Bush Commutes Libby Prison Sentence
WASHINGTON -- President Bush commuted the sentence of former aide I. Lewis "Scooter" Libby Monday, sparing him from a 2 1/2-year prison term in the CIA leak case. Bush left intact a $250,000 fine and two years probation for Libby, according to a senior White House official, who spoke on condition of anonymity because the decision had not been announced.
Bush's move came hours after a federal appeals panel ruled Libby could not delay his prison term in the CIA leak case. That decision put the pressure on the president, who had been sidestepping calls by Libby's allies to pardon the former chief of staff to Vice President Dick Cheney.

The United States Court of Appeals for the D.C. Circuit today rejected Lewis Libby's request to remain free on bail while pursuing his appeals for the serious convictions of perjury and obstruction of justice. As a result, Mr. Libby will be required to turn himself over to the Bureau of Prisons to begin serving his prison sentence.
I have said throughout this process that it would not be appropriate to comment or intervene in this case until Mr. Libby's appeals have been exhausted. But with the denial of bail being upheld and incarceration imminent, I believe it is now important to react to that decision.
From the very beginning of the investigation into the leaking of Valerie Plame's name, I made it clear to the White House staff and anyone serving in my administration that I expected full cooperation with the Justice Department. Dozens of White House staff and administration officials dutifully cooperated.
After the investigation was under way, the Justice Department appointed United States Attorney for the Northern District of Illinois Patrick Fitzgerald as a Special Counsel in charge of the case. Mr. Fitzgerald is a highly qualified, professional prosecutor who carried out his responsibilities as charged.
This case has generated significant commentary and debate. Critics of the investigation have argued that a special counsel should not have been appointed, nor should the investigation have been pursued after the Justice Department learned who leaked Ms. Plame's name to columnist Robert Novak.
Furthermore, the critics point out that neither Mr. Libby nor anyone else has been charged with violating the Intelligence Identities Protection Act or the Espionage Act, which were the original subjects of the investigation. Finally, critics say the punishment does not fit the crime:
Mr. Libby was a first-time offender with years of exceptional public service and was handed a harsh sentence based in part on allegations never presented to the jury.
Others point out that a jury of citizens weighed all the evidence and listened to all the testimony and found Mr. Libby guilty of perjury and obstructing justice. They argue, correctly, that our entire system of justice relies on people telling the truth. And if a person does not tell the truth, particularly if he serves in government and holds the public trust, he must be held accountable. They say that had Mr. Libby only told the truth, he would have never been indicted in the first place.
Both critics and defenders of this investigation have made important points. I have made my own evaluation. In preparing for the decision I am announcing today, I have carefully weighed these arguments and the circumstances surrounding this case. Mr. Libby was sentenced to thirty months of prison, two years of probation, and a $250,000 fine. In making the sentencing decision, the district court rejected the advice of the probation office, which recommended a lesser sentence and the consideration of factors that could have led to a sentence of home confinement or probation.
I respect the jury's verdict. But I have concluded that the prison sentence given to Mr. Libby is excessive. Therefore, I am commuting the portion of Mr. Libby's sentence that required him to spend thirty months in prison.
My decision to commute his prison sentence leaves in place a harsh punishment for Mr. Libby. The reputation he gained through his years of public service and professional work in the legal community is forever damaged. His wife and young children have also suffered immensely. He will remain on probation. The significant fines imposed by the judge will remain in effect. The consequences of his felony conviction on his former life as a lawyer, public servant, and private citizen will be long-lasting.
The Constitution gives the President the power of clemency to be used when he deems it to be warranted. It is my judgment that a commutation of the prison term in Mr. Libby's case is an appropriate exercise of this power.

Show AllIt is important to remember that a full pardon would have resulted in the revocation of Libby's right to plead he doesn't have to testify against himself based on the Fifth Amendment. So the elimination of the prison sentence but preserving the conviction prevents Leahy and Conyers (the two respective heads of their congressional judiciary committees) from getting Libby's full testimony under oath. Of course the president doesn't respect the rule of law, or justice, or right and wrong. But we already knew that. I suspect that this approach was the strategy all along for anyone from his administration convicted: no time, but no testimony either.
The fix was always in, from the time this rat in the White House winked at the camera saying "Florida is a done deal".
I hope everyone this 4th is carrying impeachment signs and calling representatives and giving our sit-on-her-hands-till-2009 Speaker of the House what-for. Don't let any of our representatives get ANY rest until they put this criminal regime out of office and these criminals behind bars.
And it's time to take away the pardon power from the office of the President.

One criminal commutes the sentence of another criminal. This is the same Bush who was always so eager to refuse a pardon to prisoners sentenced to death when he was governor of Texas.
Shit, it never stops. No one in that administration will ever be held accountable for all the pain and suffering they have caused. Worst of all much of it may never be rolled back and the suffering will continue. Libby was just the tip of the iceberg and even he couldnt be made to "pay the price".
If he was made to "pay the price", he might have been
tempted to talk. Haul 'em all off to The Hague after

No problem. Our President is in his last two years of office and has nothing to lose. The top Republicans can rightly say they are not tied to this administration, and they will condemn this action. Bush frees his boy, The presidential candidates can condemn then sidestep the issue (knowing they will probably need the same power should one of them be voted in), and above all they know that the average US citizen will have forgotten all about it come election day.
It's a win-win for them. Were the roles reversed the Democrats would (and have) take the same action.

I just sent one and expressed my anger over his total disregard of the rule of law and the Constitution.
Bush has shown over and over again that he doesn't care what the law says or whether he is within the boundary of the law. He also doesn't care what we citizens think.

Why not? Considering Bush's approval ratings, what does he have to lose? And if Libby is confronting him with a walk or talk choice, it would be dangerous not to commute.
This isn't very helpful for his party come 2008, but one thing the Democrats are really good at is missing opportunities.
Commuting the sentence of a potential witness against you is obstruction of justice and racketeering. President or no president, Bush is going to jail for this one.
If people had been HALF as mad as this about Marc Rich's pardon, after he bribed Clinton, it would be a lot more believable.
For how many mentally ill or retarded convicts did W commute sentences as governor or in the White House? W makes exceptions only for neo-cons who take the hit to protect Cheney and others.
Libby absorbs the blow by obstructing the investigation of Cheney and others regarding the outing of a CIA agent. But the sentence is commuted. The Dems have already given Cheney and W a pass: "impeachment is off the table."

BTW - The Mark Rich pardon was not the same as this at all. It was not right, but not the same as this. Bush is, if nothing else, loyal to his cronies. They in turn are loyal to him. It is why we have such difficulty getting anyone to squeal loudly enough or with enough dirt to get nail him. Bush is not dumb, he just enjoys speaking like a dope.

As Mr. Bush says, Mr. Libby has not, "been charged with violating the Intelligence Identities Protection Act or the Espionage Act..." Let us remedy that situation. It is time bring charges of treason, not just to the door of Mr. Libby, but to the shadow office of Dick Cheney and to the office of the President himself. Leave no one to pardon the rats as quickly as we put them away.

If this is an example of the outcome of the Democrats strategy of "taking impeachment off the table so we can investigate and prosecute the Bush Administration's crimes", the Republicans will have any easy time winning in 2008.
Investigation and prosecution will be of no value as long as Bush has the veto and pardon hammers in hand.

I am forced to reiterate part of my earlier post, and add some:
If King George the Lesser invokes clemency for Libby, he will remove all doubt that he is truly the all-powerful king of the United Kingdom of America.
Now it's become more obvious whom Libby was protecting, but the more important question still unanswered is: Who outed Valerie Plame? Someone committed a crime and messed up Plame's life, and no one is going to jail. It's a slap on the face of the American Justice system. Then again, in the country of the rich, by the rich, and for the rich, justice is only for the poor. When all legal tricks failed, godfather stepped in and saved the day for Libby.
Jam Senator Reid's and Rep. Pelosi's phone lines and emails. I realize that they probably will not do anything, but it is worth the effort. I just got a reply from Pelosi saying that her emails are full. CBS can't even post the responses from readers because they are overwhelmed (and do not want to publish any negative comments). This is the time to bombard Congress with emails!

A sad day for America, lady justice hangs her head in shame. Remove her blindfold, throw it on the floor, laugh at her tears repigs, justice is just a liberal "feel good" notion; when there are REAL men to protect, and real money to be made, and REAL conservative causes to sheild, justice will NOT be served. This is a classical case of why impeachment of Number One and Number Two should have been the first order of business for this new Congress. Any other convictions from here on will have the same sad outcome:"commuted". I doubt Nancy Pelosi, who would be president if congress had done it's job, would have "commuted" Libby's sentence today. The "significant fine" of $250,000 fine is "pocket change" for these clowns.

But I also think he has PO'd the CIA (among other intellence agencies) big time because of this. After all Bush freed a guy that endangered their agents because of polictical benifit. And they don't like that. So look for some time of payback from them in response to this.

When I was a kid living in my third world country we were fed, I duno by who, some stories about America. One such story was about equality and justice in America. The story went something like this: One day as the president of the United States was driving, a policeman stops him and gives him a ticket for violating a traffic law. We were all astonished. Look, just a simple cop can stop the president of the country and give him a traffic citation to pay or appear in court to face the judge! Wow, what a justice, what a beautiful country. No wonder they're ahead of other countries. This was some 60 years ago.
Now I know better. The stupid bastard (probably CIA propaganda) was lying.
