladder to Carl Rove and Dick Cheney. And why were they involved? Petty vengence against someone that would not give them the lie they needed about a Saddam - Nigerian nuclear bomb material sales that would have fed into other lies and manipulated intel to get the US to invade Iraq.
So here we are on July 3, 2007 saying its OK for Libby to lie inorder to cover up the humungous lies of Bush and Cheney that has most likely cost us over 3 trillion dollars, thousands of troop casualties, tens of thousands maimed for life, and hundreds of thousands of Iraqi casualties.

In calling Scooter's prison sentence "excessive", Bush was obviously more distressed by the fact that Scooter may have been sent to some cushy federal prison where he could still have had his fingernails polished than by the fact that on his orders untold numbers of nameless, faceless "enemy combatants" have been sent to secret prisons to have their fingernails pulled.

I think the great majority of commenters at this website know that Bush did not use the "Pardon" for political reasons and instead "commuted" the sentence. It is all part of the spin game. However, for all practical purposes, it will be pretty much the same result. A "pardon" by any other name, will still smell as sweet, or, in this case for most people, as putrid.
While we're convinced the Republic is dead, the Republicans blithely ride along knowing they are right. It helps to know the enemy. For example, today in the NYT, David Brooks, right-wing apologist, has his op-ed piece on the Libby affair. He thinks the whole Plamegate thing was a farce, Joe Wilson is a lying attention whore, Plame was not an undercover agent, and the Fitzgerald settled for Libby when his real target was the innocent Rove. Finally, he praises Bush's decision as a triumph of sanity and justice over partisanship.
Now the Murdoch right-wing bloviators will dumb down Brooksies's piece and spew it all over the airwaves. Small-minded Dupes like Jarhead68 will hear it and take it as a validation of their tunnel-vision "my country right or wrong" world view.

The important point is that Libby broke the law to protect Bush and Cheney and Bush, certainly with Cheney's full support, "took care of" Libby. That is completely different from pardoning a criminal whose crimes had nothing to do with the administration. When the pardon power was put into the Constitution, it surely was not intended to be used by a President to protect those who carried out criminal activities at the behest of that President. The Founders probably understood this defect, but thought that the Impeachment clause covered it.
Now there can be no argument. Bush and Cheney MUST be Impeached or we live under a completely criminal government. Every Democrat who does not push for Impeachment now must be opposed in the next Democratic primary at which he or she is up for reelection.
Mr. Bush just put Impeachment back on the table, and Ms. Pelosi must be thrown out by the San Francisco voters if she does not recognize this.
Watching C-Span this morning about the pardon (commutation) given to Libby, you would think most people are happy to get a criminal in the Administration into jail, but he is getting a LOT of sympathy from 'the Republican base', and they are all saying how the President needs support now. Ha.. I guess these die hard fans still don't realize that there is a REASON (well many many many reasons) why there is no overwhelming support for the criminals in the White House.
So Scooter Libby doesn't deserve to serve any time for lying and obstruction of justice in a case of national importance, a case where a dedicated CIA employee was publicly, illegally outed for purely political purposes, forcing her out of her job. They were felony charges...yet he deserves no jail time, according to our President.
C'mon. Even Paris Hilton had to serve some time. As for the commutation serving as punishment enough for his crimes? Who are they trying to kid here? Gee, that $250,000 fine will probably be handled nicely by the Scooter Libby Defense Fund...he won't have to pay a dime out of pocket. And losing his law license? Don't worry, Scooter will have plenty of lucrative job offers lined up aided by his former corrupt boss who he's covering for, Dick Cheney.

The framers were also insightful enough to know that what they were writing was just a start, and intended that as our society changed we would need to update our constitution to reflect those changes. Here you have the basic difference between your old school "Liberals" and your old school "Conservatives". The Liberals wanted to move forward, allowing more power and freedom to the masses, while the conservatives wanted the power to stay in the grip of the ruling elite. Of course once the "Liberals" began to gain power they were easily corrupted and began building huge governmental institutions whose sole purpose was self perpetuation.
But alas the nature of power is to corrupt.

But of course, in Bush-think "lying" is not really a punishable offense, since everything he does, thinks, dreams, eats and farts is a lie. In Bush logic lying to cover a crime is the natural course that everyone, his father, his mother, and everyone and everything he knows follows.

Anybody who has any respect for Democracy, Justice or has ever in anyway felt love for the United States of America must now call for the Impeachment of both President Bush and Vice President Dick Cheney.
Any of the vicious, lying, stealing thugs in Bush's gang will get the same thing. Pardoned or commuted, probably given medals of freedom, too. The rot in this administration is so deep that only removal of the entire bunch, by impeachment, for which the Constitution bars pardons, will clean house.
If the Cheney/Bush gang does not declare martial law after a black op so they can stay in power as long as they want, you will probably see some sort of blanket pardon for everyone involved in the Bush government.
This is not to even mention Cheney/Bush's fixation on starting another war by nuking Iran and/or Syria.
The only reason we are not seeing impeachment ON the table right now is that, if impeachment were to be used as the Constitution defines it, most of the House and Senate would also find themselves up on charges; so they just avoid the whole thing. Some Supreme Court Judges could use it also, as they are supposed to use the Constitution, not abuse it.

It's too bad that a lot of the comments here are a little heavy on emotions and light on knowledge. It's understandable given the circumstances, but let's all try to be smarter than those who would oppress us, and learn to fight the negatives within ourselves.
The right to pardon IS in the constitution, so we can't call THAT unconstitutional. However, there are plenty of other unconstitutional things that Bush may be impeached for.
The up side to this is that it leaves Cheney especially vulnerable.
If the Democrats don't want the aftermath (and the blame) for the Iraq war dumped in their laps in 2008, they had best be more aggressive and push for impeachment NOW. It's like the game "hot potato" - do you think they're going to turn the music off when the Republicans are in office?

Valerie Plame was not a covert agent, according to Victoria Toensing, one of the co-authors of the statute. Fitzgerald knew that Richard Armitage was Novak's source within a few weeks of starting his fishing expedition. Knowing that he couldn't "get Rove", he deliberately told Armitage to "keep quiet" and proceeded to try to trip someone up during testimony. Mr. Libby was the victim of Fitzgerald's overreaching power. Much the same way Lewinsky was a victim of Ken Starr and Bill Clinton. Talk about wasting tax-payer money. Wilson and Plame have been exposed as liars and they should now be prosecuted for perjury, obstruction of justice, conspiracy and fraud. Plus, the revenue from their book should go to the Scooter Libby Defense Fund. That's intellectual honesty and liberals should embrace it. I have.

We must push Impeachment of Cheney now. If you've read the recent series on Cheney in the Washington Post you'll see the power lies in his hands and that Bush basically signs off on what Cheney puts in front of him. The major point is that Cheney has been signalling for many months now an immanent attack against Iran - which is bad enough in and of itself - using "limited" (!!!!!) nuclear weapons. Impeachment is critical to preventing a widening of the war in the Middle East and further corrosion of our Constitutional government. Waiting for 2008 is not an option, to paraphrase our Speaker!

No one said this is going to be easy. If you haven't voiced an objection where directly to people that represent you, then that should be a priority. Don't forget that a criminal has been convicted, a vot of thanks should be offered for these efforts. We should acknowledge that a criminal has been removed from the White House or at least has some accountability.
I am a bit disappointed when I read some of the solutions being put forth here. We can and must learn that contingencies are important to outcomes. The law worked in this case, the penalty is still in question. Take time to formulate a good objection and then voice that with your representative and ask for accountability for how they respond.

Libby is a convicted criminal and should be excluded from any position of public trust. The intervention of the president does not mitigate that a crime was committed and that restitution is warrented. Possibly Libby would be liable for a civil action that would sense. The is our government, we have a right to be represented in a civil manner...we pay for it.
Should we not follow the Declaration of Independence where it gives we the people the right to change our form of government? Does that not mean we can dissolve the Executive, Legislative, and Judicial branches and form our own new government? Why not? Our leaders think they are above the law, so why can we not go to the White House and remove them from office? I understand that we would get arrested, sent to Gitmo, and never be heard from again. I am not by any means suggesting a coup, or violence, or breaking the law. Avoid the Court System entirely - Impeach Bush!
Dear Citizens of Common Dreams, can we tell anything from taking stock of Honorable Bush's dishonorable behavior?
Let me rehearse some of the crassest and basest instances of that behavior.
1. He does not care about poor people in general, and black people in particular, as his nonchalant behavior towards Katrina and its aftermath has clearly demonstrated.
2. He does not care about the mothers of soldiers who lost a child in the treacherous terrain of Iraq and who would like him to specify in person what the "noble cause" is their child died for, as was made plain by his refusal to look Cindy Sheehan in the eye and to give her the respect she deserves.
3. He does not care about the soldiers who are occupying Iraq for him and his cronies at Halliburton, Blackwater, and other corporations and contracting outfits, as the lack of body armor and properly armored vehicles, and the reception by the Department of Veterans Affairs of traumatized, injured, jobless, and homeless soldiers have amply made clear.
4. He does not care about science and scientific inquiry, as evidenced by his approval of intelligent design, his condemnation of stem cell research, his contempt for the world's scientific community's warnings regarding global warming, his administration's falsification of governmental scientific reports, and so on.
5. He does not care about the law, the Constitution of the United States, international laws and treaties, or the United Nations, as shown by his frequent signing statements, his endorsement of torture and the practice of extraordinary rendition, his establishment of a concentration camp at Guantanamo Bay and of military tribunals that operate outside the law of the land, his cancellation of habeas corpus, his invasion and occupation of Iraq, his eavesdropping on his fellow citizens, the countless instances of corruption that have been marring his administration and, more widely, his party, et cetera.
6. He did not care about the people trapped in the burning towers of the World Trade Center on September 11, 2001, as attested by his insisting on reading My Pet Goat with the children in that Florida classroom for twenty minutes after being informed of the attacks against the towers.
7. He did not care about the crews of rescuers, firemen, and workers toiling and laboring at the World Trade Center site in the days and months following the attacks, or about the inhabitants in the neighborhoods adjacent to the site, as was made plain by the fact that the air quality in the area was declared safe by his administration.
8. Today, with the absolution of Mr. Libby, we are made the witnesses of another aspect of Honorable Bush's seemingly infinite listlessness: today, we observed not only that Bush the Lesser has a fine disregard for the law, a spectacle we have already endured for nearly seven years, but that he also has contempt for the Central Intelligence Agency and the national security he and Vice Cheney never miss an opportunity to claim as their all-consuming object of concern.
Given this record of blatant and multifaceted carelessness, can we pin down what Honorable Bush really cares about?
Is the pardon Bush bestowed on underling Libby an unwitting recognition of his own guilt?
I know it's an insult to the chimpanzees to call Bush "Chimpy", but I am not saying he is one. My pet name comes from a desire not to give him the respect of using his real name, and a simultaneous slap at his appearance, his need of a handler, his penchant for slinging his crap around, and his stance on evolution.
