Scooter Libby Cannot Delay Sentence
A federal appeals court panel has unanimously ordered that a former White House aide, I. Lewis Libby Jr., is not entitled to remain free while he appeals his convictions for obstruction of justice, false statements, and perjury in connection with an investigation into the leak of a CIA officer's identity. Barring intervention from the Supreme Court or President Bush, Libby is likely to be required to report within the next few weeks to begin his 2 1/2-year prison sentence.
The three appeals court judges who considered Libby's request for release pending his appeal, David Sentelle, Karen Henderson, and David Tatel, offered only a brief explanation of why the motion was rejected. "Appellant has not shown that the appeal raises a substantial question" under the federal bail statute," the judges' order said. They noted that under the law a substantial question is defined as one that is "close" or "could very well be decided the other way."
The decision putting Libby ever closer to the jailhouse door is certain to step up pressure on Mr. Bush to grant a pardon or some other form of clemency. Libby has a large contingent of supporters who have asserted that he is the victim of overzealous pursuit by the special prosecutor who brought the case, Patrick Fitzgerald.
Libby's full appeal of his convictions could take another year or more. Aides to Mr. Bush have said he would not consider any pardon until the legal process was complete. However, some statements from the White House have suggested the president might take up the issue of clemency if Libby's jailing seemed imminent. Mr. Fitzgerald, who was appointed to investigate the leak to the press of the identity of a CIA operative, Valerie Plame, never brought charges against anyone for leaking. However, Libby was charged with obstructing the probe by lying about where and when he learned of Ms. Plame's CIA tie. A jury convicted Libby in March on two counts of obstruction of justice, two counts of lying to a grand jury, and one count of lying to the FBI.
Libby argued to the trial judge, Reggie Walton, that he should be released during his appeal because he had strong legal issues to raise. The most notable was that Justice Department officials gave Mr. Fitzgerald so much authority that he was constitutionally unaccountable. Judge Walton said he found that argument unpersuasive. Now, the appeals court seems to have agreed.
The appeals panel's ruling is also something of a snub to a dozen eminent legal scholars, including a Harvard law professor, Alan Dershowitz, and a former federal appeals court judge, Robert Bork. They attempted to file with the court an amicus brief contending that Libby had valid arguments against the constitutionality of Mr. Fitzgerald's appointment and conduct in office. The appeals panel refused the brief and, today, suggested that those issues are less substantial than the professors contended.

This individual was a law school hero of mine back in the '70's for his strong stance on civil rights. Now he has devolved into a neocon looking to accelerate the decline of American democracy, even going so far as interfering in the tenure application of another professor whose "offense" is to be truthful about Israel.
If there was a bit of justice at Harvard, he would be fired for cause.

If Martha Stewart can do jail time for lying to a grand jury then why shouldn't Scooter?...
If King George the Lesser invokes clemency for Libby, he will remove all doubt that he is truly the all-powerful king of the United Kingdom of America.
Also, if you wonder what Alan Dorshowitz, the professor of torture, is doing here it maybe because AIPAC is calling all hands on deck. Some professors are so mean-spirited and inhumane that makes one wonder in what kennel or stable did they study and receive their sheepskins.
Whatever "the issues" Dorshowitz and the others have called to attention, the truth remains that Libby, a Lawyer, was convicted by a jury, in a very open court. He was a lawyer who lied under oath, most likely to protect his employer(s), and he "got caught"..........he knew better, and most likely thought himself immune from prosecution. He was wrong. My hope is the rest of the "merry band of bandits" get the same day in court that Libby did.
He has no one to blame but himself.

If there is to be a SHRED of belief in the impartiality of the American legal system left, Libby needs to report to the appointed detention center asap. What's sauce for the goose (Martha Stewart) is sauce for the gander (Scooter).
It is interesting to me that there are STILL jurists left in the system who are intent on acting as judges and not as political hacks, despite the efforts of the Bush Maladministration to purge everyone who is not in lockstep with their principal philosophical tenets. If only John Roberts and Sam Alito had such scruples.
This is a test to see if Scooter has broken suction on Shotgun Dick's anus. If Shotgun thinks Scooter might crack during a romantic moment in the big house Bu$h the inferior will pardon him with the blessing and approval of fascist pro-torture media darling Dershowitz.
Unless Shotgun Dick thinks Bu$h the inferior will not be hurt much or that it won't interfere with the rest of his plans if Bu$h the inferior gets in deeper then they will let old Scooter take one for the team.
Either way it can't get bad enough for any of these slime balls.
One last thought - this pardon will be issued late Friday probably during the announcement of an Iran terror link or the beginning of bombing in operation Iran Nuclear Safety.

And to say that Patrick Fitzgerald is in the wrong about how he conducted his business, is like saying that Bush is in the right about the way he conducts his business.
The only thing (as far as I can see, that Fitzgerald did wrong, is by not filing charges against Vice President Cheney, for authorizing the outing of a CIA agent.
It is a sad state of affairs in this country, when perjury is punished while treason is ignored.

The principal reason for having min.security camps for the boyscouts and virgins, is that they are CHEAPER to operate. Staffing is the principal cost of prisons, and staffing of camps is a quarter to an eighth of the staffing of max. security prisons, where staff outnumber the inmates.
Inmates sleep in a dormitory of 20, 30 or more, and work at KP and other jobs to maintain and operate the joint. It may not resemble movie versions of San Quentin, Sing Sing or Leavenworth, but you have no privacy anywhere, including in the showers and toilets.
Would you like to try a few months there?

News - Bush has just commuted Libby's jail sentence. Libby's get out of jail card comes at a cost of a $250,000 fine.
I didn't even realise that Bush had the power to commute sentences. You guys are really in deep shit aren't you? It's clear now that Bush has no consideration for the law, legal processes or convictions/sentencing.
America is fast devolving into a dictatorship. 14 months to go. At least a few Republicans are starting to criticise Bush and Cheney. I hope the few grow into the many. Maybe this decision of Bush's will help it along.

I don't think it has occurred to George that HE is responsible for all this skullduggery and that Cheney may not be able to or even care about getting him out of it.

So Libby argues that Fitzgerald had "so much authority that he was constitutionally unaccountable". This is the same Libby that was Cheney's right hand man? Talk about constitutionally unaccountable. Too bad irony is lost on hypocrites.
Regarding the commutation of Libby's sentence – you can bet his wealthy friends will pay that for him. Technically, he's still a felon – until January 2008, when Bush will pardon him before he leaves office. You can bet the farm on that.

Here is something the Democrats can and should do, and it doesn't need Bush's cooperation. The Constitution must be amended so as to eliminate any sitting President's power to pardon, or otherwise reduce the sentence of, any official of his Administration or of any Administration in which the President served as Vice President. The latter provision would have prevented George H.W. Bush from pardoning Casper Weinberger.
Until and less the President's pardon power is reduced to eliminate self-interested pardons, this nonsense will continue.
And yes, I agree -- this isn't over yet. Bush will pardon Libby as soon as the election is over. He won't even wait until January 2009.

Pelosi has never had a legitimate reason for keeping impeachment off the table. By doing so, she is as bad as Bush for flouting the law as well as her Constitutional duty as a member of Congress and Speaker of the House.

What the Dems need to do which doesn't need Bush's cooperation is to impeach both Bush and Cheney.
Bush nor Cheney have ever had respect for the rules, the rule of law, the Constitution, or the offices they hold.
They have held American citizens for years without charges or the right of habeus corpus in violation of the 5th, 6th, and 8th amendments to the Constitution
They have spied on American citizens without warrants, violating both the 1978 FISA act, and the fourth amendment to the Constitution.
They have violated the Geneva conventions by torturing those they have in custody and by extraordinary renditions.
They have violated their oath of office in which they swore on a bible to uphold and defend the Constitution.
They have violated the nuclear non-proliferation treaty by offering U.S. nuclear technology to India who is not a signer of the treaty and by trying to deny the technology to Iran who is a signer.

Bush just pardoned Libby. He said the sentence was too "excessive," but he didn't find the 152 death warrants he signed as govenor of Texas as too "excessive." Laws are designed, written and trapped to entrap certain groups, but the rich white men are to never go to jail. A psychopathic jail system, built on systems of rape and brutailty, rich white male anuses must be protected!

There is no excuse for this one. He was convicted and sentenced to jail time. It was more than a slap on the wrist, but not a lot more. Even if he appealed and got a reduction then he would have been within the law, but this is a travesty.
I have known since forever that Bush is the wrong person for this job and nothing convinces me more that I was right than when he does things like this that circumvent the laws of this nation.
