Has Bush Committed Impeachable Acts?
As an attorney I often get asked if I think President Bush has committed any impeachable "high crimes or misdemeanors." The Constitution gives the power to remove the President to the Congress, not the judiciary, so the question is more political than legal. The legalistic language about "high crimes and misdemeanors" and a "trial" in the Senate reminds Congress that ours is not a parliamentary system; Congress cannot remove a president with a mere "no confidence" vote. In terms of whether President Bush has committed any offenses that could justify impeachment, consider the following:
U.S. Supreme Court Justice Robert Jackson, who served as the chief prosecutor of the major Nazi war criminals, called starting a war without cause the "supreme war crime" because all other war crimes flow from it. Under the United Nations Charter, which is a binding international treaty ratified by the United States, it is illegal to attack another nation except: 1) when authorized by the Security Council; or 2) when necessary for self-defense and then only for as long as necessary to get the matter to the Security Council.
The Security Council unanimously passed Resolution 1441 that found Iraq in material breach of prior resolutions and warned of "severe consequences" if Iraq didn't conform. But that resolution also explicitly stated that the Security Council remained seized of the issue and the United States assured the other members that Resolution 1441 did not authorize it to attack Iraq; the U.S. would have to return to the Security Council for another resolution before it could attack Iraq. In early 2003, the United States did return to the Security Council with a resolution authorizing an attack on Iraq. When it became clear that the proposed resolution could not muster a majority, the United States withdrew the resolution and attacked Iraq anyway. There is no crime more serious than illegally starting a war.
In garnering support for his invasion of Iraq, President Bush selectively cherry-picked the advice and intelligence that supported the end result he wanted to achieve. Many career officers at the CIA and the Pentagon quit when their reservations about the war were ignored. President Bush misled Congress when he pretended he had solid intelligence that Iraq had the ability and desire to attack America.
President Bush has shown a consistent hostility to civil rights. Tens of thousands were swept up in immigration raids after the Bush administration announced it intended to use immigration laws against suspect populations not for immigration purposes but as part of its "War on Terror." It claimed a right to seize U.S. citizens on U.S. soil and to hold them indefinitely without charges, a trial, an attorney or even the right to remain silent. It not only supported the USA PATRIOT Act but, according to the inspector general, systematically abused it after it became law.
In the late 1970s, Congress established a secret court to issue search warrants in foreign intelligence cases. Congress diluted the definition of "probable cause" in foreign intelligence cases to make these warrants easy to get. President Bush, however, authorized the National Security Agency to seize telephone records without getting warrants from the foreign intelligence court. The NSA had the technology to monitor all phones calls and did not want to identify the particular records to be seized as is done in search warrants. The idea was to seize all phone records and then "data mine" them to see if any of them contained foreign intelligence information. This invasion of privacy not only circumvented the statute establishing the foreign intelligence court but the particularity requirement of the Fourth Amendment as well. The Fourth Amendment was designed to prohibit the British type of "general warrant" that authorized a particular person to search or seize anything he wants.
Although the Bush administration uses the language of war, such as "War on Terrorism," it insisted that the prisoners captured in Afghanistan were not entitled to the protections of the Geneva Conventions because they did not wear uniforms. President Bush's attorney called the Geneva Conventions "quaint." However, the same administration claimed a right to detain these prisoners indefinitely without any kind of hearing on the grounds that prisoners of war can be detained without hearing until the war ends. President Bush uses the international law of warfare selectively, saying it applies when it suits his purposes but does not apply when it does not suit his purposes.
Both international and U.S. law condemn torture. President Bush's administration has redefined torture to only include serious physical injury that can lead to death and then used that narrowed definition to authorize "water boarding," sensory deprivation, sleep denial, and other aggressive interrogation techniques commonly understood to be torture. In response, Congress passed a statute outlawing inhumane treatment of prisoners. When he signed that statute into law, President Bush issued a separate "signing statement," saying that he reserved the right to use torture if he thought it was necessary for national security.
President Bush has authorized the use of depleted uranium shells in Iraq, which will create health hazards there for decades to come. He authorized the use of phosphorus bombs against Fallujah, a civilian target. While it's true that phosphorus bombs burn people, their primary purpose is to suck oxygen out of the air so people hiding in buildings suffocate. "Daisy cutter" bombs create a concussion that makes the eye balls and ear drums of people hiding in bunkers explode.
My conclusion: It is the political will to impeach, not the legal grounds, that we lack.

Show AllGet off the key boards and do as the freeway blogger has done for years. Get cardboard , paint it white and project letters on it expressing such sentiment as : SAVE AMERICA IMPEACH BUSH/CHENEY and then place them in high traffic or profile areas. This is a wonderful means of empowerment and costs next to nada. Help propel this potential juggernaught of people powered media straight up this junta's collective noses. It is your country---take it back!

The irony here is that Bill Clinton was not impeached because he had sex with an intern. He was impeached because he LIED about it to a grand jury. So let's see ... on the one hand you have a married man who lied about getting caught with his pants down(we're all shocked he'd lie about that) and on the other, a man who took a country suffering from the shock of 9/11 into a war with a country that had nothing to do with 9/11. Cheney still LIES about that. He LIED about wmd. Where are all those Republicans with the hanging nooses eager to get to Bill Clinton because he had "undermined the integrity of his office, has brought disrepute to the Presidency, has betrayed his trust as President and has acted in a manner subversive of the rule of law and justice, to the manifest injury of the people of the United States."
I've read that L. Paul Bremer III repeatedly violated the Articles of War in his role as U.S. viceroy in Iraq. We daily witness the consequences of his having disbanded the Iraqi army, whose former members now populate the insurgency. In Bremer's case, impeachment doesn't apply but if there are to be criminal proceedings against the Bush coterie, it would seem an injustice not to include Bremer in the crowd.
If we could get KindaSleazy Rice to give Bush a BJ then perhaps the political will could be found to impeach.

How much more clarity do the nefarious Actions of Bush – Cheney – Rumsfeld require in defining their concerted lust to take out a failed business partner – Saddam – and confiscate the resources of another sovereign by force?
This effort can be traced back to Papa Bush's first incursion, which too was contrived.

If and when Congress begins impeachment proceedings, I hope all those charges are included. Bush and Cheney are the worst criminals ever to occupy the White house.
I'm hard pressed to find a crime they have NOT committed. Little care for the law at all.
The Dems are on the verge of becoming accessories after the fact, unless they get their butts in gear and do what they were elected to do. IMPEACH

In my opinion, Nancy Pelosi should NOT have said impeachment was "off the table" before the elections last fall. It's not just the war crimes, lies and corruption that exemplify him and his administration, it is the real likelihood of his appointing additional right-wing, religious right, economic fundamentalist, incompetent cronies to YET MORE positions from which they can destroy the departments they are appointed to manage or to work in. It's Katrina. It's Guantanamo. It's all the extravagant promises of help for those in need that somehow never come true.

The legislation to impeach Cheney was presented by Kucinich as HR333 on April 24th. Articles of Impeachment are ALREADY in the House! Every day, in every way, take action to support HR333. Call, write, email your Congressional representatives and Pelosi to move HR333 forward. And get everyone else you know to do the same. EVERY day! Do something EVERY day until this band of thugs is in jail for their crimes!

Check out the Green Party. If the Dems continue to spend more time apologizing or denying than being a genuine opposition party, they need to step aside and let an actual opposition party take over. But as others have indicated, one can certainly be active in the Dems to promote the Kuciniches, etc. from within. But when you're in the booth on November and your choice is the Republicrats in both parties, you can always turn toward a third party.
Gore caved in, in 2000, far more easily than was warranted or expected of a good leader, one who must be a fighter, etc. Also, remember that he chose the most conservative running mate out there (Liebermann) who failed to even get his own party's nomination last time around. Deciding instead to put his love the Iraq war and other interests ahead of his own party standing.
And so is Gore trying to redeem himself, or is he basically unchanged?
I don't think that Bush had an affair with an intern so far as I know... isn't that the bench mark for empeachment?
We just need to make an effort and look at old footage from Iraq about Jan. to March 2003 and admire the good job they have done considering the sanctions and no-fly zones etc. We should also look a little further back at Kabul in the mid-60th, we will be shocked to find a modern city, hardly differently from any city in Europe at the time. When we have the courage to open our eyes we will se clearly, what has been created in our names.
When impeachment starts, it is vital that there is enough evidence that it succeeds. A failed impeachment might strengthen Bush and be seen by some as an endorsement. Holding off on impeachment while all the various investigations yield ever more damning evidence against Bush and his men is probably the best tactic - even if it seems frustrating at times.
All the evidence that is needed for impeachment is already there. There is no need to wait and find out more. It's not even a matter of whether the impeachment succeeds or not. The process needs to start NOW!!! Support the Articles of Impeachment against Cheney (HR333) introduced to the House by Kucinich last week. Do it now! Call your Congressional reps and Pelosi and tell them to fast tract the process. In the name of justice and accountability, impeachment needs to start NOW!
Take action EVERY DAY to make impeachment happen!

I agree that the Dem's are doing a rotten job of representing the people of America. I suggest that EVERYONE vote for Kucinich in the primaries. When the Dem's put up another bought and paid for candidate, reregister in another party or as an independent and vote for whatever reputable candidate you can find in '08. And don't forget to write the DNC and tell them WHY you are no longer a Democrat!

I'd like to see "DEPRAVED INDIFFERENCE" to human life as an article of impeachment, given this imbecile's smug rejection of investment in alternative fuel sources. 99% of peer-reviewed scientific studies show that the human footprint is impacting earth's climate for the worst; and the fact that many in Bush's cabinet profit directly from oil explains their blatant disregard for finding fuel sources that would sustain rather than capsize life on this fragile planet. Katrina is another example of depraved indifference, which is one of the categories for manslaughter (or homicide) if I'm not mistaken. The killer in chief... how does Laura sleep with him? In this instance, I am not even offended by the "send Monica" jokes as international first aid remedy!

I'm sorry, but just seeing this as a headline here made me want to throw a brick at my monitor.
This question was answered years ago, with lists of impeachable offenses outlined in excrutiating detail by a dozen or so respected journalists and others in books and articles.
To even ask this question, regardless of the author's conclusion, is at best condescending, and at worst, retarded.

I get tired of hearing people say Al Gore caved in too soon. He fought it to the Supreme Court, which illegally intervened in a state issue and handed the election to Bush.. What was he to do after that? What higher court could he appeal to? He did all he could, then he handled the defeat with class. He, Kucinich, and Feingold are the ONLY Democrats I would vote for enthusiastically. I may vote for a 3rd party this year (or write in Kucinich) just as a protest vote. I'm sick of both major parties. I was happy with the Democratic win until Pelosi took impeachment off the table. It was done for political purposes only, without a care of establishing a dangerous precedent for future tyrants.

It isn't that there is insufficient evidence of impeachable offenses committed by the Bush administration. It is a matter of forcing the media and the general public to acknowledge the crimes committed by these gangsters. The oversight hearings bring the evidence out. When the evidence is on the table, Pelosi will not be able to keep impeachment "off the table".
I am, however, short on patience. Every day that these crooks are in office, more horrific events happen in Iraq and in other secret corners of the world that we don't even know about. More right wing judges are appointed; more damage is done to the environment; more civil rights are revoked. So, let's keep pushing Congress for IMPEACHMENT.

Indeed. These are the worst crimes committed in our names--and they go on daily. Those in congress who ignore them while being capable of acting on them are accessories to those crimes.
In what world to those proto-candidates and Congresspeople live, not to notice the impeachable crimes. The want to wish them away so it stops spoiling their bids to power.
The main threat to our security is doemestic. Our rights are being attacked by this Administration just as those coutries who somehow happen to sit on our resources have been.
Until Mike Gravel spoke recently, I have yet to hear a clear denunciation by those pretending to be our saviors of what those threats and crime look like. Even Kucinich's masterful call for Cheney's impeachment, while courageously going where no congressperson has gone before, is not a full enough denunciation of the crimes and the fearful lot that enables them to give Americans the scope and direction needed to stop this cycle of hubris and madness.
This is the most colossal charade ever carried out in this nation, yet none of our national so-called leadership sees, hears or says anything about the real threats to our nation, or dares include the people in the solution.

I figure right now both Republicans and Democrats are going for the independent vote . . . Right. Well there must be more Independents and Independents can mean ALL those other parties. If Nancy Pelosi et al. are also so blind and heartless not to act on IMPEACHMENT and also dig in their heels to STOP THE WAR NOW and thus end the carnage and beyond-words' suffering of innocent people for control of OIL, they all should go live in a group home for sub-humans with bionic hearts and be fed a diet of Exxon motor oil with a chaser of gasoline-flavored Shell Kool-Aid for the rest of their lives in penance for closing-in-on-a-million dead Iraqis.
Never has there been such cowardice, lack of integrity, and inhumanity in our government on such a broad scale.
But never also have we had such a population that a good 39-40 per cent of voting-age people do not know who the Vice President of our country is, and the vast majority of the rest could care less and would never give up watching American Idol if a special was on laying out the substantive reasons for Impeachment of the Bush Administration.
How many watched the Bill Moyers' PBS special, "Buying the War," last week rather than the hockey or other play-offs or a favorite sit-com, old movie or whatever instead?
And for the rest of us who are informed and voraciously read all the latest and then write back and forth with our fellow Choir members, do we at least put bumper stickers on our cars or signs on our lawns that say IMPEACH or something akin?
I have read so many comments and essays, including on this site, that after expressions of outrage, then gravely suggest that The Congress and so and so ought to do this or that to solve the problemo(s) ... I've got news ... WE ARE THE PEOPLE and this is our government and waddaWEgonna' do about it? It's getting late in the day.

Often it is only when people are brought to their knees by great calamity do they then "get it." The way it's all going, it sure looks like we're all well on our way to being part of a great calamity, despite all the dedicated souls out there trying as hard as they can to change the course of this government's policies and the course of the fate of this planet before it's too late.

Bush & Company, however, have a crap game going with all the rest of the world, and they're playing with loaded dice, of course.
But too many of our elected officials are playing in that crappy crap game too, and pretending they don't know that the dice are loaded. Heavens, wouldn't want to jeopardize all those campaign donations by speaking the Truth.
How can each one of us, as individuals, do something right in our own home area, our block, our neighborhood, our town that is enough to raise the eyebrows high over local sleepy eyes ... and then comes an opportunity to educate, to organize, to do something together ... Little by little is how it works.
Takes guts usually to shake up the marbles and brave some tar and feathers.
Are WE THE PEOPLE, the supposed "ascendants" of a brave and bold Revolutionary movement that birthed the promise and possibility of a Great Nation, up to the job anymore? Am I, as one person, up to the job anymore or will I just yammer and leave it all to others to do something a little more active and visible and courageous?
If I'm not up to it, if you're not, if WE are not, then we might want to add some kneepads to our list for next time's shopping at Wal-Mart's.
Sure is easy to forgive the German People now, whose mantra at the end of WWII and the revelations of The Holocaust was: "We didn't know. Oh, we didn't know."
