To the Courts, Then, on Behalf of the Constitution!
The founder of the Republic, conscious of the excesses that resulted when King George III and his Parliament cooperated, endeavored to put the legislative and executive branches of the United States at odds with one another.
Jefferson believed: "The concentrating [of the legislative, executive and judicial powers] in the same hands is precisely the definition of despotic government."
To combat such despotism, the first democrat said, "The powers of government should be so divided and balanced among several bodies of magistracy, as that no one could transcend their legal limits, without being effectually checked and restrained by the others."
Jefferson's frequent rival, John Adams, agreed with him on this point, arguing that, "[Checks and balances] are our only security."
During the first six years of the Bush-Cheney interregnum, the system of checks and balances established at the opening of the American experiment effectively collapsed. Republicans, who generally controlled the legislative branch of government during the period, were more concerned with party loyalty than their duties to the Republic. Democrats, who briefly controlled the Senate, operated as a compromised opposition party under the cowering "leadership" of House Minority Leader Dick Gephardt and Senate Majority Leader Tom Daschle.
Since the November, 2006, elections, which marked something of a breaking point in the pattern of executive dominance that had been in operation up to that point, there has been much talk about the restoration of the separation of powers required by the Constitution.
Only now, however, with the declaration by Senate Judiciary Committee chair Patrick Leahy, D-Vermont, that he will take the Bush-Cheney White House to court if the administration continues to refuse to cooperate with subpoenas, does the talk begin to have meaning.
"The president and vice president are not above the law anymore than you and I are," Leahy declared Sunday.
Asked on NBC's "Meet the Press" whether he would seek a congressional vote on contempt citations that would take the subpoena fight to the courts, Leahy said, "If they don't cooperate, yes I'll go that far." Speaking of White House stonewalling in the struggle to get to the bottom of the U.S. Attorneys scandal and related cases of executive excess, the senior senator from Vermont said of Bush and Cheney, "They've chosen confrontation rather than compromise or cooperation. The bottom line is in the U.S. attorney investigation, we have people manipulating law enforcement. Law enforcement can't be partisan."
Leahy's committee has, with support from Democrats and Republicans, issued subpoenas the White House seeking documents relating to the firings of eight U.S. Attorneys who were deemed to be insufficiently partisan in their investigations and prosecutions. The committee has also sent subpoenas to the White House and the office of Vice President Dick Cheney seeking documents detailing the legal debates around the administration's warrantless wiretapping program. And it has issued summons to key players in the administration and the Justice Department.
The administration's reaction has, so far, been one of refusal to cooperate in a serious manner. White House counsel Fred Fielding announced last week that the president was invoking "executive privilege" in refusing to turn over requested documents on the firings. Bush has also claimed the right to prevent former White House counsel Harriet Miers and former White House political director Sara Taylor from testifying under oath about their role in pressuring U.S. Attorneys to politicize prosecutions.
Leahy's statements Sunday indicate a willingness to have lawmakers vote to cite the White House for contempt of Congress. Ironically, the matter would then be referred to the U.S. Attorney for the District of Columbia to bring before a grand jury.
If the matter actually gets to court, it would be the first time that such a dispute has been so litigated since the Watergate-era clashes between Nixon White House and Congress. The value of those clashes, above all, was the role they played in restoring a measure of Constitutional order to the Republic.
What is amusing is that some media outlets have in recent days taken to speculating about whether a constitutional crisis might ensue if Leahy takes things to the courts.
In fact, the constitutional crisis has played out over the past six years. What Leahy proposes is to address it.
John Nichols' new book is The Genius of Impeachment: The Founders' Cure for Royalism. Rolling Stone's Tim Dickinson hails it as a "nervy, acerbic, passionately argued history-cum-polemic [that] combines a rich examination of the parliamentary roots and past use of the 'heroic medicine' that is impeachment with a call for Democratic leaders to 'reclaim and reuse the most vital tool handed to us by the founders for the defense of our most basic liberties.'"

Show AllDoes anybody know if the court likely to hear this has already given itself over to the "Unitary Executive" theory? At what level of court would this subpoena be fought? And would it end up in the Supreme Court where the justices are so pro-Bush that they might actually rule in his favor?
Losing your grip on the power grab? Indictments in your future? Too bad YOU can't appoint the judges and have them confirmed by your co-conspirators. I can't wait to see how this check/balance battle turns out. Can you say "Federalist Society"?

When we fight for liberty and Justice, nothing is guaranteed....If it was there would be no fight.
My thinking is not so much to "give Peace a chance" we have been hung up on that for too long now....It is time to take a chance on Peace.

Hurrah for the Leahy's nerve address!
As I said in another thread, "Bush is the result of a Nixon pardon. What will be the terrible result of a Bush-Cheney non-impeachment? It all hangs in the balance. When George Washington was offered more than the Presidency he refused. Bush is a traitor to the father of our country in his expansion of powers and his lawlessness. He needs to be stopped and calling him to account is the only way. That way is impeachment of both Bush and that ugly little man they call Cheney. Without it we are doomed to future failure. But what do I know?"
Problem is we've become such a country of chickens, we're afraid to take down this administration, no matter how illegal and venal they get. It's "other" countries that have revolutions, and overthrows, and special elections - not the best God-blessed land of freedom lovers on Earth!
Too bad God didn't bless us with balls or we would have already arrested Cheney/Bush for confessing to FISA law violations, which specifically point out that a "sitting President" can be arrested and prosecuted for such violations. And we have their confessions. And their sworn promise to continue to break the FISA law.
Is there a more open and shut case?

When we muster up the courage to act for the benefit of our inalienable rights, we regain our self-respect.
It is time to recognize once and for all the nefarious enabling role played in all this by the Democratic Party when they allowed both Roberts and Alito into the Supreme Court with little or no resistance.
Any excuse they come up with is just that, an excuse: there is no historical justification for their cowardice. They had to try stop a Bush-Imperial-controlled Supreme Court in getting consolidated or risk their seats in the process.
It was obvious what those two were being sent to the SC to do. Oh, the Dems whine and go on about having only the slimmest majority. Well, the Repbulicans in the minority are showing more clout now than the Dems in majority. Why couldn't they have shown the same guts by pushing for a filibuster (win or lose) when they could have?
Problem is, they haven't met a corporate funder they couldn't cozy up to. The fear of losing any of THEM is what makes the Dems dance to the piper.
Calling on the PEOPLE to stand up and lead the way is the ONLY viable way left to us. The Court system may or may not wend its way to "judicious" decisions on the subpeonas.
This Attack On America has gone too far for our Congresspeople to continue to pretend there is a valid governing process still in place. THAT IS A BIG LIE.
We send real men and women to die (and kill) every single day -- supposedly to defend this nation against...well, whatever they tell us. We pay them with our tax dollars and others stolen illegally and surreptitiously from our Budget. Is it too much to ask those in Congress who benefit so much from privilege to stand up, risking their very lives and careers if necessary, to defend us citizens from the DOMESTIC Enemies that are using every device to bring our nation down??
Pretending they don't see it is just another LIE!! Pretending that this Administration is working within the law does not stop it from being a LIE.
We are suffering from multiple assaults (court appointments, voting fraud, wiretapping, breaking laws, signing statements, secret deals) and the Congressional Dems timid actions and reliance on normal procedure and stacked courts, rather than a full-scale daily verbal assault on this Regime to get the people ready to DEMAND change and impeachment.
The people must FORCE Dems to act. One way is shown at switch2green.org. All around the country meetings and rallies to DEMAND impeachment must grow to a fever pitch those slugs and weasels can no longer ignore.
Those who don't think we need to grow another party are being seen more and more as the delusional ones. We need a political instrument (party) that will SAY what must be said about this Regime! The investment of more time and energy into further supporting this enabling bunch of tools who immobilize legitimate action and rage can no longer be afforded. As impossible as a third party might seem to many, it is far more proactive, acceptable, and necessary than sitting around dumbfounded watching what you consider to be an "opposition party" allow thieving and murderous corporate mafiosos take over every institution and position of power in our nation and not even describing what is going on, much less organizing a coherent and active resistance to it.
Those who say the problem is all with the Republicans must face the fact that Democrats do not protect us from their corporate rule. Far from it.
Left to their own devices, the Democratic leadership will allow America to be dead and buried with barely a whimper. What else can you conclude? It's an ugly truth, but if you love this country you have to admit it to start doing something about it.
Their is no valid excuse not to impeach! It is what is called for. It is a defensive measure against the fanatical fascistic Right to screw up their momentum. It is what may still save some credibility and at least some of the rapidly dwindling reputation as a haven of honor or democracy in the world.
It is time for the Spirit of '76, not the Spin of '08!
It is time to ask the American People to Stand Up until these Usurpers of Power Stand Down and get our country back! We're gonna have to take it back -- they won't give it!
If you think these words are too strong or call for confrontation, sorry -- the confrontation has already arrived!! Just who do you think began this confrontation, and to what degree are they willing to destroy us all to get what they want? Who will stand up to it? You?
This latest assault started decades ago, but never came up in polite conversation. McCarthyism (The Great American Purge) and ever-increasing media concentration (thanks, Bill) helped push the corporate globalization agenda into our schools, healthcare, sports, arts, environment, voting systems, trade policies, bedrooms, Congress, Cabinet, military and now the White House.
Why should we be surprised that both major parties allowed it to happen?
WE must use whatever tools and measures we can to get this Congress to act in the legitimate defense of this nation and our Constitution, or it will all go rapidly downhill from here. It IS NOT Business As Usual. It is not just about the '08 election. Everything is at stake. Make this Congress -- and your neighbors -- understand that. If there is to be any USA worth saving, WE have to do it.
