Neanderthal Supreme Court Decision on Abortion
The religious right got its reward on April 26, when the Supreme Court banned an abortion procedure.
And the reasoning of the Bush Court was Neanderthal.
"Supreme Court justices have exchanged their black robes for white ones, never bothering to go to med school for the privilege.
The decision will jeopardize the health of some women, and it will criminalize the practice of some doctors who perform abortions. But it will not reduce abortions.
Under Roe v. Wade, a woman's health is supposed to be protected.
But this decision blithely ignored that key precedent by claiming, contrary to the conclusion of the American College of Obstetricians and Gynecologists, that there was no health concern present in the banning of the intact dilation and evacuation procedure.
"The safety advantages of intact dilatation and evacuation (intact D&E) procedures are widely recognized—in medical texts, peer-reviewed studies, clinical practice, and in mainstream, medical care in the United States," the group said in a statement denouncing the decision [1].
"This decision discounts and disregards the medical consensus that intact D&E is safest and offers significant benefits for women suffering from certain conditions that make the potential complications of non-intact D&E especially dangerous. Moreover, it diminishes the doctor-patient relationship by preventing physicians from using their clinical experience and judgment."
Supreme Court justices now purport to have greater medical expertise than the specialists in the field. They've exchanged their black robes for white ones, never bothering to go to med school for the privilege.
What's more, their decision may not prevent a single abortion. It will only change the way a small fraction of abortions are done--from safe to less safe.
If their concern was with the fetus, they haven't accomplished anything.
But betraying a huge streak of paternalism, their professed concern was with the woman's mental state were she to find out how this kind of abortion was performed.
Abortion is a difficult moral decision for women. But they are fully capable of making it, regardless of the procedure.
A woman doesn't need five men who aren't doctors to pretend to shield her, even as they deprive her of autonomy.

Show AllIn the words of Dennis Kucinich: "What the supreme Court did
was quite invasive of the very sacred sphere of a women's health and privacy. But if our society is truly committed
to life, then all of us need to close ranks behind a program which will show real concern for life. And that includes prenatal care, postnatal care, child care, a living wage, universal health care....and the end of war.
Then we will have achieved a much more tolerable expression of support for life, than the Supreme Court did".
Thank you Dennis!
Do they thinktheir decision will mean less abortions, or simply less safe abortions? And how dare they tell us we are the weaker sex who must let men make our decisions for us?
Don't forget that this is not the first time that Supreme Court Justices have "exchanged black robes for white ones." The multiple instances when the Court has ruled against medical marijuana, based on the determination of Congress that Schedule I drugs have no medicinal value, may as well have been a Decision that the Moon is made of green cheese.
This courts misogynistic ruling basically comes down to this:
1. A woman's primary purpose in life is to create babies.
2. Pregnancies come with no danger to the mother after three months.
3. Pregnancy complications that can endanger a woman's life like hyprocephalus and polyhydramnio are only a figment of our imagination.
4. Men know what's best for women.
This was the inevitable outcome when Scalia and his gang of five stopped Democracy dead in its tracks by halting the count of Black votes in the Florida 2000 election.

Abortion in Mexico is supposedly legal in certain cases such as rape and incest. However, the legal system that is supposed to protect women instead penalizes them by refusing permission in the aforementioned cases, especially in states that are run by PAN, the equivalent of the Republicans. According to one of my female students from a rural area, dead babies are found pitched into the fields by the edge of the road on practically a daily basis, but no one talks about it. So that is the choice that the antiabortionists have made there, abortion=bad, infanticide=good. I submit that the so-called "right to life" movement is making the same choice.
I vainly wish that the female members of the right wing had to face the consequences that they force on other less privileged women, but like Mexico, the rich are privileged and the poor get the shaft. My wife, a school teacher in a PAN district, tells me that it is not at all uncommon for a girl from a "good" family to go visit her "aunt" in Texas for a week or two during the middle of the school year. When she returns, she no longer has to throw up a couple times every morning.
Viper,
There's only two words that apply here: Gender Slavery. 4000 years of Gender Slavery.
Biological Self-Determination and Economic Self-Determination are the fraternal twins of Personal Freedom. Without those two, anyone is a slave. After ending a woman's Right to terminate a pregnancy, next comes property rights and all forms of birth control. Then we're back to the feudalism our Oligarchy loves almost as much as the Church of Rome, and they think women should go back to being slaves as well. Says so somewhere in one of their flat-earth genocidal "Holy Books" doesn't it? You know, the one with the Quotes For EVERY Occasion?
The flat-earthers have been pushing for this for 34 years. They stacked an entire Supreme Court and the Federal Judiciary so they could do it. And now they can put you in prison for it. I suppose that's better than if they just 'disappear' you off the streets. At least you get to know what the charges are before they shove the electrodes up your ass.
And no, there are no arguments from the "other" side, merely a daisy wheel of different sized sledge hammers to beat you into slavery - and they are playing for keeps. You know how violent those animals are. Just like the boys from the Klan in their day. They like their women Obedient and properly Submissive to their Master. Sound vaguely familiar?
Yes, we are a lovely bunch of coconuts.
Peace.
More wisdom from the same bunch of bozos that brought you nonfunding for the no child left behind act, no national health care, defunding of the headstart program, defunding the school lunch program, not to ever mention the shattered lives and cooked babies of the middle east- ah the infinite insight, logic, and of course morality of the bible thumping new right supremes.
"Biological Self-Determination and Economic Self-Determination are the fraternal twins of Personal Freedom. Without those two, anyone is a slave"
Tell that to men forced to pay child support for a child they never wanted?
Oh yeah, shoulda kept their pants on, right?
Smurfy.
In a word, yes. Men have just as much responsibility for conception decisions as women. Women are more likely, however, to be raising children alone and in poverty. They are also the ones whose bodies are changed forever by pregnancy.
But as usual, your rant misses the whole point. The point is that a group of conservative men believe that they have the right to determine what decisions a woman and her doctor are allowed to make about her health and that of her fetus. They also have no consideration for the woman's health.
All religious objections aside, isn't this a slippery slope? What's next?
SPERM is a dangerous substance, especially lethal to lovely young white girls. Why don't we make sperm a controlled substance?
Your innocent daughter could be seduced, raped, impregnanated, railroaded into a forced pregancy, brainwashed and coerced into 'Infant-Adoption' courtesy of baby-farms like Gladney in Texas and elsewhere. "Infant-Adoption' = extreme sexual violence. Is reproductive slavery what the Bushies have in mind for your grandchildren?
Where is the respect of Mother&child? And I mean NATURAL MOTHER & CHILD!
Don't be fooled - Motherhood is NOT transferrable.
Abortions should be made easier to obtain not more difficult.
If a person does not want a child they should not be forced into motherhood. So many people just have them for all of the wrong reasons.
The court is assuming the mom will be able to support the child.
The court assumes the father will be in the child's life and take care of the child.
The court assumes the child will be a Doctor, Scientist and not a mass murder.
The court has decided the risk of child birth poses no risk to the mother's health.
Unless a person can afford the best of care they may be dead if they are a diabetic,on drugs, have a perforation-just a few examples.
What will be next? Medications pose no risk to health? The pharmacutical companies do not want to pay lawsuits what would stop the court of deciding this opinion.
Wow, who needs health insurance or a Dr. I will just ask the courts about my medical needs.
Hey, lets ban abortions because they kill an "unborn" baby while we vote to kill millions of citizens around the world at the hands of our mercenaries who also give up their lives in the name of freedom. While all this goes on in the world, our "pro-life" conservatives playfully shoot innocent animals for pleasure and also keep voting to keep measures in place that destroy natural habitats which in turn kills even more animals and people!
So much for the love of life!
I'm a man.
I've been a "feminist" since I was about 10 years old --- quite some time age -- long before the word became common currency, and maybe I'll tell you that story sometime.
I believe unequivocally in the social, political and economic equality of women, and I have little respect for any man (or woman) who doesn't.
This Supreme Court decision should come as no surprise, sad to say. Supreme Courts have often upheld the most reprehensible notions (Dred Scott Act, anyone?) if the political wind was blowing that way.
You don't hear the Supremes weighing in on a man's right to have a vasectomy, do you?
Abortion is solely and exclusively the woman's decision, however much she may wish to seek advice from anyone else.
It's completely, disingenuous of the anti-abortion fanatics (actually, anti-sex fanatics) to describe a fetus as a "baby" or "child," and it always fascinates me that so many folks who are so concerned with the welfare of "children" who AREN'T here yet, don't seem to give much of a damn about the children who ARE -- like the ones we're blowing to pieces in Iraq. Apparently, they believe that potential people, who haven't been born yet, somehow have rights that supercede those of actual people who have.
Not sure how sound that really is, intellectually, morally or legally.

No matter how hard these fascists on the right try to make abortions illegal they will never EVER stop them. By banning abortions we'll just go back to the way it was before Roe v. Wade- shady unsafe procedures performed by shady unsafe "doctors" in shady unsafe backrooms and alleyways.
What kills me is that the morons who want to ban abortion are the same ones who don't want to provide our children with sound sex education and don't want schools handing out free condoms. But hypocrisy from the right wing nutjobs is nothing new.
We can not have the government regulate private businesses. We cannot have the government regulate guns because that's absolute Commie Shit! But we can have a government which dictates how doctors should treat their patients according to the bible? Better yet, its absolutely gruesome to dismember an unborn fetus but its quite ok to dismember and mutilate thousands of fully grown men and women to bring about Jesus' arrival. Dont you think we have a slight problem with our priorities?
I'm sure Jesus loves an unborn fetus more than people because the Bible says so!
