Cheney Blocked Official's Promotion
WASHINGTON - Vice President Dick Cheney blocked the promotion of a Justice Department official involved in a bedside standoff over President Bush's eavesdropping program, a Senate committee learned Wednesday.
In a written account, former Deputy Attorney General James Comey said Cheney warned Attorney General Alberto Gonzales that he would oppose the promotion of a department official who once threatened to resign over the program.
Gonzales eventually decided against trying to promote Patrick Philbin to principal deputy solicitor general, Comey said.
"I understood that someone at the White House communicated to Attorney General Gonzales that the vice president would oppose the appointment if the attorney general pursued the matter," Comey wrote. "The attorney general chose not to pursue it."
Comey responded to written questions from the Senate Judiciary Committee chairman, Sen. Patrick Leahy (news, bio, voting record), D-Vt.
Comey's account provides new detail in a sprawling, Democratic-elicited story of how much the White House influences the department's operations.
Also Wednesday, the department released 39 new pages of internal e-mails and documents that partly detail efforts by the department's former White House liaison, Monica Goodling, in January 2006 to obtain authority to hire and fire political staffers.
"Ok to send up directly to me, outside of system," Goodling wrote in a Jan. 19, 2006, e-mail to Paul Corts, the assistant attorney general for administration.
The Democrats' investigation into whether the firings of eight U.S. attorneys were improperly political led to testimony last month in which Comey disclosed details of a hospital visit on March 10, 2004, to the attorney general at that time, John Ashcroft.
Democrats contend the story shows the White House's heavy-handed influence over the department, including the agency's role to periodically endorse the National Security Agency's eavesdropping program.
Philbin was one of two Justice Department officials who led a review of the classified program and provided some of the research that led Comey to refuse to endorse it, Comey said.
"Mr. Comey has confirmed what we suspected for a while that White House hands guided Justice Department business," said Sen. Chuck Schumer, D-N.Y., who is leading the Senate's investigation. "The vice president's fingerprints are all over the effort to strong-arm Justice on the NSA program."
Cheney spokeswoman, Lea Anne McBride, declined to respond, citing the administration's policy of not commenting on personnel matters.
According to Comey, he and Ashcroft had refused to recertify the legality of Bush's warrantless wiretapping program for reasons that are classified. When Ashcroft fell ill with pancreatitis, the powers of his office transferred to Comey, Ashcroft's deputy.
During a meeting at the White House on March 9, 2004, Comey told Cheney he would not certify the program, he said in his written remarks Wednesday.
The next night, then-White House Counsel Gonzales and Bush's chief of staff, Andy Card, went to Ashcroft's bedside in intensive care unit at George Washington University Hospital. Tipped to the impending visit, Comey and his aides were present when Gonzales urged Ashcroft to recertify the program. Ashcroft, who just had gall bladder surgery, refused, Comey testified last month.
The White House recertified the program without the department's endorsement. That led Comey, Ashcroft, FBI Director Robert Mueller, Philbin and other department officials to prepare their resignations. Faced with a mass walkout at the top of his Justice Department, Bush relented and changes in the eavesdropping program that Comey and Mueller said were necessary to win their approval.
According to Comey, Philbin later was considered for a promotion to be principal deputy solicitor general - lieutenant to the lawyer who represents the government before the Supreme Court.
"It was my understanding that the vice president's office blocked that appointment," Comey said in his written remarks.

I guess the rest of government is "irrelevent" under the Bush Administration....They strongarm the Congress to get what they want, they veto it if they dont get what they want, they add a "signing statement" if they can't veto it, then they pack the justice department with cronies, and strongarm THEM into bending the law to their perverted neocon adgenda.
Add this one to the long list of crimes against America by the loose cannon Darth Cheney.
Why should any of this surprise anyone?

i submitted a letter to my regional paper (printed) in early november 2002 asking for the impeachment of cheney..........i'm with you folks, impeach this s.o.b.........if that damn pelosi will allow it.

I get really sick of this type of comment. The people are not rolling over and playing dead. This country has been completely bought by corporations. The congress, nor anyone else in Washington, is listening to the people. The people have not rolled over - they have been perfectly clear, from the elections last fall to the support of people's candidates for president such as Ron Paul. It is the establishment that will not allow the people's voice, and it is not the fault of the people for that. Yes, some people are misguided, stubborn supporters of this criminal cabal in control. But, the vast majority of people want the same thing - real representation, which is completely absent now.
Nothing will stop what is happening except nuclear anhilation on a planetary scale, or global revolution of the people, which seems unlikely. We are all trapped in this hell, it's much too late to stop it. Greed, power, hegemony, theocracy, fascism, and corportism have won, at least for now.
another point in favor of impeachment.......it grabs headlines and basically neuters bush and puts cheney on constant defense........effectively ending the "reign of terror".
billjv and others who feel that the recent election was some sort of anti-Bush/Cheney mandate may find, as you make conversation with people you dont know that this may not be the case. At least not the way the left "wants to see it". I think that most of the electorate dont mind Cheney and Bush's lies, illegal and immoral war, loss of civil rights and so forth-they are just unhappy that the war hasnt been won in a clear fashion like Rambo would have done. FOX news glosses over most of the other stuff but they are tired of it not being finished and still talked about. People with short memories and attention spans like new news, even new wars.
You can moan about hijacked elections but the fact is that if the Democrats had won by a landslide (which considering the Republican candidate they should have been able to engineer) there would have been no worry about hanging chads, Supreme Court rulings, blacklisted non-anglos in Florida and so on.
So I say we got what we wanted. I think that if Bush could just declare victory his rating would skyrocket. After all he IS the type of guy you would like to sit down and have a beer with-that hasnt changed. The Democrats had better get some clear cut ideas about who they are and what they invission for this Country or they might lose what majority they have and see a Republican President.
Another "with that information I would have sent troops into Iraq" Kerry type and it's goodbye Dems.

Anyone who thinks it's about Dems vs. Repubs is kidding themselves. Both are totally sold out to corporate power. The liberal vs. conservative arguments are really just a smokescreen, meant to keep people arguing amongst themselves instead of seeing who is really in control. Until people wake up to this we really are a hopeless cause as a global population.
BTW, not everyone wants to sit and have a beer with the pResident. I'd rather see him choke on a pretzel. Oh wait, he already did that. Too bad the pretzel lost.
Well, Ken, I support HR 333 too. But the House Representative from my area is a Republican and I could e-mail him till the letters fell off the keyboard and I would get the same response...'Thank you for your concern. As you know, Impeachment is a serious process' blah,blah,blah. But here's the capper, Ken. If I e-mailed Nancy Pelosi about this, I would pretty much get the same response!
Is there a pattern here, Ken? What do you think? Who's in bed with who here, buddy? Yeah, I'd love to see the bald headed bastard get his just rewards. But, in this political climate, I'm no holding my breathe or planning an 'Impeachment Party.'
If we impeach one, either Cheney or Bush, and not the other, we really won't be any better off, although I do believe that Cheney is more dangerous and Bush is just more stupid. (Although, given that, I am wondering which is actually more dangerous, now.)
The only alternative would be to impeach both at the same time.
Can we do that?
Is that legal?
And if we could, if we did, that would put Polaski up as President (3rd in line) until elections.
Now, I wouldn't have any problem with that, but as to the fact that "a woman" is 3rd in line to the Presidency, but would that fact NOT perhaps be (TOTALLY UNREASONABLE YES but) HIGHLY EFFECTIVE in giving others enough motive to SUCCESSFULLY THWART an effort on our part to impeach BOTH?
And if THAT happened, we'd be back at equare one, above.
Talking in circles, am I? Pardon. I've re-read this more than once, and edited it more than once, and can only hope that it makes enough sense to essentially communicate what I want to let you know, ask, consider, and enlighten me on.

Impeach Cheney and you cut the legs off of Bush and those who think like he does. As it is, Bush already looks like a zombie to me.
More importantly, a message is sent. The message says - The US is better than what our pathetic leaders have been for the past however many years, and the message also says "the times they are a changing".
But hey, if the will is not there, then its not there, and as others have said, then we will get what we deserve. Is that what you want steppenRazor? Its not what I want, but I know, I ain't calling the shots. I'm just trying to put it all on the table the best I'm able.

Hey, did you all see that Paris Hilton has been released from jail and there is a large brush fire in Arizona, or somewhere out west. The stock market is falling once again but when the closing bell rang a bunch of high rollers were applauding. Home interest rates are rising but it's now possible for anyone to buy a good credit rating if they need one.
I love to watch the news, fifteen minutes of stupid news and fifteen of advertisements. Oh, almost forgot, Bush is in Europe and he and Putin are making a deal, so the defense missiles over there will be acceptable to all of us. The madman running North Korea tested some short range missiles too. Ain't that amazing. Haven't seen a thing about the VP though. That Paris Hilton is a looker huh?
And the beat goes on. Every day I go out on our back deck and look skyward, to see if any pigs are flying. When they do, I'll know Bush and Cheney have been impeached. Yep, like the vast majority, I'm right up on what's goinig on in our country and in the world. I think I'll buy a cave, one with Dish.

Czechoslovakia's Velvet Revolution, Romania's overthrow of CeauÅŸescu (and later his death by firing squad), and the rest of the fall of the Iron Curtain came about because the People took action. Some of it was soft, some hard, but it only came about when the people did something.
The American people have done very little to change the course of events here. We're over-fed, over-worked, and over-entertained. We simply don't have the time nor the interest in fixing our own house. If/when we finally get a clue and realize that we have to actually get off our asses and do something (hold citizen meetings, attend sit-ins, start work-stoppages), then things will change and after a critical mass is built, it will become unstoppable. Until then...yawn...blather, blather, blather...

HI ken, Well, I don't know, might have to build my own cave. I went to the website steppenRazor suggested and read about the caves the elected elite have readied for themselves. I won't be able to afford anything like that of course. Maybe three or four romms, one for me, one for Paris Hilton, (I am a male by the way, using Evelyn Smith as a code name.) Then we'll need a food locker; been conversing with some Mormans on how to get that set up, and we'll need a water storage room. I don't know yet. We live up in the mountains now, maybe I can just find an abandoned mine or deep cave near here.
Seriously, I'm not all that worried about a nuclear war, it will never happen as long as we have sane leaders in the world. Oops, wonder if that last comment is a conflict of thoughts?
Ken Hausle: Hey Ken, thought about your plan to march to Washington DC in peaceful protest, (by yourself if necessary you state.) Be better if you had some supporters carrying AMERICAN flags though.
Perhaps you could consider this option. Start a chain letter, NOT only on the internet!! Use regular mail. Send a brief letter to five people you know, or any that you know who have your opiniion on the issue. If at all possible, don't have the letter sound like it is from a flaming liberal or nutcase. (It would cost you about two bucks for postage and another dime or so for stationary.)
Ask them to pledge two (2)things. One, they will march at least five miles with you in DC in September, if no impeachment proceedings had been initiated by then. Two, pledge that they will send out five exact letters to people they feel would be highly interested.
If my math is correct, (if the chain is not broken,) after ten mailings, there would be near ten million pledgers in the chain. If half of the pledgees show up, you have a real croud. It has to be peaceful, has to display intelligence, firmness, loyalty to our flag and country and be protesting, (by and for the people.)
The downsides? People may have to take off from work for a couple of days or more, it could be a bit costly for many, there may be shills join who support our present regieme and who could attept to turn a peaceful protest into a riot. But if the figure of 65% of Americans are fed up is correct, think of how many pledgees you could have after a rolling snowball of thirty mailings.

I checked the math myself, it is far more than ten million people. Oh, for each person who sends out five letters, one of the five should be addressed to you Ken, you would then have a fair idea how many agree with you and how many may show up.
Dick Cheney is quite plainly...an asshole. I don't believe I have ever known a person that is so thoroughly evil, greedy, selfish, power crazed, and cowardly. Five deferments to keep his candy ass safe from Nam. How this guy could ever achieve a position as vice-president of the United States is beyond me. He issues threats to Iran while standing on the decks of an aircraft carrier bristling with guns. He hunts quai that have just been relesed from a cage. He loathes homosexuals yet has a lesbian daughter (I wonder if he loathes her as well?) He lies at the drop of a hat for any reason, as long as he benefits from the lie. He has what, an 8% approval rating right now? I wonder who the 8% would be?

Never have truer words been spoken. However, he will probably never see the inside of a courtroom. The best we can hope for is a meciful God who would be kind enough to give this creep a heart attack. Please excuse my profanity, but what I say is true. This guy is a true piece of shit.

If no progress is made toward impeachment come September, I am going to be walking into DC. I think it would be awesome if many chose to do this. I would like to just be one of the many.
I know that you said your days of long walks are not like they used to be, but anybody could implement your idea of sending out letters proposing a peaceful protest. In fact, that is the whole point. People need to start talking to each other however they can, and then taking action. I don't care who organizes it or even when it happens, but I don't think much is going to change unless a bunch of people physically converge upon Washington DC and communicate their dissatisfaction by virtue of action.
I appreciate your idea. I know that I am trying to connect with others as best I can, and I hope something of substance comes to fruition.

Impeach! Impeach! Impeach! What is wrong with you, America? You remain happy to have dishonest, amoral thieves running your country. Apart from a small minority, as a nation you do not appear to have any moral standards. Surface attachment of many Americans to old testament (and therefore pre-Christ) principles whilst calling themselves Christian fools no one but those so claiming to be Christian. Indeed, the Christ of love and charity (in the real, non-US, meanings of those words) would not identify with many Americans who use his name as a cover for thier actions. No wonder the extremists call the US the great Satan
Personally I would not care if their action did not jeopardize the lives and happiness of the rest of us who are not Americans but infortunately they do.
Apart from the disastrous wars they start and which affect us all, they run the US for US big business and then use the US massive financial clout to force the smaller countries to run their economies to benefit the US (and not their own citizens) so that they are also run for the benefit of US business.
Huge resentment against the US grows and continues to grow, even among its friends.
